• "Exhibit A "- • NOTICE OF DECISION MINOR LAND PARTITION MLP 95 -0004 VARIANCE VAR 95 -0004 BURKEY / SIMS APPLICATION: A request for the following development applications: 1) Minor Land Partition approval to divide one parcel of approximately 26,547 square feet into three parcels of approximately 7,500, 10,000 and 7,724 square feet; 2) Variance approval to allow the continuation of a 5'5" side yard setback whereas a 10 foot flag lot, side yard setback is required. ZONE: R-4.5 (Residential, 4.5 units per acre). LOCATION: 12695 SW Watkins Avenue (WCTM 2S1 2BC, tax Tots 1801) East side of SW Watkins Street and West of SW Pathfinder Avenue. APPLICABLE LAW: Community Development Code Chapters 18.50, 18.88.040(C)(1), 18.162.040, 18.162.050, 18.164 DECISION: Notice is hereby given that the Planning Director's designee for the City of Tigard has APPROVED Minor Land Partition MLP 95 -0004 / Variance VAR 95 -0004 SUBJECT TO CERTAIN CONDITIONS as listed below. SECTION I - CONDITIONS OF APPROVAL: THE FOLLOWING CONDITIONS SHALL BE SATISFIED OR FINANCIALLY SECURED PRIOR TO RECORDING THE FINAL PLAT. UNLESS OTHERWISE NOTED, THE STAFF CONTACT FOR ALL CONDITIONS SHALL BE MICHAEL ANDERSON, ENGINEERING DIVISION: 1. Additional right -of -way shall be dedicated to the Public along the SW Watkins Avenue frontage to increase the right -of -way to 30 feet from the centerline. The description shall be tied to the existing right -of -way centerline. The dedication document shall be on City forms. The applicant shall obtain a street opening permit for any changes to the existing driveway in SW Watkins Avenue and for the three sewer connections to the existing main. Lot 3 shall direct the storm water through the existing curb in SW Pathfinder Court, and the applicant shall obtain a street opening work for the sidewalk, driveway and pipe construction. A joint use and maintenance agreement shall be executed and recorded on City . standard forms for all common driveways. The agreement shall be referenced on and become part of all applicable parcel Deeds and /or shown on the final partition plat. An agreement shall be executed by the applicant, on forms provided by the City, which waives the property owner's right, for Lots 1 and 2, to oppose or remonstrate against a future Local Improvement District formed to improve SW Watkins Avenue. The applicant shall pay the fees as established under the guidelines of Unified Sewerage Agency Resolution and Order No. 91-47. NOTE: This is a two part fee which is paid at different times. The first part is paid with any associated public improvements which is for that portion of the development which increases the impervious area within the public right -of -way. The second part is paid at Building Permit issuance which is for each individual lot. 6. Final Plat Application Submission Requirements: A. Three copies of the partition plat prepared by a land surveyor licensed to practice in Oregon, and necessary data or narrative. B. The partition plat and data or narrative shall be drawn to the minimum standards set forth by the Oregon Revised Statutes (ORS 92.05), Washington County, and by the City of Tigard. C. The 7.5 foot wide pedestrian easement shall be dedicated on the final plat. STAFF CONTACT: John Hadley, Engineering Department (639 - 4171). 7. A revised site plan which shows the adjusted lot lines reflecting the 5 foot dedication along SW Watkins Avenue. Both lots shall be a minimum of 7,500 square feet. 8. A revised site plan shall be submitted which shows the provision of an emergency vehicle turnaround. This access shall be a level, hammerhead configured, paved surface with each leg of the hammerhead having a minimum depth of 40 feet and a minimum width of 20 feet. The applicant shall submit this plan for review and approval from the Tualatin Valley Fire District. 9. A screening plan shall be submitted which shows how parcel 1 shall be screened along the flag lot access drive. Screening shall comply with section 18.100.080 and 18.100.090. NOTICE OF DECISION MLP 95 -0004 / VAR 95 -0004 - Burkey / Sims Page 2 • • 10. The applicant shall provide a 7.5 foot public, pedestrian easement along the southern property line. A revised plan shall be submitted showing the location of this easement and a profile of the compatibility of the future path with the driveway. PRIOR TO THE ISSUANCE OF A BUILDING PERMIT THE FOLLOWING CONDITIONS SHALL BE SATISFIED OR FINANCIALLY ASSURED: 11. Provide the Engineering Department with a recorded mylar copy of the partition plat; or if not recorded with Washington County but has been approved by the City of Tigard the applicant shall have 30 days after recording with Washington County to submit the copy. 12. The applicant shall provide for roof and pavement rain drainage to the public stormwater drainage system or to the public street. STAFF CONTACT: David Scott, Building Division (639- 4171). SECTION II - FINDINGS OF FACT: 1. Vicinity Information The subject site is located east of SW Pathfinder Avenue, west of SW Watkins Street and South of SW Walnut Street. Surrounding properties are zoned R -4.5 (Residential, 4.5 units per acre) and are developed with single family residential development. 2. Site Information and Proposal Description This site is approximately 26,547 square feet in size. The site is developed with a single family residence with frontage on both SW Watkins Street and SW Pathfinder Way. The site slopes down from the its frontage on SW Watkins Street from an elevation of approximately 184 to an elevation of approximately 180 at the north property boundary. There is an approximately 6 foot grade differential between the property and SW Pathfinder Way. The applicant requests for the following development applications: 1) Minor Land Partition approval to divide one parcel of approximately 26,547 square feet into three parcels of approximately 7,500, 10,000 and 7,724 square feet; 2) Variance approval to allow the continuation of a 5'5" side yard setback whereas a 10 foot flag lot, side yard setback is required. 3. Agency Comments NOTICE OF DECISION MLP 95 -0004 / VAR 95 -0004 - Burkey / Sims Page 3 • • The City of Tigard Building Division has reviewed this proposal and has offered the following comments: All concentrated storm water to be conveyed to the public storm system. The Unified Sewerage Agency has reviewed this proposal and has offered the following comments: Public storm and sanitary sewers should be made available to each lot line. Private off site storm and sanitary not recommended. GTE has reviewed this proposal and has offered the following comments: Developer to coordinate utility placement for all utilities. The City of Tigard Maintenance Services Department, City of Tigard Police Department, City of Tigard Water Department, Tualatin Valley Fire District, and Portland General Electric have reviewed this proposal and have no objection to it. No other comments have been received. SECTION III - FINDINGS AND CONCLUSIONS - Minor Land Partition Section 18.162.040 contains the following general approval criteria for a Minor Land Partition: 1. The proposal conforms with the City's Comprehensive Plan; 2. The proposed partition complies with all statutory and ordinance requirements and regulations; 3. Adequate public facilities are available to serve the proposal; 4. All proposed lots conform to the size and dimensional requirements of this title; and 5. All proposed improvements meet City and applicable agency standards (Ord. 89 -06; Ord. 83 -52). The proposal conforms with the City's comprehensive plan in that the newly created lots will continue to allow for residential development. This proposal supports the Low Density Comprehensive Plan designation. This proposed partition complies with all statutory and ordinance requirements and regulations as demonstrated both by the NOTICE OF DECISION MLP 95 -0004 / VAR 95 -0004 - Burkey / Sims Page 4 • • analysis presented within this administrative decision and by this application and review process. Adequate public facilities are available to serve the proposal or shall be conditioned to be made available. Section 18.162.050 contains the following special provisions for lots created through the Partition Process: A. Lot Width: The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district. B. Lot Area: The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the accessway may not be included in the lot area calculation. C. Lot Frontage: Each lot created through the partition process shall front a public right -of -way by at least 15 feet or have a legally recorded minimum 15 foot wide access easement. D. Setbacks: Setbacks shall be as required by the applicable zoning district. E. Front Yard Determination for Flag Lot: When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. F. Screening on Flag Lots: A screen shall be provided along the property line of a lot of record where the paved drive in an accessway is located within ten feet of an abutting lot in accordance with Sections 18.100.080 and 18.100.090. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. G. Fire Protection: The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire fighting capabilities. H. Reciprocal Easements: Where a common drive is to be provided to serve more than one lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. NOTICE OF DECISION MLP 95 -0004 / VAR 95 -0004 - Burkey / Sims Page 5 • • I. Accessway: Any accessway shall comply with the standards set forth in Chapter 18.108, Access, Egress, and Circulation. J. Where landfill and /or development is allowed within or adjacent to the one - hundred -year floodplain, the City shall require the dedication of sufficient open land area for greenway adjoining and within the floodplain. This area shall include portions at a suitable elevation for the construction of a pedestrian /bicycle pathway with the floodplain in accordance with the adopted pedestrian /bicycle pathway plan. Criteria A is satisfied as the proposed lot widths for parcels 1, 2 and 3 are approximately 85, 100, and 100 feet respectively, exceeding the minimum 50 foot lot width requirement in the R -4.5 zone. The R -4.5 zone requires a 7,500 square foot minimum lot size. Criteria B is satisfied on lot 3 as the proposal shows the provision of 7,724 square feet. The proposed lot 1 shows the provision of a 7,500 square foot lot, however, the Minor Collector status of SW Watkins Street requires the dedication of an additional 5 feet from centerline. The proposed lot lines of lot 1 and 2 shall be modified to reflect the 5 foot dedication. The adjusted lot sizes of lots 2 and 3 shall be a minimum of 7,500 square feet in compliance with the R -4.5 zoning requirement. The proposed lot frontages are approximately 85, 15, and 100 feet respectively, thereby satisfying the minimum 15 foot frontage requirement of Criteria C. Setbacks on parcels 1 and 3 shall be reviewed when they are built upon. As indicated on the site plan, parcel 2 is in compliance with the front and rear yard setback requirements of the R -4.5 zone, thereby satisfying Criteria D. The applicant is requesting a variance to the 10 foot, flag lot, side yard setback requirement. Staff admistratively approves this variance based on the analysis and findings presented in Section IV of this report. The setback for an accessory structure is 5 feet from the rear and side property line. As indicated on the site plan, the applicant is proposing to remove a portion of the garage to provide a rear yard setback of 10 feet and a side yard setback of 5'5" thereby meeting the minimum setback standards for accessory structures. Criteria E is not applicable to parcels 1 and 3 as these lots are not flag Tots. Criteria E shall be satisfied on parcel 2 as the revised site plan will show the adjusted setbacks are in accordance with zone setbacks. Criteria F shall be satisfied as the applicant shall provide a screening plan which screens parcel 1 in accordance with screening requirements. Fire hydrants shall be consistent with Uniform Fire Code standards thereby satisfying Criteria G. Criteria H shall be satisfied for Tots 1 and 2 as a joint use and maintenance agreement shall be recorded with the plat for the common driveway. Criteria I shall be satisfied on lots 1 and 3 when the lots are built upon. The site plan indicates that lot 2 shall be served by a 15 foot access drive. In addition, access drives in excess NOTICE OF DECISION MLP 95 -0004 / VAR 95 -0004 - Burkey / Sims Page 6 • • of 150 feet in length shall provide for an emergency vehicle turnaround. This access shall be a level, hammerhead configured, paved surface with each leg of the hammerhead having a minimum depth of 40 feet and a minimum width of 20 feet. A revised site plan shall be submitted which provides for an emergency vehicle turnaround in accordance with this criteria. This plan shall be reviewed and approved by the Tualatin Valley Fire District. Criteria J is not applicable to these Tots as they are not within the floodplain. Section 18.88.O1O(Solar Access) states that all newly created lots within the City of Tigard shall promote the use of renewable energy sources by providing for improved access to sunlight for residential dwellings. A lot meets the basic requirement if it has a north -south dimension of 90 feet or more and has a front lot line that is oriented within 30 degrees of a true east -west axis. Section 18.88.040(E), however, allows the approval authority to exempt new Tots from the solar access standard in certain cases, including situations where existing right -of -way prevents Tots from being oriented for solar access. The existing orientation of SW Watkins Avenue as well as SW Pathfinder Way and the configuration of the subject site prevents the proposed parcels from being orientated for solar access. Therefore, the new parcels are except from the solar access standard. Section 18.164.040(B)(1) (Block Design) states that the perimeter of blocks formed by streets shall not exceed 1,800 feet measured along the right -of -way line. Section 18.164.04O(B)(2) states that when block lengths greater than 600 feet are permitted, pedestrian / bikeways shall be provided through the block. Currently, there is no street connection along the entire length of SW Watkins Street. The block perimeter encompassing SW Watkins Street and SW Pathfinder Avenue is well in excess of 1,800 feet. A 10 foot pedestrian easement connects SW Pathfinder Way and SW Pathfinder Court. This connection also provides access with a City owned open space / greenway area. A pedestrian easement along the subject southern property line would create a block perimeter of approximately 800 feet and would provide the only pedestrian connection between SW Watkins Street and SW Pathfinder Court. This easement and location would ultimately make for a connection to the greenway area. Therefore, the applicant shall be required to provide a 7.5 foot public, pedestrian easement along the southern property line to provide a pedestrian connection in accordance with this section. This easement may be contained within the proposed 15 foot utility and access easement. The applicant shall provide a plan showing how the driveway will be compatible with the proposed future pathway. The pathway will be a four foot paved path along the property line. The remaining 7.5 foot required width of the NOTICE OF DECISION MLP 95 -0004 / VAR 95 -0004 - Burkey / Sims Page 7 • • pedestrian easement (and 4 foot paved path) shall be sought from the adjoining tax lot 2200 in conjunction with future development applications. The applicant is not responsible for the construction of the pedestrian pathway, only the dedication of the easement is required at this time. Construction of the pathway would be undertaken by the City at some future date. Sections 18.164.030 (Streets), 18.164.090 (Sanitary Sewer), and 18.164.100 (Storm Drains) have been addressed and are satisfied as specified below: 1. Streets: Access to the parcels is proposed from both streets. The applicant proposes two driveways onto SW Watkins Avenue, a Minor Collector street as shown on the City Comprehensive Plan. The right -of -way for SW Watkins Avenue is not consistent with the City standards and the applicant should dedicate an additional 5 feet to establish the width at 30 feet, as measured from centerline. In addition, the driveway for Lot 1 should be designed to connect to the existing driveway that will serve Lot 2, consistent with the requirements of Section 18.108.060 (B), that restricts driveway access to collectors. Lot 3 would face SW Pathfinder Court and a driveway would connect to the existing pavement. The existing street right -of -way width for SW Pathfinder Court is 50 feet and no further dedications are required. The improvements along SW Pathfinder Court have been constructed with the adjoining Yolo Estates subdivision, with the exception of the sidewalk. The sidewalk should be completed with the construction proposed for Lot 3. With respect to SW Watkins Avenue, the street has not been improved to City standards and the applicant should be required to sign an agreement to waive the property owner's right to oppose or remonstrate against the formation of a future Local Improvement District to improve SW Watkins Avenue. The driveway proposed for Lot 1 should connect to the existing paved driveway within the proposed easement. In addition, Lots 1 and 2 shall agree to a joint use and maintenance of the common driveway, and the agreement and recording information shall be noted on the final partition plat. In regards to the requirements of Ordinance No. 94 -07, relating to Street Alignment and Connections, it has been determined that a street connection between SW Watkins Avenue and SW Pathfinder Court is not appropriate due to topography and the adjoining residential development. The Planning Department has suggested that an easement for pedestrian access between the two streets be dedicated along the NOTICE OF DECISION MLP 95 -0004 / VAR 95 -0004 - Burkey / Sims Page 8 • • southerly boundary of the property as an alternative, in accordance with Section • 18.164.040(6)2 of the Code. The easement would be 15 feet wide centered on the property line and constructed in the future. 2. Sanitary Sewer: The existing 8" sewer located in SW Watkins Avenue has sufficient capacity for the proposed development. The applicant proposes to construct separate gravity service laterals for each lot that would connect to the main in SW Watkins Avenue. The sewer main has sufficient capacity to serve the proposed development. As an alternative, the applicant may wish to construct a sewer main to serve all three properties that could be located within the proposed 15 feet access driveway, in a 15 foot wide public utility easement. 3. Storm Sewer: The property slopes in a east/west direction away from the existing house. All drainage from the development shall be directed to either of the two adjacent streets in accordance with the City Standards and as approved by the City Engineering Department. The Unified Sewerage Agency has established and the City has agreed to enforce (Resolution and Order No. 91 -47) Surface Water Management Regulations requiring the construction of on -site water quality facilities or fees in -lieu of their construction. Section 7.10b of the above noted Resolution and Order cites conditions under which the fee in -lieu may be accepted. Specifically, it provides, that if, "The site is small compared to the development plan, and the loss of area for the on -site facility would preclude the effective development. ", the fee may apply. It is our opinion that this site is consistent with this criteria, and we recommend that a fee in -lieu be required. SECTION IV. ANALYSIS AND CONCLUSION - VARIANCE Community Development Code section 18.134.050 provides standard for granting a variance: 1. The proposed variance will not be materially detrimental to the purposes of this title, be in conflict with the policies of the Comprehensive Plan, to any other applicable policies and standards, and to other properties in the same zoning district or vicinity; NOTICE OF DECISION MLP 95 -0004 / VAR 95 -0004 - Burkey / Sims Page 9 • 2. There are special circumstances that exist which are peculiar to the lot size • or shape, topography or other circumstances over which the applicant has no control, and which are not applicable to other properties in the same zoning district; 3. The use proposed will be the same as permitted under this title and City standards will be maintained to the greatest extent that is reasonably possible while permitting some economic use of the land; 4. Exisiting physical and natural systems, such as but not limited to traffic, drainage, dramatic land forms, or parks will not be adversely affected any more than would occur if the development were located as specified in this title; and 5. The hardship is not self- imposed and the variance requested is the minimum variance which would alleviate the hardship. Criteria 1: The applicant is requesting a variance from the 10 foot flag lot, side yard setback requirement, to allow a side yard setback of 5'5" for an existing single family home. Criteria E of the partition criteria states that the developer may determine the location of the front yard, provided that no side yard is Tess than 10 feet and that structures shall generally be located so as to maximize separation from existing structures. This variance will in no way impact the adjoining property as this is an existing structure therefore this variance will not be materially detrimental to purposes of the Community Development Code. The creation of a flag lot imposes a new setback standard upon an existing structure and as such the adjacent property will notice no change in the setback area. Criteria 2: The special circumstances which exist are the lot shape, location of the existing structure and the City's requirement of a 10 foot flag lot, side yard setback whereas a 5 foot side yard setback is normally required. The shape of the exiting property and definition of flag lot setbacks prohibits the applicant from satisfying the required setback. Criteria 3: The requested variance will in no way affect the permitted use status of the existing single family residence or proposed development. All other City standards will be maintained, as discussed in Section 111 - Analysis and Conclusions. Criteria 4: Existing physical and natural systems will not be adversely affected any more than would occur if the variance were not requested. Drainage will be connected to an approved system thereby minimizing adverse effects on the natural system. Traffic will be no heavier than that allowed by the density of NOTICE OF DECISION MLP 95 -0004 / VAR 95 -0004 - Burkey / Sims Page 10 • • the zone. The impact of this variance will be limited to an encroachment into the required setback, but there will be no change in the actual setback of the existing home. - Criteria 5: The hardship related to this variance is brought about through the location of the existing house and is not self- imposed as the City's Code requires a change in the minimum setback. The requested variance is the minimum variance which would alleviate the hardship, since the proposal relates to an existing structure and does not require eliminating any additional setback area. Therefore, staff finds that the requested variance meets the applicable criteria and is APPROVED. SECTION V - DECISION The Planning Division hereby APPROVES Minor Land Partition MLP 95 -0004 subject to the conditions listed in Section I at the beginning of this decision. THIS APPROVAL IS VALID IF EXERCISED WITHIN EIGHTEEN MONTHS OF THE EFFECTIVE DATE OF THIS DECISION. 1. The following are comments and /or clarifications of some of the statements related to City of Tigard requirements and positions. 1. All conditions are standard conditions as found in the Community Development Code. Given the requirements as outlined in the pre - application notes, a major rework of the project is not necessary. 2. The lot lines of the proposed lot #1 will have to be adjusted. SW Watkins Street is classified as a minor collector street, with a total right -of -way width of 60 feet or 30 feet from centerline. The current tax maps indicate that there is currently 25 feet from centerline, requiring a dedication of an additional 5 feet. The applicant would not be required to improve the street, but would be required to sign a waiver of non - remonstrance for future street improvements. The rear lot line of proposed lot #1 would therefore have to be moved 5 feet back in order to maintain the minimum lot size of 7,500 as shown on the proposed site plan. Preliminary review of the square footages and setbacks as shown on the proposed site plan indicate that the property can accommodate the minor adjustment. 3. A 7.5 foot pedestrian easement will be required along the south property line. A pedestrian walkway is not required to be constructed by the property owners. The path may be constructed by the City at some future date. This easement can be incorporated within the proposed 15 foot utility easement and 15 foot access driveway. 4. A sidewalk will be required along the frontage of SW Pathfinder Way. RESIDENTIAL DENSITY CALCULATION Community Development Code Chapter 18.92 specifies that the Net Residential Units allowed on a particular site may be calculated by dividing the net area of the developable land by the minimum number of square feet required per dwelling unit as specified by the applicable zoning designation. Net development area is calculated by subtracting the following land area(s) from the gross site area: 1. All sensitive lands areas including - Land within the 100 year floodplain - Slopes exceeding 25% - Drainageways 2. Land dedicated for park purposes 3. Public right -of -way dedication 4. All land to be provided for private streets (includes accessways through parking areas) RESIDENTIAL DENSITY TRANSFER The City of Tigard allows a Residential Density Transfer of up to 25% of the units that could otherwise have been developed on sensitive lands areas listed in (1) above which may be applied to the developable portion of the site (Code Section 18.92.030). It is the responsibility of the applicant for a residential development application to provide a detailed calculation for both the permitted residential density and the requested density transfer. RESIDENTIAL DENSITY TRANSITION Regardless of the allowed housing density in a zoning district, any property within 100 feet of a designated established area shall not be developed at a density greater than 125 percent of the maximum Comprehensive Plan designation (not zoning) of the adjacent parcel. .�.� RESIDENTIAL DEVELOPMENT SOLAR ACCESS REQUIREMENTS All subdivisions and minor partitions are subject to solar access requirements. These requirements state that a minimum of 80% of all lots created must be oriented for solar accessibility. The basic standard, which determines solar accessibility, requires that 80 % of total number of proposed lots: 1) demonstrate a north -south dimension of at least 90 feet; and 2) demonstrate a front lot line orientation within 30 degrees of a true east -west axis. The total or partial exemption of a site from the solar access requirement may be approved for the following reasons: - East, west or north slopes steeper than 20 %. - Off -site shade sources (structures, vegetation, topography). - On -site shade sources (vegetation). Page 2 • • Adjustments allowing a reduction of the 80% solar lot design requirement may be made for the following reasons: - Reduced density or an increased cost of at least five percent due to either: * east, west or north slope greater than 10 %, * significant natural feature, * existing road or lotting pattern, * public easement or right -of -way. - Reduction in important development amenities. - Pre - existing shade (vegetation). PLEASE NOTE: Maps and text are required which are sufficient to show that the development complies with the solar design standards, or that specific lots should be exempted or adjusted out. The following items shall be included in the analysis: a. The north -south lot dimension and front lot line orientation of each proposed lot; b. Protected solar building lines and relevant building site restrictions, if applicable; c. For the purpose of identifying trees related to exemption requests, a map showing existing trees which are at least 30 feet tall and over 6 inches diameter at a point 4 feet above grade shall be submitted. This map shall including their height, diameter, and species, and a statement declaring that they are to be retained; and d. Copies of all private restrictions relating to solar access. The design characteristics of a developed solar- oriented lot are high levels of wintertime sun striking the south walls and roofs of the house, house orientation maximizing south window area, and a south - sloping roof area. To achieve this, one may utilize the following: b. Protected Solar Building Line: The solar building line must a) be oriented to within 30 degrees of a true east -west axis, b) provide a minimum distance of 70 feet from the middle of the lot to the south property line, and c) provide a minimum distance of 45 feet from the northernmost buildable boundary of the subject lot to the north property line. c. Performance Options: There are two performance options which may be utilized. The first option requires the house to be oriented within 30 degrees of an east -west axis and have at least 80% of the ground floor's south wall protected from shade. The second option requires that at least 32% of the glass and 500 square feet of the roof area face south and be protected from shade. Please contact the Building Division for further information regarding the Protected Solar Building Line and Performance Options relating to building height and construction. CLEAR VISION AREA The City requires that clear vision areas be maintained between three and eight feet in height at road /driveway, road /railroad, and road /road intersections. The size of the required clear vision area depends upon the abutting street's functional classification. ---- 3d Page 4 • • BUFFERING AND SCREENING In order to increase privacy and to either reduce or eliminate adverse noise or visual impacts between adjacent developments, especially between different land uses, the City requires landscaped buffer areas along certain site perimeters. Required buffer areas are described by the Code in terms of width. Buffer areas must be occupied by a mixture of deciduous and evergreen trees and shrubs and must also achieve a balance between vertical and horizontal plantings. Site obscuring screens or fences may also be required; these are often advisable even if not required by the Code. The required buffer areas may only be occupied by vegetation, fences, utilities, and walkways. Additional information on required buffer area materials and sizes may be found in Code Chapter 18.100. Street trees must be placed either within the public right -of -way or on private property within six feet of the right -of -way boundary. Street trees must have a minimum caliper of at least two inches when measured four feet above grade. Street trees should be spaced 20 to 40 feet apart depending on the branching width of the tree at maturity. Further information on regulations affecting street trees may be obtained from the Planning Division. SIGNS Sign permits must be obtained prior to installation of any s'gn in the City of Tigard. APPLICATION SUBMITTAL PROCESS All applications must be accepted by a Planning Division staff member at the Community Development Department counter at City Hall. PLEASE NOTE: Applications submitted by mail or dropped off at the counter without Planning Division acceptance may be returned. Applications submitted after 4:30 P.M. on Thursday will be batched for processing with the following week's applications. Applications will NOT be accepted after 3:00 P.M. on Fridays or 4:30 on other days. Maps submitted with an application shall be folded IN ADVANCE to 8.5 by 11 inches. One 8.5 inch by 11 inch map of a proposed proiect should be submitted for attachment to the staff report or administrative decision. Application with unfolded maps shall not be accepted. The Planning Division and Engineering Division will preform a preliminary review of the application and will determine whether an application is complete within 10 days of the counter submittal. The administrative decision or public hearing will typically occur approximately 45 to 60 days after an application is accepted as being complete by the Planning Division. There will be no final recommendation to the decision making authority on behalf of the City staff until all concerned commenting agencies, City staff and the public have had an opportunity to review and comment on the application. The following comments are a projection of public improvement related requirements that may be required as a condition of development approval for your proposed project. Right-of-way dedication: The City of Tigard requires that land area be dedicated to the public: 1) to increase abutting public rights -of -way to the ultimate functional street classification right -of -way width as specified by the Community Development Code; or 2) for the creation of new streets. We appreciate your comments and recognize your concerns. The partition will allow the development of one (1) additional house which will have access to SW Watkins Avenue. The lot proposed behind the existing residence will take access off SW Pathfinder Court. According to the Institute of Transportation Engineers, one single family residence is expected to generate an additional 10 vehicle trips per day. The current traffic volume is 1,408 vehicle trips per day and is well within the standard for a Minor Collector street. Still, it does mean an increase in traffic. To reduce traffic impacts, the City attempts to make traffic improvements through its Capital Improvements Program and through programs like the Washington County MSTIP. In addition, plan review requirements imposed by the City require more connectivity between developments in an effort to reduce traffic and congestion on our streets. One way to lessen traffic is to provide for pedestrian and bicycle trips wherever possible. This helps to reduce the number of automobile trips. The dedication of an pedestrian easement in the Sims partition is a small piece of that effort. Thank you again for your comments. MEMORANDUM CITY OF TIGARD TO: Will D'Andrea March 10, 1995 FROM: Michael Anderson, Development Review Engineer 0 SUBJECT: MLP 95 -0004 BURKEY /SIMS Applicant is requesting approval to divide Tax Lot 2S1 2BC 1801, a parcel located between SW Watkins Avenue and SW Pathfinder Court, southerly of SW Walnut Street, into three parcels with areas of 7500 sft, 7724 sft, and 10,000 sft. The existing residence would remain on the proposed middle parcel, Lot 2. Findings: 1. Streets: Access to the parcels is proposed from both streets. The applicant proposes two driveways onto SW Watkins Avenue, a Minor Collector street as shown on the City Comprehensive Plan. The right -of -way for SW Watkins Avenue is not consistent with the City standards and the applicant should dedicate an additional 5 feet to establish the width at 30 feet, as measured from centerline. In addition, the driveway for Lot 1 should be designed to connect to the existing driveway that will serve Lot 2, consistent with the requirements of Section 18.108.060 (B), that restricts driveway access to collectors. Lot 3 would face SW Pathfinder Court and a driveway would connect to the existing pavement. The existing street right -of -way width for SW Pathfinder Court is 50 feet and no further dedications are required. The improvements along SW Pathfinder Court have been constructed with the adjoining Yolo Estates subdivision, with the exception of the sidewalk. The sidewalk should be completed with the construction proposed for Lot 3. With respect to SW Watkins Avenue, the street has not been improved to City standards and the applicant should be required to sign an agreement to waive the property owner's right to oppose or remonstrate against the formation of a future Local Improvement District to improve SW Watkins Avenue. The driveway proposed for Lot 1 should connect to the existing paved driveway within the proposed easement. In addition, Lots 1 and 2 shall agree to a joint use and maintenance of the common driveway, and the agreement and recording information shall be noted on the final partition plat. In regards to the requirements of Ordinance No. 94 -07, relating to Street Alignment and Connections, it has been determined that a street connection between SW Watkins Avenue and SW Pathfinder Court is not appropriate due to topography and the adjoining residential development. The Planning Department has suggested that an easement for pedestrian access between the two streets be dedicated along the southerly boundary of the property as an alternative, in accordance with Section 18.164.040(8)2 of the Code. Sanitary Sewer: The existing 8" sewer located in SW Watkins Avenue has sufficient capacity for the proposed development. The applicant proposes to construct separate gravity service laterals for each lot that would connect to the main in SW Watkins Avenue. The sewer main has sufficient capacity to serve the proposed development. As an alternative, the applicant may wish to construct a sewer main to serve all three properties that could be located within the proposed 15 feet access driveway, in a 15 foot wide public utility easement. 3. Storm Sewer: The property slopes in a east /west direction away from the existing house. All drainage from the development shall be directed to either of the two adjacent streets in accordance with the City Standards and as approved by the City Engineering Department. The Unified Sewerage Agency has established and the City has agreed to enforce (Resolution and Order No. 91 -47) Surface Water Management Regulations requiring the construction of on -site water quality facilities or fees in -lieu of their construction. Section 7.10b of the above noted Resolution and Order cites conditions under which the fee in -lieu may be accepted. Specifically, it provides, that if, "The site is small compared to the development plan, and the loss of area for the on -site facility would preclude the effective development. ", the fee may apply. It is our opinion that this site is consistent with this criteria, and we recommend that a fee in- lieu be required. Recommendations: ALL CONDITIONS SHALL BE SATISFIED OR FINANCIALLY ASSURED PRIOR TO RECORDING THE FINAL PLAT WITH WASHINGTON COUNTY. 1. Additional right -of -way shall be dedicated to the Public along the SW Watkins Avenue frontage to increase the right - - way to 30 feet from the centerline. The description shall be tied to the existing right - - way centerline. The dedication document shall be on City forms. The partition plat and data or narrative shall be drawn to the minimum standards set forth by the Oregon Revised Statutes (ORS 92.05), Washington County, and by the City of Tigard. C.
