SUMMARY The applicant requests approval of a conditional use permit to remodel a portion of the basement of an existing single family detached dwelling to create a 700-square foot living unit to be occupied by the mother of the one of the resident-owners of the home. Two duly noticed public hearings were held to review the application. City staff recommended conditional approval. The applicant accepted the recommendation without objections. Owners of a property adjoining the site objected to the conditional use permit. The hearings officer approves the conditional use permit as provided herein. II. FINDINGS ABOUT SITE, SURROUNDINGS AND PUBLIC FACILITIES The hearings officer incorporates by reference the findings about the site and surroundings in Section II of the City of Tigard Staff Reported dated June 19, 1995 (the "Staff Report"), and the agency comments in Section IV of the Staff Report. III. APPLICABLE APPROVAL STANDARDS The hearings officer incorporates by reference the approval standards in Section III of the Staff Report. IV. HEARINGS AND RECORD 1. Hearings Officer Larry Epstein (the "hearings officer") received testimony at the public hearings about this application on June 26 and July 24, 1995. The testimony is included herein as Exhibit A (Parties of Record), Exhibit B (Taped Proceedings), and Exhibit C (Written Testimony). These exhibits are filed at the Tigard City Hall. 2. City planner Will D'Andrea testified for the City. He summarized the Staff Report. He also introduced a letter dated July 24, 1995 from Kris and Ron Farrimond, owners and residents of property adjoining the Leichty property. Based on their letter, the Farrimonds oppose the conditional use permit for the following reasons: a. The proposed living unit would violate the conditions, covenants and restrictions ("CC & R's") that apply to lots in the Hillshire subdivision. b. If this conditional use permit is approved, it will be a precedent, and anyone else who wants such a living unit will be able to build one, increasing traffic and other effects. c. There is not enough parking around the cul de sac that the lots adjoin. Another living unit will make things worse. d. There is not enough parking on the Leichty property; a driveway should not count as a parking space. Hearings Ofcer Final Order CUP 95-0003 (Leichty) Page 1 If the application is approved, the Farrimonds argue the occupants of the living unit should have to park in the Leichty driveway, and notice of limits on the permitted use of the living unit should be given to potential purchasers of the property. 3. Mary and Mark Leichty testified as the applicants. They explained what they propose to do. They accepted the Staff Report without objections or corrections. They agreed to accept a condition of approval requiring filing of a covenant with the deed to the property describing the limitations that apply to the second living unit. They disputed some of the statements in the Farrimonds' letter. V. EVALUATION OF REQUEST 1. The hearings officer incorporates the findings about compliance with the Community Development Code and Comprehensive Plan in Section V of the Staff Report. 2. The hearings officer finds the reasons given by the Farrimonds to deny the CUP are not relevant or are rebutted by substantial evidence in the record as follows: a. Compliance with private CC & R's is not a standard for approval of a conditional use permit in the City Code. Based on ORS 227.173(1), approval or denial of an application can be based only on applicable standards and criteria in the local development regulations and comprehensive plan. Whether the second living unit in the home violates the CC & R's is not relevant to the CUP, and the hearings officer expresses no opinion about the merits of that claim. b. Approval of the CUP in this case does not create a "precedent" in the sense that that term is used in a court of law. Each application is unique and is judged on its own merits. A decision in prior local land use case has no binding effect on subsequent cases. A second living unit is permitted in a single family zone by conditional use permit, subject to applicable standards and criteria. Those standards and criteria severely limit the potential for such units. A second living unit in a single family home can be occupied only by a family member of the occupant of the home. Therefore the Farrimonds' concern about the precedential effect of the CUP in this case is misplaced and unjustified. Moreover the issue is not relevant to the CUP in question, because it is not relevant to an applicable approval standard or criteria. c. The standards for a second living unit require the applicant to show that the property complies with off-street parking standards by having at least two parking spaces for the principal dwelling unit and an additional parking space for the second living unit. CDC 18.130.150(C)(1)(e). The hearings officer finds the applicant made that showing. The parking regulations require 2 off-street spaces for a single family home. There are at least four off-street parking spaces on the property: two in the garage and two on the driveway. Therefore the CUP complies with the parking standard. The fact that two of the parking spaces are tandem spaces is not relevant. Tandem spaces are permitted in such a setting. See CDC 18.106.050(F)(1) and (I)(1). Because the residents of the two dwelling units are related, it is reasonable to expect them to cooperate about moving vehicles onto and off of the property. The hearings officer finds the site is of a sufficient size and is improved sufficient to accommodate the parking needs of the proposed CUP. The hearings officer finds the Fatrimonds' perceived on-street parking constraints are not relevant to the applicable approval criteria. d. Parking spaces are required to be provided on the site of a dwelling. But they are not required to be used. On-street parking can be used if it is available. It does not count toward required on-site parking. CDC 18.106.020(V). The hearings officer finds Hearings Officer Final Order CUP 95-0003 (Leichry) Page 2 no basis at law for requiring the Leichtys to parking the vehicle of the resident of the second living unit in the garage or on the driveway. If on-street parking is available, the Leichtys are allowed to use it to park vehicles consistent with the CDC. 3. However the hearings officer finds that a CUP for a second living unit is subject to one standard that must be fulfilled over time. CDC 18.130.150(C)(1) provides that the second living unit can be occupied only by a person related by blood or marriage to the owner of the property, and that owner must occupy the principal dwelling on the site. Compliance with this standard must occur over time and across changes in ownership. To facilitate continuing compliance with that standard, the hearings officer finds a condition of approval should be imposed requiring the applicant to file a statement in the office of the County Recorder with the deed to the property that the second living unit can be occupied only by a relative of the owner of the property, and that owner must occupy the principal dwelling on the site. This will put potential third party purchasers of the property on notice that the second living unit is subject to certain limitations. VI. CONCLUSION AND DECISION 1. Based on the findings adopted and incorporated herein, the hearings officer concludes that the proposed conditional use permit complies with the applicable criteria and standards of the Community Development Code, provided development that occurs after this decision complies with applicable local, state, and federal laws and with conditions of approval warranted to ensure such compliance occurs. 2. In recognition of the findings and conclusions contained herein, and incorporating the Staff Report and other reports of effect agencies and public testimony and exhibits received in this matter, the Hearings Officer hereby approves CUP 95-0003, subject to the following conditions of approval: a. The applicant shall apply to the City for and receive approval of a building permit for conversion of the basement into an accessory living unit. b. Before the City issues the building permit, the applicant shall file the following statement or equivalent in the office of the County Recorder with the deed to the property: "The second living unit can be occupied only by a person related by blood or marriage to the owner of the property, and that owner must occupy the principal dwelling on the site. Other occupancy violates the Tigard Community Development Code. The City may enforce the restrictions on the use of the second dwelling unit, such as by ordering the vacation or conversion of the second living unit if the property owner does not comply with applicable use restrictions." West of SW Hillshire Drive, east of SW 136th Place and south of SW Westridge Terrace within Hillshire Subdivision. APPLICABLE LAW: Community Development Code Chapters 18.52, 18.106, 18.108. 18.130. 13.164. Comprehensive Plan Policies 2.1.1, 7.1.2, 7.3.1, 7.4.4, 7.6.1, and 8.1.3. STAFF RECOMMENDATION: Approval subject to conditions. IL SITE AND VICINITY INFORMATION A. Background Information: The subject parcel was created in 1993 with the recording of the "Hillshire" subdivision. No other development applications have been filed with the City. The applicant proposes to provide an accessory dwelling unit of approximately 700 square feet within the basement of the existing residence, to be occupied by the owner's mother-in-law. C. Vicinitv Information: The subject parcel and surrounding parcels are zoned R-7 (Residential, 7 units per acre). The area is predominantly developed with single family residential dwellings. III. APPLICABLE APPROVAL STANDARDS A. Communitv Development Code: 1. Chapter 18.52.040 lists Accessory Dwelling Unit as a Conditional Use in the R-7 zone. 2. Chapter 18.130.040 contains the following general approval criteria for a Conditional Use: A) The site size and dimensions provide adequate area for the needs of the proposed use; B) The characteristics of the site are suitable for the proposed use considering size. shape, location, topography, and natural features. C) All required public facilities have adequate capacity to serve the proposal. D) The applicable requirements of the zoning district are met except as modified by this chapter. E) The supplementary requirements set forth in Chapter 18.114 (Signs) and Section 18.120.180 (Approval Standards) Site Development Review, if applicable, are met. F) The use will comply with the applicable policies of the Comprehensive Plan. HEARINGS OFFICER - CUP 95-0003 - LIECHTY Paget J. Section 18.130.150(C)(1) states that a secondary unit may be allowed within an existing single-family detached unit for occupation by a person related by blood or marriage to the property owner providing each of the following conditions are satisfied: A) The lot coverage standards of the base zone are not exceeded, B) There are a minimum of 250 gross square feet of floor area for each occupant; however, there shall be no more than two occupants and the unit shall be limited in size to 800 gross square feet; C) One of the units shall be occupied by the property owner at all times that the accessory dwelling unit is occupied. Should the property owner vacate one of the units, the accessory unit shall not be occupied; D) All requirements of the base zone shall be satisfied and required yard areas shall not be used for parking; and E) The off-street parking .requirements of Chapter 18.106 shall be satisfied for the principal dwelling and one additional space shall be provided for the accessory dwelling unit. 4. Section 18.52.050 (R-7 Zone) states that the minimum lot area shall be 5,000 square feet, the minimum lot width shall be 50 feet, and that the maximum lot coverage-shall be 80 percent. 5. Section 18.106.030(A)(1) (Parking) requires 2 off-street spaces for each dwelling unit. 6. Section 18.108.070(A) (Access) requires one driveway with a width of 15 feet (10 feet of pavement) for a single-family residence. 7. Chapter 18.164 contains standards for streets and utilities. a. Section 18.164.030(A) requires streets within and adjoining a development to be dedicated and improved based on the classification of the street. b. Section 18.164. 100 requires adequate provisions for storm water runoff and dedication of easements for storm drainage facilities. B. Applicable Comprehensive Plan Policies. 1. Policy 2. 1.1 provides the City will assure that citizens will be provided an opportunity to participate in all phases of the planning and development review process. 2. Policy 7.1.2 provides the City will require, as a condition of development approval, that public water, sewer, and storm drainage will be provided and designed to City standards and utilities placed underground. 3. Policy 7.3.1 provides the City will coordinate water services with water districts. 4. Policy 7.4.4 requires all new development to be connected to an approved sanitary sewer system. 5. Policy 8. 133 provides the City will require as a precondition of approval that: a. Development abut a dedicated street or have other adequate access; b.. Street right-of-way shall be dedicated where the street is substandard in width; C. The developer shall commit to construction of the streets, curbs, sidewalks to City standards within the development. d. The developer shall participate in the improvement of existing streets, curbs, and sidewalks to the extent of the development's impacts; IV. AGENCY COMMENTS 1. The City of Tigard Building Division states that a building permit is required and the accessory dwellinc, unit must meet Building Code standards, which include the provision of a one-hour separation wall. HEARINGS OFFICER - CUP 95-0003 - LIECHTY Page4 V. EVALUATION OF REQUEST 1. Compliance with Community Development Code. Section 18.130.040: The site size is adequate for the proposed use as the site exceeds the 5,000 square foot minimum lot size and will be within an existing single family residence; Adequate public facilities currently serve the site; Applicable requirements of the zoning district are satisfied;. Site Development Review supplemental requirements are not applicable as there is no modification or addition to the existing structure; and Comprehensive Plan Policies are satisfied as discussed below. Section 18.130.150(C)(1) is satisfied. The lot coverage standards of the zone are not affected by this conditional use and the lot coverage standards were reviewed during building permit review. The acessory unit will be 700 gross square feet, under the maximum 800 allowed. The property owner will occupy the principal residence. All base zone standards are satisfied as reviewed with the building permit review process. The applicant is proposing to utilize the existing garage and driveway and will not be using required yard area for parking. The property contains a double car garage and a 20 foot driveway. The garage and driveway area shall provide adequate area for parking as the garage will provide the two required spaces for the principal residence with the driveway providing the space for the accessory unit. Section 18.106.030(A)(1) and 18.108.070(A) are satisfied as three parking spaces are provided and as the residence has a minimum 15 foot wide driveway. 2. Compliance -vith Comprehensive Plan Policies: This proposed Conditional Use complies with all applicable Comprehensive Plan Policies as follows: 1. Citizen Involvement. Policy 2. 1.1 is satisfied because notice of the application and public hearing on this item was provided to owners of property in the vicinity of the site and in a newspaper of general circulation. 2. Public Facilities and Services. The conditional use complies with Policies 7.1.2, 7.3.1. and 7.4.4 because the serving Private Utility Companies and Public Agencies have been provided with copies of the proposed development application. Fire Protection: Tualatin Valley Fire and Rescue was provided with a copy of the development plan in compliance with Policy 7.6.1. The Fire Department has not provided objections to this proposal. 4. Transportation. This application complies with Policy 8.1.3 because SW 136th Place has been developed to City street standards. VI. CONCLUSION AND RECOMMENDATION The Planning Division concludes that the Conditional Use request will promote the general welfare of the City and will not be significantly detrimental nor injurious to surrounding properties provided that development which occurs after this decision complies with applicable local state and federal laws. In recognition of the findings, staff recommends APPROVAL of Conditional Use Permit CUP 95-0003 subject to the following conditions: 1. Mary and Mark Leichty testified as the applicants. They explained what they propose to do. They accepted the Staff Report without objections or corrections. They agreed to accept a condition of approval requiring filing of a covenant with the deed to the property describing the limitations that apply to the second living unit. They disputed some of the statements in the Farrimonds' letter. V. EVALUATION OF REQUEST 1. The hearings officer incorporates the findings about compliance with the Community Development Code and Comprehensive Plan in Section V of the Staff Report. 2. The hearings officer finds the reasons given by the Farrimonds to deny the CUP are not relevant or are rebutted by substantial evidence in the record as follows: a. Compliance with private CC & R's is not a standard for approval of a conditional use permit in the City Code. Based on ORS 227.173(1), approval or denial of an application can be based only on applicable standards and criteria in the local development regulations and comprehensive plan. Whether the second living unit in the home violates the CC & R's is not relevant to the CUP, and the hearings officer expresses no opinion about the merits of that claim. b. Approval of the CUP in this case does not create a "precedent" in the sense that that term is used in a court of law. Each application is unique and is judged on its own merits. A decision in prior local land use case has no binding effect on subsequent cases. A second living unit is permitted in a single family zone by conditional use permit, subject to applicable standards and criteria. Those standards and criteria severely limit the potential for such units. A second living unit in a single family home can be occupied only by a family member of the occupant of the home. Therefore the Farrimonds' concern about the precedential effect of the CUP in this case is misplaced and unjustified. Moreover the issue is not relevant to the CUP in question, because it is not relevant to an applicable approval standard or criteria. c. The standards for a second living unit require the applicant to show that the property complies with off-street parking standards by having at least two parking spaces for the principal dwelling unit and an additional parking space for the second living unit. CDC 18.130.150(C)(1)(e). The hearings officer finds the applicant made that showing. The parking regulations require 2 off-street spaces for a single family home. There are at least four off-street parking spaces on the property: two in the garage and two on the driveway. Therefore the CUP complies with the parking standard. The fact that two of the parking spaces are tandem spaces is not relevant. Tandem spaces are permitted in such a setting. See CDC 18.106.050(F)(1) and (1)(1). Because the residents of the two dwelling units are related, it is reasonable to expect them to cooperate about moving vehicles onto and off of the property. The hearings officer finds the site is of a sufficient size and is improved sufficient to accommodate the parking needs of the proposed CUP. The hearings officer finds the Farrimonds' perceived on-street parking constraints are not relevant to the applicable approval criteria. d. Parking spaces are required to be provided on the site of a dwelling. But they are not required to be used. On-street parking can be used if it is available. It does not count toward required on-site parking. CDC 18.106.020(V). The hearings officer finds Hearings Officer Final Order CUP 95-0003 (Leiciuy) Page 2 • no basis at law for requiring the Leichtys to parking the vehicle of the resident of the second living unit in the garage or on the driveway. If on-street parking is available, the Leichtys are allowed to use it to park vehicles consistent with the CDC. 3. However the hearings officer finds that a CUP for a second living unit is subject to one standard that must be fulfilled over time. CDC 18.130.150(C)(1) provides that the second living unit can be occupied only by a person related by blood or marriage to the owner of the property, and that owner must occupy the principal dwelling on the site. Compliance with this standard must occur over time and across changes in ownership. To facilitate continuing compliance with that standard, the hearings officer finds a condition of approval should be imposed requiring the applicant to file a statement in the office of the County Recorder with the deed to the property that the second living unit can be occupied only by a relative of the owner of the property, and that owner must occupy the principal dwelling on the site. This will put potential third party purchasers of the property on notice that the second living unit is subject to certain limitations. VI. CONCLUSION AND DECISION 1. Based on the findings adopted and incorporated herein, the hearings officer concludes that the proposed conditional use permit complies with the applicable criteria and standards of the Community Development Code, provided development that occurs after this decision complies with applicable local, state, and federal laws and with conditions of approval warranted to ensure such compliance occurs. 2. In recognition of the findings and conclusions contained herein, and incorporating the Staff Report and other reports of effect agencies and public testimony and exhibits received in this matter, the Hearings Officer hereby approves CUP 95-0003, subject to the following conditions of approval: a. The applicant shall apply to the City for and receive approval of a building permit for conversion of the basement into an accessory living unit. b. Before the City issues the building permit, the applicant shall file the following statement or equivalent in the office of the County Recorder with the deed to the property: "The second living unit can be occupied only by a person related by blood or marriage to the owner of the property, and that owner must occupy the principal dwelling on the site. Other occupancy violates the Tigard Community Development Code. The City may enforce the restrictions on the use of the second dwelling unit, such as by ordering the vacation or conversion of the second living unit if the property owner does not comply with applicable use restrictions." Vicinitv Information: The subject parcel and surrounding parcels are zoned R-7 (Residential, 7 units per acre). The area is predominantly developed with single family residential dwellings. III. APPLICABLE APPROVAL STANDARDS A. Community Development Code: 1. Chapter 18.2.040 lists Accessory Dwelling Unit as a Conditional Use in the R-7 zone. 2. Chapter 18.130.040 contains the following general approval criteria for a Conditional Use: A) The site size and dimensions provide adequate area for the needs of the proposed use; B) The characteristics of the site are suitable for the proposed use considering size, shape, location, topography, and natural features. C) All required public facilities have adequate capacity to serve the proposal. D) The applicable requirements of the zoning district are met except as modified by this chapter. E) The supplementary requirements set forth in Chapter 18.114 (Signs) and Section 18.120.180 (Approval Standards) Site Development Review, if applicable, are met. F) The use will comply with the applicable policies of the Comprehensive Plan. HEARINGS OFFICER - CUP 95-0003 - LIECHTY Paget J. Section 18.130.150(C)(1) states that a secondary unit may be allowed within an existing single-family detached unit for occupation by a person related by blood or marriage to the property owner providing each of the following conditions are satisfied: A) The lot coverage standards of the base zone are not exceeded; B) There are a minimum of 250 gross square feet of floor area for each occupant; however, there shall be no more than two occupants and the unit shall be limited in size to 800 gross square feet; C) One of the units shall be occupied by the property owner at all times that the accessory dwelling unit is occupied. Should the property owner vacate one of the units, the accessory unit shall not be occupied; D) All requirements of the base zone shall be satisfied and required yard areas shall not be used for parking; and E) The off-street parking requirements of Chapter 18.106 shall be satisfied for the principal dwelling and one additional space shall be provided for the accessory dwelling unit. 4. Section 18.52.050 (R-7 Zone) states that the minimum lot area shall be 5,000 square feet, the minimum lot width shall be 50 feet, and that the maximum lot coverage shall be 80 percent. 5. Section 18.106.030(A)(1) (Parking) requires 2 off-street spaces for each dwelling unit. 6. Section 18.108.070(A) (Access) requires one driveway with a width of 15 feet (10 feet of pavement) for a single-family residence. 7. Chapter 18.164 contains standards for streets and utilities. a. Section 18.164.030(A) requires streets within and adjoining a development to be dedicated and improved based on the classification of the street. b. Section 18.164. 100 requires adequate provisions for storm water runoff and dedication of easements for storm drainage facilities. B. Analicable Comprehensive Plan Policies. 1. Policy 3.1.1 provides the City will assure that citizens will be provided an opportunity to participate in all phases of the planning and development review process. 2. Policy 7.1.2 provides the City will require, as a condition of development approval, that public water, sewer, and storm drainage will be provided and designed to City standards and utilities placed underground. 3. Policy 7.3.1 provides the City will coordinate water services with water districts. 4. Policy 7.4.4 requires all new development to be connected to an approved sanitary sewer system. 5. Policy 8. 13 provides the City will require as a precondition of approval that: a. Development abut a dedicated street or have other adequate access; b.. Street right-of-way shall be dedicated where the street is substandard in width; C. The developer shall commit to construction of the streets, curbs, sidewalks to City standards within the development. d. The developer shall participate in the improvement of existing streets, curbs, and sidewalks to the extent of the development's impacts, IV. AGENCY COMMENTS 1. The City of Tigard Buildina Division states that a building permit is required and the accessory dwelling unit must me-It Building Code standards, which include the provision of a one-hour separation wall. Section 18.130.040: The site size is adequate for the proposed use as the site exceeds the 5,000 square foot minimum lot size and will be within an existing single family residence; Adequate public facilities currently serve the site; Applicable requirements of the zoning district are satisfied;. Site Development Review supplemental requirements are not applicable as there is no modification or addition to the existing structure; and Comprehensive Plan Policies are satisfied as discussed below. Section 18.130.150(C)(1) is satisfied. The lot coverage standards of the zone are not affected by this conditional use and the lot coverage standards were reviewed during building permit review. The acessory unit will be 700 gross square feet, under the maximum 800 allowed. The property owner will occupy the principal residence. All base zone standards are satisfied as reviewed with the building permit review process. The applicant is proposing to utilize the existing garage and driveway and will not be using required yard area for parking. The property contains a double car garage and a 20 foot driveway. The garage and driveway area shall provide adequate area for parking as the garage will provide the two required spaces for the principal residence with the driveway providing the space for the accessory unit. Section 18.106.030(A)(1) and 18.108.070(A) are satisfied as three parking spaces are provided and as the residence has a minimum 15 foot wide driveway. 2. Compliance with Comprehensive Plan Policies: This proposed Conditional Use complies with all applicable Comprehensive Plan Policies as follows: 1. Citizen Involvement. Policy 2. 1.1 is satisfied because notice of the application and public hearing on this item was provided to owners of property in the vicinity of the site and in a newspaper of general circulation. 2. Public Facilities and Services. The conditional use complies with Policies 7.1.2, 7.3.1. and 7.4.4 because the serving Private Utility Companies and Public Agencies have been provided with copies of the proposed development application. All utilities are available to serve this proposal. The Fire Department has not provided objections to this proposal. 4. Transportation. This application complies with Policy 8.1.3 because SW 136th Place has been developed to City street standards. VI. CONCLUSION AND RECOMMENDATION The Planning Division concludes that the Conditional Use request will promote the general welfare of the City and will not be significantly detrimental nor injurious to surrounding properties provided that development which occurs after this decision complies with applicable local state and federal laws. In recognition of the findings, staff recommends APPROVAL of Conditional Use Permit CUP 95-0003 subject to the following conditions: 1. Vicinity Information: The subject parcel and surrounding parcels are zoned R-7 (Residential, 7 units per acre). The area is predominantly developed with single family residential dwellings. III. APPLICABLE APPROVAL STANDARDS A. Community Development Code: 1. Chapter 18.52.040 lists Accessory Dwelling Unit as a Conditional Use in the R-7 zone. 2. Chapter 18.130.040 contains the following general approval criteria for a Conditional Use: A) The site size and dimensions provide adequate area for the needs of the proposed use; B) The characteristics of the site are suitable for the proposed use considering size, shape, location, topography, and natural features. C) All required public facilities have adequate capacity to serve the proposal. D) The applicable requirements of the zoning district are met except as modified by this chapter. E) The supplementary requirements set forth in Chapter 18.114 (Signs) and Section 18.120.180 (Approval Standards) Site Development Review, if applicable, are met. - F) The use will comply with the applicable policies of the Comprehensive Plan. Section 18.130.150(C)(1) states that a secondary unit may be allowed within an existing single-family detached unit for occupation by a person related by blood or marriage to the property owner providing each of the following conditions are satisfied: A) The lot coverage standards of the base zone are not exceeded; B) There are a minimum of 250 gross square feet of floor area for each occupant; however, there shall be no more than two occupants and the unit shall be limited in size to 800 gross square feet; C) One of the units shall be occupied by the property owner at all times that the accessory dwelling unit is occupied. Should the property owner vacate one of the units, the accessory unit shall not be occupied; D) All requirements of the base zone shall be satisfied and required yard areas shall not be used for parking; and E) The off-street parking requirements of Chapter 18.106 shall be satisfied for the principal dwelling and one additional space shall be provided for the accessory dwelling unit. 4. Section 18.52.050 (R-7 Zone) states that the minimum lot area shall be 5,000 square feet, the minimum lot width shall be 50 feet, and that the maximum lot coverage shall be 80 percent. 5. Section 18.106.030(A)(1) (Parking) requires 2 off-street spaces for each dwelling unit. 6. Section 18.108.070(A) (Access) requires one driveway with a width of 15 feet (10 feet of pavement) for a single-family residence. 7. Chapter 18.164 contains standards for streets and utilities. a. Section 18.164.030(A) requires streets within and adjoining a development to be dedicated and improved based on the classification of the street. b. Section 18.164. 100 requires adequate provisions for storm water runoff and dedication of easements for storm drainage facilities. B. Applicable Comprehensive Plan Policies. 1. Policy 2.1.1 provides the City will assure that citizens will be provided an opportunity to participate in all phases of the planning and development review process. 2. Policy 7.1.2 provides the City will require, as a condition of development approval, that public water, sewer, and storm drainage will be provided and designed to City standards and utilities placed underground. 3. Policy 7.3.1 provides the City will coordinate water services with water districts. 4. Policy 7.4.4 requires all new development to be connected to an approved sanitary sewer system. 5. Policy 8. 13 provides the City will require as a precondition of approval that: a. Development abut a dedicated street or have other adequate access; b. Street right-of-way shall be dedicated where the street is substandard in width; C. The developer shall commit to construction of the streets, curbs, sidewalks to City standards within the development. d. The developer shall participate in the improvement of existing streets, curbs, and sidewalks to the extent of the development's impacts; IV. AGENCY COMMENTS 1. The City of Tigard Building Division states that a building permit is required and the accessory dwelling unit must meet Building Code standards, which include the provision of a one-hour separation wall. Section 18.130.040: The site size is adequate for the proposed use as the site exceeds the 5,000 square foot minimum lot size and will be within an existing single family residence; Adequate public facilities currently serve the site; Applicable requirements of the zoning district are satisfied; Site Development Review supplemental requirements are not applicable as there is no modification or addition to the existing structure; and Comprehensive Plan Policies are satisfied as discussed below. Section 18.130.150(C)(1) is satisfied. The lot coverage standards of the zone are not affected by this conditional use and the lot coverage standards were reviewed during building permit review. The acessory unit will be 700 gross square feet, under the maximum 800 allowed. The property owner will occupy the principal residence. All base zone standards are satisfied as reviewed with the building permit review process. The applicant is proposing to utilize the existing garage and driveway and will not be using required yard area for parking. The property contains a double car garage and a 20 foot driveway. The garage and driveway area shall provide adequate area for parking as the garage will provide the two required spaces for the principal residence with the driveway providing the space for the accessory unit. Section 18.106.030(A)(1) and 18.108.070(A) are satisfied as three parking spaces are provided and as the residence has a minimum 15 foot wide driveway. 2. Compliance with Comprehensive Plan Policies: This proposed Conditional Use complies with all applicable Comprehensive Plan Policies as follows: 1. Citizen Involvement. Policy 2. 1.1 is satisfied because notice of the application and public hearing on this item was provided to owners of property in the vicinity of the site and in a newspaper of general circulation. 2. Public Facilities and Services. The conditional use complies with Policies 7.1.2, 7.3.1, and 7.4.4 because the serving Private Utility Companies and Public Agencies have been provided with copies of the proposed development application. Fire Protection: Tualatin Valley Fire and Rescue was provided with a copy of the development plan in compliance with Policy 7.6.1. The Fire Department has not provided objections to this proposal. 4. Transportation. This application complies with Policy 8.1.3 because SW 136th Place has been developed to City street standards. VI. CONCLUSION AND RECOMMENDATION The Planning Division concludes that the Conditional Use request will promote the general welfare of the City and will not be significantly detrimental nor injurious to surrounding properties provided that development which occurs, after this decision complies with applicable local state and federal laws. This is a direct violation of the codes, covenants, and restrictions which the Liechty's agreed to comply with when they purchased their home (copy of CCR's enclosed). The CCR's specifically state that the houses built in this development must be single family dwellings. There are very few houses in the neighborhood which cost less than $250,000.00 and some of the houses cost as much as 500,000.00. We are in disbelieve that the zoning laws would allow anyone to build an apartment in the houses around us. When we moved into the neighborhood, we assumed that people who bought the houses would be able to afford them and they would not need to rent out part of their house to make the payments. We moved into the neighborhood because it was quiet and away from heavy traffic. We searched diligently for a house located on a cul-de-sac hoping to have some privacy. If the Liechty's are allowed to build an apartment in their house this will allow anyone who owns a house in the neighborhood to build an apartment. This will significantly increase the density of the population and if everyone in the cul-de-sac builds an apartment there will be at least an additional 9 cars on the street (assuming the people who occupy the apartments only have one car). We have a severe shortage of parking space in the neighborhood. The police have already towed away one car because of the lack of parking space. The house the Liechty's own is located on the edge of a cul-de-sac which as you know severely limits the amount of street parking which is available. We continually have strange vehicles parked in front of our house and two of the lots in the cul-de-sac still do not have houses built on them. Once these houses are built, the problem will get worse. I have three kids which I do not want to have abducted. This is an upper middle class neighborhood which we moved into to avoid all the traffic which would be created by apartments. Recently the Liechty's filed a complaint with the City of Tigard because we have a basketball hoop in front of our house. The basketball hoop interferes with nothing other than parking in the front of our house. Therefore, we have to assume that the Liechty's want the basketball hoop removed so that they can have the people living in the apartment park in front of our house. This supports our claim that there is not adequate parking in the neighborhood. When my husband talked to Mr. William D'Andrea about the impact that the apartment would have on parking in the neighborhood, he said he did not care. Then my husband ask him what parking requirements had to be met for them to build the apartment. He said that they have to have two spaces for the residence and one for the apartment which are not on the street. My husband told him that they only have a two car garage and he said that they can count the driveway as parking space. This is not a practical or reasonable alternative since they can not get cars out of the garage with cars in the driveway. Thus, the car for the occupant of the apartment will continue to be parked on the street. When my husband raised this issue to Mr. D'Andrea he said that once the variance was approved they could park any where they want to. Mr. D'Andrea must have called the Liechty's because after the issue was raised the Liechty's started parking the car in the driveway (After my husband's discussion with Mr. D'Andrea was the first time I have ever saw this car parked in the driveway). If the variance is approved the car will probably never be parked in the driveway again. In summary, the conditional use permit should not be granted. The Liechty's agreed to maintain their house as a single family dwelling when they purchased it. There is not adequate parking on the Liechty's property or on the street for the occupant of the apartment. The driveway should not be counted as parking space in order to circumvent the zoning requirements. Permitting the Liechty's to put an apartment in their house would have a significant negative impact on the neighborhood. However, if the conditional use permit is granted the following restrictions should be included as conditions to the permit: • The car(s) being used by the occupants of the apartment should be required to be parked in the space which is being use to satisfy the requirements of the conditional use permit ie. the driveway. • The Liechty's should be required to notify any potential buyer of the property of the restrictions as to who can live in the apartment. NUISANCES No noxious or offensive activity shall be conducted upon any lot, nor shall anything be done thereon which may be or may become an unreasonable annoyance or nuisance to the neighborhood. 5. PARKING Parking of boats, trailers, motor homes, motorcycles, one ton or larger trucks, truck- campers and the like equipment shall not be allowed on any part of said property nor on public ways adjacent thereto excepting when parked in the residential driveway for not more than seven consecutive days or within the confines of an enclosed garage. Parking of boats mounted on a trailer or camper trailers shall be permitted if they are fully screened from view of any street, provided, any boat mounted on a trailer, including its windshield, or camper trailer, does not exceed 6' feet in height 6. VEHICLES IN DISREPAIR No owner shall permit any vehicle which is in an extreme state of disrepair to be abandoned or to remain parked upon any lot or on the open space or on any street for a period in excess of forty-eight (48) hours. A vehicle shall be deemed to be in an "extreme state of disrepair" when its presence reasonably offends the occupants of two (2) or more lot owners of the neighborhood. 7. FENCES AND HEDGES As defined in this section, "fencing" shall mean any barrier or wall other than natural living organic vegetation, including trees and shrubs. Gates shall have no hinges visible from the street All fences shall be approved in writing by Declarant for location prior to construction and shall not detract from the appearances of the dwelling houses located on adjacent lots or be offensive to the owners or occupants thereof. 8. SIGNS No signs shall be erected on any lot except that not more than one "For Sale" sign placed by owner, the Declarant, or by a licensed real estate agent, not exceeding twenty- four (24) inches high and thirty-six (36) inches long may be temporary displayed on any lot This restriction shall not prohibit the temporary placement of "political" signs on any lot by the owner, or the placement of a professional sign by-Declarant, which-must comply with the City of Tigard sign ordinances. 9. TEMPORARY STRUCTURES No structure of a temporary character, trailer, basement, shack, garage, barn or other outbuilding shall be used on any lot at any time as a residence, whether temporarily or permanently. Tents used fo recreational purposes will be limited to seven consecutive days. 10. UTILPITES All plumbing facilities shall comply with the requirements of the plumbing code of the City of Tigard. No outdoor overhead wire or service drop for the distribution of electric energy or for telecommunication purposes, nor any pole, tower or other structure supporting said outdoor overhead wires shall be erected, placed or maintained within "Hillshire." All owners of lots within this subdivision, their heirs, successors and assigns shall use underground service wires to connect their premises and the structures built thereon to the underground electric or telephone utility facilities provided. 13. MAINTENANCE All lots, at all times, shall be kept in a neat and orderly condition free of brush, vines, weeds, debris, and the grass thereon cut or mowed at sufficient intervals to, prevent creation of a nuisance or fire hazard. 14. BUSINESS AND COMMERCIAL USES No goods, equipment, vehicles, materials or supplies used in connection with any trade, service or business shall be kept or stored outside of the house or garage on any lot, excepting the right of any home builder and the Declarant to construct residences on any lot, to store construction equipment and materials on said lots in the normal course of said construction, and' to use any single family residence as a sales office or model home for- purposes of sales in "lEllshire." 15. All plans and specifications of houses to be constructed in "Hillshire" subdivision shall be approved in writing by the Declarant In the event that the Declarant fails to approve or disapprove of the plans and specifications within ten (10) days after they have been submitted, or in any event, if no suit to enjoin construction has been commenced prior to the completion thereof, approval will not be required and the related covenants shall be deemed to have been fully complied with. Declarant reserves the right to reasonably waive or modify the terms of this Declaration as part of the process of approving plans and specifications, on a case by case basis. 2. The Declarant or any designee of the Declarant shall not be liable to any owner, occupant, builder or developer for any damage, loss or prejudice suffered or claimed due to any action or failure to act by the Declarant or its designee, provided that the Declarant or designee, in accordance with actual knowledge possessed by it, acted in good faith. ARTICLE IV GENERAL PROVISIONS 1. TERMS These covenants are to run with the land and shall be binding on all parties and all persons claiming under them until amended or revoked in the manner provided herein.
