EXHIBIT A NOTICE OF DECISION MINOR LAND PARTITION [MLPI 97-0016 2, L CITY OF TIGARD, VARIANCE (VAR) 97-0015 Community Development BURKS PARTITION ShapingABewrCommunity 120 DAYS = 7/31/98 SECTION I. APPLICATION SUMMARY CASE NO(S).: FILE NAME: BURKS PARTITION Minor Land Partition (MLP) 97-0016 Variance (VAR) 97-0015 PROPOSAL: A request for Minor Land Partition approval to divide one (1) parcel of approximately 16,050 square feet into two (2) lots of 10,930 and 5,150 square feet. The request also involves a variance to the front and rear yard setbacks to allow for the creation of a property line between the two (2) existing structures. COMPREHENSIVE PLAN DESIGNATION: R-7; Residential, 7 Units Per Acre. LOCATION: 11635 SW Greenburg Road; WCTM 1 S135DC, Tax Lot 02700. APPLICABLE REVIEW CRITERIA: Community Development Code Sections 18.52, 18.88, 18.92, 18.96, 18.100, 18.102, 18.108, 18.134, 18.162 and 18.164. SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request subject to certain conditions. The findings and conclusions on which the decision is based are noted in Section IV. NOTICE OF DECISION BURKS PARTITION - MLP 97-00161VAR 97-0015 PAGE 1 OF 11 CONDITIONS OF APPROVAL PRIOR TO THE APPROVAL OF THE FINAL PARTITION PLAT, THE FOLLOWING CONDITIONS SHALL BE SATISFIED: (Unless otherwise noted, the staff contact shall be Brian Rager in the Engineering Department at (503) 639-4171). 1. Provide evidence that the two (2) dwelling units were legal prior to the current development code standards. This verification must show documentation of when the structures were constructed or converted and evidence that Washington County standards permitted the use of two (2) structures on a single lot when the uses were established. Staff will accept documentation that provides evidence of the dwelling units in existence at a time when the uses were permitted (in-lieu of actual building permit data). Staff contact, Julia Hajduk. 2. Remove the deck on Parcel 1 so that it does not protrude onto Parcel 2 and the rear setback is no less than the variance permits and the side yard setback is met. Staff contact, Julia Hajduk. 3. Reconstruct the garage on Parcel 1 so that it no longer extends into the proposed easement. Contact the Building Division for permits and Julia Hajduk for condition sign-off. 4. Pave the driveway and install screening along the panhandle access driveway serving Parcel 2. Contact the Building Division for permits and Julia Hajduk for condition sign-off. 5. Obtain a street opening permit for this project to cover extending a new sanitary sewer lateral from the main line in SW Greenburg Road, as well as, for any other work necessary in the public right-of-way. The applicant will need to submit five (5) copies of a proposed public improvement plan for review and approval. NOTE: these plans are in addition to any drawings required by the Building Division and should only include information relevant to the public improvements. 6. As a part of the public improvement plan submittal, provide the Engineering Department with the name, address and telephone number of the individual or corporate entity who will be responsible for executing the compliance agreement and providing the financial assurance for the public improvements. 7. Utilize the existing driveway near the east end of the site frontage to serve both parcels. The existing driveway near the west end of the site frontage shall be removed and the curb and sidewalk replaced to City standards. This work shall be included under the Street Opening Permit. 8. The final plat shall indicate an ingress/egress easement over Parcel 1 for benefit of Parcel 2, and the plat shall contain a note indicating that the joint driveway shall be jointly maintained by the owners of both parcels. 9. Any new water services shall be approved by the City. The City's Public Works Department will install such service(s). The applicant's engineer shall provide a storm drainage plan for both parcels to be approved by the City Engineering Department (Brian Rager). 11. Final Plat Application Submission Requirements: A. submit for City review three (3) paper copies of the partition plat prepared by a land surveyor licensed to practice in Oregon, and necessary data or narrative; B. the partition plat and data or narrative shall be drawn to the minimum standards set forth by the Oregon Revised Statutes (ORS 92.05), Washington County, and by the City of Tigard; and C. once the City and County have reviewed the plat, submit two (2) mylar copies of the partition plat for City Engineer's signature. PRIOR TO THE ISSUANCE OF BUILDING PERMITS, THE FOLLOWING CONDITION SHALL BE SATISFIED: 12. Prior to issuance of any building permits on this site, the applicant shall provide the Engineering Department with a recorded mylar copy of the subdivision/partition plat. j THIS APPROVAL IS VALID IF EXERCISED WITHIN EIGHTEEN (18) MONTHS OF THE FINAL DECISION DATE NOTED UNDER THE PROCESS AND APPEAL SECTION OF THIS REPORT. SECTION III. BACKGROUND INFORMATION Property History: No development applications were found to have previously been filed with the City. The plan shows two (2) dwellings on the property, which would not be permitted on a single lot under the existing Tigard Development Code. The City has no record of building permits for this property. The County Tax Assessor's office indicates the building construction date is 1957, however, staff can not determine if this date includes the structure on Parcel 2 or just the one (1) on Parcel 1. Washington County would have been the permitting authority of development at that time. Due to the number of years the structures have been in existence, it is likely that the existence of the two (2) structures on a single lot is pre-existing non-conforming. Staff can not make that determination, however, without additional information which will be discussed and conditioned further in this decision. Site Information and Proposal Description: The proposal is to create two (2) lots from one (1) 16,050 square foot lot. Parcel 1 will have 10,090 square feet and Parcel 2 will have 5,960 square feet. The existing dwelling on Parcel 1 will have a rear yard setback of 5.4 feet with a variance and will have a 15-foot easement granting access to Parcel 2. The existing dwelling on Parcel 2 will have a 5.4-foot front yard setback with a variance. The side yard on the east property line has only three (3) feet between the structure and the property line at its closest point. NOTICE OF DECISION BURKS PARTITION - MLP 97-0016NAR 97-0015 PAGE 3 OF 11 Because the partition is not creating this non-conforming setback, no variance is required. The applicant should be aware, however, that the side yard setback is non-conforming and if the building needed re-construction it would have to be built in compliance with the setback standards at the time. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS FOR A MINOR LAND PARTITION REVIEW GENERAL APPROVAL CRITERIA: Section 18.162.040 contains the following general approval criteria for a Land Partition: The proposal conforms with the City's Comprehensive Plan; The proposal conforms with the City's Comprehensive Plan in that the newly created lot will continue to allow for residential development. The proposed partition complies with all statutory and ordinance requirements and regulations; This proposed partition complies with all statutory and ordinance requirements and regulations as demonstrated both by the analysis presented within this administrative decision, and by the application and review process with the exception of the setbacks for which the variance is requested and the non-conforming side yard setback. Since the partition does not make the side yard setback more non-conforming, it is satisfactory. Adequate public facilities are available to serve the proposal; Adequate public facilities are, or will be conditioned to be available to serve the proposal and will be constructed to meet City standards. All proposed lots conform to the size and dimensional requirements of this title; and While the proposal does not fully comply with the dimensional requirements due to the location of the existing structures, this is discussed in detail, and conditioned if necessary, in SPECIAL PROVISIONS (page 5). All proposed improvements meet City and applicable agency standards (Ord. 89- 06; Ord. 83-52). The public facilities and proposed improvements will be reviewed during the construction phase at which time, the appropriate review authority will insure that the City and other applicable standards are met. NOTICE OF DECISION BURKS PARTITION - MLP 97-0016NAR 97-0015 PAGE 4 OF 11 FINDING: Staff finds that the criteria above have been met outright or will be met as a result of conditions imposed in this decision as further described within this staff report. SPECIAL PROVISIONS: Section 18.162.050 contains the following special provisions for lots created through the Partition Process: Lot Width: The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district. The minimum lot width in the R-7 zoning district is 50 feet. The lot width at the location of the existing house on Parcel 2 is 50 feet. The lot width for Parcel 1 at the building location is approximately 110 feet. Lot Area: The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the accessway may not be included in the lot area calculation. The minimum lot area for R-7 zoning is 5,000 square feet per unit. Parcel 1 will have 10,090 square feet of lot area. Parcel 2 will have 5,960 square feet of lot area. Both Parcels exceed the minimum lot area requirement. Lot Frontage: Each lot created through the partition process shall front a public right-of-way by at least 15 feet, or have a legally recorded minimum 154oot-wide access easement. Parcel 1 has approximately 138 feet of frontage on SW Greenburg Road. Parcel 2 will have access to SW Greenburg Road via a 15-foot access easement across Parcel 1, therefore, this standard has been satisfied. Setbacks: Setbacks shall be as required by the applicable zoning district. The R-7 zoning requires front and rear setbacks of 15 feet, comer yard setbacks of ten (10) feet and side yard setbacks of five (5) feet. As proposed, the front yard setback for the dwelling on Parcel 2 and the rear yard setback for the dwelling on Parcel 1 are not met as there is only 10.8 feet between the two (2) structures. A variance has been requested for the front yard and rear yard setbacks and is discussed and approved further in this decision. The side yard for the existing dwelling on Parcel 2 does not meet the setback standards, however, it is pre-existing non-conforming and this partition is not making the setback worse, therefore, staff finds that the setback standards for the partition have been satisfied. All other setbacks between the existing dwellings and the property lines are met, with the exception of the deck on Parcel 1. This deck protrudes onto Parcel 2. The applicant has indicated that this deck will be removed. Prior to final partition plat approval, the deck must be removed so that it meets the rear yard setback permitted by the variance and meets the required side yard setback of five (5) feet.. NOTICE OF DECISION BURKS PARTITION - MLP 97-00161VAR 97-0015 PAGE 5 OF 11 Front Yard Determination for Flag Lot: When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. Parcel 2 meets the definition of flag lot because its sole access is via a 15 foot access easement and the majority of the lot is behind Parcel 1. The applicant has requested a variance for the front yard setback to reduce the setback to 5.4 feet and the eastern side yard setback is non-conforming. All other setbacks for the existing dwelling on Parcel 2 will exceed ten (10) feet. Screening on Flag Lots: A screen shall be provided along the property line of a lot of record where the paved drive in an accessway is located within ten feet of an abutting lot in accordance with Sections 18.100.080 and 18.100.090. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. The applicant's narrative states that a visual screen of either arbor-vitae hedge or a six (6)-foot fence might be appropriate to be installed along the east line of Parcel 2. Either of these options is acceptable, however, the applicant must indicate which type of screening will be used and install it prior to final partition plat approval. Fire Protection: The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire fighting capabilities. The Tualatin Valley Fire and Rescue (TVF&R) Standard #14 requires that, "Fire hydrants for single-family dwellings and duplexes shall be placed at each intersection. Intermediate fire hydrants are required if any portion of a structure exceeds 500 feet from a hydrant as measured in an approved manner around the outside of the structure and along approved fire apparatus access roadways. Placement of additional fire hydrants shall be as approved by Tualatin Valley Fire and Rescue (UFC Sec. 903.4.2.2)." The nearest fire hydrant is approximately 98 feet to the south of this site. The existing houses are within 500 feet on all sides. This standard has, therefore, been satisfied. (Standards referred to are from a brochure provided by TVF&R entitled "Fire and Life Safety Requirements for Fire Department Access and Water Supplies") Reciprocal Easements: Where a common drive is to be provided to serve more than one (1) lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. The applicant has proposed an access easement from Parcel 1 granting access to Parcel 2. This easement must be shown on the final partition plat. Accessway: Any accessway shall comply with the standards set forth in Chapter 18.108; Access, Egress, and Circulation. NOTICE OF DECISION BURKS PARTITION - MLP 97-0016NAR 97-0015 PAGE 6 OF 11 The minimum access width for a driveway serving two (2) lots is 15 feet with 10 feet of pavement width. The applicant has proposed a 15-foot-wide driveway that will serve as an easement back to Parcel 2. Currently, the garage on Parcel 1 extends into the proposed easement. The applicant has indicated the garage will be cut and reconstructed so as not to extend into this easement. This must be done prior to final partition plat approval. In addition, the driveway must be paved prior to the final recording. Floodplain: Where landfill and/or development is allowed within or adjacent to the one-hundred-year floodplain, the City shall require the dedication of sufficient open land area for greenway adjoining and within the floodplain. This area shall include portions at a suitable elevation for the construction of a pedestrian/bicycle pathway with the floodplain in accordance with the adopted pedestrian/bicycle pathway plan. This site is not with a 100-year floodplain, therefore, this standard does not apply. FINDING: Based on the analysis detailed in the criteria above, staff finds that the Special Provisions for lots created through the partition process will be satisfied provided that the driveway serving Parcel 2 is screened, the garage is reconstructed so that it no longer extends into the proposed easement, the deck on parcel 1 is removed and the driveway is paved. CONDITIONS: Prior to final partition plat approval, reconstruct the garage on Parcel 1 so that it no longer extends into the proposed easement, remove the deck on parcel 1 so that required setbacks are satisfied, and pave the driveway and install screening along the panhandle access driveway serving Parcel 2. ADDITIONAL APPLICABLE STANDARDS: Sections 18.164.030 (Streets), 18.164.090 (Sanitary Sewer), and 18.164.100 (Storm Drains) have been addressed and are satisfied as specified below: Streets: This site is located adjacent to the south edge of SW Greenburg Road, between SW 91st Avenue and SW 92nd Avenue. Greenburg Road is classified as a major collector street on the City's Transportation Plan Map and was fully improved in this area as a part of a City capital improvement project. There is 30 feet of right-of-way (ROW) from the centerline adjacent to this site. Since the street is fully improved, no additional improvements are necessary. Therefore, no additional ROW is required. The applicant is proposing to utilize the existing 36-foot wide driveway near the east end of the site frontage to access both parcels. This concept is acceptable to Staff. There is also an additional existing 16-foot wide driveway near the west end of the site frontage that should be closed off once this partition is approved. Both Parcels 1 and 2 should utilize the one driveway. NOTICE OF DECISION BURKS PARTITION - MLP 97-0016NAR 97-0015 PAGE 7 OF 11 Water: This site will be served from the City's public water system in SW Greenburg Road. Any new water service into this site shall be approved by the City. The City's Public Works Department will install the service(s) once approved. Sanitary Sewer: There is an existing public sanitary sewer line located in SW Greenburg Road that is adequately sized to serve this site. The existing house on Parcel 1 is presently connected to the public sewer line. The applicant will tap the main line and extend a new lateral to the property to serve the existing house on Parcel 2. A Street Opening Permit will be required for this, and any other work in the public ROW. Storm Drainage: The topography of this site falls to the south away from SW Greenburg Road. The applicant did not indicate clearly on the preliminary plan as to how the storm drainage for the houses will be conveyed. It may be possible to run the roof drains to the existing storm drainage system in Greenburg Road, but the applicant's engineer will need to verify this prior to recording of the final plat. If the Greenburg Road system is not deep enough to accommodate the site runoff, the applicant's engineer will need to submit a proposed drainage plan for City review and approval prior to recording the final plat. Storm Water Quality: No additional dwellings are proposed. Therefore, this section does not apply. FINDING: The City of Tigard utility improvement standards are not met outright, however, as discussed in this decision and conditioned, the standards can be met. The applicant must comply with the CONDITIONS OF APPROVAL 5-12 indicated in this decision in order to meet the standards and obtain final plat approval. Section 18.134 Variance Criteria Section 18.134.050 allows the Director to approve, approve with conditions or deny an application for a variance based on finding that the following criteria are satisfied: The proposed variance will not be materially detrimental to the purposes of this title, be in conflict with the policies of the comprehensive plan, to any other applicable policies and standards, and to other properties in the same zoning district or vicinity; Approval of a variance to reduce the rear yard setback on Parcel 1 and the front yard setback on Parcel 2 to 5.4 feet each, will not be materially detrimental to the purposes of this title because the lot area will be met and each house will still have an extensive amount of yard area. There are special circumstances that existing which are peculiar to the lot size or shape, topography or other circumstances over which the applicant has no control, and which are not applicable to other properties in the same zoning district; NOTICE OF DECISION BURKS PARTITION - MLP 97-00161VAR 97-0015 PAGE 8 OF 11 The applicant has stated "this property has a peculiar situation, which is the long time presence of two separate dwellings which were allowed to be built very close to each other. These buildings were permitted long before the applicant owned the property so their location was beyond her control. As far as we know, that situation does not exist elsewhere in this neighborhood." In order for staff to concur with the applicant, it must be verified that the construction and/or conversion of the two (2) dwelling units on a single parcel were permitted at the time they were built. If the applicant provides verification that the units were legally created and are now non-conforming, staff can determine that the partition will enable the structures to better comply with the Tigard Development Code. By allowing the setback variance, each unit will be on a separate lot and thus, the use will then be conforming. The use proposed will be the same as permitted under this title and City standards will be maintained to the greatest extent that is reasonably possible while permitting some economic use of the land. The use will be two (2) single-family detached units on individual lots. This use is permitted under Section 18.52, therefore, the proposed use will be the same as that permitted under the current development code. Existing physical and natural systems, such as but not limited to traffic, drainage, dramatic land forms, or parks will not be adversely affected any more than would occur if the development were located as specified in the title; and Because both of the structures already exist, no existing physical or natural systems will be affected any more than they currently are as a result of this variance. The hardship is not self-imposed and the variance requested is the minimum variance which would alleviate the hardship. The variance is the minimum necessary to permit a lot line between the two (2) existing structures. Because the structures are existing and were constructed long before the applicant took ownership of this property, the hardship is not self-imposed. FINDING: Staff finds that if the applicant provides evidence that both structures were legally created or met the development standards at the time they were constructed and/or converted, the variance criteria will be satisfied and the variance can be approved. CONDITION: Provide evidence that the two (2) dwelling units were legal prior to the current development code standards. This verification must show documentation of when the structures were constructed or converted and evidence that Washington County standards permitted the use of two (2) structures on a single lot when the uses were established. Staff will accept documentation that provides evidence of the dwelling units in existence at a time when the uses were permitted (in-lieu of actual building permit data). AGENCY AND OTHER STAFF COMMENTS The record on this case contains the comments from each agency that provided comments in its entirety. The City of Tigard Engineering Department had the opportunity to review the proposal and has provided comments which have been incorporated into the body of this decision. The City of Tigard Building Division had the opportunity to review the proposal and has indicated that roof drains for the house on Parcel 2 must be piped to SW Greenburg Road and a building permit is required to modify the garage on Parcel 1. Work must be completed prior to granting a certificate of occupancy for either house. City of Tigard Water Department had the opportunity to review the proposal and has indicated that each lot shall have its own service (water) and meter. The new water meter may not be located in a paved area, meters must be in a landscaped area. Tualatin Valley Fire and Rescue, USA, Washington County, GTE, NW Natural Gas, Metro Area Communications. PGE, TCI Cable and US West had the opportunity to review the proposal and have offered no comments or objections. SECTION VI. That is, Parcel 2 will still have over 65 feet between its house and Greenburg Rd. right of way; and Parcel 1 will still have a large, usable back yard, accessible from the southwest portion of the house. 2) This property has a peculiar situation, which is the long-time presence of two separate dwellings which were allowed to be built very close to each other. These buildings were permitted long before the applicant owned the property, so their location was beyond her control. As far as we know, that situation does not exist elsewhere in the neighborhood. 3) The proposed use of this property is for single family dwellings, on parcels averaging over 8,000 square feet. This use is normally permitted by the City in this zone (5,000 square feet minimum). City standards for front and rear setbacks will be maintained as much as is reasonably possible, while allowing a more normal economic use of this property. 4) If the house on Parcel 2 was located farther away from Parcel 1, so that no variance would be necessary, then the impact on the existing physical and natural systems would be exactly the same as now, which is exactly the same as if the variance was granted for the house as is. That is, the house's impact on water, sewer, drainage and other systems will be the same whether the variance is granted or not. 5) The hardship of substandard front and rear setbacks is not self imposed, and the variances requested are the minimum which would alleviate the hardship. There is 30 feet of right-of-way (ROW) from the centerline adjacent to this site. Since the street is fully improved, no additional improvements are necessary. Therefore, no additional ROW is required. The applicant is proposing to utilize the existing 36-foot wide driveway near the east end of the site frontage to access both parcels. This concept is acceptable to Staff. There is also an additional existing 16-foot wide driveway near the west end of the site frontage that should be closed off once this partition is approved. Both Parcels 1 and 2 should utilize the one driveway. 2. Water: This site will be served from the City's public water system in SW Greenburg Road. Any new water service into this site shall be approved by the City. The City's Public Works Department will install the service(s) once approved. The existing house on Parcel 1 is presently connected to the public sewer line. The applicant will tap the main line and extend a new lateral to the property to serve the existing house on Parcel 2. A Street Opening Permit will be required for this, and any other work in the public ROW. 4. Storm Drainage: The topography of this site falls to the south away from SW Greenburg Road. The applicant did not indicate clearly on the preliminary plan as to how the storm drainage for the houses will be conveyed. It may be possible to run the roof drains to the existing storm drainage system in Greenburg Road, but the applicant's engineer will need to verify this prior to recording of the final plat. If the Greenburg Road system is not deep enough to accommodate the site runoff, the applicant's engineer will need to submit a proposed drainage plan for City review and approval prior to recording the final plat. 5. Storm Water Quality: No additional dwellings are proposed. Therefore, this section does not apply. Storm Sewer Improvements: All proposed development within the City shall be designed such that storm water runoff is conveyed to an approved public drainage system. The applicant will be required to submit a proposed storm drainage plan for the site, and may be required to prepare a subbasin drainage analysis to ensure that the proposed system will accommodate runoff from upstream properties when fully developed. A downstream analysis will also likely be necessary to determine if runoff from the proposed development will cause adverse impacts to the existing storm system downstream of the site. Maintenance access roadways may be required if existing or proposed facilities are not otherwise readily ac essible. 11 I a S ~ lou-e.c~ STORM WATER QUALITY The City has agreed to enforce Surface Water Management (SWM) regulations established by the Unified Sewerage Agency (USA) (Resolution and Order No. 91-47, as amended by R&O 91-75) which requires the construction of on-site water quality facilities. The resolution contains a provision that would allow an applicant tQ pay a fee in-lieu of constructing an on-site facility provided specific criteria are met. The City will use discretion in determining whether or not the fee in-lieu will be offered. If the fee is allowed, it will be based upon the amount of new impervious surfaces created; for every 2,640 square feet, or portion thereof, the fee shall be $180.00. Preliminary sizing calculations for any proposed water quality facility shall be submitted with the development application. It is anticipated that this project will require: ( ) Construction of an on-site water quality facility. Payment of the fee in-lieu. Fdz- mc., pgxj-zZ TRAFFIC IMPACT FEES In 1990, Washington County adopted a county-wide Traffic Impact Fee (TIF) ordinance. The Traffic Impact Fee program collects fees from new development based on the development's projected impact upon the City's transportation system. The applicant shall be required to pay a fee based upon the number of trips which are projected to result from the proposed development. The calculation of the TIF is based on the proposed use of the land, the size of the project, and a general use based fee category. The TIF shall be calculated at the time of building permit issuance. In limited circumstances, payment of the TIF may be allowed to be deferred until the issuance of an occupancy permit. Deferral of the payment until occupancy is permissible o when the TIF is greater than $5,000.00. P F PERMITS Engineering Department Permits: Any work within a public right-of-way in the City of Tigard requires a permit from the Engineering Department. There are two types of permits issued by Engineering, as follows: Street Opening Permit (SOP). This permit covers relatively minor work in a public right-of-way or easement, such as sidewalk and driveway installation or repair, and service connections to main utility lines. This work may involve open trench work within the street. The permittee must submit a plan of the proposed work for review and approval. The cost of this type of permit is calculated as 4% of the cost of the work and is payable prior to issuance of the permit. In addition, the permittee will be required to post a bond or similar financial security for the work. ®Compliance Agreement (CAP). This permit covers more extensive work such as main utility line extensions, street improvements, etc. In subdivisions, this type of permit also covers all grading and private utility work. Plans prepared by a registered professional engineer must be submitted for review and approval. The cost of this permit is also calculated as 4% of the cost of the improvements, based on the design engineer's estimate, and is payable prior to issuance of the approved plan. The permittee will also be required to post a performance bond, or other such suitable security, and execute a Developer/Engineer Agreement which will obligate the design engineer to perform the primary inspection of the public improvement construction work. Prior to City acceptance of any permitted work, and prior to release of work assurance bond(s), the work shall be deemed complete and satisfactory by the City in writing. The permittee is responsible for the work until such time written City acceptance of the work is posted. Building Department Permits: The following is a brief overview of the type of permits issued by the Building Department. For a more detailed explanation of these permits, contact the Development Services Counter at 639-4171, ext. 304. Site Improvement Permit (SIT). This permit is generally issued for all new commercial, industrial and multi-family projects. This permit will also be required for land partitions where lot grading and private utility work is required. This permit covers all on-site preparation, grading and utility work. Home builders will also be required to obtain a SIT permit for grading work in cases where the lot they are working on has slopes in excess of 20% and foundation excavation material is not to be hauled from the site. Building Permit (BUP). This permit covers only the construction of the building and is issued after, or concurrently with, the SIT permit. Master Permit (MST). This permit is issued for all single and multi-family buildings. It covers all work necessary for building construction, including sub-trades (excludes grading, etc.). This permit can not be issued in a subdivision until the public improvements are substantially complete and a mylar copy of the recorded plat has been returned by the applicant to the City. For a land partition, the applicant must obtain an Engineering Permit, if required, and return a mylar copy of the recorded plat to the City prior to issuance of this permit. Other Permits. There are other special permits, such as mechanical, electrical and plumbing that may also be required. Contact the Development Services Counter for more information. GRADING PLAN REQUIREMENTS FOR SUBDIVISIONS All subdivision projects shall require a proposed grading plan prepared by the design engineer. The engineer will also be required to indicate which lots have natural slopes between 10% and 20%, as well as lots that have natural slopes in excess of 20%. This information will be necessary in determining if special grading inspections will be required when the lots develop. The design engineer will also be required to shade all structural fill areas on the construction plans. In addition, each homebuilder will be required to submit a specific site and floor plan for each lot. The site plan shall include topographical contours and indicate the elevations of the corners of the lot. The builder shall also indicate the proposed elevations at the four corners of the building.
