APPLICABLE REVIEW CRITERIA: Community Development Code Sections 18.54, 18.100, 18.102, 18.106, 18.108, 18.162 and 18.164 SECTION II: DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request subject to certain conditions. The findings and conclusions on which the decision is based are noted in Section IV. NOTICE OF DECISION CAHN PARTITION - MLP 97 -0013 PAGE 1 OF 9 • • CONDITIONS OF APPROVAL PRIOR TO THE APPROVAL OF THE FINAL PARTITION PLAT, THE FOLLOWING CONDITIONS SHALL BE SATISFIED: (Unless otherwise noted, the staff contact shall be Brian Rager in the Engineering Department at (503) 639 - 4171). 1. Remove the accessory structures (garage and storage shed) on Parcel 1. If applicable, obtain necessary permits. 2. Prior to approval of the final plat, additional right -of -way shall be conveyed to the State of Oregon, by and through its Department of Transportation, Highway Division, along the frontage of SW Hall Boulevard to increase the right -of -way to 45 feet from centerline. The description shall be tied to the existing right -of -way centerline. Verification that the conveyance has been submitted to the State shall be provided to the City Engineering Department. (For additional information, contact Myron Melick; Oregon Department of Transportation, Right -of -Way Section, 7165 SW Fir Loop, Tigard, Oregon 97223, 684 - 1510). 3. The final plat shall show cross -over ingress and egress easements between Parcels 1 and 2, and cross -over ingress and egress easements between both parcels and the adjacent properties to the north and south to facilitate future consolidation of driveways onto Hall Boulevard. 4. Either place the existing overhead utility lines along SW Hall Boulevard underground as a part of this project, or they shall pay the fee in -lieu of undergrounding. The fee shall be calculated by the frontage of the site that is parallel to the utility lines and will be $ 27.50 per lineal foot. If the fee option is chosen, it shall be paid prior to approval of the final plat. 5. Final Plat Application Submission Requirements: A. Three mylar copies of the partition plat prepared by a land surveyor licensed to practice in Oregon, and necessary data or narrative. B. The partition plat and data or narrative shall be drawn to the minimum standards set forth by the Oregon Revised Statutes (ORS 92.05), Washington County, and by the City of Tigard. C. The right -of -way dedication for SW Hall Boulevard shall be shown on the partition plat. PRIOR TO THE ISSUANCE OF BUILDING PERMITS, THE FOLLOWING CONDITION SHALL BE SATISFIED: NOTICE OF DECISION CAHN PARTITION - MLP 97 -0013 PAGE 2 OF 9 • . 6. Provide the Engineering Department with a recorded mylar copy of the partition plat prior to the issuance of building permits on Parcel 1. THIS APPROVAL IS VALID IF EXERCISED WITHIN EIGHTEEN (18) MONTHS OF THE FINAL DECISION DATE NOTED UNDER THE PROCESS AND APPEAL SECTION OF THIS REPORT. SECTION III: BACKGROUND INFORMATION Property History: No development applications were found to have been filed with the City. The plan shows 2 dwellings on the property, and 3 accessory structures. The applicant had a dwelling and an accessory structure demolished on 8 -12 -97 and utility lines capped and vacated. The remaining dwelling is located on proposed parcel 2, the garage and a shed is located on proposed parcel 1. Site Information and Proposal Description: The proposal is to create 2 lots from one .92 acre lot. Parcel 1 will have 33,631 square feet and Parcel 2 will have 6,058 square feet. The site has an existing dwelling on proposed parcel 2. There are 2 remaining accessory structures on parcel 1 which have not been proposed to be removed. SECTION IV: APPLICABLE REVIEW CRITERIA AND FINDINGS MINOR LAND PARTITION GENERAL APPROVAL CRITERIA Section 18.162.040 contains the following general approval criteria for a Major Land Partition: The proposal conforms with the City's Comprehensive Plan; The proposal conforms with the City's Comprehensive Plan in that the newly created lot will continue to allow for residential development. The proposed partition complies with all statutory and ordinance requirements and regulations; This proposed partition complies with all statutory and ordinance requirements and regulations as demonstrated both by the analysis presented within this administrative decision, and by the application and review process with the following exception: The applicant has proposed creating a lot with 2 accessory structures (a garage and storage shed). An accessory structure is defined in 18.144.020, "Accessory structure means a subordinate structure located on the lot, the use of which is clearly incidental to and associated with the principal structure." The accessory structures, therefore, may not be NOTICE OF DECISION CAHN PARTITION - MLP 97 -0013 PAGE 3 OF 9 • • located on a lot without a primary dwelling. The accessory structures must be removed prior to approving the final partition plat. Adequate public facilities are available to serve the proposal; Adequate public facilities are, or will be, conditioned to be available to serve the proposal and will be constructed to meet City standards. All proposed lots conform to the size and dimensional requirements of this title; and The proposal complies with the lot size and dimensional requirements. This is discussed in detail in SPECIAL PROVISIONS, page 4. All proposed improvements meet City and applicable agency standards (Ord. 89- 06; Ord. 83 -52). The public facilities and proposed improvements will be reviewed during the construction phase, at which time the appropriate review authority will insure that the City and other applicable standards are met. FINDING: Staff finds that, if the existing garage and accessory structure are removed, the remaining criteria above have been met outright or will be met as a result of conditions imposed in this decision in further sections. SPECIAL PROVISIONS Section 18.162.050 contains the following special provisions for lots created through the Partition Process: Lot Width: The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district. There is no minimum lot width in R -12, therefore, this standard has been met. Lot Area: The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the accessway may not be included in the lot area calculation. The minimum lot area for R -12 zoning is 3,000 square feet per unit. Parcel 1 will have 33,631 square feet and there is currently no dwelling unit on the property (the garage and storage shed are on the property and have been addressed in the previous section). Parcel 2 has one dwelling and 6,058 square feet of lot area. Both parcels exceed the minimum lot area requirement. NOTICE OF DECISION CAHN PARTITION - MLP 97 -0013 PAGE 4 OF 9 • • Lot Frontage: Each lot created through the partition process shall front a public right -of -way by at least 15 feet, or have a legally recorded minimum 15- foot -wide access easement. Parcel 1 has 85.57 feet of frontage and Parcel 2 has 64.93 feet of frontage on SW Hall, therefore, this standard has been satisfied. Setbacks: Setbacks shall be as required by the applicable zoning district. Parcel 1 currently has a garage and storage shed (the dwelling and accessory structure were demolished 8- 12 -97). The garage and storage shed will be required to be removed prior to final approval and any structures placed on Parcel 1 will be required to meet applicable setbacks at the time of further development proposals. Parcel 2 has an existing house. The setbacks for single - family structures in R -12 are as follow: 15 -foot front yard, 5 -foot side yard, and 15 -foot rear yard. The existing structure meets the front, rear and north side yard setbacks. The south side yard setback appears to be 0. This setback is pre- existing non - conforming and not made worse by this partition, therefore, the setback standards have been met. Front Yard Determination for Flag Lot: When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. The proposal does not involve a flag lot, therefore, this standard does not apply. Screening on Flag Lots: A screen shall be provided along the property line of a lot of record where the paved drive in an accessway is located within ten feet of an abutting lot in accordance with Sections 18.100.080 and 18.100.090. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. This proposal does not involve a flag lot, therefore, this standard does not apply. Fire Protection: The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire fighting capabilities. The Tualatin Valley Fire and Rescue (TVF &R) Standard #14 requires that, "Fire hydrants for single - family dwellings and duplexes shall be placed at each intersection. Intermediate fire hydrants are required if any portion of a structure exceeds 500 feet from a hydrant as measured in an approved manner around the outside of the structure and along approved fire apparatus access roadways. Placement of additional fire hydrants shall be as approved by the Chief. (UFC Sec. 903.4.2.2)" The nearest fire hydrant is approximately 300 feet to the south of this site. The existing house is within 500 feet on all sides. Staff can not determine, at this time, if a future structure on parcel 1 will be NOTICE OF DECISION CAHN PARTITION - MLP 97 -0013 PAGE 5 OF 9 • • within 500 feet, however any new structures proposed will be reviewed and must be within 500 feet of a fire hydrant on all sides. This standard has, therefore, been satisfied. TVF &R Standard #1 states, "Access Roads shall be within 150 feet of all portions of the exterior wall of the first story of the building as measured by an approved route around the exterior of the building. An approved turnaround is required if the remaining distance to an approved intersecting roadway, as measured along the fire apparatus access road, is greater than 150 feet. (UFC Sec. 902.2.1) ". Parcel 2 meets this standard. Parcel 1 is vacant, however, any dwellings placed on this lot must meet this requirement and will be reviewed at the time of future development proposals. (Standards referred to are from a brochure provided by TVF &R entitled "Fire and Life Safety Requirements for Fire Department Access and Water Supplies') Reciprocal Easements: Where a common drive is to be provided to serve more than one (1) lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. No reciprocal easements have been proposed. ODOT has requested, however, that the applicant provide cross -over easements between Parcels 1 and 2, and from both parcels to the adjacent properties to the north and south to allow for future consolidation of driveways. This is discussed in more detail and conditioned in further sections of this decision. Accesswav: Any accessway shall comply with the standards set forth in Chapter 18.108; Access, Egress, and Circulation. The existing access drives meet the minimum width requirements. The code requires a minimum of 20 feet in length to provide for off - street parking for at least two (2) cars. Parcel 2 has a circular access drive that will provide for at least two (2) off - street parking spaces. Parcel 1 will be required to meet this standard at the time of further development, therefore, this standard has been satisfied. Floodplain: Where landfill and/or development is allowed within or adjacent to the one - hundred -year floodplain, the City shall require the dedication of sufficient open land area for greenway adjoining and within the floodplain. This area shall include portions at a suitable elevation for the construction of a pedestrian/bicycle pathway with the floodplain in accordance with the adopted pedestrian/bicycle pathway plan. This site is not with a 100 -year floodplain, therefore, this standard does not apply. FINDING: Based on the analysis detailed in the criteria above, staff finds that the Special Provisions for lots created through the partition process have been satisfied. NOTICE OF DECISION CAHN PARTITION - MLP 97 -0013 PAGE 6 OF 9 • • ADDITIONAL APPLICABLE STANDARDS Sections 18.164.030 (Streets), 18.164.090 (Sanitary Sewer), and 18.164.100 (Storm Drains) have been addressed and are satisfied as specified below: Streets: This site lies adjacent to SW Hall Boulevard, which is an arterial street under ODOT jurisdiction. ODOT issued comments to the City with regard to this application and indicate that when the site redevelops, a half- street improvement will be required. At this time, there is only 35 feet of right -of -way (ROW) west of the roadway centerline adjacent to this site. ODOT recommends that the applicant dedicate additional right -of- way (ROW) to meet their current 3 -lane standard, which is 45 feet from centerline. The City concurs with ODOT's recommendation and has included an appropriate condition of approval in this decision. ODOT is also concerned with access from these parcels onto Hall Boulevard. Wherever possible, joint access easements are required to limit the number of driveways onto the roadway. ODOT recommends that the applicant be required to provide cross -over easements between Parcels 1 and 2, and from both parcels to the adjacent properties to the north and south. These cross -over easements will enable the existing driveways to be consolidated in the future upon further development. Staff concurs and has included an appropriate condition of approval in this decision Water: This site lies within the Tualatin Valley Water District (TVWD) service area. Any proposed connections to public water lines shall be reviewed and approved by TVWD. Sanitary Sewer: There is an existing 8 -inch public sanitary sewer line in SW Hall Boulevard that can adequately serve this site. The existing house on Parcel 2 is presently served by the public sanitary sewer system. Sewer service to Parcel 1 can be provided upon further development of that parcel. Storm Drainage: The drainage for Parcel 2 is presently served from SW Hall Boulevard. A storm drainage plan will be needed for Parcel 1 at a later date when further development of Parcel 1 is proposed. No plan is needed for this application. Storm Water Quality: Does not apply. Existing Overhead Utility Lines: There are existing overhead utility lines along SW Hall Boulevard. Section 18.164.120 of the TMC requires all overhead utility lines adjacent to a development to be placed underground or, at the election of the developer, a fee in -lieu of undergrounding can be paid. If the fee in -lieu is proposed, it is equal to $ 27.50 per lineal foot of street frontage that contains the overhead lines. NOTICE OF DECISION CAHN PARTITION - MLP 97 -0013 PAGE 7 OF 9 • • FINDING: The City of Tigard utility improvement standards and ODOT and City of Tigard street standards are not met outright, however, as discussed in this decision and conditioned, the standards can be met. The applicant must comply with the CONDITIONS OF APPROVAL 2 -6 indicated in this decision in order to meet the standards and obtain final plat approval. SECTION V. AGENCY AND OTHER STAFF COMMENTS The record on this case contains the comments from each agency in its entirety. The City of Tigard Maintenance Services Department had the opportunity to review the proposal and has offered no comments or objections. Tualatin Valley Water Department had the opportunity to review the proposal and has offered no comments. Unified Sewerage Agency (USA) had the opportunity to review the proposal and issued comments which have been incorporated into this decision. Oregon Department of Transportation (ODOT) had the opportunity to review the proposal and issued comments which have been incorporated into this decision. SECTION VI. The impact study shall quantify the effect of the development on public facilities and services. The study shall address, at a minimum, the transportation system, including bikeways, the drainage system, the parks system, the water system, the sewer system and the noise impacts of the development. For each public facility system and type of impact, the study shall propose improvements necessary to meet City standards, and to minimize the impact of the development on the public at large, public facilities systems, and affected private property users. In situations where the Community Development Code requires the dedication of real property interests, the applicant shall either specifically concur with the dedication requirement, or provide evidence which supports the conclusion that the real property dedication requirement is not roughly proportional to the projected impacts of the development. The resolution contains a provision that would allow an applicant to pay a fee in -lieu of constructing an on -site facility provided specific criteria are met. The City will use discretion in determining whether or not the fee in -lieu will be offered. If the fee is allowed, it will be based upon the amount of new impervious surfaces created; for every 2,640 square feet, or portion thereof, the fee shall be $180.00. Preliminary - sizing calculations for any proposed water - quality facility shall be submitted with the development application. TRAFFIC IMPACT FEES In 1990, Washington County adopted a county-wide Traffic Impact Fee (TIF) ordinance. The Traffic Impact Fee program collects fees from new development based on the development's projected impact upon the City's transportation system. The applicant shall be required to pay a fee based upon the number of trips which are projected to result from the proposed development. The calculation of the TIF is based on the proposed use of the land, the size of the project, and a general use based fee category. The TIF shall be calculated at the time of building permit issuance, In limited circumstances, payment of the TIF may be allowed to be deferred until the issuance of an occupancy permit. PERMITS Engineering Department Permits: Any work within a public right -of -way in the City of Tigard requires a permit from the Engineering Department. There are two types of permits issued by Engineering, as follows: Street Opening Permit (SOP). This permit covers relatively minor work in a public right -of -way or easement, such as sidewalk and driveway installation or repair, and service connections to main utility lines. This work may involve open trench work within the street. The permittee must submit a plan of the proposed work for review and approval. The cost of this type of permit is calculated as 4% of the cost of the work and is payable prior to issuance of the permit. In addition, the permittee will be required to post a bond or similar financial security for the work. Compliance Agreement (CAP). This permit covers more extensive work such as main utility line extensions, street improvements, etc. In subdivisions, this type of permit also covers all grading and private utility work. Plans prepared by a registered professional engineer must be submitted for review and approval. The cost of this permit is also calculated as 4% of the cost of the improvements, based on the design engineer's estimate, and is payable prior to issuance of the approved plan. The permittee will also be required to post a performance bond, or other such suitable security, and execute a Developer /Engineer Agreement which will obligate the design engineer to perform the primary inspection of the public improvement construction work. Prior to City acceptance of any permitted work, and prior to release of work assurance bond(s), the work shall be deemed complete and satisfactory by the City in writing. The permittee is responsible for the work until such time written City acceptance of the work is posted. Building Department Permits: The following is a brief overview of the type of permits issued by the Building Department. For a more • detailed explanation of these permits, contact the Development Services Counter at 639 -4171, ext. 304. Site Improvement Permit (SIT). This permit is generally issued for all new commercial, industrial and multi - family projects. This permit will also be required for land partitions where lot grading and private utility work is required. This permit covers all on -site preparation, grading and utility work. Home builders will also be required to obtain a SIT permit for grading work in cases where the lot they are working on has slopes in excess of 20% and foundation excavation material is not to be hauled from the site. Building Permit (BUP). This permit covers only the construction of the building and is issued after, or concurrently with, the SIT permit. Master Permit (MST). This permit is issued for all single and multi - family buildings. It covers all work necessary for building construction, including sub - trades (excludes grading, etc.). This permit can not be issued in a subdivision until the public improvements are substantially complete and a mylar copy of the recorded plat has been returned by the applicant to the City. For a land partition, the applicant must obtain an Engineering Permit, if required, and return a mylar copy of the recorded plat to the City prior to issuance of this permit. Other Permits. There are other special permits, such as mechanical, electrical and plumbing that may also be required. Contact the Development Services Counter for more information. • GRADING PLAN REQUIREMENTS FOR SUBDIVISIONS All subdivision projects shall require a proposed grading plan prepared by the design engineer. The engineer will also be required to indicate which lots have natural slopes between 10% and 20 %, as well as Tots that have natural slopes in excess of 20 %. This information will be necessary in determining if special grading inspections will be required when the lots develop. The design engineer will also be required to shade all structural fill areas on the construction plans. In addition, each homebuilder will be required to submit a specific site and floor plan for each lot. The site plan shall include topographical contours and indicate the elevations of the corners of the lot. The minimum yard requirement shall be increased in the event a yard abuts a street having a right -of -way width less than required by its functional classification on the City's transportation plan map and, in such case, the setback shall be not less than the setback required by the zone plus one -half of the projected road width as shown on the transportation map. (Ord. 92 -23; Ord. 89 -06; Ord. 83 -52) 18.96.030 Distance Between Multiple - Family Residential Structure and Other Structures on the Site A. To provide privacy, light, air, and access to the multiple and attached residential dwellings within a development, the following separations shall apply: 1. Buildings with windowed walls facing buildings with windowed walls shall have a 25 feet separation; 2. Buildings with windowed walls facing buildings with a blank wall shall have a 15 feet separation; 3. Buildings with opposing blank walls shall have a 10 feet separation; 4. Building separation shall also apply to buildings having projections such as balconies, bay windows, and room projections; and • 5. Buildings with courtyards to maintain separation of opposing walls as listed in 1, 2, and 3 above for walls in separate buildings. B. Where buildings exceed a horizontal dimension of 60 feet or exceed 30 feet in height, the minimum wall separation shall be one foot for each 15 feet of building length over 50 feet and two feet for each 10 feet of building height over 30 feet. C. Driveways, parking lots, and common or public walkways shall maintain the following separation for dwelling units within eight feet of the ground level: Revised 3/17/93 Page 208 1. Driveways and parking lots shall be separate rom windowed walls by at least eight feet; walkways running parallel to the face of the structures shall be separated by at least five feet; and 2. Driveways and parking lots shall be separated from living room windows by at least 10 feet; walkways running parallel to the face of the structure shall be separated by at least seven feet. (Ord. 89 -06; Ord. 83 -52) 18.96.040 No Yard Required: Structure Not on Property Line A. In zoning districts where a side yard or a rear yard setback is not required, a structure which is not to be built on the property line shall be set back from the property line by a distance in accordance with the Uniform Building Code requirements. (Ord. 89 -06; Ord. 83 -52) 18.96.050 Exceptions to Yard Requirements A. If there are dwellings on both abutting lots with front yard depths less than the required depth for the zone, the depth of the front yard for the intervening lot need not exceed the average depth of the front yards of the abutting lots. B. If there is a dwelling on one abutting lot with a front yard of less depth than the required depth for the zone, the front yard for the lot need not exceed a depth one -half way between the depth of the abutting lot and the required front yard depth. (Ord. 89 -06; Ord. 83 -52) 18.96.060 Storaae in Front Yard A. Boats, trailers, campers, camper bodies, house trailers, recreation vehicles, or commercial vehicles in excess of 3/4 ton capacity may be stored in a required front yard in a residential zone subject to the following: 1. No such unit shall be parked in a visual clearance area of a corner lot or in the visual clearance area of a driveway which would obstruct vision from an adjacent driveway or street. 2. No such unit shall be used for dwelling purposes except that one camper, house trailer or recreational vehicle may be used for sleeping purposes only by friends, relatives, or visitors on land entirely owned by or leased to the host person for a period not to exceed 14 days in one calendar year, provided that such unit shall not be connected to any utility, other than temporary electricity hookups and provided that the host person shall receive no compensation for such occupancy or use. 3. Any such unit parked in the front yard shall have current state license plates or registration and must be kept in mobile condition. (Ord. 93 -06; Ord. 89 -06; Ord. 83 - 52) 18.96.070 Projections into Required Yards • A. Cornices, eaves, belt courses, sills, canopies, or similar architectural features may extend or project into a required yard not more than 36 inches provided the width of such yard is not reduced to less than three feet. B. Fireplace chimneys may project into a required front, side, or rear yard not more than three feet provided the width or such yard is not reduced to less than three feet.
