The subject parcels are located north of SW Walnut Street and east of SW Brookside Avenue. APPLICABLE REVIEW CRITERIA: Community Development Code Sections 18.50, 18.162.040, 18.162.050, 18.164.030, 18.164.090 and 18.164.100. SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request subject to certain conditions. The findings and conclusions on which the decision is based are noted in Section IV. NOTICE OF DECISION MLP 97- 0021/MIS 97 -0028 - WOODARD PARTITION PAGE 1 OF 11 . • • CONDITIONS OF APPROVAL PRIOR TO THE APPROVAL OF THE FINAL PARTITION PLAT, THE FOLLOWING CONDITIONS SHALL BE SATISFIED: (Unless otherwise noted, the staff contact shall be Brian Rager in the Engineering Department (503) 639 - 4171.) 1. Final Plat Application Submission Requirements: A. Submit for City review three (3) paper copies of the partition plat prepared by a land surveyor licensed to practice in Oregon, and necessary data or narrative. B. The partition plat and data or narrative shall be drawn to the minimum standards set forth by the Oregon Revised Statutes (ORS 92.05), Washington County and by the City of Tigard. C. Once the City and County have reviewed the plat, submit two (2) mylar copies of the partition plat for City Engineer's signature. . 2. The applicant shall cause a statement to be placed on the final plat to indicate that the private driveway will be jointly owned and maintained by the private property owners who abut and take access from it and the granting of a pedestrian easement within Parcel 1 and SW Woodard Lane. 3. Revised site and landscaping plans shall be submitted for review by the Planning Division. STAFF CONTACT: William D'Andrea. The revised plans shall include the following: A. Location of the existing structure on the proposed 10,290 square foot lot. PRIOR TO THE ISSUANCE OF BUILDING PERMITS, THE FOLLOWING CONDITIONS SHALL BE SATISFIED: 4. Prior to issuance of building permits, the applicant shall provide the Engineering Department with a recorded mylar copy of the subdivision /partition plat. 5. If any existing water services are required to be relocated due to the lot line adjustments or the partition, the applicant shall bear the cost of such relocations. The City Water Department will perform the work and will invoice the applicant for the costs. 6. Prior to issuance of the building permits, the applicant shall pay the standard water quality fee of $210.00 per lot. 1 THIS APPROVAL IS VALID IF EXERCISED WITHIN EIGHTEEN MONTHS OF THE FINAL DECISION DATE NOTED UNDER THE PROCESS AND APPEAL SECTION BELOW. BACKGROUND INFORMATION Property History: The subject properties were created through a previous Minor Land Partition (MLP 93- 0011) and recording of the partition plat ( #1994 -004). No other development applications were found to have been filed with the City. Site Information and Proposal Description: The property is currently developed with a single - family residence. The applicant has made a request for the following development applications: 1. Lot Line Adjustment approval to adjust two (2) parcels of approximately 70,831 and 10,290 square feet into two (2) parcels of approximately 71,001 and 10,120 square feet; and 2. Minor Land Partition approval to divide one (1) parcel of approximately 71,001 square feet into three (3) parcels of approximately 18,454 square feet, 9,107 square feet and 43,440 square feet. IV. APPLICABLE REVIEW CRITERIA AND FINDINGS - MINOR LAND PARTITION Section 18.162.040 contains the following general approval criteria for a Major Land Partition: 1. The proposal conforms with the City's Comprehensive Plan; 2. The proposed partition complies with all statutory and ordinance requirements and regulations; 3. Adequate public facilities are available to serve the proposal; 4. All proposed lots conform to the size and dimensional requirements of this title; and 5. All proposed improvements meet City and applicable agency standards (Ord. 89-06; Ord. 83 -52). The proposal conforms with the City's Comprehensive Plan in that, the newly created lots will continue to allow for residential development. This proposal, therefore, is not in conflict with the Comprehensive Plan Low Density designation. This proposed partition complies with all statutory and ordinance requirements and regulations as demonstrated both by the analysis presented within this administrative decision, and by this application and review process. Adequate public facilities are or will be conditioned to be available to serve the proposal. Section 18.162.050 contains the following special provisions for lots created through the Partition Process: 1. Lot Width: The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district. NOTICE OF DECISION MLP 97- 0021/MIS 97 -0028 - WOODARD PARTITION PAGE 3 OF 11 • 2. Lot Area: The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the accessway may not be included in the lot area calculation. 3. Lot Frontage: Each lot created through the partition process shall front a public right -of -way by at least 15 feet, or have a legally recorded minimum 15 foot wide access easement. 4. Setbacks: Setbacks shall be as required by the applicable zoning district. 5. Front Yard Determination for Flaq Lot: When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. 6. Screening on Flaq Lots: A screen shall be provided along the property line of a lot of record where the paved drive in an accessway is located within ten feet of an abutting lot in accordance with Sections 18.100.080 and 18.100.090. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. 7. Fire Protection: The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire fighting capabilities. 8. Reciprocal Easements: Where a common drive is to be provided to serve more than one (1) lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. 9. Accesswav: Any accessway shall comply with the standards set forth in Chapter 18.108; Access, Egress, and Circulation. 10. Floodplain: Where landfill and/or development is allowed within or adjacent to the one - hundred -year floodplain, the City shall require the dedication of sufficient open land area for greenway adjoining and within the floodplain. This area shall include portions at a suitable elevation for the construction of a pedestrian/bicycle pathway with the floodplain in accordance with the adopted pedestrian/bicycle pathway plan. Criteria 1 is satisfied as the proposed lot widths are approximately 195, 75 and 200 feet respectively, exceeding the minimum 50 -foot lot width requirement in the R -4.5 zone. Criteria 2 is satisfied as this partition would create lots of approximately 18,454, 9,107 and 43,440 square feet, exceeding the 7,500 square foot minimum lot size requirement. Criteria 3 is satisfied as the lots have approximately 200, 46 and 175 feet of frontage on SW Woodard Lane. The required setbacks in the R -4.5 zone are as follows: front yard -20 feet; side yard -5 feet; rear yard -15 feet; and garage -20 feet. As indicated on the site plan, the existing single - family home on Parcel 3 complies with the R -4.5 zone setbacks. Compliance with setbacks on the proposed Lots 1 and 2 will be reviewed at the time of building permits, thereby, satisfying Criteria 4. Criteria 5 and 6 are satisfied as none of the lots are flag lots. Fire hydrants shall be consistent with Uniform Fire Code standards, thereby, satisfying Criteria 7. Criteria 8 shall be satisfied as a joint use and maintenance NOTICE OF DECISION MLP 97- 0021/MIS 97 -0028 - WOODARD PARTITION PAGE 4 OF 11 • agreement shall be provided for the common driveway. Criteria 9 shall be satisfied as all three (3) lots will use SW Woodard Lane. Criteria 10 is not applicable as none of the parcels are within the floodplain. Lot Line Adjustment - Approval Standards: Section 18.162.060 contains the following standards for approval of a lot line adjustment request: 1. An additional parcel is not created by the Lot Line Adjustment, and the existing parcel reduced in size by the adjustment is not reduced below the minimum lot size established by the zoning district; 2. By reducing the lot size, the lot or structure(s) on the lot will not be in violation of the site development or zoning district regulations for that district; and 3. The resulting parcels are in conformity with the dimensional standards of the zoning district. The proposed lot line adjustment is consistent with these standards. The proposed adjustment will reconfigure the lot lines, however, an additional parcel will not be created by the adjustment. Both lots will meet the 7,500 square foot minimum lot size and the 50 -foot average minimum lot width requirements of the R -4.5 zone. All site development improvements will remain consistent with Code requirements. Special Provisions for Lots Created Through Partition Process: Section 18.162.060 states that in addition to meeting the above standards, a Lot Line Adjustment must also meet the following criteria applicable to lots created through the Minor Land Partition process: 1. Lot Width: The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district. 2. Criteria 1 is satisfied as the minimum lot widths of Parcels 1 and 2 are 170 and 60 feet respectively, thereby, exceeding the 50 -foot minimum lot width requirement of the R -4.5 zone. Criteria 2 is satisfied as the lot areas are approximately 70,831 and 10,290 square feet, exceeding the minimum 7,500 minimum lot size requirement. Criteria 3 is satisfied as the lots contain approximately 200 and 32 feet of frontage on SW Woodard Lane, satisfying the 15 -foot minimum lot width requirement. Criteria 4 shall be satisfied as a revised site plan shall be submitted that shows the location of the structure on the adjusted 10,290 square foot parcel, to demonstrate compliance with setbacks. Criteria 5 and 6 are not applicable as neither of these lots are flag lots. Fire hydrants shall be consistent with Uniform Fire Code standards, thereby, satisfying Criteria 7. Criteria 8 is not applicable as a reciprocal easement and joint use and maintenance agreement is not needed because of the adjustment. Criteria 9 is satisfied as driveways have been provided in accordance with access standards. Criteria 10 is not applicable as none of the parcels are within the floodplain. Section 18.88.010 (Solar Access) states that all newly created lots within the City of Tigard shall promote the use of renewable energy sources by providing for improved access to sunlight for residential dwellings. A lot meets the basic requirement if it has a north -south dimension of 90 feet or more and has a front lot line that is oriented within 30 degrees of a true east -west axis. Section 18.88.040(E), however, allows the approval authority to exempt new lots from the solar access standard in certain cases including situations where existing right -of -way (ROW) prevents lots from being oriented for solar access. The existing orientation of SW Woodard Lane and the configuration of the subject site prevents the proposed parcels from being orientated for solar access. Therefore, the new parcels are except from the solar access standard. It should be noted that new structures must comply with the Solar Balance Point Ordinance even if a lot has been exempted from the basic solar requirement. NOTICE OF DECISION MLP 97- 0021/MIS 97 -0028 - WOODARD PARTITION PAGE 6 OF 11 . • Impact Study: Section 18.32.050 states that the applicant shall provide an impact study to quantify the effect of development on public facilities and services. For each public facility system and type of impact, the study shall propose improvements necessary to meet City standard, and to minimize the impact of the development on the public at large, public facilities systems, and affected private property users. In situations where the Community Development Code requires the dedication of real property interests, the applicant shall either specifically concur with a requirement for public right -of -way dedication, or provide evidence that supports that the real property dedication requirement is not roughly proportional to the projected impacts of the development. Section 18.32.250 states that when a condition of approval requires the transfer to the public of an interest in real property, the approval authority shall adopt findings which support the conclusion that the interest in real property to be transferred is roughly proportional to the impact the proposed development will have on the public. Any required street improvements to certain collector or higher volume streets and the Washington County Traffic Impact Fee (TIF) are mitigation measures that are required at the time of development. Based on a transportation impact study prepared by Mr. David Larson for the A -Boy Expansion /Dolan II /Resolution 95 -61, TIF's are expected to recapture 32% of the traffic impact of new development on the Collector and Arterial Street system. Presently, the TIF for each trip that is generated is $179. The total TIF for an attached, single - family dwelling is $1,790. Upon completion of this development, the future builders of the residences will be required to pay TIF's of approximately $3,580.00 ($1,790 x 2 dwelling units). Based on the estimate that total TIF fees cover 32% of the impact on major street improvements citywide, a fee that would cover 100% of this projects traffic impact is $11,187. ($3,580 divided by .32). The difference between the TIF paid and the full impact, is considered an unmitigated impact. Since the TIF paid is $3,580.00, the unmitigated impact can be valued at $7,607. The applicant is being required to dedicate a ten (10)- foot -wide pedestrian connection, in accordance with Section 18.164.040(B)(1). Based on past City of Tigard land acquisitions, property can be valued at $2.50 per square foot. The total area comprised of the ten (10)- foot -wide easement is approximately 1,050 square feet. Using a value of $2.50 per square foot, the value of this area is approximately $2,625. Given these estimates, the conditions are more than roughly proportional to the impacts since the unmitigated impact ($7,607) is more than the value of the easement ($2,625.00). Block Design: Section 18.164.040(A) states that the length, width and shape of blocks shall be designed with due regard to providing adequate building sites for the use contemplated, consideration of needs for convenient access, circulation, control and safety of street traffic and recognition of limitations and opportunities of topography. Block Sizes: Section 18.164.040(B)(1) states that the perimeter of blocks formed by streets shall not exceed 1,800 feet measured along the right -of -way line except: NOTICE OF DECISION MLP 97- 0021/MIS 97-0028 - WOODARD PARTITION PAGE 7 OF 11 • • 1. Where street location is precluded by natural topography, wetlands or other bodies of water or, pre - existing development or; 2. For blocks adjacent to arterial streets, limited access highways, major collectors or railroads. 3. For non - residential blocks in which internal public circulation provides equivalent access. This criteria is satisfied as the site is constrained from meeting the specified block perimeter because SW Woodard Lane is a private street and the site is constrained from providing a public street connection. The block in this area is bounded by SW Brookside Avenue, SW Walnut Street, SW Grant Street and SW Johnson Street, and is well in excess of 1,800 feet. Block Lengths: Section 18.164.040(B)(2) states that when block lengths greater than 600 feet are permitted, pedestrian/bikeways shall be provided through the block. The property is precluded from providing a street connection between SW Brookside Avenue and SW Grant Avenue. Currently, there is no street or pedestrian connection along the entire length of SW Brookside Avenue and the block perimeter encompassing SW Brookside Avenue, SW Walnut Street, SW Grant Street and SW Johnson Street is well in excess of 1,800 feet. Since the block exceeds 600 feet, the applicant shall provide a pedestrian pathway connection through the block to provide connectivity with SW Grant Avenue. The applicant has proposed a 10 -foot pedestrian easement within the proposed Parcel 1. The abutting property to the north is a 1.84 acre parcel that may be redeveloped in the future. A pedestrian easement may be obtained with future redevelopment and would thus, provide a connection through the block. Such a connection would create a block perimeter of approximately 2,140 feet but would provide the only pedestrian connection between SW Brookside Avenue and SW Grant Avenue. Therefore, the applicant shall be required to provide a ten (10 )- foot -wide public, pedestrian easement within Parcel 1 to provide a pedestrian connection in accordance with this section. The applicant is not responsible for the construction of the pedestrian pathway, only the granting of an easement is required at this time. Construction of the pathway would be undertaken by the City at some future date. The plat shall reflect the granting of a pedestrian easement within SW Woodard Lane. As previously discussed in Section 18.32 of this report, the requirement for a pedestrian easement is roughly proportional. Sections 18.164.030 (Streets), 18.164.090 (Sanitary Sewer), and 18.164.100 (Storm Drains) have been addressed and are satisfied as specified below: STREETS: This site is located on SW Woodard Lane, which is a private street intersecting with SW Brookside Avenue. The private street was created by the applicant as a part of a previous partition (Plat #1994 -004). The street is fully improved. No additional ROW dedications or improvements are required. NOTICE OF DECISION MLP 97-0021/MIS 97 -0028 - WOODARD PARTITION PAGE 8 OF 11 • • WATER: There is an existing 8 -inch public water line located in SW Woodard Lane with services previously provided by the Tigard Water Department in 1994. The Water Department indicates that if water services are required to be relocated due to the lot line adjustments or partition, the applicant will bear the expense of those relocations. SANITARY SEWER: There is an existing 8 -inch public sanitary sewer line located in a 10- foot -wide public easement across this property with service laterals stubbed to the existing properties and proposed new parcels. In 1994, the applicant installed future sewer services for the proposed lots, so no additional sewer line work is needed or required. STORM DRAINAGE: There is a private storm line located in Woodard Lane that presently serves the existing lots and will adequately serve the proposed lots. No additional storm sewer work is necessary. STORM WATER QUALITY: The City has agreed to enforce Surface Water Management (SWM) regulations established by the Unified Sewerage Agency (USA) Design and Construction Standards (adopted by Resolution and Order No. 96 -44) which require the construction of on -site water quality facilities. However, the USA standards include a provision that would exclude small projects such as residential land partitions. It would be impractical to require an on -site water quality facility to accommodate treatment of the storm water from the three parcels. Rather, the USA standards provide that applicants should pay a fee in -lieu of constructing a facility if deemed appropriate. Staff recommends payment of the fee in -lieu on this application. GRADING AND EROSION CONTROL: USA Design and Construction Standards also regulates erosion control to reduce the amount of sediment and other pollutants reaching the public storm and surface water system resulting from development, construction, grading, excavating, clearing, and any other activity which accelerates erosion. Per USA regulations, the applicant is required to submit an erosion control plan for City review and approval prior to issuance of City permits. V. STAFF COMMENTS City of Tigard Water Department states that although there are no objections to the partition, please advise the applicant that if the existing water services need to be adjusted due to the partition, we will be invoicing the owner for the relocation work. The City of Tigard Police Department, City of Tigard Building Division and City of Tigard Maintenance Services Division have all reviewed the proposal and have offered no objections. AGENCY COMMENTS Unified Sewerage Agency has the following comments: Sanitary Sewer: Each lot within the development shall be provided with a means of disposal for sanitary sewer. The means of disposal should be in accordance with R &O 96 -44 (Unified Sewerage Agency's Construction Design Standards, July 1996 edition). Engineer should verify public sanitary sewer is available to up -hill adjacent properties or extend service as required by R &O 96 -44. Storm Sewer: Each lot within the development should have access to public storm sewer. Engineer should verify that public storm sewer is available to up -hill adjacent properties, or extend storm service as required by R &O 96 -44. Hydraulic and hydrological analysis of storm conveyance system is necessary. If downstream storm conveyance does not have the capacity to convey the volume during a 25 -year, 24 -hour storm event, the applicant is responsible for mitigating the flow. Water Quality: Developer should provide a water quality facility to treat the new impervious surface being constructed as part of this development. If a water quality facility was not constructed with the original subdivision, then provisions for water quality will need to be addressed with this application for the entire development.. WOODARD AND ARLIE C. WOODARD. December 31, 1997 City of Tigard Code 18.162.040 Partition Approval Criteria. A. A request to partition land shall meet all of the following criteria. 1. The proposal conforms with the City's comprehensive plan. The subject property was previously approved as a partition plat recorded as Partition 1994 -004. This proposal re -plats a portion of the previous plat. All of the lots will meet or exceed the zoning requirements of R -4.5 (7.500) SF per parcel. 2. The proposed partition compiles with all statutory and ordinance requirements and regulations. The requirements for the re- division of this existing partition plat were set forth in the pre - application conference with the owner. The proposed preliminary partition plat conforms with these requirements and those of the existing zone. 3. Adequate public facilities are available to serve the proposed partition. When the existing partition was created a private roadway easement as well as public water, sewer and drainage facilities were constructed and accepted by the city. At the time of this construction stub outs for the future connection to the water and sewer systems were provided and approved, all parcels proposed in this proposal are capable of being served with all public facilities and private utilities. 4. All proposed parcels conform to the size and dimensional requirements of this title, and. The parcels as proposed meet the size and dimensional requirements of the zone which applies to the property and as shown on the preliminary plat. 5. As stated above all necessary facilities are in place to serve the proposed partition. • • City code 18.162.050 Special Provisions for Lots Created through the Partition Process. A. Lot Width: 1. The minimum width of the building envelope area shall meet the parcel requirement of the applicable zoning district. The parcels as proposed will meet or exceed the building envelope requirements of the zone. B. Lot Area: 1. The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the access way may not be included in the lot area calculation. The lot areas are as shown on the preliminary plat, they all exceed the minimum requirement. C. Lot Frontage 1. Each lot created through the partition process shall front a public right of way by at least 15 feet or have a legally recorded minimum 15 foot wide access easement. Storm Sewer Improvements: All proposed development within the City shall be designed such that storm water runoff is conveyed to an approved public drainage system. The applicant will be required to submit a proposed storm drainage plan for the site, and may be required to prepare a subbasin drainage analysis to ensure that the proposed system will accommodate runoff from upstream properties when fully developed. A downstream analysis will also likely be necessary to determine if runoff from the proposed development will cause adverse impacts to the existing storm system downstream of the site. Other Comments: All proposed sanitary sewer and storm drainage systems shall be designed such that City maintenance vehicles will have unobstructed access to critical manholes in the systems. Maintenance access roadways may be required if existing or proposed facilities are not otherwise readily accessible. STORM WATER QUALITY The City has agreed to enforce Surface Water Management (SWM) regulations established by the Unified Sewerage Agency (USA) (Resolution and Order No. 91-47, as amended by R &O 91 -75) which requires the construction of on -site water quality facilities. TRAFFIC IMPACT FEES In 1990, Washington County adopted a county -wide Traffic Impact Fee (TIF) ordinance. The Traffic Impact Fee program collects fees from new development based on the development's projected impact upon the City's transportation system. The applicant shall be required to pay a fee based upon the number of trips which are projected to result from the proposed development. The calculation of the TIF is based on the proposed use of the land, the size of the project, and a general use based fee category. The TIF shall be calculated at the time of building permit issuance. In limited circumstances, payment of the TIF may be allowed to be deferred until the issuance of an occupancy permit: Deferral of the payment until occupancy is permissible only when the TIF is greater than $5,000.00. PAS Ftss - PERMITS Engineering Department Permits: Any work within a public right -of -way in the City of Tigard requires a permit from the Engineering Department. There are two types of permits issued by Engineering, as follows: d9 Street Opening Permit (SOP). This permit covers relatively minor work in a public right -of -way or easement, such as sidewalk and driveway installation or repair, and service connections to main utility lines. This work may involve open trench work within the street. The permittee must submit a plan of the proposed work for review and approval. The cost of this type of permit is calculated as 4% of the cost of the work and is payable prior to issuance of the permit. In addition, the permittee will be required to post a bond or similar financial security for the work. Compliance Agreement (CAP). This permit covers more extensive work such as main utility line extensions, street improvements, etc. In subdivisions, this type of permit also covers all grading and private utility work. Plans prepared by a registered professional engineer must be submitted for review and approval. The cost of this permit is also calculated as 4% of the cost of the improvements, based on the design engineer's estimate, and is payable prior to issuance of the approved plan. The permittee will also be required to post a performance bond, or other such suitable security, and execute a Developer /Engineer Agreement which will obligate the design engineer to perform the primary inspection of the public improvement construction work. Prior to City acceptance of any permitted work, and prior to release of work assurance bond(s), the work shall be deemed complete and satisfactory by the City in writing. The permittee is responsible for the work until such time written City acceptance of the work is posted. This permit is issued for all single and multi - family buildings. It covers all work necessary for building construction, including sub - trades (excludes grading, etc.). This permit can not be issued in a subdivision until the public improvements are substantially complete and a mylar copy of the recorded plat has been returned by the applicant to the City. For a land partition, the applicant must obtain an Engineering Permit, if required, and return a mylar copy of the recorded plat to the City prior to issuance of this permit. Other Permits. There are other special permits, such as mechanical, electrical and plumbing that may also be required. Contact the Development Services Counter for more information. GRADING PLAN REQUIREMENTS FOR SUBDIVISIONS All subdivision projects shall require a proposed grading plan prepared by the design engineer. The engineer will also be required to indicate which lots have natural slopes between 10% and 20 %, as well as lots that have natural slopes in excess of 20 %. This information will be necessary in determining if special grading inspections will be required when the lots develop. The design engineer will also be required to shade all structural fill areas on the construction plans. In addition, each homebuilder will be required to submit a specific site and floor plan for each lot. The site plan shall include topographical contours and indicate the elevations of the corners of the lot. The builder shall also indicate the proposed elevations at the four corners of the building. Findings: 1. Streets: This site is located on SW Woodard Lane, which is a private street intersecting with SW Brookside Avenue. The private street was created by the applicant as a part of a previous partition (Plat #1994 -004). The street is fully improved. No additional ROW dedications or improvements are required. 2. Water: There is an existing 8 -inch public water line located in SW Woodard Lane with services previously provided by the Tigard Water Department in 1994. The Water Department indicates that if water services are required to be relocated due to the lot line adjustments or partition, the applicant will bear the expense of those relocations. 3. Sanitary Sewer: There is an existing 8 -inch public sanitary sewer line located in a 10 -foot wide public easement across this property with service laterals stubbed to the existing properties and proposed new parcels. In 1994, the applicant installed future sewer services for the proposed lots, so no additional sewer line work is needed or required. Storm Drainage: There is a private storm line located in Woodard Lane that presently serves the existing Tots and will adequately serve the proposed lots. No additional storm sewer work is necessary. 5. Storm Water Quality: The City has agreed to enforce Surface Water Management (SWM) regulations established by the Unified Sewerage Agency (USA) Design and Construction Standards (adopted by Resolution and Order No. 96-44) which require the construction of on -site water quality facilities. However, the USA standards include a provision that would exclude small projects such as residential land partitions. It would be impractical to require an on -site water quality facility to accommodate treatment of the storm water from the three parcels. Rather, the USA standards provide that applicants should pay a fee in -lieu of constructing a facility if deemed appropriate. Staff recommends payment of the fee in -lieu on this application. 6. Grading and Erosion Control: USA Design and Construction Standards also regulates erosion control to reduce the amount of sediment and other pollutants reaching the public storm and surface water system resulting from development, construction, grading, excavating, clearing, and any other activity which accelerates erosion. Per USA regulations, the applicant is required to submit an erosion control plan for City review and approval prior to issuance of City permits.
