The applicant proposes to then partition Tax Lot 01201 into two (2) lots of 8,000 and 8,050 square feet respectively. A 2,250 square foot Tract A private street has been proposed to serve these parcels. The applicant has also requested a three (3) -foot Variance from the 15 -foot minimum, corner lot side yard setback requirement. Prior to approval of the final plat, a public improvement permit and compliance agreement is required for this project to cover the installation of the new public sanitary sewer line plus any other proposed work in the public right -of -way or public easement. Five (5) sets of detailed public improvement plans and profile construction drawings shall be submitted for preliminary review to the Engineering Department. Once redline comments are addressed and the plans are revised, the design engineer shall then submit eight (8) sets of revised drawings and one (1) itemized construction cost estimate for final review and approval (NOTE: these plans are in addition to any drawings required by the Building Division and should. only include sheets relevant to public improvements. Public improvement plans shall conform to City of Tigard Public Improvement Design Standards, which are available at City Hall. 2. As a part of the public improvement plan submittal, the Engineering Department shall be provided with the name, address and telephone number of the individual or corporate entity who will be responsible for executing the compliance agreement and providing the financial assurance for the public improvements. 3. Prior to approval of the final plat, the applicant shall obtain a Site Permit from the Building Division to cover all grading for the lots, all on -site private utility installation (water, sewer, storm, etc.), and all driveway construction. NOTE: this permit is separate from any permit issued by the Engineering Department for work in the public right -of -way. • 4. An agreement shall be executed by the applicant, on forms provided by the City, which waives the property owner's right to oppose or remonstrate against a future Local Improvement District formed to improve SW Oak Street. 5. The final plat shall show on its face that Tract A will serve as joint ingress and egress easement for both Parcels 1 and 2. The plat shall also indicate that maintenance of Tract A will be the responsibility of the owners of Parcels 1 and 2. 6. The applicant shall obtain a permit from the Tualatin Valley Water District for the proposed water connection prior to issuance of the City's public improvement permit. 7. Prior to issuance of the building permits for Parcels 1 and 2, the applicant shall pay the standard water quality fee of $180 per lot. The applicant shall either place the existing overhead utility lines along SW Oak Street underground as a part of this project, or they shall pay the fee in -lieu of • undergrounding. The fee shall be calculated by the frontage of the site that is parallel to the utility lines and will be $27.50 per lineal foot. If the fee option is chosen, it shall be paid prior to approval of the final plat. 9. Final Plat Application Submission Requirements: A. Three (3) mylar copies of the partition plat prepared by a land surveyor licensed to practice in Oregon, and necessary data or narrative. B. The partition plat and data or narrative shall be drawn to the minimum standards set forth by the Oregon Revised Statutes (ORS 92.05), Washington County, and by the City of Tigard. 10. The Tualatin Valley Fire District reviewed this application and stated that the plans were not approved. Plans reflecting the changes listed under the agency comments' section of this report shall be submitted to the Tualatin Valley Fire District. The applicant shall provide proof that the existing residence has a setback of a minimum of 15 feet from the new street "Tract A" area. If the existing home is less than 15 feet from the proposed street, the street shall either be adjusted towards the applicants' residence on Tax Lot 01300, or a variance for a reduction to the required 15 -foot corner side yard setback shall be filed. The applicant shall revise the partition plat to indicate the existing 15 foot access easement over the western portion of proposed Parcel 1 and reconfigure both Parcels 1 and 2 to provide 7,500 square foot minimum parcels. This may mean that the applicant would not record the Lot Line Adjustment or that the adjustment would need to be revised. Alternatively, the applicant may provide legal documentation that conclusively demonstrates that the western 15 feet of proposed Parcel 1 are not impacted by an access easement. Prior to issuance of building permits on either parcel, the applicant shall provide the Engineering Department with a recorded mylar copy of the subdivision /partition plat. 14. Prior to issuance of building permits on either parcel, the public improvements (specifically the public sanitary sewer line), shall be deemed substantially complete by • the City Engineer. Substantial completion shall be when the sanitary sewer line is completely installed and inspected for compliance with City standards. The vacant parcel to be partitioned has approximately a one (1) percent slope towards SW Oak Street. The site to be partitioned contains no significant natural features. Site Information and Proposal Description: The applicant has requested a Lot Line Adjustment to subtract 2,475 square feet from Tax Lot 01201 which is currently vacant, and add this area to Tax Lot 1400 which is developed with a single - family residence. The applicant proposes to Partition Tax Lot 01201 into two lots of 8,000 and 8,050 square feet respectively. A 2,250 square foot Tract A private street has been proposed to serve these new lots. The applicant has also requested a 3 -foot variance from the 15 -foot minimum corner lot, side yard setback requirement. The variance has been requested in order to allow a new private street that would be constructed within the side yard area of Tax Lot 01300 which is currently developed with a detached, single - family residence. On June 23, 1997 a neighboring property owner contacted the City with evidence that Tax Lot 01201 has a recorded access easement over 15 feet of the western portion of the property. Based on this evidence an additional Condition of Approval has been added that requires the recorded Partition Plat to show the access easement on the Partition Plat and adjust the lot dimensions accordingly or provide conclusive legal evidence that no such access easement exists. SECTION IV: APPLICABLE REVIEW CRITERIA AND FINDINGS COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: Partition - Approval Standards; Section 18.162.040 contains the following general approval criteria for a Partition: 1. The proposal conforms with the City's Comprehensive Plan; 2. The proposed partition complies with all statutory and ordinance requirements and regulations; 3. Adequate public facilities are available to serve the proposal; 4. All proposed lots conform to the size and dimensional requirements of this title; and 5. All proposed improvements meet City and applicable agency standards (Ord. 89 -06; Ord. 83 -52). NOTICE OF AMENDED DECISION MLP 97- 0007/MIS 97- 0001NAR 97 -0002 - SARVAY PARTITION PAGE 4 OF 13 • The proposed lot size and type of development conforms with the type of density range allowed by the Comprehensive Plan as required by Criteria 1. The applicable development standards that implement the Comprehensive Plan designation for this property are reviewed elsewhere within this report. Each of the proposed parcels would exceed the 7,500 square foot minimum where the properties are adjusted, as necessary, to account for the 15 foot access easement that has been described on documents provided by a neighboring property owner. The proposed parcels would also exceed the 50 -foot average width requirement, as required by Section 18.50. The parcels, as proposed, would allow the development of up to two (2) additional detached, single - family residential dwelling units. The development, as proposed, does not exceed the maximum residential density allowed under Chapter 18.92 for a .38 acre parcel within the R-4.5 Zoning District. After deduction of the proposed private street area, the net area would exceed the 7,500 square foot minimum requirement. Because the access easement discussed by the neighboring property owner would impact the net area of the proposed parcels, if the easement is determined to be valid, the applicant shall either reconfigure the proposed lot lines to accomodate the area impacted by the access easement. If it is found to be impossible to reconfigure lot lines to provide 7,500 square feet of net lot area the lot line adjustment may be recorded but not the partition. Because the subject properties do not have 100 feet of frontage on a street, the street tree planting requirements are not applicable to this proposal. Upon completion of the appeal period, the development will have complied with the statutory requirements of the City of Tigard for development review, as required by Criteria 2. Adequate public facilities are available, or have been required to be provided to serve this site, as set forth in Sections 18.164.030 (Streets), 18.164.090 (Sanitary Sewer), and 18.164.100 (Storm Drain) and other public facilities have been reviewed elsewhere within this report, as required by Criteria 3. These standards are reviewed by the Engineering Department elsewhere within this report. The new parcels do not exceed a two and one -half, to one, length to depth ratio. The 50- foot average width requirement is also met by these parcels. For these reasons, the proposed parcel configurations conform with size and dimensional requirements of the R-4.5 Zoning District, as required by Criteria 4. As proposed, the improvements will comply with City and applicable agency standards in satisfaction with Criteria 5, as reviewed through the building permit Plan Check process. Both new parcels comply with the Basic Solar Access requirements because the north to south lot dimension of these parcels would exceed 90 feet in length. Future development of structures on the new parcels will require compliance with Solar Balance Point Standards of • the solar access requirements. NOTICE OF AMENDED DECISION MLP 97- 0007/MIS 97- 0001NAR 97 -0002 - SARVAY PARTITION PAGE 5 OF 13 • • Section 18.162.050 contains the following special provisions for lots created through the Partition Process: 1. Lot Width: The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district. 2. Lot Area: The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the accessway may not be included in the lot area calculation. 3. Lot Frontage: Each lot created through the partition process shall front a public right -of -way by at least 15 feet or have a legally recorded minimum 15- foot -wide access easement. 4. Setbacks: Setbacks shall be as required by the applicable zoning district. 5. Front Yard Determination for Flag Lot: When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. 6. Screening on Flag Lots: A screen shall be provided along the property line of a lot of record where the paved drive in an accessway is located within ten feet of an abutting lot in accordance with Sections 18.100.080 and 18.100.090. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. 7. Fire Protection: The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire fighting capabilities. 8. Reciprocal Easements: Where a common drive is to be provided to serve more than one lot, a reciprocal easement that will ensure access and maintenance rights shall be recorded with the approved partition map. 9. Accessway: Any accessway shall comply with the standards set forth in Chapter 18.108, Access, Egress, and Circulation. 10. Floodplain: Where landfill and /or development is allowed within or adjacent to the one - hundred -year floodplain, the City shall require the dedication of sufficient open land area for greenway adjoining and within the floodplain. This area shall include portions at a suitable elevation for the construction of a pedestrian and or bicycle pathway with the floodplain in accordance with the adopted pedestrian and or bicycle pathway plan. Criterion's 1, 2, 3 and 4 are satisfied. The parcels will exceed the area requirement of 7,500 square feet required for properties zoned R-4.5. Parcels 1 and 2 would have direct access to a private street that would have 15 feet of frontage on SW Oak Street, in satisfaction of the minimum frontage standard for partitions. The standards for setbacks and clear vision will be reviewed for new structures at the time of building permit review. Both existing residences will comply with the front, rear, and side yard setback requirements except for the corner side yard setback standard that is addressed within the variance review portion of this report, in satisfaction with Criteria 4. It is not clear if the existing home on Tax Lot 01202 complies with the corner lot, side yard setback standard. The applicant shall provide proof that the existing residence has a setback of a minimum of 15 feet from the new "Tract A" street area. If the existing home is less than 15 feet from the proposed street, the street NOTICE OF AMENDED DECISION MLP 97- 0007/MIS 97- 0001NAR 97 -0002 - SARVAY PARTITION PAGE 6 OF 13 • shall either be adjusted towards the applicants residence on Tax Lot 01300 or a variance for a reduction to the required 15 -foot corner, side yard setback shall be completed. Criterion's 5 and 6 have been addressed. If the partition plat is recorded, Parcels 1 and 2 would not meet the definition of a flag lot and, therefore, no flag lot setback determination would be necessary. Tax Lot 01300 is presently developed with a detached, single - family residence. Tax Lot 01400 is presently developed with a detached, single - family residence and also does not meet the definition of a flag lot because it has 200 feet of frontage on a 10- foot -wide public right -of -way area that provides access to SW Oak Street. If necessary, flag lot setback standards will be applied through the building permit review. Through the building permit review, fire hydrants shall be consistent with Uniform Fire Code standards, thereby, satisfying Criteria 7. Criteria 8, requiring a reciprocal access and maintenance agreement, has been addressed through the recommended Conditions of Approval. A shared maintenance and access agreement shall be provided for the proposed "Tract A" access area. Criteria 9 will be satisfied through the requirement for a 10- foot -wide minimum paved driveway to serve Parcels 1 and 2. Criteria 10 has been met because the parcel is not located within the 100 -year floodplain or in areas with slopes exceeding 25 percent. Because the site does not adjoin the 100 -year floodplain, dedication of areas for pathway purposes is not applicable. Section 18.134.050 allows the Director to approve, approve with conditions or deny a request for a variance based on the following findings: The proposed variance will not be materially detrimental to the purposes of this title, be in conflict with the policies of the Comprehensive Plan, to any other applicable policies and standards, and to any other properties in the same zoning district or vicinity; The proposed variance will allow a limited reduction to the corner, side yard setback from a residential dwelling unit on Tax Lot 01300 from 15 feet, to 12 feet. This will allow development of the minimum width driveway 15 feet with a 10 -foot paved section that is permitted to serve the two (2) proposed dwelling units on Parcels 1 and 2. This application did not include the precise location of the adjoining home on Tax Lot 01202. A variance to a portion of the same 15 -foot corner yard setback standard for Tax Lot 01202 may also be necessary to accommodate a street in this area. Because Tax Lot 01202 is under the control of the applicant, it is appropriate that if necessary, the proposed private street "Tract A" could be moved to the east a distance necessary to eliminate the need for a variance to the setback on the adjoining property. For this reason, a variance of more than the three (3) feet proposed for the setback to the home on Tax Lot 01300 should be allowed through the final plat recording process. There are special circumstances that exist which are peculiar to the lot size, shape, topography or other circumstances over which the applicant has no control, and which are not applicable to other properties in the same zoning district; The existing residence on Tax Lot 01300 was developed in such a way where the affected side yard setback (the west side of the parcel), was the widest side yard available to provide direct NOTICE OF AMENDED DECISION MLP 97- 0007 /MIS 97- 0001NAR 97 -0002 - SARVAY PARTITION PAGE 7 OF 13 • . access for a new street to SW Oak Street. Using the west side of the parcel allows the minimum width access street to be built without the need to remodel or demolish the existing • home. The use proposed will be the same as permitted under this title and City standards will be maintained to the greatest extent that is reasonably possible while permitting some economic use of the land; Because the proposed "Tract A" private street has been proposed to be developed at the narrowest allowable width to provide access to the new parcels, the proposed variance to the setback requirements would provide the applicant with limited relief from a development standard while slightly impacting the applicants own residence. The variance will allow the applicant to continue to utilize the existing residential dwelling unit for its intended purpose. Remodeling the residence to comply would involve rebuilding critical load bearing portions of the building. Existing physical and natural systems, such as but not limited to traffic, drainage, dramatic land forms or parks will not be adversely affected any more than would occur if the development were located as specified by this title; and Due to its limited nature, the variance does not affect the above listed natural and physical systems. The hardship is not self imposed and the variance requested is the minimum variance which would alleviate the hardship. The hardship is due to the development configuration of properties around the parcel to be partitioned, and the location of the existing residence on Tax Lot 01300. Because the variance allows a limited encroachment into a single corner side yard setback, the variance is the minimum required to alleviate the hardship of reconstructing the building to comply with the standard. Where no variance is found to be required to the corner yard setback to the existing home on Tax Lot 01202, the limited impact of the proposed variance would be upon the applicants' existing residence. If a separate variance is required to the home on Tax Lot 1202, approval of a separate variance to that setback, or realignment of the proposed street would be necessary. Lot Line Adjustment - Approval Standards: Section 18.162.060 contains the following standards for approval of a lot line adjustment request: 1. An additional parcel is not created by the Lot Line Adjustment, and the existing parcel reduced in size by the adjustment is not reduced below the minimum lot size established by the zoning district; 2. By reducing the lot size, the lot or structure(s) on the lot will not be in violation of the site development or zoning district regulations for that district; and 3. The resulting parcels are in conformity with the dimensional standards of the zoning district. The proposed lot line adjustment is consistent with these standards. The proposed adjustment will reconfigure lot lines but no additional parcel will be created by the adjustment. Each of the proposed parcels will continue to comply with the 7,500 square foot minimum lot size of the R-4.5 Zoning District. The 50 -foot average width standard is also met by this adjustment. All existing site improvements have been reviewed through the NOTICE OF AMENDED DECISION MLP 97- 0007 /MIS 97- 0001NAR 97 -0002 - SARVAY PARTITION PAGE 8 OF 13 • • submittal of a site plan indicating the setbacks of the existing structures in relationship to the proposed new property lines. Special Provisions for Lots Created Through Partition Process: Section 18.162.060 states that in addition to meeting the above standards, a Lot Line Adjustment must also meet the following criteria applicable to lots created through the Minor Land Partition process: 1. Lot Width: The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district. 2. Lot Area: The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the accessway may not be included in the lot area calculation. 3. Lot Frontage: Each lot created through the partition process shall front a public right -of -way by at least 15 feet, or have a legally recorded minimum 15- foot -wide access easement. 4. Setbacks: Setbacks shall be as required by the applicable zoning district. 5. Accessway: Any accessway shall comply with the standards set forth in Chapter 18.108; Access, Egress, and Circulation. 10. Floodplain: Where landfill and/or development is allowed within or adjacent to the one - hundred -year floodplain, the City shall require the dedication of sufficient open land area for greenway adjoining and within the floodplain. This area shall include portions at a suitable elevation for the construction of a pedestrian /bicycle pathway with the floodplain in accordance with the adopted pedestrian /bicycle pathway plan. Criteria 1 has been complied with because an average lot width of 50 feet has been maintained. Criteria 2 is not applicable because a minimum lot area of 7,500 square feet has been maintained for each lot. Criteria 3 is satisfied because the affected and new parcels would have a minimum of 15 feet of frontage on a public street. Criteria 4 has been addressed because the existing residence complies with the setback standards of the R-4.5 Zoning District, as indicated within the information materials submitted by the applicant. NOTICE OF AMENDED DECISION MLP 97- 0007/MIS 97- 0001NAR 97 -0002 - SARVAY PARTITION PAGE 9 OF 13 • • Criteria 5 and 6 are applicable to Tax Lots 01201 and 01400 because these are flag lots. However, should the applicant record the proposed partition, the new parcels created from Tax Lot 01201 would not be considered flag lots because access would be taken from a • separate tract that meets the definition of a street. If the partition is not recorded, then the flag lot setback standards would be reviewed upon future development of this site. Flag lot screening will also be required upon future redevelopment of Tax Lot 01400, as applicable. Upon future development of Tax Lot 01201, fire hydrants shall be provided that are consistent with Uniform Fire Code standards, thereby, satisfying Criteria 7. Criteria 8 is applicable because the proposed parcels would share a private street. A Condition of Approval has been required that a note be placed on the face of the recorded partition plat stating that "maintenance of the private street is the shared responsibility of both property owners." Criteria 9 is not affected because driveways or access to the properties is not affected through this adjustment. Criteria 10 is not applicable as neither parcel is within or adjacent to floodplain areas. • PUBLIC FACILITY CONCERNS: Section's 18.164.030(E)(1)(a) (Streets), 18.164.090 (Sanitary Sewer), 18.164.100 (Storm Drains) shall be satisfied. Development Code provisions related to Storm Water Quantity, Storm Water Quality, Existing Utility Line Undergrounding, Water Service, and Site Permits are also addressed below: Streets This site is adjacent to SW Oak Street, which is a local street. There is adequate right -of- way (ROW) at this time, so no further dedications are required. The street is paved, but not to a full public standard width. TMC 18.164.030(A)(1)(a) states that streets within a development and streets adjacent shall be improved in accordance with City standards. However, 18.164.030(A)(1)(c) states that the City may accept a future improvement guarantee in lieu of street improvements if the improvement associated with the project does not, by itself, provide a significant improvement to the street safety or capacity. • Although this development will incrementally increase the amount of traffic on the roadway, the increase will not substantially degrade the level of service on the street. A street improvement adjacent to this site, therefore, will not significantly improve the safety or capacity of the street. Staff, therefore, recommends that the applicant be required to enter into a non - remonstrance agreement with the City, whereby, the owner agrees to participate in any future widening project for the street carried out through a local improvement district. This agreement must be executed prior to approval of the final plat. Access to the two (2) new lots will be via a 15- foot -wide tract out to SW Oak Street. This access will be acceptable provided the final plat is clear that the ownership and maintenance of the tract will be by the owners of Parcels 1 and 2. • NOTICE OF AMENDED DECISION MLP 97- 0007 /MIS 97- 0001NAR 97 -0002 - SARVAY PARTITION PAGE 10 OF 13 • • Water: This site lies within the Tualatin Valley Water District's service area. Any proposed connections to the public water system must first be approved and permitted by the Water District. Sanitary Sewer: There is an 8 -inch public sanitary sewer line in SW Oak Street that can serve the new lots. The applicant is proposing to extend a new public sewer line north from the main line in Oak Street, along the new driveway to serve the lots. This plan will comply with standards set by Unified Sewerage Agency (USA) and is supported by Staff. Storm Drainage: The topography of this site falls to the southeast. The applicant is proposing to construct a private storm drainage line in the private driveway that will convey water from the new lots to the existing roadside ditch in SW Oak Street. This plan is acceptable to Staff. Storm Water Quality: The City has agreed to enforce Surface Water Management (SWM) regulations established by the Unified Sewerage Agency (USA) (Resolution and Order No. 91 -47, as amended by R &O 91 -75) which require the construction of on -site water quality facilities. However, the R &O includes a provision that would exclude small projects such as residential land partitions. It would be impractical to require an on -site water quality facility to accommodate treatment of the storm water from Parcel 2. Rather, the R &O provides that applicants should pay a fee in -lieu of constructing a facility if deemed appropriate. Staff recommends payment of the fee in -lieu on this application. Existing Overhead Utility Lines: There are existing overhead utility lines along SW Oak Street. Section 18.164.120 of the TMC requires all overhead utility lines adjacent to a development to be placed underground or, at the election of the developer, a fee in -lieu of undergrounding can be paid. If the fee in -lieu is proposed, it is equal to $27.50 per lineal foot of street frontage that contains the overhead lines. Site Permit Required: The applicant is required to obtain a Site Permit from the Building Division to cover all on- site private utility installations (water, sewer, storm, etc.) and driveway construction. This permit shall be obtained prior to approval of the final plat. SECTION V: OTHER STAFF COMMENTS The Public Works Department reviewed this application and had the following comment: • The minimum (or preferably more) distance should be maintained between the water and sewer lines. Please refer to the City of Tigard specifications concerning water lines crossing sewer lines. Plans reflecting the following comments shall be submitted to Gene Birchill of the Fire Marshall's office: Fire hydrants for single - family dwellings and duplexes shall be placed at each intersection. Intermediate fire hydrants are required in any portion of a structure exceeds 500 feet from a hydrant as measured in an approved manner around the outside of the structure and along approved fire apparatus access roadways. Placement of additional fire hydrants shall be as approved by the Chief (UFC Sec. 903.4.2.2). The minimum available fire flow for single - family dwellings and duplexes shall be 1,000 gallons per minute. If the structure(s) are 3,600 square feet or larger, the required fire flow shall be determined according to UFC Appendix Table A- III -A -1 (UFC Appendix III -A, Sec. 5). The Unified Sewerage Agency of Washington County reviewed this application and provided the following comments: SANITARY SEWER: Each lot within the development should be provided with a means of disposal for sanitary sewer. The means of disposal should be in accordance with R &O 96 -44 (Unified Sewerage Agency's Construction Design Standards, July 1996 edition). Engineer should verify that public sanitary sewer is available to uphill adjacent properties, or extend service as required by R &O 96 -44. STORM SEWER: Each lot within the development should have access to public storm sewer. Hydraulic and hydrological analysis of storm conveyance system is necessary. SECTION IV: APPLICABLE REVIEW CRITERIA AND FINDINGS COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: Partition - Approval Standards: Section 18.162.040 contains the following general approval criteria for a Partition: 1. The proposal conforms with the City's Comprehensive Plan; 2. The proposed partition complies with all statutory and ordinance requirements and regulations; 3. Adequate public facilities are available to serve the proposal; 4. All proposed lots conform to the size and dimensional requirements of this title; and 5. All proposed improvements meet City and applicable agency standards (Ord. 89 -06; Ord. 83 -52). The proposed lot size and type of development conforms with the type of density range allowed by the Comprehensive Plan as required by Criteria 1. The applicable development standards that implement the Comprehensive Plan designation for this property are reviewed elsewhere within this report. Each of the proposed parcels would exceed the 7,500 square foot minimum. The proposed parcels would also exceed the 50 -foot average width requirement, as required by Section 18.50. The parcels, as proposed, would allow the development of up to two (2) additional detached, single - family residential dwelling units. NOTICE OF DECISION MLP 97- 0007 /MIS 97- 0001NAR 97 -0002 - SARVAY PARTITION PAGE 4 OF 13 • • The development, as proposed, does not exceed the maximum residential density allowed • under Chapter 18.92 for a .38 acre parcel within the R-4.5 Zoning District. After deduction of - the proposed private street area, both parcels would exceed the 7,500 square foot minimum requirement. Because the subject properties do not have 100 feet of frontage on a street, the street tree planting requirements are not applicable to this proposal. Upon completion of the appeal period, the development will have complied with the statutory requirements of the City of Tigard for development review, as required by Criteria 2. Adequate public facilities are available, or have been required to be provided to serve this site, as set forth in Sections 18.164,030 (Streets), 18.164.090 (Sanitary Sewer), and 18.164.100 (Storm Drain) and other public facilities have been reviewed elsewhere within this report, as required by Criteria 3. These standards are reviewed by the Engineering Department elsewhere within this report. The new parcels do not exceed a two and one -half, to one, length to depth ratio. The 50- foot average width requirement is also met by these parcels. For these reasons, the proposed parcel configurations conform with size and dimensional requirements of the R-4.5 • Zoning District, as required by Criteria 4. As proposed, the improvements will comply with City and applicable agency standards in satisfaction with Criteria 5, as reviewed through the building permit Plan Check process. Both new parcels comply with the Basic Solar Access requirements because the north to south lot dimension of these parcels would exceed 90 feet in length. Future development of structures on the new parcels will require compliance with Solar Balance Point Standards of the solar access requirements. Section 18.162.050 contains the following special provisions for lots created through the Partition Process: 1. Lot Width: The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district. 2. Lot Area: The lot area shall be as required by the applicable zoning district. In • the case of a flag lot, the accessway may not be included in the lot area calculation. 3. Lot Frontage: Each lot created through the partition process shall front a public right -of -way by at least 15 feet or have a legally recorded minimum 15- foot -wide access easement. 4. Setbacks: Setbacks shall be as required by the applicable zoning district. 5. Front Yard Determination for Flag Lot: When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Screening on Flag Lots: A screen shall be provided along the property line of • • a lot of record where the paved drive in an accessway is located within ten feet • of an abutting lot in accordance with Sections 18.100.080 and 18.100.090. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. 7. Fire Protection: The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire fighting capabilities. 8. Reciprocal Easements: Where a common drive is to be provided to serve more than one lot, a reciprocal easement that will ensure access and maintenance rights shall be recorded with the approved partition map. 9. Accessway: Any accessway shall comply with the standards set forth in Chapter 18.108, Access, Egress, and Circulation. 10. Floodplain: Where landfill and /or development is allowed within or adjacent to • the one - hundred -year floodplain, the City shall require the dedication of sufficient open land area for greenway adjoining and within the floodplain. This area shall include portions at a suitable elevation for the construction of a pedestrian and or bicycle pathway with the floodplain in accordance with the adopted pedestrian and or bicycle pathway plan. Criterion's 1, 2, 3 and 4 are satisfied. The parcels will exceed the area requirement of 7,500 square feet required for properties zoned R-4.5. Parcels 1 and 2 would have direct access to a private street that would have 15 feet of frontage on SW Oak Street, in satisfaction of the minimum frontage standard for partitions. The standards for setbacks and clear vision will be reviewed for new structures at the time of building permit review. Both existing residences will comply with the front, rear, and side yard setback requirements except for the corner side yard setback standard that is addressed within the variance review portion of this report, in satisfaction with Criteria 4. It is not clear if the existing home on Tax Lot 01202 complies with the corner lot, side yard setback standard. The applicant shall provide proof • that the existing residence has a setback of a minimum of 15 feet from the new "Tract A" street area. If the existing home is less than 15 feet from the proposed street, the street shall either be adjusted towards the applicants residence on Tax Lot 01300 or a variance for a reduction to the required 15 -foot corner, side yard setback shall be completed. Criterion's 5 and 6 have been addressed. If the partition plat is recorded, Parcels 1 and 2 would not meet the definition of a flag lot and, therefore, no flag lot setback determination would be necessary. Tax Lot 01300 is presently developed with a detached, single - family residence. Tax Lot 01400 is presently developed with a detached, single - family residence and also does not meet the definition of a flag lot because it has 200 feet of frontage on a 10- foot -wide public right -of -way area that provides access to SW Oak Street. If necessary, flag lot setback standards will be applied through the building permit review. Through the building permit review, fire hydrants shall be consistent with Uniform Fire Code standards, thereby, satisfying Criteria 7. Criteria 8, requiring a reciprocal access and • maintenance agreement, has been addressed through the recommended Conditions of Approval. A shared maintenance and access agreement shall be provided for the proposed "Tract A" access area. NOTICE OF DECISION MLP 97- 0007 /MIS 97- 0001NAR 97 -0002 - SARVAY PARTITION PAGE 6 OF 13 • • Criteria 9 will be satisfied through the requirement for a 10- foot -wide minimum paved • • driveway to serve Parcels 1 and 2. Criteria 10 has been met because the parcel is not • located within the 100 -year floodplain or in areas with slopes exceeding 25 percent. Because the site does not adjoin the 100 -year floodplain, dedication of areas for pathway purposes is not applicable. Section 18.134.050 allows the Director to approve, approve with conditions or deny a request for a variance based on the following findings: The proposed variance will not be materially detrimental to the purposes of this title, be in conflict with the policies of the Comprehensive Plan, to any other applicable policies and standards, and to any other properties in the same zoning district or vicinity; The proposed variance will allow a limited reduction to the corner, side yard setback from a residential dwelling unit on Tax Lot 01300 from 15 feet, to 12 feet. This will allow development of the minimum width driveway 15 feet with a 10 -foot paved section that is permitted to serve the two (2) proposed dwelling units on Parcels 1 and 2. This application did not include the precise location of the adjoining home on Tax Lot 01202. A variance to a portion of the same 15 -foot corner yard setback standard for Tax Lot 01202 may also be necessary to accommodate a street in this area. Because Tax Lot 01202 is under the control of the applicant, it is appropriate that if necessary, the proposed private street "Tract A" could be moved to the east a distance necessary to eliminate the need for a variance to the setback on the adjoining property. For this reason, a variance of more than the three (3) feet proposed for the setback to the home on Tax Lot 01300 should be allowed through the final plat recording process. There are special circumstances that exist which are peculiar to the lot size, shape, topography or other circumstances over which the applicant has no control, and which are not applicable to other properties in the same zoning district; The existing residence on Tax Lot 01300 was developed in such a way where the affected side yard setback (the west side of the parcel), was the widest side yard available to provide direct access for a new street to SW Oak Street. Using the west side of the parcel allows the minimum width access street to be built without the need to remodel or demolish the existing home. The use proposed will be the same as permitted under this title and City standards will be maintained to the greatest extent that is reasonably possible while permitting some economic use of the land; Because the proposed "Tract A" private street has been proposed to be developed at the narrowest allowable width to provide access to the new parcels, the proposed variance to the setback requirements would provide the applicant with limited relief from a development standard while slightly impacting the applicants own residence. The variance will allow the applicant to continue to utilize the existing residential dwelling unit for its intended purpose. Remodeling the residence to comply would involve rebuilding critical load bearing portions of the building. Existing physical and natural systems, such as but not limited to traffic, drainage, dramatic land forms or parks will not be adversely affected any more than would NOTICE OF DECISION MLP 97- 0007 /MIS 97- 0001NAR 97 -0002 - SARVAY PARTITION PAGE 7 OF 13 • . occur if the development were located as specified by this title; and Due to its limited nature, the variance does not affect the above listed natural and physical systems. • The hardship is not self imposed and the variance requested is the minimum variance . which would alleviate the hardship. The hardship is due to the development configuration of properties around the parcel to be partitioned, and the location of the existing residence on Tax Lot 01300. Because the variance allows a limited encroachment into a single corner side yard setback, the variance is the minimum required to alleviate the hardship of reconstructing the building to comply with the standard. Where no variance is found to be required to the corner yard setback to the existing home on Tax Lot 01202, the limited impact of the proposed variance would be upon the applicants' existing residence. If a separate variance is required to the home on Tax Lot 1202, approval of a separate variance to that setback, or realignment of the proposed street would be necessary. Lot Line Adjustment - Approval Standards: Section 18.162.060 contains the following standards for approval of a lot line adjustment request: 1. An additional parcel is not created by the Lot Line Adjustment, and the existing parcel reduced in size by the adjustment is not reduced below the minimum lot size established by the zoning district; 2. By reducing the lot size, the lot or structure(s) on the lot will not be in violation of the site development or zoning district regulations for that district; and 3. The resulting parcels are in conformity with the dimensional standards of the zoning district. The proposed lot line adjustment is consistent with these standards. The proposed adjustment will reconfigure lot lines but no additional parcel will be created by the adjustment. Each of the proposed parcels will continue to comply with the 7,500 square foot minimum lot size of the R-4.5 Zoning District. The 50 -foot average width standard is also met by this adjustment. All existing site improvements have been reviewed through the submittal of a site plan indicating the setbacks of the existing structures in relationship to the proposed new property lines. Special Provisions for Lots Created Through Partition Process: Section 18.162.060 states that in addition to meeting the above standards, a Lot Line Adjustment must also meet the following criteria applicable to lots created through the Minor Land Partition process: 1. Lot Width: The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district. 2. Criteria 1 has been complied with because an average lot width of 50 feet has been maintained. Criteria 2 is not applicable because a minimum lot area of 7,500 square feet has been maintained for each lot. Criteria 3 is satisfied because the affected and new parcels would have a minimum of 15 feet of frontage on a public street. Criteria 4 has been addressed because the existing residence complies with the setback standards of the R-4.5 Zoning District, as indicated within the information materials submitted by the applicant. Criteria 5 and 6 are applicable to Tax Lots 01201 and 01400 because these are flag lots. However, should the applicant record the proposed partition, the new parcels created from Tax Lot 01201 would not be considered flag lots because access would be taken from a separate tract that meets the definition of a street. If the partition is not recorded, then the flag lot setback standards would be reviewed upon future development of this site. Flag lot screening will also be required upon future redevelopment of Tax Lot 01400, as applicable. Upon future development of Tax Lot 01201, fire hydrants shall be provided that are consistent with Uniform Fire Code standards, thereby, satisfying Criteria 7. Criteria 8 is applicable because the proposed parcels would share a private street. A Condition of Approval has been required that a note be placed on the face of the recorded partition plat stating that "maintenance of the private street is the shared responsibility of both property owners." NOTICE OF DECISION MLP 97- 0007 /MIS 97- 0001NAR 97 -0002 - SARVAY PARTITION PAGE 9 OF 13 • • • Criteria 9 is not affected because driveways or access to the properties is not affected through this adjustment. Criteria 10 is not applicable as neither parcel is within or adjacent to floodplain areas. . PUBLIC FACILITY CONCERNS: Section's 18.164.030(E)(1)(a) (Streets), 18.164.090 (Sanitary Sewer), 18.164.100 (Storm Drains) shall be satisfied. Development Code provisions related to Storm Water Quantity, Storm Water Quality, Existing Utility Line Undergrounding, Water Service, and Site Permits are also addressed below: Streets This site is adjacent to SW Oak Street, which is a local street. There is adequate right -of- way (ROW) at this time, so no further dedications are required. The street is paved, but not to a full public standard width. TMC 18.164.030(A)(1)(a) states that streets within a development and streets adjacent shall be improved in accordance with City standards. However, 18.164.030(A)(1)(c) states that the City may accept a future improvement guarantee in lieu of street improvements if the improvement associated with the project does not, by itself, provide a significant improvement to the street safety or capacity. Although this development will incrementally increase the amount of traffic on the roadway, the increase will not substantially degrade the level of service on the street. A street improvement adjacent to this site, therefore, will not significantly improve the safety or capacity of the street. Staff, therefore, recommends that the applicant be required to enter into a non - remonstrance agreement with the City, whereby, the owner agrees to participate in any future widening project for the street carried out through a local improvement district. This agreement must be executed prior to approval of the final plat. Access to the two (2) new lots will be via a 15- foot -wide tract out to SW Oak Street. This access will be acceptable provided the final plat is clear that the ownership and maintenance of the tract will be by the owners of Parcels 1 and 2. Water: This site lies within the Tualatin Valley Water District's service area. Any proposed connections to the public water system must first be approved and permitted by the Water District. • Sanitary Sewer: There is an 8 -inch public sanitary sewer line in SW Oak Street that can serve the new lots. The applicant is proposing to extend a new public sewer line north from the main line in Oak Street, along the new driveway to serve the lots. This plan will comply with standards set by Unified Sewerage Agency (USA) and is supported by Staff. Storm Drainage: The topography of this site falls to the southeast. The applicant is proposing to construct a private storm drainage line in the private driveway that will convey water from the new lots to the existing roadside ditch in SW Oak Street. This plan is acceptable to Staff. NOTICE OF DECISION MLP 97- 0007/MIS 97- 0001NAR 97 -0002 - SARVAY PARTITION PAGE 10 OF 13 • • Storm Water Quality: The City has agreed to enforce Surface Water Management (SWM) regulations • established by the Unified Sewerage Agency (USA) (Resolution and Order No. 91 -47, as amended by R &O 91 -75) which require the construction of on -site water quality facilities. . However, the R &O includes a provision that would exclude small projects such as residential land partitions. It would be impractical to require an on -site water quality facility to accommodate treatment of the storm water from Parcel 2. Rather, the R &O provides that applicants should pay a fee in -lieu of constructing a facility if deemed appropriate. Staff recommends payment of the fee in -lieu on this application. Existing Overhead Utility Lines: There are existing overhead utility lines along SW Oak Street. Section 18.164.120 of the TMC requires all overhead utility lines adjacent to a development to be placed • underground or, at the election of the developer, a fee in -lieu of undergrounding can be paid. If the fee in -lieu is proposed, it is equal to $27.50 per lineal foot of street frontage that contains the overhead lines. Site Permit Required: The applicant is required to obtain a Site Permit from the Building Division to cover all on- site private utility installations (water, sewer, storm, etc.) and driveway construction. This permit shall be obtained prior to approval of the final plat. SECTION V: OTHER STAFF COMMENTS The Public Works Department reviewed this application and had the following comment: The minimum (or preferably more) distance should be maintained between the water and sewer lines. Please refer to the City of Tigard specifications concerning water lines • crossing sewer lines. The Police Department reviewed this application and had the following comment: Addresses are needed to be marked for each home on SW Oak Street so we can locate the homes easily. No other Staff comments or objections have been received. SECTION VI: AGENCY COMMENTS The Tualatin Valley Fire District reviewed this application and stated that the plans were mot approved. Plans reflecting the following comments shall be submitted to Gene Birchill of the Fire Marshall's office: Fire hydrants for single - family dwellings and duplexes shall be placed at each intersection. Intermediate fire hydrants are required in any portion of a structure exceeds 500 feet from a hydrant as measured in an approved manner around the outside of the structure and along approved fire apparatus access roadways. Placement of additional fire hydrants shall be as approved by the Chief (UFC Sec. 903.4.2.2). NOTICE OF DECISION MLP 97- 0007 /MIS 97- 0001NAR 97 -0002 - SARVAY PARTITION PAGE 11 OF 13 • • The minimum available fire flow for single - family dwellings and duplexes shall be 1,000 gallons per minute. If the structure(s) are 3,600 square feet or larger, the required fire flow shall be determined according to UFC Appendix Table A- III -A -1 (UFC Appendix III -A, Sec. 5). The Unified Sewerage Agency of Washington County reviewed this application and provided the following comments: SANITARY SEWER: Each lot within the development should be provided with a means of disposal for sanitary sewer. The means of disposal should be in accordance with R &O 96 -44 (Unified Sewerage Agency's Construction Design Standards, July 1996 edition). Engineer should verify that public sanitary sewer is available to uphill adjacent properties, or extend service as required by R &O 96 -44. STORM SEWER: Each lot within the development should have access to public storm sewer. Engineer should verify that public storm sewer is available to uphill adjacent properties, or extend storm service as required by R &O 96 -44. Hydraulic and hydrological analysis of storm conveyance system is necessary. If downstream storm conveyance does not have the capacity to convey the volume during a 25 -year, 24 -hour storm event, the applicant is responsible of mitigating the flow. WATER QUALITY: Developer should provide a water quality facility to treat the new impervious surface being constructed as part of this development. No other Agency comments or objections have been received. The site is located at 6913 and 6917 SW Oak Street (WCTM 1S1 36AA, tax lots 1201, 1300 and 1400). Findings: 1. Streets: This site is adjacent to SW Oak Street, which is a local street. There is adequate right -of -way (ROW) at this time, so no further dedications are required. The street is paved, but not to a full public standard width. TMC 18.164.030(A)(1)(a) states that streets within a development and streets adjacent shall be improved in accordance with City standards. However, 18.164.030(A)(1)(c) states that the City may accept a future improvement guarantee in lieu of street improvements if the improvement associated with the project does not, by itself, provide a significant improvement to the street safety or capacity. Although this development will incrementally increase the amount of traffic on the roadway, the increase will not substantially degrade the level of service on the street. A street improvement adjacent to this site, therefore, will not significantly improve the safety or capacity of the street. Staff therefore recommends that the applicant be required to enter into a non - remonstrance agreement with the City whereby the owner agrees to participate in any future widening project for the street carried out through a local improvement district. This agreement must be executed prior to approval of the final plat. Access to the two new lots will be via a 15 -foot wide tract out to SW Oak Street. This access will be acceptable provided the final plat is clear that the ownership and maintenance of the tract will be by the owners of Parcels 1 and 2. Any proposed connections to the public water system must first be approved and permitted by the Water District. 3. Sanitary Sewer: There is an 8 -inch public sanitary sewer line in SW Oak Street that can serve the new lots. The applicant is proposing to extend a new public sewer line north from the main line in Oak Street, along the new driveway to serve the lots. This plan will comply with standards set by Unified Sewerage Agency (USA) and is supported by Staff. 4. Storm Drainage: The topography of this site falls to the southeast. The applicant is proposing to construct a private storm drainage line in the private driveway that will convey water from the new lots to the existing roadside ditch in SW Oak Street. This plan is acceptable to Staff. 5. Storm Water Quality: The City has agreed to enforce Surface Water Management (SWM) regulations established by the Unified Sewerage Agency (USA) (Resolution and Order No. 91-47, as amended by R &O 91 -75) which require the construction of on -site water quality facilities. However, the R &O includes a provision that would exclude small projects such as residential land partitions. It would be impractical to require an on -site water quality facility to accommodate treatment of the storm water from Parcel 2. Rather, the R &O provides that applicants should pay a fee in- lieu of constructing a facility if deemed appropriate. Staff recommends payment of the fee in -lieu on this application. 6. Existing Overhead Utility Lines: There are existing overhead utility lines along SW Oak Street. Section 18.164.120 of the TMC requires all overhead utility lines adjacent to a development to be placed underground or, at the election of the developer, a fee in -lieu of undergrounding can be paid. Site Permit Required: The applicant is required to obtain a Site Permit from the Building Division to cover all on -site private utility installations (water, sewer, storm, etc.) and driveway construction. This permit shall be obtained prior to approval of the final plat. Recommendations: THE FOLLOWING CONDITIONS SHALL BE SATISFIED PRIOR TO APPROVAL OF THE FINAL PLAT: Note: Unless otherwise noted, the staff contact for the following conditions will be Brian Rager, Engineering Department (639- 4171). 1. Prior to approval of the final plat, a public improvement permit and compliance agreement is required for this project to cover the installation of the new public sanitary sewer line plus any other proposed work in the public right -of -way or public easement. Five (5) sets of detailed public improvement plans and profile construction drawings shall be submitted for preliminary review to the Engineering Department. Once redline comments are addressed and the plans are revised, the design engineer shall then submit eight (8) sets of revised drawings and one (1) itemized construction cost estimate for final review and approval (NOTE: these plans are in addition to any drawings required by the Building Division and should only include sheets relevant to public improvements. Prior to approval of the final plat, the applicant shall obtain a Site Permit from the Building Department to cover all grading for the lots, all on -site private utility installation (water, sewer, storm, etc.) and all driveway construction. Prior to issuance of the building permits for Parcels 1 and 2, the applicant shall pay the standard water quality fee of $ 180 per lot. 8. The applicant shall either place the existing overhead utility lines along SW Oak Street underground as a part of this project, or they shall pay the fee in -lieu of undergrounding. The fee shall be calculated by the frontage of the site that is parallel to the utility lines and will be $ 27.50 per lineal foot.
