Three (3) mylar copies of the partition plat prepared by a land surveyor licensed to practice in Oregon, and necessary data or narrative. b. The partition plat and data or narrative shall be drawn to the minimum standards set forth by the Oregon Revised Statutes (ORS 92.05), Washington County, and by the City of Tigard. c. The Final Plat shall show a joint access easement to cover the common driveways. SECTION III: BACKGROUND INFORMATION Property History: The subject property was annexed into the City in 1972 (ZC 5 -72). The property was changed from Washington County P -R, Planned Residential, to City of Tigard P -D, Planned Development. The Tigard Planning Commission recommended approval of the development plan and program for the Summerfield Planned Development, in which a shopping center was to be located, on February 6, 1973 and the Council adopted the Commission's recommendation of February 12, 1973. In September of 1979, a Site Design Review (SDR 26 -79) was granted for phase I and II for the Summerfield Commercial Center. In August of 1983, the Planning Commission approved an applicant's request to eliminate a tenant mix restriction of 13% financial, 24% office, and 63% retail for this shopping center. In May 1996, a Site Development Review application (SDR 96 -0003) was approved to construct a 5,775 square foot commercial building that included modifications to the existing parking within the center. No other development applications were found to have been filed with the City. NOTICE OF DECISION WILLOWBROOK BUSINESS PARK PARTITION - MLP 97 -0004 PAGE 2 • • . Site Information and Proposal Description: The property is currently developed with a five (5) building, 58,025 square foot shopping center, commonly known as the "Willowbrook Shopping Center." The applicant is proposing to divide one (1) parcel of approximately 221,283 square feet into two (2) parcels of approximately 203,504 and 17,779 square feet. The partition will create a new lot for the 5,775 square foot office building approved through the Site Development Review (SDR 96 -0003) that was approved in 1996. SECTION IV: APPLICABLE REVIEW CRITERIA AND FINDINGS (MINOR LAND PARTITION) Section 18.162.040 contains the following general approval criteria for a Minor Land Partition: 1. The proposal conforms with the City's Comprehensive Plan; 2. The proposed partition complies with all statutory and ordinance requirements and regulations; 3. Adequate public facilities are available to serve the proposal; 4. All proposed lots conform to the size and dimensional requirements of this title; and 5. All proposed improvements meet City and applicable agency standards (Ord. 89 -06; Ord. 83 -52). The proposal conforms with the City's Comprehensive Plan in that the newly created lot will continue to allow for commercial development. This proposal, therefore, is not in conflict with the General Commercial Plan designation. This proposed partition complies with all statutory and ordinance requirements and regulations as demonstrated both by the analysis presented within this administrative decision, and by this application and review process. Adequate public facilities are, or will be, conditioned to be available to serve the proposal. Section 18.162.050 contains the following special provisions for lots created through the Partition Process: 1. Lot Width: The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district. 2. Lot Area: The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the accessway may not be included in the lot area calculation. 3. Lot Frontage: Each lot created through the partition process shall front a public right -of -way by at least 15 feet, or have a legally recorded minimum 15 foot wide access easement. 4. Setbacks: Setbacks shall be as required by the applicable zoning district. NOTICE OF DECISION WILLOWBROOK BUSINESS PARK PARTITION - MLP 97 -0004 PAGE 3 • • . 5. Front Yard Determination for Flag Lot: When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. 6. Screening on Flag Lots: A screen shall be provided along the property line of a lot of record where the paved drive in an accessway is located within ten feet of an abutting lot in accordance with Sections 18.100.080 and 18.100.090. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. 7. Fire Protection; The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire fighting capabilities. 8. Reciprocal Easements; Where a common drive is to be provided to serve more than one (1) lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. 9. Accessway: Any accessway shall comply with the standards set forth in Chapter 18.108; Access, Egress, and Circulation. 10. Floodplain: Where landfill and/or development is allowed within or adjacent to the one - hundred -year floodplain, the City shall require the dedication of sufficient open land area for greenway adjoining and within the floodplain. This area shall include portions at a suitable elevation for the construction of a pedestrian /bicycle pathway with the floodplain in accordance with the adopted pedestrian /bicycle pathway plan. Criteria 1 is satisfied as the proposed lot widths are approximately 400 and 130 feet respectively, exceeding the minimum 50 -foot lot width requirement in the C -G zone. Criteria 2 is not applicable as there is no minimum lot size requirement in the C -G zone. Criteria 3 is satisfied as parcel one (1) has 500 feet of frontage on SW Pacific Highway and parcel two (2) has 130 feet of frontage on SW Durham Road. Criteria 4 is satisfied as there are no setbacks applicable to this property. Criteria 5 and 6 are not applicable as neither lot is a flag lot. Fire hydrants shall be consistent with Uniform Fire Code standards, thereby, satisfying Criteria 7. Criteria 8 shall be satisfied as a joint use and maintenance agreement shall be provided for the common driveway. Criteria 9 shall be satisfied as both lots will use existing, approved driveways that serve the business park. Criteria 10 is not applicable as neither of the parcels are within the floodplain. NOTICE OF DECISION WILLOWBROOK BUSINESS PARK PARTITION - MLP 97 -0004 PAGE 4 • • Sections 18.164.030 (Streets), 18.164.090 (Sanitary Sewer), and 18.164.100 (Storm Drains) have been addressed and are satisfied as specified below: Streets This site lies adjacent to SW Pacific Highway, SW Durham Road, and SW Summerfield Drive. All three (3) roadways are fully improved adjacent to this site. No additional right -of -way (ROW) dedications or street improvements are necessary, or required. Water: Both parcels are presently served by the Tigard Water Department system. No additional water line work is required for this partition. Sanitary Sewer: Both parcels are presently served by an on -site sanitary sewer line. No additional sewer work is necessary. Storm Drainage: There is an existing on -site storm drainage system that presently serves both parcels. No additional storm drainage work is necessary, or proposed. Storm Water Quality: The City has agreed to enforce Surface Water Management (SWM) regulations established by the Unified Sewerage Agency (USA) (Resolution and Order No. 91 -47, as amended by R &O 91 -75) which requires the construction of on -site water quality facilities. Any redevelopment of these parcels, where the impervious surface area will be increased, may result in a requirement for the construction of an on -site water quality facility. SECTION V: AGENCY AND OTHER STAFF COMMENTS City of Tigard Building Division, City of Tigard Maintenance Services Division, and Tualatin Valley Fire and Rescue have reviewed the proposal and have offered no comments or objections. The City of Tigard approved site development review and planned development review applications for the Willowbrook Business Park in 1996 (SDR 96- 0003/PDR 96- 0001). The 1996 approvals authorized the development of a 5,775 square foot commercial building ( "Building 6 ") at Willowbrook. The purpose of the minor partition is to create two parcels, one encompassing the Building 6 site, and the other parcel encompassing the remainder of the Willowbrook Business Park. The entire site has a Comprehensive Plan designation and Zoning designation of General Commercial (CG). II. Applicable Standards The approval standards for a minor partition are set forth in Section 18.162.040: "1. The proposal conforms with the City's comprehensive plan." This application is for a minor partition on a site developed in accordance with the CG designation under the Comprehensive Plan. The partition will not alter the existing or planned development on the site, and therefore should have not have any impact on substantive policies or implementation strategies under the Comprehensive Plan. 0126045.01 • "2. The proposed partition complies with all statutory and ordinance requirements and regulations." Compliance with substantive provisions of the Tigard Municipal Code is addressed below. The statutory standards for reviewing a preliminary partition map are set forth in ORS 92.090(2): ORS 92.090(2)(a): The proposed partition does not involve the creation of a street or road, and does not alter the location of existing streets or roads. ORS 92.090(2)(b): The proposed partition does not involve the creation of streets or roads held for private use, and there are no private streets or roads within the existing development on the site. ORS 92.090(2)(c): As discussed below, the preliminary partition map complies with the applicable zoning ordinances and regulations. "3. Adequate public facilities are available to serve the proposal." Public facilities issues were addressed in connection with the 1996 site development review and planned development review. The proposed minor partition does not alter any aspect of the approved development or expand public facilities requirements for the Willowbrook Business Park. "4. All proposed lots conform to the size and dimensional requirements of this title." Chapter 18.62 There is no minimum lot or parcel size in the CG zone. The minimum average lot width pursuant to Section 18.62.050(A)(2) is 50 feet. The average width of Parcel 1, as shown on the Preliminary Partition Map, is over 200 feet. The average width of Parcel 2 is over 100 feet. Section 18.62.050(5) and (6) permit maximum site coverage of 85 percent and require minimum landscaping of 15 percent. Site coverage and landscaping requirements for the Willowbrook Business Park as a whole were addressed in the 1996 site development review and planned development review process. Chapter 18.162 Section 18.162.070(B)(9) provides: "Where it is evident that the subject parcel can be further partitioned, the applicant must show that the land partition will not preclude the efficient division of land in the future." The proposed minor partition would not preclude future partitioning in that Parcel 1 encompasses 203,504 sq. ft., with extensive street frontage. The 0126045.01 • • partition efficiently creates a parcel for one building site in the southeast corner of the Willowbrook Business Park. The arrangement of the two parcels preserves the ability to create lots for other buildings within Willowbrook if the need arises in the future. • Section 18.162.050(C)(1) requires that each lot created through the partition process must have at least 15 feet of frontage on a public right -of -way or have a legally recorded minimum 15 foot wide access easement. Parcel 1 has over 500 feet of frontage on S.W. Pacific Highway and over 160 feet of frontage on S.W. Durham Road. Parcel 2 has approximately 130 feet of frontage on S.W. Durham Road. Chapter 18.164 Section 18.164.060(A)(1): "The size, shape and orientation of the two proposed parcels is appropriate for the location of the development and the type of use contemplated. The site is already developed, with the exception of Parcel 2 (for which development has been approved through site development review and planned development review, but has not yet been constructed). The size, shape and orientation of the two parcels fits with the established commerical development on the site. Section 18.164.060(A)(2): "The depth of all lots shall not exceed 2 -1/2 times the average width, unless the parcel is less than 1 -1/2 times the minimum lot size of the applicable zoning district." Parcel 2 is approximately equal in depth and width. Section 18.164.060(A)(3): "Depth and width of properties zoned for commercial and industrial purposes shall be adequate to provide for the off - street parking and service facilities required by the type of use proposed." With the exception of Parcel 2, the site is already developed. The proposed minor partition does not alter the provision of off - street parking and service facilities, which were determined adequate in the 1996 site development review and planned development review. Section 18.164.060(B)(1): Because this is a minor partition application, Section 18.162.050(C) applies. Compliance with that standard is addressed above. Section 18.164.060(C): This provision is not applicable. Parcel 1 is a corner lot, and Parcel 2 is not a through lot. Section 18.164.060(D)(1): "The side lot lines of lots, as far as practicable, shall be at right angles to the street upon which the Lots front." The only side lot line being created is the line along the west side of Parcel 2. That line is at right angles to S.W. Durham Road, upon which Parcels 1 and 2 front. Section 18.164.060(E)(1): As discussed above, the proposed minor partition preserves the potential for future redivision of Parcel 1, in that Parcel 2 encompasses one approved building site. However, because the site is already almost entirely developed, concerns about interference with future development potential or extension of public facilities are minimal. 0126045.01 • • "5. All proposed improvements meet City and applicable agency standards." No new improvements are proposed in connection with this application.
