Prior to approval of the final plat, a Street Opening Permit will be required for this project to cover the new sanitary sewer connection and any other work in the public right -of -way. The applicant will need to submit five (5) sets of the proposed public improvement plans for review and approval. NOTE: these plans are in addition to any drawings required by the Building Division and should only include information relevant to the public improvements. 2. As a part of the public improvement plan submittal, the Engineering Department shall be provided with the name, address and telephone number of the individual or corporate entity who will be responsible for executing the compliance agreement and providing the financial assurance for the public improvements. 3. Prior to issuance of any building permits on this site, the applicant shall obtain a Site Permit from the Building Division to cover all grading for the lot, all on -site private utility installation (water, sewer, storm, etc.) and all driveway construction. NOTE: this permit is separate from any permit issued by the Engineering Department for work in the public right -of -way. 4. Any necessary off -site utility easements shall be the responsibility of the applicant to obtain and shall be submitted to and accepted by the City prior to construction. 5. The final plat shall show on its face a joint access easement to cover the common driveway that will serve both lots. 6. The applicant shall obtain a permit from the Tualatin Valley Water District for the proposed water connection prior to issuance of the City's public improvement permit. 7. Prior to approval of the final plat, the applicant shall submit a storm drainage plan for the new lot that indicates how the additional storm water runoff will be accommodated in light of the fact the system downstream of Alfred Street on 69th Avenue is presently overburdened. 8. The applicant shall either place the existing overhead utility lines along SW Alfred Street underground as a part of this project, or they shall pay the fee in -lieu of undergrounding. The fee shall be calculated by the frontage of the site that is parallel to the utility lines and will be $ 27.50 per lineal foot. Three (3) mylar copies of the partition plat prepared by a land surveyor licensed to practice in Oregon, and necessary data or narrative. B. The partition plat and data or narrative shall be drawn to the minimum standards set forth by the Oregon Revised Statutes (ORS 92.05), Washington County, and by the City of Tigard. 10. Site Information and Proposal Description: The property is currently developed with a single - family residence. The applicant is proposing to divide one (1) parcel of approximately 20,689 square feet into two (2) parcels of approximately 8,750 and 11,939 square feet. APPLICABLE REVIEW CRITERIA AND FINDINGS - MINOR LAND PARTITION Section 18.162.040 contains the following general approval criteria for a Minor Land Partition: 1. The proposal conforms with the City's Comprehensive Plan; 2. The proposed partition complies with all statutory and ordinance requirements and regulations; 3. Adequate public facilities are available to serve the proposal; 4. All proposed lots conform to the size and dimensional requirements of this title; and 5. All proposed improvements meet City and applicable agency standards (Ord. 89 -06; Ord. 83 -52). The proposal conforms with the City's Comprehensive Plan in that the newly created lot will continue to allow for residential development. This proposal, therefore, is not in conflict with the Low Density Plan designation. This proposed partition complies with all statutory and ordinance requirements and regulations as demonstrated both by the analysis presented within this administrative decision, and by this application and review process. Adequate public facilities are or will be conditioned to be available to serve the proposal. Section 18.162.050 contains the following special provisions for lots created through the Partition Process: 1. Lot Width: The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district. 2. Lot Area: The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the accessway may not be included in the lot area calculation. 3. Lot Frontage: Each lot created through the partition process shall front a public right -of -way by at least 15 feet, or have a legally recorded minimum 15 foot wide access easement. 4. Setbacks: Setbacks shall be as required by the applicable zoning district. 5. Front Yard Determination for Flag Lot: When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. NOTICE OF DECISION REED /BIDEN - MLP 97 -0001 PAGE 4 • • 6. Screening on Flag Lots: A screen shall be provided along the property line of a lot of record where the paved drive in an accessway is located within ten feet of an abutting lot in accordance with Sections 18.100.080 and 18.100.090. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. 7. Fire Protection: The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire fighting capabilities. 8. Reciprocal Easements: Where a common drive is to be provided to serve more than one (1) lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. 9. Accessway: Any accessway shall comply with the standards set forth in Chapter 18.108; Access, Egress, and Circulation. 10. Floodplain: Where landfill and /or development is allowed within or adjacent to the one - hundred -year floodplain, the City shall require the dedication of sufficient open land area for greenway adjoining and within the floodplain. This area shall include portions at a suitable elevation for the construction of a pedestrian /bicycle pathway with the floodplain in accordance with the adopted pedestrian /bicycle pathway plan. Criteria 1 is satisfied as the proposed lot widths are approximately 70 and 85 feet respectively, exceeding the minimum 50 -foot lot width requirement in the R-4.5 zone. Criteria 2 is satisfied as this partition would create lots of approximately 8,750 and 11,939 square feet, exceeding the 7,500 square foot minimum lot size requirement. Criteria 3 is satisfied as parcel one (1) has 70 feet of frontage on SW Alfred Street and parcel two (2) has 15 feet of frontage on SW Alfred Street. The required setbacks in the R-4.5 zone are as follows: front yard -20 feet; side yard -5 feet; rear yard -15 feet; and garage -20 feet. As indicated on the site plan, the existing single - family home on parcel one (1) complies with the setbacks, thereby, satisfying Criteria 4. Compliance with flag lot setbacks on the newly created parcel will be reviewed when it is built upon. Criteria 5 shall be satisfied as the front yard determination for parcel two (2) shall be reviewed during the building permit process when the property is built upon. Criteria 6 shall be satisfied as the applicant shall submit a revised plan which provides screening along the entire length of the flag driveway, in accordance with Section 18.100.080 and 18.100.090. Fire hydrants shall be consistent with Uniform Fire Code standards, thereby, satisfying Criteria 7. Criteria 8 shall be satisfied as a joint use and maintenance agreement shall be provided for the common driveway. Criteria 9 shall be satisfied as both lots will use an existing 20- foot -wide paved driveway. Criteria 10 is not applicable as neither of the parcels are within the floodplain. NOTICE OF DECISION REED /BIDEN - MLP 97 -0001 PAGE 5 • Section 18.88.010 (Solar Access) states that all newly created lots within the City of Tigard shall promote the use of renewable energy sources by providing for improved access to sunlight for residential dwellings. A lot meets the basic requirement if it has a north -south dimension of 90 feet or more and has a front lot line that is oriented within 30 degrees of a true east -west axis. As proposed, the newly created lots will meet the basic solar access requirement. The lots have north - south dimensions of 125 and 128 feet and the front lot line is oriented within 30 degrees of a true east -west axis. Sections 18.164.030 (Streets), 18.164.090 (Sanitary Sewer), and 18.164.100 (Storm Drains) have been addressed and are satisfied as specified below: Streets This site lies adjacent to SW Alfred Street, east of SW 69th Avenue. Southwest Alfred Street is classified as a local residential street and is currently not improved to City standards. However, the City completed a pavement overlay on this street during the Summer, 1996. There is presently 50 feet of right -of -way (ROW) adjacent to this site, which is adequate for this type of street. No additional ROW dedications or improvements are required. There is an existing 20- foot -wide paved access that serves the existing house (north lot). This driveway will serve as a joint access to also serve the new flag lot (south lot). The applicant shall show on the face of the final plat a joint access easement to cover this driveway. Water: This site lies within the Tualatin Valley Water District (TVWD) service area. TVWD provided comments related to this application and indicated that there is an existing fl- inch public water line in SW Alfred Street that can serve this site. A new water meter will need to be set at the ROW to serve the new flag lot; the current cost for this service is $2,445.00. The applicant will need to contact TVWD to obtain the service (Stu Davis, 848 - 3025). Sanitary Sewer: There is an existing 8 -inch public sewer line in SW Alfred Street that can serve this site. The existing house is already served by this sewer line. In order to serve the new house (south lot), the applicant will need to obtain a Street Opening Permit from the City to extend a new sewer service line from the main line in the street to the new lot. NOTICE OF DECISION REED /BIDEN - MLP 97 -0001 PAGE 6 • • Storm Drainage: The natural topography of this site slopes to the southwest away from SW Alfred Street. There is a marginal roadside ditch along the south edge of the street adjacent to this site, but the ditch becomes undefined immediately west of the site. Storm water from Alfred Street presently flows down the street to SW 69th Avenue, where it then flows south on 69th Avenue to the end of the cul -de -sac. The City's Public Works Department indicates that there is a problem with excessive surface water runoff on the 69th Avenue cul -de -sac; additional surface water should not be directed toward that street. On the north side of Alfred Street, the roadside ditch is picked up in a piped system that directs storm water away from the 69th Avenue cul -de -sac. South of this site, there is a developed single - family subdivision, which may make off -site conveyance of storm water a challenge. The applicant's plan indicates a proposal to pipe the storm water from the new home (south lot) out to SW Alfred Street. However, based upon the existing problems downstream on 69th Avenue, this proposal can not be supported. In addition, the topography maps indicate that piping roof and foundation drains from the south lot to SW Alfred Street may be impossible because of the adverse grade. At best, the grade is flat, which would still present a problem in getting the drainage to flow to the north. In summary, the applicant's plan appears to be problematic and should be researched further before approval by the City and recording of the final plat. The applicant may want to contact a professional civil engineer for assistance in designing the storm drainage system. Storm Water Quality: The City has agreed to enforce Surface Water Management (SWM) regulations established by the Unified Sewerage Agency (USA) (Resolution and Order No. 91 -47, as amended by R &O 91 -75) which require the construction of on -site water quality facilities. However, in cases where the size of the development is small, the R &O allows the payment of a fee in -lieu. Staff recommends the fee in -lieu option be approved for this application. Grading and Erosion Control: USA R &O 91 -47 also regulates erosion control to reduce the amount of sediment and other pollutants reaching the public storm and surface water system resulting from development, construction, grading, excavating, clearing, and any other activity which accelerates erosion. Per R &O 91 -47, the applicant is required to submit an erosion control plan for City review and approval prior to issuance of City permits. NOTICE OF DECISION REED /BIDEN - MLP 97 -0001 PAGE 7 • • Site Permit Required: The applicant is required to obtain a Site Permit from the Building Division to cover all on -site private utility installations (water, sewer, storm, etc.) and driveway construction. This permit shall be obtained prior to issuance of the permit from Engineering allowing work in the ROW. Existing Overhead Utility Lines: There are existing overhead utility lines along SW Alfred Street. Section 18.164.120 of the TMC requires all overhead utility lines adjacent to a development to be placed underground or, at the election of the developer, a fee in -lieu of undergrounding can be paid. If the fee in -lieu is proposed, it is equal to $27.50 per lineal foot of street frontage that contains the overhead lines. V. AGENCY AND OTHER STAFF COMMENTS The City of Tigard Building Division states that the applicant's comment on storm sounds acceptable, however, the topography shows this may not be practical. Require before recording the final plan, a plan that shows how they will accomplish this. City of Tigard Maintenance Services Division states that the 5 -foot easement may not be adequate if there are existing utilities. Storm and sanitary should not be beyond the curb line. This partition should have private systems. Storm across the street is piped. Do not allow run -off to go west onto 69th cul -de -sac as existing runoff is a problem. There is no ditch on SW Alfred Street that property could drain to. The storm pipe would have to be RCP, DI, or C- 900 -152 minimum. Tualatin Valley Fire and Rescue states that the following items shall be addressed and approved by the Fire Marshall's office: Fire apparatus access roads shall have an unobstructed width of not less than 20 feet (15 feet for not more than two dwelling units), and an unobstructed vertical clearance of not less than 13 feet 6 inches (UFC Sec. 902.2.2.1). Fire apparatus access roads shall be of an all- weather surface that is easily distinguishable from the surrounding area and is capable of supporting not less than 12,500 pounds point load (wheel load) and 50,000 pounds live load (gross vehicle weight) (UFC Sec. 902.2.2.2). Fire hydrants for single - family dwellings and duplexes shall be placed at each intersection. Intermediate fire hydrants are required in any portion of a structure that exceeds 500 feet from a hydrant as measured in an approved manner around the NOTICE OF DECISION REED /BIDEN - MLP 97 -0001 PAGE 8 • • outside of the structure and along approved fire apparatus access roadways. Placement of additional fire hydrants shall be as approved by the Chief (UFC Sec. 903.4.2.2). The minimum available fire flow for single - family dwellings and duplexes shall be 1,000 gallons per minute. If the structure(s) are 3,600 square feet or larger, the required fire flow shall be determined according to UFC Appendix Table A- III -A -1 (UFC Appendix III= A, Sec. 5). Approved fire apparatus access roadways and fire fighting water supplies shall be installed and operational prior to any other construction on the site or subdivision (UFC Sec. 8704). Tualatin Valley Water District states that there is a 4 -inch water line in the street. The existing water meter may need to be relocated (at developer's expense) if storm water or curb improvements encroach on the meter. Setting of new water meter for flag lot at the right -of -way adjacent to the flag driveway (existing) is required. Current cost of water service is $2445.00. Unified Sewerage Agency has the following comments: Sanitary Sewer: Each lot within the development shall be provided with a means of disposal for sanitary sewer. The means of disposal should be in accordance with . R &O 96-44 (Unified Sewerage Agency's Construction Design Standards, July 1996 edition). Engineer should verify public sanitary sewer is available to up -hill adjacent properties or extend service as required by R &O 96-44. Storm Sewer: Each lot within the development should have access to public storm sewer. Engineer should verify that public storm sewer is available to up -hill adjacent properties, or extend storm service as required by R &O 96-44. Hydraulic and hydrological analysis of storm conveyance system is necessary. If downstream storm conveyance does not have the capacity to convey the volume during a 25 -year, 24 -hour storm event, the applicant is responsible for mitigating the flow. The City of Tigard Police Department and Portland General Electric have reviewed the proposal and have offered no comments or objections. Alfred Street• Tigard, OR 97223 NARRATIVE General: This R4.5 -zoned 20,689 sq.ft. lot at 6770 S.W. Alfred Street in • Tigard is to be divided into two lots. The north lot with the existing residence will be 70 x 125 or sq.ft.; the south flag lot will be 85 x 118.4 or 10,064 sq.ft. plus _a 15 x 125 flag. The land slopes slightly to the west and to the north. All utilities are in place in the public right -of -way and can be accessed by a 5 -foot easement on the west side of the north lot. The front yard will be the north 20' of the new lot. We believe this partition request meets all code requirements and that all utilities are readily available. There are no deed restrictions. Code Section 18.100 -- Landscaping and Screening Two approved street trees will be planted on or about the northerly property line. Buffering of the flag is currently in place in the form of a hedge along the easterly property line. A new garage and driveway for the existing residence will provide additional buffering for the 15 -foot flag to the new lot. Code Section 18.106 - -Off- street Parking Two on -site parking spaces will be provided on the new site. Code Section 18.108 -- Access and Egress The new lot will have an owned 15 -foot wide flag as shown on the plat map. There is an existing 20 -foot wide blacktop driveway that overlaps the west line of the flag. This existing driveway will be used by both lot owners. Proper easement and maintenance agreements will be recorded against both properties. (Refer to Code Se tion 18.102) CITY OF TIGARD Pre - Application Conference Notes Page 5 of 10 Residential ApplicationiPlanning Department Section • • BUFFERING AND SCREENING In order to increase privacy and to either reduce or eliminate adverse noise or visual impacts between adjacent developments, especially between different land uses, the City requires landscaped buffer areas along certain site perimeters. Required buffer areas are described by the Code in terms of width. Buffer areas must be occupied by a mixture of deciduous and evergreen trees and shrubs and must also achieve a balance between vertical and horizontal plantings. Site obscuring screens or fences may also be required; these are often advisable even if not required by the Code. The required buffer areas may only be occupied by vegetation, fences, utilities, and walkways. Additional information on required buffer area materials and sizes may be found in the Community Development Code. Street trees must be placed either within the public right -of -way or on private property within six feet of the right -of -way boundary. Street trees must have a minimum caliper of at least two inches when measured four feet above grade. Street trees should be spaced 20 to 40 feet apart depending on the branching width of the proposed tree species at maturity. Further information on regulations affecting street trees may be obtained from the Planning Division. A minimum of one tree for eve seven parking spaces must be planted in and around all parking areas in order to provide a vegetative anopy effect. Landscaped parking areas shall include special design features which effectively screen th arking lot areas from view. These design features may include the use of landscaped berms, decorativ walls, and raised planters. For detailed information on design requirements for parking areas and acc ses. (Refer to Code Chapters 18.100, 18.106 and 18.108) TREE REMOVAL PLAN REQ IREMENTS A tree pan for the pla ting, removal and protection of trees prepared by a certified arborist shall be provided for any lot, p rcel or combination of lots or parcels for which a development application for a subdivision, major artition, site development review, planned development or conditional use is filed. Protection is pre rred over removal where possible. The tree plan shall include a following: Identification of the I cation, size and species of all existing trees including trees designated as significant by the c ty; Identification of a prog m to save existing trees or mitigate tree removal over 12 inches in caliper. The facilities shall be designed to remove 65 percent of the phosphorus contained in 100 percent of the storm water runoff generated from newly created impervious surfaces. The resolution contains a provision that would allow an applicant to pay a fee in -lieu of constructing an on -site facility provided specific criteria are met. The City will use discretion in determining whether or not the fee in -lieu will be offered. If the fee is allowed, it will be based upon the amount of new impervious surfaces created; for every 2,640 square feet, or portion thereof, the fee shall be $180.00. Preliminary sizing calculations for any proposed water quality facility shall be submitted with the development application. 1 Fes-- ReW TRAFFIC IMPACT FEES In 1990, Washington County adopted a county -wide Traffic Impact Fee (TIF) ordinance. The Traffic Impact Fee program collects fees from new development based on the development's projected impact upon the City's transportation system. The calculation of the TIF is based on the proposed use of the land, the size of the project, and a general use based fee category. The site is located at 6770 SW Alfred Street (WCTM 1S1 25DA, Tax Lot 6000). Findings: 1. Streets: This site lies adjacent to SW Alfred Street, east of SW 69th Avenue. Alfred Street is classified as a local residential street and is currently unimproved. However, the City completed a pavement overlay on this street during Summer, 1996. There is presently 50 feet of right -of -way (ROW) adjacent to this site, which is adequate for this type of street. No additional ROW dedications or improvements are required. There is an existing 20 -foot wide paved access that serves the existing house (north lot). This driveway will serve as a joint access to also serve the new flag lot (south lot). The applicant shall show on the face of the final plat a joint access easement to cover this driveway. 2. Water: This site lies within the Tualatin Valley Water District (TVWD) service area. TVWD provided comments related to this application and indicated that there is an existing 4 -inch public water line in Alfred Street that can serve this site. A new water meter will need to be set at the ROW to serve the new flag lot; the current cost for this service is $2,445.00. The applicant will need to contact TVWD to obtain the service (Stu Davis, 848- 3025). ENGINEERING COMMENTS MLP 97 -0001 Reed /Biden Partition PAGE 1 • 3. Sanitary Sewer: There is an existing 8 -inch public sewer line in SW Alfred Street that can serve this site. The existing house is already served by this sewer line. In order to serve the new house (south lot), the applicant will need to obtain a Street Opening Permit from the City to extend a new sewer service line from the main line in the street. 4. Storm Drainage: The natural topography of this site slopes to the southwest away from SW Alfred Street. There is a marginal roadside ditch along the south edge of the street adjacent to this site, but the ditch becomes undefined immediately west of the site. Storm water from Alfred Street presently flows down the street to SW 69th Avenue, where it then flows south on 69th Avenue to the end of the cul -de -sac. The City's Public Works Department indicates that there is a problem with excessive surface water runoff on the 69th Avenue cul -de -sac; additional surface water should not be directed toward that street. On the north side of Alfred Street, the roadside ditch is picked up in a piped system that directs storm water away from the 69th Avenue cul -de -sac. South of this site, there is a developed single - family subdivision, which may make off -site conveyance of storm water a challenge. The applicant's plan indicates a proposal to pipe the storm water from the new home (south lot) out to SW Alfred Street. However, based upon the existing problems downstream on 69th Avenue, this proposal can not be supported. In addition, the topography maps indicate that piping roof and foundation drains from the south lot to Alfred Street may be impossible because of the adverse grade. At best, the grade is flat, which would still present a problem in getting the drainage to flow to the north. In summary, the applicant's plan appears to be problematic and should be researched further before approval by the City and recordation of the final plat. The applicant may want to contact a professional civil engineer for assistance in designing the storm drainage system. 5. Storm Water Quality: The City has agreed to enforce Surface Water Management (SWM) regulations established by the Unified Sewerage Agency (USA) (Resolution and Order No. 91 -47, as amended by R &O 91 -75) which require the construction of on -site water quality facilities. However, in cases where the size of the development is small, the R &O allows the ENGINEERING COMMENTS MLP 97 -0001 Reed /Biden Partition PAGE 2 • • • payment of a fee in -lieu. Staff recommends the fee in -lieu option be approved for this application. 6. Grading and Erosion Control: USA R &O 91 -47 also regulates erosion control to reduce the amount of sediment and other pollutants reaching the public storm and surface water system resulting from development, construction, grading, excavating, clearing, and any other activity which accelerates erosion. Per R &O 91- 47, the applicant is required to submit an erosion control plan for City review and approval prior to issuance of City permits. 7. Existing Overhead Utility Lines: There are existing overhead utility lines along SW Alfred Street. Section 18.164.120 of the TMC requires all overhead utility lines adjacent to a development to be placed underground or, at the election of the developer, a fee in -lieu of undergrounding can be paid. If the fee in -lieu is proposed, it is equal to $ 27.50 per lineal foot of street frontage that contains the overhead lines. 8. Site Permit Required: The applicant is required to obtain a Site Permit from the Building Division to cover all on -site private utility installations (water, sewer, storm, etc.) and driveway construction. This permit shall be obtained prior to issuance of the permit from Engineering allowing work in the ROW. Recommendations: THE FOLLOWING CONDITIONS SHALL BE SATISFIED PRIOR TO APPROVAL OF THE FINAL PLAT: Note: Unless otherwise noted, the staff contact for the following conditions will be Brian Rager, Engineering Department (639- 4171). 1. Prior to approval of the final plat, a Street Opening Permit will be required for this project to cover the new sanitary sewer connection and any other work in the public right -of -way. The applicant will need to submit five (5) sets of the proposed public improvement plans for review and approval. NOTE: these plans are in addition to any drawings required by the Building Division and should only include information relevant to the public improvements. As a part of the public improvement plan submittal, the Engineering Department shall be provided with the name, address and telephone number of the individual or corporate entity who will be responsible for executing the compliance agreement and providing the financial assurance for the public improvements. 3. Prior to issuance of any building permits on this site, the applicant shall obtain a Site Permit from the Building Department to cover all grading for the lot, all on -site private utility installation (water, sewer, storm, etc.) and all driveway construction. NOTE: this permit is separate from any permit issued by the Engineering Department for work in the public right -of -way. 4. Any necessary off -site utility easements shall be the responsibility of the applicant to obtain and shall be submitted to and accepted by the City prior to construction. 5. The final plat shall show on its face a joint access easement to cover the common driveway that will serve both lots. 6. The applicant shall obtain a permit from the Tualatin Valley Water District for the proposed water connection prior to issuance of the City's public improvement permit. 7. Prior to approval of the final plat, the applicant shall submit a storm drainage plan for the new lot that indicates how the additional storm water runoff will be accommodated in light of the fact the system downstream of Alfred Street on 69th Avenue is presently overburdened. 8. The applicant shall either place the existing overhead utility lines along SW Alfred Street underground as a part of this project, or they shall pay the fee in -lieu of undergrounding. The fee shall be calculated by the frontage of the site that is parallel to the utility lines and will be $ 27.50 per lineal foot. If the fee option is chosen, it shall be paid prior to approval of the final plat. 9. Final Plat Application Submission Requirements: A. Three mylar copies of the partition plat prepared by a land surveyor licensed to practice in Oregon, and necessary data or narrative. B. The partition plat and data or narrative shall be drawn to the minimum standards set forth by the Oregon Revised Statutes (ORS 92.05), Washington County, and by the City of Tigard.
