Prior to approval of the final plat, a street opening permit will be required for this project to cover the proposed sanitary sewer, storm, and water service extensions to the new lots. The permit will also cover the installation of the new driveway apron. The applicant will need to submit five (5) sets of the proposed public improvement plans for review and approval. NOTE: These plans are in addition to any drawings required by the Building Division and should only include information relevant to the public improvements. • 2. As a part of the public improvement plan submittal, the Engineering Department shall be provided with the name, address, and telephone number of the individual or corporate entity who will be responsible for executing the compliance agreement and providing the financial assurance for the public improvements. 3. Prior to issuance of any building permits on this site, the applicant shall obtain a Site Permit from the Building Division to cover all grading for the lot(s), all on -site private utility installation (water, sewer, storm, etc.), and all driveway construction. NOTE: This permit is separate from any permit issued by the Engineering Department for work in the public right -of -way (ROW). 4. An agreement shall be executed by the applicant, on forms provided by the City, which waives the property owner's right to oppose or remonstrate against a future Local Improvement District formed to improve SW Watkins Avenue. 5. The final plat shall show on its face that there will be a joint access easement for the common driveway to serve Lots 1 and 2. 6. The applicant shall coordinate with the City's Water Department with regard to water services for the new lots. 7. The applicant shall provide separate private sanitary sewer laterals for Lots 1 and 2. To accomplish this without the need to make two (2) open cuts in SW Watkins Avenue, the applicant could extend one (1), six (6) -inch "Public Sewer Lateral ", as provided by USA's Design and Construction Standards, to the ROW line, then extend the two (2) private laterals from there, inside the five (5) -foot easement. NOTICE OF DECISION HEIDER/SAUBER - MLP 96 -0018 PAGE 2 • • 8. The applicant should provide a sewer service connection to the existing house on Lot 3. 9. The applicant shall either place the existing overhead utility lines along SW Watkins Avenue underground as a part of this project, or they shall pay the fee in -lieu of undergrounding. The fee shall be calculated by the frontage of the site that is parallel to the utility lines and will be $27.50 per lineal foot. If the fee option is chosen, it shall be paid prior to approval of the final plat. The estimated fee for this site, based on 100 feet of frontage, is $2,750.00. 10. Final Plat Application Submission Requirements: A. Three (3) mylar copies of the partition plat prepared by a land surveyor licensed to practice in Oregon, and necessary data or narrative; B. The partition plat and data or narrative shall be drawn to the minimum standards set forth by the Oregon Revised Statutes (ORS 92.05), Washington County, and by the City of Tigard; and C. The ROW dedication for SW Watkins Avenue shall be made on the partition plat. 11. The final plat shall show on its face that there will be a seven and one -half (7'h)- foot wide public pedestrian easement. 12. Plans approved by Tualatin Valley Fire and Rescue for available fire flow. PRIOR TO; THE :ISSUANCE:OF`A BUILDING PERMIT:THE: FOLLOWING 13. Prior to issuance of building permits, the applicant shall provide the Engineering Department with a recorded mylar copy of the subdivision /partition plat. 14. III. BACKGROUND INFORMATION Property History: No development applications were found to have been filed with the City. NOTICE OF DECISION HEIDER/SAUBER - MLP 96 -0018 PAGE 3 • • Site Information and Proposal Description: The property is currently developed with a single - family residence. The applicant is proposing to divide one (1) parcel of approximately 30,056 square feet into three (3) parcels of approximately 12,551, 7,654, and 7,515 square feet. IV. APPLICABLE REVIEW CRITERIA AND FINDINGS - MINOR LAND PARTITION Section 18.162.040 contains the following general approval criteria for a Minor Land Partition: 1. The proposal conforms with the City's Comprehensive Plan; 2. The proposed partition complies with all statutory and ordinance requirements and regulations; 3. Adequate public facilities are available to serve the proposal; 4. All proposed lots conform to the size and dimensional requirements of this title; and 5. All proposed improvements meet City and applicable agency standards (Ord. 89 -06; Ord. 83 -52). The proposal conforms with the City's Comprehensive Plan in that the newly created lots will continue to allow for residential development. This proposal, therefore, is not in conflict with the Low Density Plan designation. This proposed partition complies with all statutory and ordinance requirements and regulations as demonstrated both by the analysis presented within this administrative decision, and by this application and review process. Adequate public facilities shall be available to serve the proposal. Section 18.162.050 contains the following special provisions for lots created through the Partition Process: 1. Lot Width: The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district. 2. Lot Area: The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the accessway may not be included in the lot area calculation. 3. Lot Frontage: Each lot created through the partition process shall front a public right -of -way by at least 15 feet, or have a legally recorded minimum 15 foot wide access easement. NOTICE OF DECISION HEIDER/SAUBER - MLP 96 -0018 PAGE 4 0 • 4. Setbacks: Setbacks shall be as required by the applicable zoning district. 5. Front Yard Determination for Flag Lot: When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. 6. Screening on Flag Lots: A screen shall be provided along the property line of a lot of record where the paved drive in an accessway is located within ten feet of an abutting lot in accordance with Sections 18.100.080 and 18.100.090. Screening may also be required to maintain privacy for abutting Tots and to provide usable outdoor recreation areas for proposed development. 7. Fire Protection: The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire fighting capabilities. 8. Reciprocal Easements: Where a common drive is to be provided to serve more than one (1) lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. 9. Accessway: Any accessway shall comply with the standards set forth in Chapter 18.108; Access, Egress, and Circulation. 10. Floodplain: Where landfill and/or development is allowed within or adjacent to the one - hundred -year floodplain, the City shall require the dedication of sufficient open land area for greenway adjoining and within the floodplain. This area shall include portions at a suitable elevation for the construction of a pedestrian /bicycle pathway with the floodplain in accordance with the adopted pedestrian /bicycle pathway plan. Criteria 1 is satisfied as the proposed lot widths are approximately 50, 50, and 100 feet respectively, exceeding the minimum 50 -foot lot width requirement in the R-4.5 zone. Criteria 2 is satisfied as this partition would create Tots of approximately 7,654, 7,515 and 12,551 square feet, exceeding the 7,500 square foot minimum lot size requirement. Criteria 3 is satisfied as lot three (3) has 100 feet of frontage on SW Watkins Avenue, lot two (2) has 24 -feet of frontage on SW Pathfinder Court, and lot one (1) has a 16 -foot access easement to SW Pathfinder Court. The required setbacks in the R-4.5 zone are as follows: front yard -20 feet; side yard -5 feet; rear yard -15 feet; and garage -20 feet. As indicated on the site plan, the existing single - family home on parcel one (1) complies with the setbacks, thereby, satisfying Criteria 4. Compliance with setbacks on the newly created parcels will be reviewed when they are built upon. Criteria 5 and Criteria 6 are not applicable as none of the Tots are flag lots. Fire hydrants shall be consistent with Uniform Fire Code standards, thereby, satisfying Criteria 7. Criteria 8 shall be satisfied as a joint use and maintenance agreement shall be provided for the common driveway. Criteria 9 shall be satisfied as the current residence will NOTICE OF DECISION HEIDER/SAUBER - MLP 96 -0018 PAGE 5 . • continue to use the existing driveway and a driveway shall be provided for the new lots when they are built upon. Criteria 10 is not applicable as none of the parcels are within the floodplain. Section 18.88.010 (Solar Access) states that all newly created Tots within the City of Tigard shall promote the use of renewable energy sources by providing for improved access to sunlight for residential dwellings. A lot meets the basic requirement if it has a north -south dimension of 90 feet or more and has a front lot line that is oriented within 30 degrees of a true east -west axis. Section 18.88.040(E), however, allows the approval authority to exempt new lots from the solar access standard in certain cases, including situations where existing ROW prevents lots from being oriented for solar access. The existing orientation of SW Watkins Avenue, as well as SW Pathfinder Way, and the configuration of the subject site prevents the proposed parcels from being orientated for solar access. Therefore, the new parcels are except from the solar access standard. It should be noted that new structures must comply with the Solar Balance Point Ordinance even if a lot has been exempted from the basic solar requirement. Section 18.164.040(B)(1) (Block Design) states that the perimeter of blocks formed by streets shall not exceed 1,800 feet measured along the right -of -way line. Section 18.164.040(B)(2) states that when block lengths greater than 600 feet are permitted, pedestrian /bikeways shall be provided through the block. Currently, there is no street connection along the entire length of SW Watkins Avenue and the block perimeter encompassing SW Watkins Avenue and SW Pathfinder is well in excess of 1,800 feet. A 10 -foot wide pedestrian easement connects SW Pathfinder Way and SW Pathfinder Court. This connection also provides access with a City owned open space /greenway area. There is an existing seven and one -half (7'/2) -foot wide pedestrian easement along the southern property line of the adjoining tax lots 7100, 7200, and 7300. A pedestrian easement along the northern properly line of the subject site would create a block perimeter of approximately 800 feet and would provide the only pedestrian connection between SW Watkins Avenue and SW Pathfinder Court. This easement and location would ultimately make for a connection to the greenway area. Therefore, the applicant shall be required to provide a seven and one -half (71/2 ) -foot wide public, pedestrian easement along the northern property line to provide a pedestrian connection in accordance with this section. Within this easement, the pathway will be a four (4) -foot wide paved path along the property line. The total width of the constructed pathway will be eight (8) feet, with the remaining four (4) -feet of width constructed within the easement on the adjacent properties. The applicant is not responsible for the construction of the pedestrian pathway, only the granting of an easement is required at this time. Construction of the pathway would be undertaken by the City at some future date. NOTICE OF DECISION HEIDER/SAUBER - MLP 96 -0018 PAGE 6 • • Impact Study: Section 18.32.050.B.5 states that an application shall include an impact study that quantifies the effect of the development on public facilities and services. In situations where the Community Development Code requires the dedication of real property interests, the applicant shall either specifically concur with the dedication requirement or provide evidence which supports the conclusion that the real property dedication requirement is not roughly proportional to the projected impacts of the development. The applicant provided with their application submittal an, "agreement to development improvements and conditions in -lieu of providing impact study ". With this agreement, the applicant agrees that the value of the real property interests required to be transferred are "roughly proportional" to the impacts of the proposed development upon public facilities and systems and as such, agree to comply fully with real property requirements and waive the right to pursue any legal challenge to those conditions. Rough Proportionality: Section 18.32.250.E.2 states that when a condition of approval requires the transfer to the public of an interest in real property, the approval authority shall adopt findings which support the conclusion that the interest in real property to be transferred is roughly proportional to the impact the proposed development will have on the public. When the two (2) proposed lots are built upon, each lot will be assessed $1,690.00 in accordance with the Washington County Traffic Impact Fee (TIF) program. Ba35 sed on a transportation impact study prepared for Resolution 95 -61, TIF's are expected to recapture 32 percent of the traffic impact of new development on the collector an arterial street system. The two (2) lots will be required to pay TIF's of approximately $3,380.00. Based upon the estimate that total TIF fees cover 32 percent of the impact on major street improvements citywide, a fee that would cover 100 percent of this projects traffic impact is $10,562.00. The unmitigated impact is therefore, $7,182.00. Based on past City of Tigard land acquisitions, property can be valued at $2.50 per square foot. The total area comprised of the five (5) -foot street dedication and seven and one -half (71/2) -foot wide easement is approximately 2,525 square feet. Using a value of $2.50 per square foot, the value of this area is approximately $6,312.00. Since the unmitigated impact is Tess than the value of the area, the conditions are "roughly proportional" to the impacts of the development. Sections 18.164.030 (Streets), 18.164.090 (Sanitary Sewer), and 18.164.100 (Storm Drains) have been addressed and are satisfied as specified below: Streets This site lies adjacent to SW Watkins Avenue and SW Pathfinder Court. Southwest Watkins Avenue is classified as a minor collector street on the City's Transportation Plan. The ROW required for a minor collector street is 60 feet. At present, there is only 25 feet of ROW from centerline. The applicant proposes to dedicate an additional five (5) feet of ROW as a part of this partition to meet the standard. Southwest Pathfinder Court is a local residential street and is fully improved in this area. The applicant is proposing to obtain access for the two (2) new lots via Pathfinder Court. A new joint NOTICE OF DECISION HEIDER/SAUBER - MLP 96 -0018 PAGE 7 • • use residential driveway will be constructed. No additional ROW dedications or improvements to Pathfinder Court will be required. Southwest Watkins Avenue is presently paved, but not fully improved adjacent to this site. Because the addition of two (2) new lots will not have a significant impact on the capacity of SW Watkins Avenue, Staff does not believe improvements are warranted at this time. Rather, Staff recommends the applicant be required to enter into an agreement that would obligate them to participate in the future widening of the street when it occurs. This agreement shall be executed prior to approval of the final plat. Water: There is an existing public water line in SW Pathfinder Court that can serve the new lots. The applicant will need to coordinate with the Tigard Water Department for the new connections. Sanitary Sewer: The only option for sewer service to the new lots is from an existing sewer line in SW Watkins Avenue. Because of the width of the existing house, there is limited space available between the house and the side property lines for new sewer service lines. The applicant's plan proposes one (1) private sewer lateral that would extend to the rear of Lot 3, then split into two (2) services for Lots 2 and 1. However, the USA Design and Construction Standards for Sanitary Sewers does not allow this type of private sewer line that would serve more than one (1) lot. It is possible to lay two (2) sanitary sewer laterals side -by -side within a five (5) -foot easement according to the Building Division. Staff recommends the applicant provide two (2) separate laterals for the Tots. In order to minimize the open cutting of the street, the applicant could tap the main line once and extend a six (6) -inch "Public Sewer Lateral" to the ROW line, as specified by USA's design manual, Drawing No. 10 -CH9. At the ROW line, a cleanout would be installed, then the two (2) private sewer laterals would be extended from there. The existing house on Lot 3 is not presently connected to public sewer. As a part of this partition, the applicant should provide a sewer connection to the existing house. Storm Drainage: Storm drainage for the new lots will be directed toward Pathfinder Court. The applicant proposes to install roof drain lines that will be connected to street curb weep holes, which is acceptable. Storm Water Quality: The City has agreed to enforce Surface Water Management (SWM) regulations established by the Unified Sewerage Agency (USA) (Resolution and Order No. 91 -47, as amended by R &O 91 -75) which requires the construction of on -site water quality facilities. However, in cases where the size of the development is small, and installation of a facility would preclude effective development of the site, then a facility is not required. In this case, Staff recommends the applicant not install a facility, but pay NOTICE OF DECISION HEIDER/SAUBER - MLP 96 -0018 PAGE 8 • • a fee in -lieu as provided by the USA R &O. The fee is payable at the time a building permit is obtained for each lot and is $180.00 per lot. Grading and Erosion Control: USA R &O 91-47 also regulates erosion control to reduce the amount of sediment and other pollutants reaching the public storm and surface water system resulting from development, construction, grading, excavating, clearing, and any other activity which accelerates erosion. Per R &O 91 -47, the applicant is required to submit an erosion control plan for City review and approval prior to issuance of City permits. Existing Overhead Utility Lines: There are existing overhead utility lines along SW Watkins Avenue. Section 18.164.120 of the TMC requires all overhead utility lines adjacent to a development to be placed underground or, at the election of the developer, a fee in -lieu of undergrounding can be paid. If the fee in -lieu is proposed, it is equal to $27.50 per lineal foot of street frontage that contains the overhead lines. Site Permit Required: The developer will be required to obtain a Site Permit from the Building Division to cover all on -site private utility installations (water, sewer, storm, etc.), and driveway construction. This permit is separate from the permit obtained from the Engineering Department for connection to public main lines and work in the ROW. V. AGENCY AND OTHER STAFF COMMENTS The City of Tigard Building Division states that the existing residence should be connected to sanitary sewer. There cannot be more than one (1) house connected to sanitary sewer via the private line. Line /easement needs to be public or provide multiple, private lines. Tualatin Valley Fire and Rescue states that the following issues have to be addressed: 1.) Fire hydrants for single - family dwellings and duplexes shall be placed at each intersection. Intermediate fire hydrants are required in any portion of a structure which exceeds 500 feet from a hydrant, as measured in an approved manner around the outside of the structure and along approved fire apparatus access roadways. Placement of additional fire hydrants shall be as approved by the Chief. (UFC Sec. 903.4.2.2). 2.) Approved fire apparatus access roadways and fire fighting water supplies shall be installed and operational prior to any other construction on the site or subdivision. (UFC Sec. 8704). NOTICE OF DECISION HEIDER/SAUBER - MLP 96 -0018 PAGE 9 • • Unified Sewerage Agency (USA) has provided the following comments: Sanitary Sewer: Each lot within the development shall be provided with a means of disposal for sanitary sewer. The means of disposal should be in accordance with R &O 96 -44 (Unified Sewerage Agency's Construction Design Handbook, July 1996 edition). Engineer should verify public sanitary sewer is available to up -hill adjacent properties or extend service as required by R &O 96 -44. The 5.0' private sewer easement should be a 15.0' public easement and shall not be encroached upon by any structure. Storm Sewer: Each lot within the development should have access to public storm sewer. Engineer should verify that public storm sewer is available to up -hill properties, or extend storm service as required by R &O 96 -44. Hydraulic and hydrological analysis of storm conveyance system is necessary. If downstream storm conveyance does not have the capacity to convey the volume during the 25 -year, 24 -hour storm event, the application is responsible for mitigating the flow. Water Quality: Developer should provide a water quality facility to treat the new impervious surface being constructed as part of this development. GTE states that both new Tots will be required to provide trenches which extend out to SW Watkins Avenue for telephone service. There is no access on SW Pathfinder Court. The City of Tigard Maintenance Services Division, City of Tigard Police Department, City of Tigard Water Department, and Portland General Electric have reviewed the proposal and have offered no comments or objections. Re• uired buffer areas are described by the Code in terms of width. Buffer areas must be occupied by a mi ure of deciduous and evergreen trees and shrubs and must also achieve a balance between vertical - d horizontal plantings. Site obscuring screens or fences may also be required; these are often advisable -ven if not required by the Code. The required buffer areas may • only be occupied by vegetation, fences, tilities, and walkways. The impact study shall quantify the effect of the development on public facilities and services. The study shall address, at a minimum, the transportation system, including bikeways, the drainage system, the parks system, the water system, the sewer system and the noise impacts of the development. For each public facility system and type of impact, the study shall propose improvements necessary to meet City standards, and to minimize the impact of the development on the public at large, public facilities systems, and affected private property users. In situations where the Community Development Code requires the dedication of real property interests, the applicant shall either specifically concur with the dedication requirement, or provide evidence which supports the conclusion that the real property dedication requirement is not roughly proportional to the projected impacts of the development. The facilities shall be designed to remove 65 percent of the phosphorus contained in 100 percent of the storm water runoff generated from newly created impervious surfaces. The resolution contains a provision that would allow an applicant to pay a fee in -lieu of constructing an on -site facility provided specific criteria are met. The City will use discretion in determining whether or not the fee in -lieu will be offered. If the fee is allowed, it will be based upon the amount of new impervious surfaces created; for every 2,640 square feet, or portion thereof, the fee shall be $180.00. Preliminary sizing calculations for any proposed water quality facility shall be submitted with the development application. The Traffic Impact Fee program collects fees from new development based on the development's projected impact upon the City's transportation system. Sincerely, • MEMORANDUM CITY OF TIGARD, OREGON DATE: January 28, 1997 TO: Will D'Andrea, Planning Division FROM: Brian Rager, Development Review Engineer ER-- RE: MLP 96 -0018, Heider /Sauber Partition Description: This application is to divide one parcel of approximately 30,056 square feet (sf) into three parcels of approximately 12,551, 7,654 and 7,515 sf. The site is located at 12735 SW Watkins Avenue (WCTM 2S1 2BC, Tax Lot 2200). Findings: 1. Streets: This site lies adjacent to SW Watkins Avenue and SW Pathfinder Court. SW Watkins Avenue is classified as a minor collector street on the City's Transportation Plan. The right -of -way (ROW) required for a minor collector street is 60 feet. At present, there is only 25 feet of ROW from centerline. The applicant proposes to dedicate an additional 5 feet of ROW as a part of this partition to meet the standard. SW Pathfinder Court is a local residential street and is fully improved in this area. The applicant is proposing to obtain access for the two new Tots via Pathfinder Court. A new joint use residential driveway will be constructed. No additional ROW dedications or improvements to Pathfinder Court will be required. SW Watkins Avenue is presently paved, but not fully improved adjacent to this site. Because the addition of two new lots will not have a significant impact on the capacity of Watkins Avenue, Staff does not believe improvements are warranted at this time. Rather, Staff recommends the applicant be required to enter into an agreement that would obligate them to participate in the future widening of the street when it occurs. This agreement shall be executed prior to approval of the final plat. ENGINEERING COMMENTS MLP 96 -0018 Heider /Sauber Partition PAGE 1 • 2. Water: There is an existing public water line in SW Pathfinder Court that can serve the new lots. The applicant will need to coordinate with the Tigard Water Department for the new connections. 3. Sanitary Sewer: The only option for sewer service to the new lots is from an existing sewer line in SW Watkins Avenue. Because of the width of the existing house, there is limited space available between the house and the side property lines for new sewer service lines. The applicant's plan proposes one private sewer lateral that would extend to the rear of Lot 3, then split into two services for Lots 2 and 1. However, the USA Design and Construction Standards for Sanitary Sewers does not allow this type of private sewer line that would serve more than one lot. It is possible to lay two sanitary sewer laterals side -by -side within a 5 -foot easement according to the Building Division. Staff recommends the applicant provide two separate laterals for the lots. In order to minimize the open cutting of the street, the applicant could tap the main line once and extend a 6 -inch "Public Sewer Lateral" to the ROW line, as specified by USA's design manual, Drawing No. 10 -CH9. At the ROW line, a cleanout would be installed, then the two private sewer laterals would be extended from there. The existing house on Lot 3 is not presently connected to public sewer. As a part of this partition, the applicant should provide a sewer connection to the existing house. 4. Storm Drainage: Storm drainage for the new lots will be directed toward Pathfinder Court. The applicant proposes to install roof drain lines that will be connected to street curb weep holes, which is acceptable. 5. Storm Water Quality: The City has agreed to enforce Surface Water Management (SWM) regulations established by the Unified Sewerage Agency (USA) (Resolution and Order No. 91 -47, as amended by R &O 91 -75) which require the construction of on -site water quality facilities. However, in cases where the size of the development is small, and installation of a facility would preclude effective development of the site, then a facility is not required. In this case, Staff recommends the applicant not install a ENGINEERING COMMENTS MLP 96 -0018 Heider /Sauber Partition PAGE 2 . • facility, but pay a fee in -lieu as provided by the USA R &O. The fee is payable at the time a building permit is obtained for each lot and is $ 180.00 per lot. 6. Grading and Erosion Control: USA R &O 91 -47 also regulates erosion control to reduce the amount of sediment and other pollutants reaching the public storm and surface water system resulting from development, construction, grading, excavating, clearing, and any other activity which accelerates erosion. Per R &O 91- 47, the applicant is required to submit an erosion control plan for City review and approval prior to issuance of City permits. 7. Existing Overhead Utility Lines: There are existing overhead utility lines along SW Watkins Avenue. Section 18.164.120 of the TMC requires all overhead utility lines adjacent to a development to be placed underground or, at the election of the developer, a fee in -lieu of undergrounding can be paid. If the fee in -lieu is proposed, it is equal to $ 27.50 per lineal foot of street frontage that contains the overhead lines. 8. Site Permit Required: The applicant is required to obtain a Site Permit from the Building Division to cover all on -site private utility installations (water, sewer, storm, etc.) and driveway construction. This permit shall be obtained prior to issuance of the permit from Engineering allowing work in the ROW. Recommendations: THE FOLLOWING CONDITIONS SHALL BE SATISFIED PRIOR TO APPROVAL OF THE FINAL PLAT: Note: Unless otherwise noted, the staff contact for the following conditions will be Brian Rager, Engineering Department (639- 4171). 1. Prior to approval of the final plat, a Street Opening Permit will be required for this project to cover the proposed sanitary sewer, storm and water service extensions to the new Tots. The permit will also cover the installation of the new driveway apron. The applicant will need to submit five (5) sets of the proposed public improvement plans for review and approval. Prior to issuance of any building permits on this site, the applicant shall obtain a Site Permit from the Building Department to cover all grading for the lot(s), all on -site private utility installation (water, sewer, storm, etc.) and all driveway construction. NOTE: this permit is separate from any permit issued by the Engineering Department for work in the public right -of -way. 4. An agreement shall be executed by the applicant, on forms provided by the City, which waives the property owner's right to oppose or remonstrate against a future Local Improvement District formed to improve SW Watkins Avenue. 5. The final plat shall show on its face that there will be a joint access easement for the common driveway to serve Lots 1 and 2. 6. The applicant shall coordinate with the City's Water Department with regard to water services for the new lots. 7. The applicant shall provide separate private sanitary sewer laterals for Lots 1 and 2. To accomplish this without the need to make two open cuts in Watkins Avenue, the applicant could extend one 6 -inch "Public Sewer Lateral ", as provided by USA's Design and Construction Standards, to the ROW line, then extend the two private laterals from there inside the 5 -foot easement. 8. The applicant should provide a sewer service connection to the existing house on Lot 3. 9. The applicant shall either place the existing overhead utility lines along SW Watkins Avenue underground as a part of this project, or they shall pay the fee in -lieu of undergrounding. The fee shall be calculated by the frontage of the site that is parallel to the utility lines and will be $ 27.50 per lineal foot. If the fee option is chosen, it shall be paid prior to approval of the final plat. The estimated fee for this site, based on 100 feet of frontage, is $ 2,750.00.
