Prior to issuance of a building permit, a Street Opening Permit will be required for this project to cover the proposed connections to the public water, sewer, and storm drain lines in SW 112th Avenue. The permit will also cover the new driveway apron construction in SW 112th Avenue. The applicant will need to submit five (5) sets of the proposed public improvement plans for review and approval. NOTE: these plans are in addition to any drawings required by the Building Division and should only include information relevant to the public improvements. This permit shall be obtained by the applicant prior to approval of the final plat. 2. As a part of the public improvement plan submittal, the Engineering Department shall be provided with the name, address and telephone number of the individual or corporate entity who will be responsible for executing the compliance agreement and providing the financial assurance for the public improvements. 3. The applicant shall provide proof of an access easement over the adjacent parcel (Lot 4 of Torland Estates). The easement shall be for joint access for Parcels 1, 2, and 3. 4. Any connection to public water lines shall be shown on the proposed public improvement construction drawings and shall be reviewed and approved by the City's Water Department. 5. The applicant will be allowed to extend a "public service lateral ", as shown in the USA construction manual (detail 101 -CH9) but shall locate the cleanout at the back of the ROW line. From the cleanout, two separate sewer laterals shall extend to serve the two new lots. The portion of the public service lateral from the public main line to the Right -of -way (ROW) and cleanout will be inspected by the Engineering Department. The two laterals from there will be inspected by the Building Division. 6. Final Plat Application Submission Requirements: A. Three mylar copies of the partition plat prepared by a land surveyor licensed to practice in Oregon, and necessary data or narrative. NOTICE OF DECISION KENYON - MLP 96 -0016 PAGE 2 • • B. The partition plat and data or narrative shall be drawn to the minimum • standards set forth by the Oregon Revised Statutes (ORS 92.05), Washington County, and by the City of Tigard. C. The plat shall indicate on its face an additional ROW dedication in SW North Dakota Street to provide 30 feet from centerline. 7. The applicant shall provide a copy of the recorded street vacation documents. 8. Revised plan which demonstrates that all storm water shall drain to the public storm system. Prior to issuance of the building permit for Parcels 2 and 3, the applicant shall pay the standard water quality fee of $180 per lot. 13. Prior to issuance of any building permits on this site, the applicant shall obtain a Site Permit from the Building Division to cover all grading for the lot(s), all on -site private utility installation (water, sewer, storm, etc.) and all driveway construction. PROCESS: AND APPEAL:SECTION.BELOW. III. BACKGROUND INFORMATION Property History: Parcel 1 was created in 1994 through the approval of a Minor Land Partition (MLP 94- 0005). No other development applications were found to have been filed with the City. NOTICE OF DECISION KENYON - MLP 96 -0016 PAGE 3 • i • Site Information and Proposal Description: The property is currently developed with a single - family residence. The applicant is proposing to divide one (1) parcel of approximately 40,946 square feet into three (3) parcels of approximately 16,000, 7,722, and 8,067 square feet. IV. APPLICABLE REVIEW CRITERIA AND FINDINGS - MINOR LAND PARTITION Section 18.162.040 contains the following general approval criteria for a Minor Land Partition: 1. The proposal conforms with the City's Comprehensive Plan; 2. The proposed partition complies with all statutory and ordinance requirements and regulations; 3. Adequate public facilities are available to serve the proposal; 4. All proposed lots conform to the size and dimensional requirements of this title; and 5. All proposed improvements meet City and applicable agency standards (Ord. 89 -06; Ord. 83 -52). The proposal conforms with the City's Comprehensive Plan in that the newly created lots will continue to allow for residential development. This proposal, therefore, is not in conflict with the Low Density Plan designation. This proposed partition complies with all statutory and ordinance requirements and regulations as demonstrated both by the analysis presented within this administrative decision, and by this application and review process. Adequate public facilities shall be available to serve the proposal. Section 18.162.050 contains the following special provisions for lots created through the Partition Process: 1. Lot Width: The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district. 2. Lot Area: The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the accessway may not be included in the lot area calculation. 3. Lot Frontage: Each lot created through the partition process shall front a public right -of -way by at least 15 feet, or have a legally recorded minimum 15 foot wide access easement. 4. Setbacks: Setbacks shall be as required by the applicable zoning district. NOTICE OF DECISION KENYON - MLP 96 -0016 PAGE 4 • 5. Front Yard Determination for Flag Lot: When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. 6. Screening on Flag Lots: A screen shall be provided along the property line of a lot of record where the paved drive in an accessway is located within ten feet of an abutting lot in accordance with Sections 18.100.080 and 18.100.090. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. 7. Fire Protection: The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire fighting capabilities. 8. Reciprocal Easements: Where a common drive is to be provided to serve more than one (1) lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. 9. Accessway: Any accessway shall comply with the standards set forth in Chapter 18.108; Access, Egress, and Circulation. 10. Floodplain: Where landfill and /or development is allowed within or adjacent to the one - hundred -year floodplain, the City shall require the dedication of sufficient open land area for greenway adjoining and within the floodplain. This area shall include portions at a suitable elevation for the construction of a pedestrian /bicycle pathway with the floodplain in accordance with the adopted pedestrian /bicycle pathway plan. Criteria 1 is satisfied as the proposed lot widths are approximately 109, 53, and 56 feet respectively, exceeding the minimum 50 -foot lot width requirement in the R-4.5 zone. Criteria 2 is satisfied as this partition would create lots of approximately 16,000, 8,067 and 7,722 square feet, exceeding the 7,500 square foot minimum lot size requirement. Criteria 3 is satisfied as parcel one (1) has 25 feet of frontage on SW North Dakota Street and parcels two (2) and three (3) have a 15 -foot access easement to SW 112th Street. The required setbacks in the R-4.5 zone are as follows: front yard -20 feet; side yard -5 feet; rear yard -15 feet; and garage -20 feet. As indicated on the site plan, the existing single - family home on parcel one (1) complies with the setbacks, thereby, satisfying Criteria 4. Compliance with setbacks on the newly created parcels will be reviewed when they are built upon. NOTICE OF DECISION KENYON - MLP 96 -0016 PAGE 5 • Criteria 5 shall be satisfied as front yard determination shall be reviewed during the • building permit process when the properties are built upon. Criteria 6 shall be satisfied as the applicant shall submit a revised plan which provides screening along lot 3, in accordance with section 18.100.080 and 18.100.090. Fire hydrants shall be consistent with Uniform Fire Code standards, thereby, satisfying Criteria 7. Criteria 8 shall be satisfied as a joint use and maintenance agreement shall be provided for the common driveway. The City of Tigard has approved the vacation of SW Torland Court public right - of -way on the adjoining subdivision Torland Estates (Ordinance 96 -37). The ordinance will become final and effective on (November 22, 1996). Lot 4 of Torland Estates will be granting the proposed lots access to SW 112th Avenue through an access easement within that portion of the vacated right -of -way. Criteria 9 shall be satisfied as the current residence will continue to use the existing driveway and a driveway shall be provided for the new lots when they are built upon. Criteria 10 is not applicable as none of the parcels are within the floodplain. Section 18.88.010 (Solar Access) states that all newly created lots within the City of Tigard shall promote the use of renewable energy sources by providing for improved access to sunlight for residential dwellings. A lot meets the basic requirement if it has a north -south dimension of 90 feet or more and has a front lot line that is oriented within 30 degrees of a true east -west axis. As proposed, the newly created lots will meet the basic requirement. Sections 18.164.030 (Streets), 18.164.090 (Sanitary Sewer), and 18.164.100 (Storm Drains) have been addressed and are satisfied as specified below: Street This site lies adjacent to SW North Dakota Street and an unimproved piece of right -of- way (ROW) for an extension of SW Torland Street. North Dakota is classified as a minor collector street to be built within a 60 -foot ROW. At present, there is only 20 feet of ROW south of the street centerline. The applicant, as a part of this partition, proposes to dedicate an additional 10 feet of ROW to provide the required 30 feet from centerline. The unimproved ROW for SW Torland Street was deemed unusable by the City Council and was approved to be vacated on October 22, 1996. The applicant for this partition was also the applicant for the ROW vacation. The applicant owns Lot 4 of Torland Estates (immediately east of the subject site and abutting the southern edge of the ROW to be vacated) and proposes to grant an access and utility easement across the vacated ROW area to serve the new lots. A joint driveway will be installed to serve all three parcels. Staff concurs with the proposed site plan provided by the applicant. NOTICE OF DECISION KENYON - MLP 96 -0016 PAGE 6 . • Water: The applicant will serve the new lots from an existing 6 -inch water line in SW 112th Avenue at Torland Street. Any connection to this water line shall be reviewed and approved by the City Water Department. Sanitary Sewer: Sanitary sewer service will be provided from an existing 8 -inch public sewer line in SW 112th Avenue. The applicant intends to run a single service to serve the two new lots. As per USA's 1996 construction design standards, two homes can not share a single sewer lateral. However, a single sewer service can be extended to the ROW line to serve two separate parcels provided a cleanout is placed at the ROW line. The applicant's plan contains a detail of a "public service lateral" as shown in the USA manual, but will need to revise the plan slightly to locate the cleanout at the back of the ROW line. From the cleanout location, two separate laterals should extend to reach the two new houses. • Storm Drainage: Storm water from the two new lots will be directed to a proposed storm drain lateral to be extended from the public main line in SW 112th Avenue. Storm Water Quality: The City has agreed to enforce Surface Water Management (SWM) regulations established by the Unified Sewerage Agency (USA) (Resolution and Order No. 91 -47, as amended by R &O 91 -75) which require the construction of on -site water quality facilities. However, in cases such as minor land partitions, a facility is impractical and a fee in -lieu is required. The applicant shall pay the standard fee in -lieu of $ 180 per lot for the two new lots. This fee is payable at issuance of the building permits for the lots. Grading and Erosion Control: USA R &O 91 -47 also regulates erosion control to reduce the amount of sediment and other pollutants reaching the public storm and surface water system resulting from development, construction, grading, excavating, clearing, and any other activity which accelerates erosion. Per R &O 91 -47, the applicant is required to submit an erosion control plan for City review and approval prior to issuance of City permits. NOTICE OF DECISION KENYON - MLP 96 -0016 PAGE 7 • • Site Permit Required: The developer will be required to obtain a Site Permit from the Building Division to cover all on -site private utility installations (water, sewer, storm, etc.) and driveway construction. This permit is separate from the permit obtained from the Engineering Department for connection to public main lines and work in the ROW. V. AGENCY AND OTHER STAFF COMMENTS The City of Tigard Building Division states that there is not enough information to know if parcels 2 and 3 can drain to the storm system they are proposing. A condition shall be necessary which states that "all storm water shall drain to the public storm system ". Tualatin Valley Fire and Rescue states that the minimum available fire flow for single - family dwellings and duplexes shall be 1,000 gallons per minute. If the structure(s) are 3,600 square feet or larger, the required fire flow shall be determined according to UFC Appendix Table A- III -A -1. (UFC Appendix III -A, Sec. 5). Where fire apparatus access roadways are not of sufficient width to accommodate parked vehicles, "No Parking" signs shall be installed on one or both sides of the roadway and in turnarounds as needed. (UFC Sec. 902.2.4). Signs shall read "NO PARKING - FIRE LANE - TOW AWAY ZONE, ORS 98.810" and shall be installed with a clear space above ground level of 7 feet. Signs shall be 12 inches wide by 18 inches high and shall have black or red letters and border on a white background. (UFC Sec. 901.4.5.(1)(2) & (3)). The City of Tigard Maintenance Services Division, City of Tigard Police Department, City of Tigard Water Department, GTE and Portland General Electric have reviewed the proposal and have offered no comments or objections. The site is located at 11202 SW North Dakota Street, WCTM 1S1 34DB, Tax Lot 6200. Findings: 1. Streets: This site lies adjacent to SW North Dakota Street and an unimproved piece of right -of -way (ROW) for an extension of SW Torland Street. North Dakota is classified as a minor collector street to be built within a 60 -foot ROW. At present, there is only 20 feet of ROW south of the street centerline. The applicant, as a part of this partition, proposes to dedicate an additional 10 feet of ROW to provide the required 30 feet from centerline. The unimproved ROW for SW Torland Street was deemed unusable by the City Council and was approved to be vacated on October 22, 1996. The applicant for this partition was also the applicant for the ROW vacation. The applicant owns Lot 4 of Torland Estates (immediately east of the subject site and abutting the southern edge of the ROW to be vacated) and proposes to grant an access and utility easement across the vacated ROW area to serve the new lots. A joint driveway will be installed to serve all three parcels. Staff concurs with the proposed site plan provided by the applicant. ENGINEERING COMMENTS MLP 96 -0016 Kenyon Partition PAGE 1 • • 2. Water: The applicant will serve the new lots from an existing 6 -inch water line in SW 112th Avenue at Torland Street. Any connection to this water line shall be reviewed and approved by the City Water Department. 3. Sanitary Sewer: Sanitary sewer service will be provided from an existing 8 -inch public sewer line in SW 112th Avenue. The applicant intends to run a single service to serve the two new lots. As per USA's 1996 construction design standards, two homes can not share a single sewer lateral. However, a single sewer service can be extended to the ROW line to serve two separate parcels provided a cleanout is placed at the ROW line. The applicant's plan contains a detail of a "public service lateral" as shown in the USA manual, but will need to revise the plan slightly to locate the cleanout at the back of the ROW line. From the cleanout location, two separate laterals should extend to reach the two new houses. 4. Storm Drainage: Storm water from the two new lots will be directed to a proposed storm drain lateral to be extended from the public main line in SW 112th Avenue. 5. Storm Water Quality: The City has agreed to enforce Surface Water Management (SWM) regulations established by the Unified Sewerage Agency (USA) (Resolution and Order No. 91 -47, as amended by R &O 91 -75) which require the construction of on -site water quality facilities. However, in cases such as minor land partitions, a facility is impractical and a fee in- lieu is required. The applicant shall pay the standard fee in -lieu of $ 180 per lot for the two new lots. This fee is payable at issuance of the building permits for the lots. 6. Grading and Erosion Control: USA R &O 91 -47 also regulates erosion control to reduce the amount of sediment and other pollutants reaching the public storm and surface water system resulting from development, construction, grading, excavating, clearing, and any other activity which accelerates erosion. Per R &O 91- 47, the applicant is required to submit an erosion control plan for City review and approval prior to issuance of City permits. Site Permit Required: The developer will be required to obtain a Site Permit from the Building Division to cover all on -site private utility installations (water, sewer, storm, etc.) and driveway construction. This permit is separate from the permit obtained from the Engineering Department for connection to public main lines and work in the ROW. Recommendations: THE FOLLOWING CONDITIONS SHALL BE SATISFIED PRIOR TO APPROVAL OF THE FINAL PLAT: Note: Unless otherwise noted, the staff contact for the following conditions will be Brian Rager, Engineering Department (639- 4171). 1. Prior to issuance of a building permit, a Street Opening Permit will be required for this project to cover the proposed connections to the public water, sewer and storm drain lines in SW 112th Avenue. The permit will also cover the new driveway apron construction in SW 112th Avenue. The applicant will need to submit five (5) sets of the proposed public improvement plans for review and approval. NOTE: these plans are in addition to any drawings required by the Building Division and should only include information relevant to the public improvements. This permit shall be obtained by the applicant prior to approval of the final plat. 2. As a part of the public improvement plan submittal, the Engineering Department shall be provided with the name, address and telephone number of the individual or corporate entity who will be responsible for executing the compliance agreement and providing the financial assurance for the public improvements. 3. The applicant shall provide proof of an access easement over the adjacent parcel (Lot 4 of Torland Estates). The easement shall be for joint access for Parcels 1, 2 and 3. 4. Any connection to public water lines shall be shown on the proposed public improvement construction drawings and shall be reviewed and approved by the City's Water Department. 5. The applicant will be allowed to extend a "public service lateral ", as shown in the USA construction manual (detail 101 -CH9) but shall locate the cleanout at the back of the ROW line. Three mylar copies of the partition plat prepared by a land surveyor licensed to practice in Oregon, and necessary data or narrative. B. The partition plat and data or narrative shall be drawn to the minimum standards set forth by the Oregon Revised Statutes (ORS 92.05), Washington County, and by the City of Tigard. C. The plat shall indicate on its face an additional ROW dedication in SW North Dakota Street to provide 30 feet from centerline. THE FOLLOWING CONDITIONS SHALL BE SATISFIED PRIOR TO ISSUANCE OF BUILDING PERMITS: 7.
