The final plat shall indicate that additional right -of -way will be dedicated in SW North Dakota Street to provide a total of 30 -feet from centerline. 2. Prior to approval of the final plat, an agreement shall be executed by the applicant, on forms provided by the City, which waives the property owner's right to oppose or remonstrate against a future Local Improvement District formed to improve SW North Dakota Street. 3. Prior to approval of the final plat, a joint use and maintenance agreement shall be executed and recorded on City standard forms for the common driveway. The agreement shall be referenced on and become part of all applicable parcel Deeds. The agreement shall be approved by the Engineering Department prior to recording. 4. A Street Opening Permit will be required for this project to cover the sanitary sewer connection to the main line in North Dakota Street. The applicant will need to submit five sets of the proposed public improvement plans for review and approval. NOTE: these plans are in addition to any drawings required by the Building Division and should only include information relevant to the public improvements. This permit shall be obtained by the applicant prior to approval of the final plat. 5. Prior to approval of the final plat, the applicant shall obtain a plumbing permit from the Building Division to extend the proposed private storm lateral from the new lot to the existing drainage ditch in North Dakota Street. 6. F ROM'THE EFFECTIVE<DATEOF: THISDECIS ION >' > < > >: >:; >, >:.. >;<:;':<;:; • SECTION III: BACKGROUND INFORMATION Site History: The site is developed and has been designated for Low Density Residential (1 -5 dwelling units per acre) with an R -3.5 Zoning District Designation (10,000 square foot minimum lot) since the Comprehensive Plan was adopted in 1983. Vicinity Information: The area is largely developed with detached, single - family residences. The subject site slopes at approximately a one percent slope to the north towards SW North Dakota Street. Site Information and Proposal Description: The site is presently a 1.18 acre flag lot shaped lot that has been developed with a detached, single - family residence. The property owner has proposed to create an additional lot behind the existing residence. SECTION IV: APPLICABLE REVIEW CRITERIA AND FINDINGS COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: Minor Land Partition - Approval Standards: Section 18.162.040 contains the following general approval criteria for a Minor Land Partition: 1. The proposal conforms with the City's Comprehensive Plan; 2. The proposed partition complies with all statutory and ordinance requirements and regulations; 3. Adequate public facilities are available to serve the proposal; 4. All proposed lots conform to the size. and dimensional requirements of this title; and 5. All proposed improvements meet City and applicable agency standards (Ord. 89 -06; Ord. 83 -52). NOTICE OF DECISION MLP 96 -0004 - Larson Partition Page 3 I • The proposed parcel exceeds the 10,000 square foot minimum lot size. The proposed parcel complies with all the other applicable development standards of the R -3.5 Zoning District. The newly created parcel would allow the development of up to two residential dwelling units. The maximum density proposed through this application is, therefore, not in excess of that allowed by the Comprehensive Plan in satisfaction of Criteria 1. The development as proposed does not exceed the maximum residential density allowed under Chapter 18.92 for a 1.18 acre R -3.5 property. The site yields the opportunity to develop up to four dwelling units after deduction of street right -of -way. Upon completion of the appeal period, the development will have complied with the statutory requirements for development review as required by Criteria 2. Adequate public facilities are available or have been required to be provided to serve this site as set forth in Sections 18.164,030 (Streets), 18.164.090 (Sanitary Sewer), and 18.164.100 (Storm Drain) as required by Criteria 3, as reviewed within the Engineering Departments comments contained elsewhere within this report. The new parcel does not exceed a two and one -half to one, length to depth ratio. The R -3.5 Zoning District has a 65 -foot average lot width requirement. The lot as proposed either has a 174 -foot or a 105 -foot average width depending on the property dimension the applicant chooses to utilize as their lot width. For these reasons, the proposed parcel configurations conform with size and dimensional requirements of the R -3.5 Zoning District as required by Criteria 4. All proposed improvements will comply with City and applicable agency standards in satisfaction with Criteria 5 as reviewed through the Plan Check process. The newly created parcel complies with the Basic Solar Access requirements because the north -south lot dimension exceeds 90 -feet in length. The development of structures on the new parcel will require compliance with Solar Balance Point Standards of the Community Development Code. Section 18.162.050 contains the following special provisions for lots created through the Partition Process: 1. Lot Width: The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district. 2. Lot Area: The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the accessway may not be included in the lot area calculation. 3. Lot Frontage: Each lot created through the partition process shall front a public right -of -way by at least 15 feet or have a legally recorded minimum 15 foot wide access easement. 4. Setbacks: Setbacks shall be as required by the applicable zoning district. NOTICE OF DECISION MLP 96 -0004 - Larson Partition Page 4 • • 5. Front Yard Determination for Flag Lot: When the partitioned lot is a flag lot, the • developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. 6. Screening on Flag Lots: A screen shall be provided along the property line of a lot of record where the paved drive in an accessway is located within ten feet of an abutting lot in accordance with Sections 18.100.080 and 18.100.090. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. 7. Fire Protection: The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire fighting capabilities. 8. Reciprocal Easements: Where a common drive is to be provided to serve more than one lot, a reciprocal easement that will ensure access and maintenance rights shall be recorded with the approved partition map. 9. Accessway: Any accessway shall comply with the standards set forth in Chapter 18.108, Access, Egress, and Circulation. 10. Floodplain: Where landfill and /or development is allowed within or adjacent to the one - hundred -year floodplain, the City shall require the dedication of sufficient open land area for greenway adjoining and within the floodplain. This area shall include portions at a suitable elevation for the construction of a pedestrian /bicycle pathway with the floodplain in accordance with the adopted pedestrian /bicycle pathway plan. Criteria 1, 2, 3, and 4 are satisfied. The parcels will exceed the area requirement of 10,000 square feet set forth within the R -3.5 Zoning District. The newly created parcel would have in excess of 15 -feet of direct frontage on a private easement in satisfaction of the lot frontage requirement in Criteria 3. Standards for setbacks and clear vision requirements will be reviewed prior to issuance of Building Permits in satisfaction of Criteria 4. Criteria 5 and 6 have been addressed because the existing and proposed lot will each have in excess of 15 -feet of frontage to SW North Dakota or to the common private driveway. The existing and proposed lots are flag lots as defined by the Community Development Code. For this reason, a building setback determination will need to be made prior to the issuance of Building Permits in satisfaction of Criteria 5. A screening plan will be required prior to recording the plat. The extent of the required screening is dependent on the existing conditions. Any required screening must be constructed or planted prior to the issuance of Occupancy Permits for new residential structures on the property in satisfaction of Criteria 6. Prior to the provision of water service to the site, a fire hydrant shall be constructed in a manner consistent with Uniform Fire Code standards, thereby, satisfying Criteria 7. Criteria 8 that requires the completion of a reciprocal access and maintenance agreement for the proposed common driveway has been addressed through the Conditions of Approval. NOTICE OF DECISION MLP 96 -0004 - Larson Partition Page 5 • • Criteria 9 is satisfied through the existing 10- foot -wide private driveway that serves the existing residence and can serve an additional lot or dwelling unit as proposed. Criteria 10 has been addressed because the parcel is not located within the 100 -year flood plain, or in areas with slopes exceeding 25 percent. Because the site does not adjoin the 100 -year flood plain, dedication of areas for pathway purposes is also not applicable. PUBLIC FACILITY CONCERNS: Section's 18.164.030(E)(1)(a) (Streets), 18.164.090 (Sanitary Sewer), and 18.164.100 (Storm Drains) shall be satisfied as specified below: STREETS: This site is adjacent to SW North Dakota Street, which is classified as a minor collector street to be built within a 60 -foot right -of -way (ROW). At present, there is only 20 -feet of ROW on the south side of centerline adjacent to this site. The applicant should be required to dedicate additional ROW to provide a total of 30 -feet from centerline. This dedication should be made on the final partition plat. At present, the street is a paved roadway at substandard width and structural section. There is a roadside ditch that conveys street and some site drainage. The roadway functions adequately under current traffic loads and this proposal will not result in a significant increase in traffic. Therefore, a half- street improvement is not warranted at this time. However, the applicant should be required to enter into a non - remonstrance agreement that will obligate the applicant to participate in the future widening of the roadway. This agreement should be executed prior to approval of the final partition plat. SANITARY SEWER: This site will be served by the existing public sanitary sewer line in SW North Dakota Street. The applicant will be required to obtain a street opening permit from the City to extend a new sewer service from the main line to the new lot. STORM DRAINAGE: The storm drainage from this site will be directed north to the existing drainage ditch in SW North Dakota Street. A private storm pipe will be extended along the private driveway to reach the ditch. Since this line will be a private storm line, the applicant will be required to obtain a plumbing permit from the Building Division for this work. STORM WATER QUALITY: The City has agreed to enforce Surface Water Management (SWM) regulations established by the Unified Sewerage Agency (USA) (Resolution and Order No. 91 -47, as amended by R &O 91 -75) which requires the construction of on -site water quality facilities. However, the R &O allows an exception in cases where the only impact is construction of single - family and /or duplex dwellings. In this case, there will be a new single - family dwelling. Therefore, this section will not apply. NOTICE OF DECISION MLP 96 -0004 - Larson Partition Page 6 ! • GRADING AND EROSION CONTROL: USA R &O 91 -47 also regulates erosion control to reduce the amount of sediment and other pollutants reaching the public storm and surface water system resulting from development, construction, grading, excavating, clearing, and any other activity that accelerates erosion. Per R &O 91 -47, the applicant is required to submit an erosion control plan for City review and approval prior to issuance of City permits. SECTION V: OTHER STAFF COMMENTS The Water Department has reviewed this proposal and stated that the following items are necessary to provide water service: 1.) A fire hydrant needs to be installed on SW North Dakota Street at the driveway (landscaped area) to provide the minimum fire protection to the proposed lot. 2.) Due to the distance from SW North Dakota Street, and depending on an exact plumbing fixture count, a minimum of a one -inch service and a one -inch meter is required. If the fixture count is greater than 31 units, a one and a half inch meter is required. • The Police Department has reviewed this application and has offered no comments or objections. SECTION VI: AGENCY COMMENTS The Unified Sewerage Agency has reviewed this proposal and has offered no comments or objections. The Tualatin Valley District and provided the following comments concerning this proposal: 1) Access to the existing lot and new adjacent lot shall be not less than 15 feet of driveable surface width with Fire District approved turn around. 2) Hydrant is required within 250 feet of all portions of the structure measured around the exterior and along all access routes. The site is located at 10730 SW North Dakota Street, (Tax Map 1S1 34DA, Tax Lot 2600). Findings: 1. Streets: This site lies adjacent to SW North Dakota Street, which is classified as a minor collector street to be built within a 60 foot right -of -way (ROW). At present there is only 20 feet of ROW on the south side of centerline adjacent to this site. The applicant should be required to dedicate additional ROW to provide a total of 30 feet from centerline. This dedication should be made on the final partition plat. At present, the street is a paved roadway at substandard width and structural section. There is a roadside ditch that conveys street and some site drainage. The roadway functions adequately under current traffic loads and this proposal will not result in a significant increase in traffic. Therefore, a half -street improvement is not warranted at this time. However, the applicant should be required to enter into a non - remonstrance agreement which will obligate the applicant to participate in the future widening of the roadway. This agreement should be executed prior to approval of the final partition plat. 2. Sanitary Sewer: This site will be served by the existing public sanitary sewer line in SW North Dakota Street. The applicant will be required to obtain a street opening permit from the City to extend a new sewer service from the main line to the new lot. ENGINEERING COMMENTS MLP 96 -04 Larson Partition PAGE 1 • . 3. Storm Drainage: The storm drainage from this site will be directed north to the existing drainage ditch in North Dakota Street. A private storm pipe will be extended along the private driveway to reach the ditch. Since this line will be a private storm line, the applicant will be required to obtain a plumbing permit from the Building Division for this work. 4. Storm Water Quality: The City has agreed to enforce Surface Water Management (SWM) regulations established by the Unified Sewerage Agency (USA) (Resolution and Order No. 91 -47, as amended by R &O 91 -75) which require the construction of on -site water quality facilities. However, the R &O allows an exception in cases where the only impact is construction of single - family and/or duplex dwellings. In this case, there will be a new single - family dwelling. Therefore, this section will not apply. 5. Grading and Erosion Control: USA R &O 91 -47 also regulates erosion control to reduce the amount of sediment and other pollutants reaching the public storm and surface water system resulting from development, construction, grading, excavating, clearing, and any other activity which accelerates erosion. Per R &O 91 -47, the applicant is required to submit an erosion control plan for City review and approval prior to issuance of City permits. Recommendations: THE FOLLOWING CONDITIONS SHALL BE SATISFIED PRIOR TO APPROVAL OF THE FINAL PLAT: Note: Unless otherwise noted, the staff contact for the following conditions will be Brian Rager, Engineering Department (639- 4171). 1. The final plat shall indicate that additional ROW will be dedicated in SW North Dakota Street to provide a total of 30 feet from centerline. 2. Prior to approval of the final plat, an agreement shall be executed by the applicant, on forms provided by the City, which waives the property owner's right to oppose or remonstrate against a future Local Improvement District formed to improve SW North Dakota Street. Prior to approval of the final plat, a joint use and maintenance agreement shall be executed and recorded on City standard forms for the common driveway. The agreement shall be referenced on and become part of all applicable parcel Deeds. The agreement shall be approved by the Engineering Department prior to recording. 4. A Street Opening Permit will be required for this project to cover the sanitary sewer connection to the main line in North Dakota Street. The applicant will need to submit five (5) sets of the proposed public improvement plans for review and approval. NOTE: these plans are in addition to any drawings required by the Building Division and should only include information relevant to the public improvements. This permit shall be obtained by the applicant prior to approval of the final plat. 5. Prior to approval of the final plat, the applicant shall obtain a plumbing permit from the Building Division to extend the proposed private storm lateral from the new lot to the existing drainage ditch in North Dakota Street.
