An agreement shall be executed by the applicant, on forms provided by the City, which waives the property owner's right to oppose or remonstrate against a future Local Improvement District formed to improve SW Fonner Street. The description shall be tied to the existing right -of -way centerline. The dedication documents shall be on City forms. Final Plat Application Submission Requirements: a. Three (3) mylar copies of the partition plat prepared by a land surveyor licensed to practice in Oregon, and necessary data or narrative. b. Copy of recorded boundary survey for site. c. The partition plat and data or narrative shall be drawn to the minimum standards set forth by the Oregon Revised Statutes (ORS 92.05) Washington County, and by the City of Tigard. 6. The applicant shall pay a fee in -lieu of an on -site water quality facility as required by Unified Sewerage Agency Resolution and Order No. 91-47. The applicant shall provide for roof and pavement rain drainage to the public • stormwater drainage system or by an on -site system designed to prevent runoff onto the adjacent property. BACKGROUND INFORMATION Property History: The property was annexed into the City in 1995. No other development applications were found to have been filed with the City. Site Information and Proposal Description: The property is currently developed with a single - family residence. The property slopes toward SW Fonner Street from approximately a 248 foot elevation, down to a 242 foot elevation. The applicant is proposing to divide one (1) parcel of approximately 21,620 square feet into two (2) parcels of approximately 10,600 and 8,080 square feet (excluding the "pole" portion of the rear lot). IV. APPLICABLE REVIEW CRITERIA AND FINDINGS - MINOR LAND PARTITION Section 18.162.040 contains the following general approval criteria for a Minor Land Partition: 1. The proposal conforms with the City's Comprehensive Plan; 2. The proposed partition complies with all statutory and ordinance requirements and regulations; NOTICE OF DECISION FISHER/HERTEL - MLP 95 -0019 PAGE 3 0 • 3. Adequate public facilities are available to serve the proposal; 4. All proposed lots conform to the size and dimensional requirements of this title; and 5. All proposed improvements meet City and applicable agency standards (Ord. 89 -06; Ord. 83 -52). The proposal conforms with the City's Comprehensive Plan in that the newly created lot will continue to allow for residential development. This proposal, therefore, is not in conflict with the Low Density Plan designation. This proposed partition complies with all statutory and ordinance requirements and regulations as demonstrated both by the analysis presented within this administrative decision and by this application and review process. Adequate public facilities are available to serve the proposal. Section 18.162.050 contains the following special provisions for lots created through the Partition Process: 1. Lot Width: The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district. 2. Lot Area: The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the accessway may not be included in the lot area calculation. 3. Lot Frontage: Each lot created through the partition process shall front a public right -of -way by at least 15 feet, or have a legally recorded minimum 15 foot wide access easement. 4. Setbacks: Setbacks shall be as required by the applicable zoning district. 5. Front Yard Determination for Flag Lot: When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. 6. Screening on Flag Lots: A screen shall be provided along the property line of a lot of record where the paved drive in an accessway is located within ten feet of an abutting lot in accordance with Sections 18.100.080 and 18.100.090. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. Fire Protection: The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire fighting capabilities. 8. Reciprocal Easements: Where a common drive is to be provided to serve more than one (1) lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. 9. Accessway: Any accessway shall comply with the standards set forth in Chapter 18.108; Access, Egress, and Circulation. 10. Floodplain: Where landfill and/or development is allowed within or adjacent to the one - hundred -year floodplain, the City shall require the dedication of sufficient open land area for greenway adjoining and within the floodplain. This area shall include portions at a suitable elevation for the construction of a pedestrian /bicycle pathway with the floodplain in accordance with the adopted pedestrian /bicycle pathway plan. Criteria 1 is satisfied as the proposed lot widths for parcels one (1) and two (2) are approximately 73 and 95 feet respectively, exceeding the minimum 50 foot lot width requirement in the R-4.5 zone. Criteria 2 is satisfied as this partition would create lots of approximately 10,600 and 8,080 square feet, exceeding the 7,500 square foot minimum lot size requirement. Criteria 3 is satisfied as the Tots contain approximately 73 and 20 feet of frontage onto SW Fonner Street. The required setbacks in the R-4.5 zone are as follows: front yard -20 feet; side yard -5 feet; rear yard -15 feet; garage -20 feet; flag lot side yard -10 feet. As indicated on the site plan, the existing single - family home on parcel one (1) complies with the setbacks, satisfying Criteria 4. Compliance with setbacks on the proposed parcel will be reviewed when it is built upon. Criteria 5 is not applicable to lot one (1) as this lot is not a flag lot. Front yard determination for the proposed lot (lot 2) will be determined at the time of building permit application. The plan shows an existing hedge along the west property line, thereby, satisfying Criteria 6. Fire hydrants shall be consistent with Uniform Fire Code standards, thereby, satisfying Criteria 7. Criteria 8 is satisfied as a joint use and maintenance agreement shall be recorded with the plat for a common driveway. Criteria 9 shall be satisfied as both parcels will share a minimum 10 foot -wide paved driveway. Criteria 10 is not applicable as none of the parcels are within the floodplain. NOTICE OF DECISION FISHER/HERTEL - MLP 95 -0019 PAGE 5 • 1 Section 18.88.010 (Solar Access) states that all newly created lots within the City • of Tigard shall promote the use of renewable energy sources by providing for improved access to sunlight for residential dwellings. A lot meets the basic requirement if it has a north -south dimension of 90 feet or more and has a front lot line that is oriented within 30 degrees of a true east -west axis. As proposed, the newly created lot will not meet the basic requirement as it can only provide a north - south dimension of 90 feet. This is due to the provision of required setbacks for the existing residence. The newly created lot is therefore exempt from meeting the basic standard. It should be noted that a new structure must comply with the Solar Balance Point Ordinance even if a lot has been exempted from the basic solar requirement. This means that any structure to be built must maintain height and setback limits which avoid casting a shadow on solar features. Sections 18.164.030 (Streets), 18.164.090 (Sanitary Sewer), and 18.164.100 (Storm Drains) have been addressed and are satisfied as specified below: Streets: Access is provided by a common driveway to SW Fonner Street, a minor collector. The frontage has existing right -of -way of 40 feet in width. The street is improved with a pavement of partial width. Sanitary Sewer: Sanitary sewer service is provided by an existing public line in SW Fonner Street. Storm Sewer: The applicant proposes to provide storm drainage by installing a private line in the common driveway to a ditch along SW Fonner Street. V. AGENCY AND OTHER STAFF COMMENTS The City of Tigard Building Division states that the applicant shall provide a topography map /grading plan which shows how impervious surface will be put into an approved system. GTE states that the developer /owner is to provide trench /conduit to GTE's specifications. The City of Tigard Maintenance Services Division, City of Tigard Police Department, City of Tigard Water Department and Portland General Electric have reviewed the proposal and have offered no comments or objections. CLEAR VISION ARE The City requires that clear vision areas be maintained between three and eight feet in height at roadldriveway, roadlrailroad, ana road/road intersections. The size of the required clear vision area depends upon the abutting street's functional classification. (Refer to Code Section 18.102) BUFFERING AND SCREENING In order to increase privacy and to either reduce or eliminate adverse noise or visual impacts between adjacent developments. especially between different land uses, the City requires landscaped buffer areas along certain site perimeters. Required buffer areas are described by the Code in terms of width. Buffer areas must be occupied by a mixture of deciduous and evergreen trees and shrubs and must also achieve a balance between vertical and horizontal plantings. Site obscuring screens or fences may also be required; these are often advisable even if not required by the Code. The required buffer areas may one be occupied by vegetation, fences, utilities, and walkways. Additional information on required buffer area materials and sizes may be found in the Community Development Code. Street trees should be spaced 20 to 40 feet apart depending on the branching width of the proposed tree species at maturity. Further information on regulations affecting street trees may be obtained from the Planning Division. A minimum of one tree for every seven parking spaces must be planted in and around all parking areas in order to provide a vegetative canopy effect. Landscaped parking areas shall include special design features which effectively screen the parking lot areas from view. Staff will attempt to preliminarily • identify sensitive lands areas at the pre-application conference based on available information. HOWEVER, the responsibility tc precisely identify sensitive lands areas, and their boundaries, is the responsibility of the applicant. Areas meeting the definitions of sensitive lands must be clearly indicated on plans submitted with the development application. (Refer to Code Chapter 18.84) Chapter 18.84 also provides regulations for the use, protection, or modification of sensitive lands areas. Residential development is prohibited within floodplains. To standardize requirements for Uniform Fire Code Sections 10.203 and 10.204 where specifics are not given. B. To provide clarification and standardization for Plans Examiners and persons developing and designing access roadways for various commercial and residential structures. AUTHORITY & RESPONSIBILITY: When access is required as prescribed by the Uniform Fire Code, Fire Department staff shall utilize the Uniform Fire Code requirements as amended by the ordinance and the interpretations below for clarification and uniform application. POLICY: A. Section 10.203: Access roadways shall not be closer than 20 feet to a structure unless topographical restrictions dictate the location. B. Section 111203, Paragraph 2: Two or more accesses to an area shall be required where - 20 of more dwelling units are constructed. C. Section 10.204(b): Driving surface may be of any type of material as long as the driving surface is distinguishable from surrounding area and it will carry a load of 50,000 pounds gross weight and 12,500 pounds point load (wheel load). Fire Districts may require plans for roadways and final inspections to be made by State of Oregon Registered Engineer. D. Section 10.204(c): Turning radii shall not be less than`45 feet outside and 25 feet inside using the same center point for both radii. (See - Attachment A.) E. Section 10.204(d): Turnarounds shall be: 1. Configured as those shown in Attachment A utilizing the minimum dimensions shown. 2.
