NOTICE OF DECISION MINOR LAND PARTITION MLP 95 -0014 BURLINGTON NORTHERN /CITY OF TIGARD/TIGARD AREA CHAMBER OF COMMERCE APPLICATION: A request for a Minor Land Partition approval to divide approximately 15,403 square feet of railroad right -of -way into two parcels of approximately 10,501 and 4,902 square feet. ZONE: CBD (Central Business District). LOCATION: 12355 SW Main Street (WCTM 2S1 2AB, tax lot 5400 -A1). APPLICABLE LAW: Community Development Code Chapters 18.66, 18.162.040, 18.162.050, 18.164.030, 18.164.090, 18.164.100. DECISION: Notice is hereby given that the Planning Director's designee for the City of Tigard has APPROVED Minor Land Partition 95 -0014 SUBJECT TO CERTAIN CONDITIONS as listed below. SECTION I CONDITIONS OF APPROVAL THE FOLLOWING CONDITIONS SHALL BE REQUIRED PRIOR TO RECORDING THE PLAT. UNLESS OTHERWISE NOTED, THE STAFF CONTACT FOR ALL CONDITIONS SHALL BE MICHAEL ANDERSON, ENGINEERING DIVISION: 1. A joint use and maintenance agreement shall be executed and recorded on City standard forms for all common driveways. The agreement shall be referenced on and become part of all applicable parcel Deeds. The agreement shall be approved by the Engineering Department prior to recording. Additional right -of -way shall be dedicated to the Public along the SW Main Street frontage to increase the right -of -way to 40 feet from the centerline. The description shall be tied to the existing right -of -way centerline. The dedication document shall be on City forms. Additional right -of -way shall be dedicated to the Public along the SW Tigard Street frontage to increase the right -of -way to 47 feet as measured from the existing curb on the opposite side of the street. The description shall be tied to the existing right -of -way centerline. The dedication document shall be on City forms. Final Plat Application Submission Requirements: A. Three copies of the partition plat prepared by a land surveyor licensed to practice in Oregon, and necessary data or narrative. B. The partition plat and data or narrative shall be drawn to the minimum standards set forth by the Oregon Revised Statutes (ORS 92.05), Washington County, and by the City of Tigard. C. The final original and two mylar copies shall be provided for signature of the City Engineer. D. The street dedications for both SW Main Street and SW Tigard Street shall be made on the final partition plat. STAFF CONTACT: John Hadley, Engineering Department (639 -4171) 7. The applicant shall complete a Covenant and Agreement for each proposed parcel indicating that the parcels will not be sold separately and will maintain the common use existing. Prior to the remodeling and relocation of the store, the City shall review the proposal for compliance with Site Development Review criteria (Ch. 18.120). Provide the Engineering Department with a recorded mylar copy of the partition plat; or if not recorded with Washington County but has been approved by the City of Tigard the applicant shall have 30 days after recording with Washington County to submit the copy. STAFF CONTACT: David Scott, Building Division (639 - 4171). SECTION II - BACKGROUND: 1. Vicinity Information The subject site is located at the corner of SW Tigard and SW Main Street. The properties to the south, east and north are zoned CBD (Central Business District). The property abuts Burlington Northern Railroad tracks on the north. The surrounding area is predominantly developed with commercial uses. 2. Site Information and Proposal Description An existing Tigard Feed and Seed store presently occupies the site and has access to SW Tigard Street. The applicant requests a Minor Land Partition approval to divide approximately 15,403 square feet of railroad right -of -way into two parcels of approximately 10,501 and 4,902 square feet. Purchase of the parcels will commence once the partition is recorded. The existing building will then be scaled down in size and relocated by the Chamber such that it will be entirely within the boundaries of parcel 1, the Chamber property. Parcel 2 will be used by the City to construct a parking lot to be used for downtown parking. Access to the Feed store (Chamber) parking will be through the access drive of the new City parking lot. A joint access agreement will be acquired to share the accessway. Prior to relocating the store and constructing the new parking lot, the City shall review the proposal for compliance with site development review criteria. 3. Aaencv Comments NOTICE OF DECISION MLP 95 -0014 BURLINGTON NORTHERN /CITY OF TIGARD Page 3 • • The City of Tigard Building Division states that prior to recordation, the applicant shall complete a Covenant and Agreement for each proposed parcel indicating that the parcels will not be sold separately and will maintain the common use existing. The Covenant and Agreement shall be on forms provided by the Building official and shall be approved by the Building Official. These covenants shall record concurrently with the partition. Alternatively, the applicant shall obtain a building permit to alter and move the existing building and perform such work. The City of Tigard Maintenance Services Department, City of Tigard Water Department, Tualatin Valley Fire District have reviewed this proposal and have offered no comments or objections. No other comments have been received. SECTION III - FINDINGS AND CONCLUSIONS - Minor Land Partition Section 18.162.040 contains the following general approval criteria for a Minor Land Partition: 1. The proposal conforms with the City's Comprehensive Plan; 2. The proposed partition complies with all statutory and ordinance requirements and regulations; 3. Adequate public facilities are available to serve the proposal; 4. All proposed lots conform to the size and dimensional requirements of this title; and 5. All proposed improvements meet City and applicable agency standards (Ord. 89 -06; Ord. 83 -52). The proposal conforms with the City's comprehensive plan in that the newly created lots will continue to allow for commercial development. This proposal therefore is not in conflict with the Central Business District Comprehensive Plan designation. This proposed partition complies with all statutory and ordinance requirements and regulations as demonstrated both by the analysis presented within this administrative decision and by this application and review process. Adequate public facilities are available to serve the proposal. Section 18.162.050 contains the following special provisions for lots created through the Partition Process: A. Lot Width: The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district. In the case of a flag lot, the accessway may not be included in the lot area calculation. C. Lot Frontage: Each lot created through the partition process shall front a public right -of -way by at least 15 feet or have a legally recorded minimum 15 foot wide access easement. D. Setbacks: Setbacks shall be as required by the applicable zoning district. E. Front Yard Determination for Flag Lot: When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. F. Screening on Flag Lots: A screen shall be provided along the property line of a lot of record where the paved drive in an accessway is located within ten feet of an abutting lot in accordance with Sections 18.100.080 and 18.100.090. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. G. Fire Protection: The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire fighting capabilities. H. Reciprocal Easements: Where a common drive is to be provided to serve more than one lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. I. Accessway: Any accessway shall comply with the standards set forth in Chapter 18.108, Access, Egress, and Circulation. J. Where landfill and/or development is allowed within or adjacent to the one - hundred -year floodplain, the City shall require the dedication of sufficient open land area for greenway adjoining and within the floodplain. This area shall include portions at a suitable elevation for the construction of a pedestrian/bicycle pathway with the floodplain in accordance with the adopted pedestrian/bicycle pathway plan. Criteria A and B are satisfied as there are no minimum lot size or width requirements in the CBD zone. The proposed lot frontages are approximately 130 and 245 feet respectively, thereby exceeding the minimum 15 foot frontage requirement of Criteria C. Criteria D is satisfied as there are no setback requirements applicable to these parcels under the CBD zone. As indicated on the site plan, the store will be on both of the proposed parcels. Upon recording of the NOTICE OF DECISION MLP 95 -0014 BURLINGTON NORTHERN /CITY OF TIGARD Page 5 • • partition plat, the existing building will be scaled down in size and relocated such that it will be entirely within the boundaries of parcel 1. Parcel 2 will then be used to construct a parking lot. Access to the relocated Feed store parking will be through the access drive of the new parking lot. A joint access agreement will be acquired to share the accessway. Prior to relocating the store and constructing the new parking lot, the City shall review the proposal for compliance with site development review criteria. Criteria E and F are not applicable to these lots as they are not flag lots. Fire hydrants shall be consistent with Uniform Fire Code standards thereby satisfying Criteria G. Criteria H shall be satisfied as a joint use and maintenance agreement shall be recorded with the plat for a common driveway. Criteria I is currently satisfied for the existing store. Criteria I shall be reviewed for compliance with access standards when the building is relocated and the parking area is constructed. Criteria J is not applicable to these lots as they are not within the floodplain. Sections 18.164.030 (Streets), 18.164.090 (Sanitary Sewer), and 18.164.100 (Storm Drains) have been addressed and are satisfied as specified below: 1. Streets: The site is located at the northwesterly side of SW Main Street, a Major Collector street as shown on the City Comprehensive Plan, at the intersection of SW Tigard Street, a Minor Collector street. Access to the site will be provided by a joint use driveway onto SW Tigard Street, that will inter - connect on -site and serve the parking lots for the two parcels which will coincide with modifications to the existing building. The applicant should provide a joint use and maintenance agreement for the proposed common use of this driveway. The right -of -way for both streets in insufficient with regards to the City standards for collector streets. The applicant should dedicate additional right -of -way for SW Main Street to establish a width of 40 feet as measured from centerline. For SW Tigard Street, the right -of -way dedication should match the existing half- street improvements on the opposite side of the street and provide for a parallel width of 47 feet, as measured from the curb line, to allow the construction of a 40 foot roadway and future 6 foot wide sidewalk. The requirement for street improvements will be a condition of approval for any future on -site development permit. 2. Sanitary Sewer: Sanitary sewer service is available from the 6" public sanitary sewer main in SW Main Street for proposed Parcel 1. In the future, any development proposed for Parcel 2, other than a parking lot, will require the extension of the public sewer main in SW Tigard Street from SW Main Street westerly to proposed Parcel 2. NOTICE OF DECISION MLP 95 -0014 BURLINGTON NORTHERN /CITY OF TIGARD Page 6 • • 3. Storm Sewer: The property slopes in a southwesterly direction toward SW Tigard Street. The roof and site drainage for the new construction should be directed to the adjoining streets. SECTION IV - DECISION The Planning Division hereby APPROVES Minor Land Partition MLP 95 -0014 subject to the conditions listed in Section I at the beginning of this decision. THIS APPROVAL IS VALID IF EXERCISED WITHIN EIGHTEEN MONTHS OF THE EFFECTIVE DATE OF THIS DECISION. SECTION V. PROCEDURE 1. Prior to relocating the store and constructing the new parking lot, the City shall review the proposal for compliance with site development review criteria. Criteria E and F are not applicable to these lots as they are not flag lots. Fire hydrants shall be consistent with Uniform Fire Code standards thereby satisfying Criteria G. Criteria H shall be satisfied as a joint use and maintenance agreement shall be recorded with the plat for a common driveway. Criteria I is currently satisfied for the existing store. Criteria I shall be reviewed for compliance with access standards when the building is relocated and the parking area is constructed. Criteria J is not applicable to these lots as they are not within the floodplain. Sections 18.164.030 (Streets), 18.164.090 (Sanitary Sewer), and 18.164.100 (Storm Drains) have been addressed and are satisfied as specified below: 1. Streets: The site is located at the northwesterly side of SW Main Street, a Major Collector street as shown on the City Comprehensive Plan, at the intersection of SW Tigard Street, a Minor Collector street. Access to the site will be provided by a joint use driveway onto SW Tigard Street, that will inter - connect on -site and serve the parking lots for the two parcels which will coincide with modifications to the existing building. The applicant should provide a joint use and maintenance agreement for the proposed common use of this driveway. The right -of -way for both streets in insufficient with regards to the City standards for collector streets. The applicant should dedicate additional right -of -way for SW Main Street to establish a width of 40 feet as measured from centerline. For SW Tigard Street, the right -of -way dedication should match the existing half- street improvements on the opposite side of the street and provide for a parallel width of 47 feet, as measured from the curb line, to allow the construction of a 40 foot roadway and future 6 foot wide sidewalk. The requirement for street improvements will be a condition of approval for any future on -site development permit. 2. Sanitary Sewer: Sanitary sewer service is available from the 6" public sanitary sewer main in SW Main Street for proposed Parcel 1. In the future, any development proposed for Parcel 2, other than a parking lot, will require the extension of the public sewer main in SW Tigard Street from SW Main Street westerly to proposed Parcel 2. (KSL:pm /0737P) • 4 APPLICANT'S STATEMENT The City of Tigard, on behalf of (name) is requesting a Minor Land Partition to partition railroad right -of -way totalling approximately 15,403 square feet into two parcels of approximately 4,902 and 10,501 square feet. The following narrative addresses the applicable approval criteria. Section 18.162.040 contains the following general approval criteria for a Minor Land Partition: 1. The proposal conforms with the City's Comprehensive Plan; 2. The proposed partition complies with all statutory and ordinance requirements and regulations; 3. Adequate public facilities are available to serve the proposal; 4. All proposed lots conform to the size and dimensional requirements of this title; and 5. All proposed improvements meet City and applicable agency standards (Ord. 89 -06; Ord. 83 -52). The proposal conforms with the City's comprehensive plan in that the newly created lot will continue to allow for commercial development. This proposal therefore is not in conflict with the Central Business District Comprehensive Plan designation. This proposed partition complies with all statutory and ordinance requirements and regulations as demonstrated both by the analysis presented within this administrative decision and by this application and review process. Adequate public facilities are either available or shall be made available to serve the proposal. Section 18.162.050 contains the following special provisions for lots created through the Partition Process: A. Lot Width: The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district. B. Lot Area: The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the accessway may not be included in the lot area calculation. C. Lot Frontage: Each lot created through the partition process shall front a public right -of -way by at least 15 feet or have a legally recorded minimum 15 foot wide access easement. 410 III D. Setbacks: Setbacks shall be as required by the applicable zoning district. E. Front Yard Determination for Flag Lot: When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. F. Screening on Flag Lots: A screen shall be provided along the property line of a lot of record where the paved drive in an accessway is located within ten feet of an abutting lot in accordance with Sections 18.100.080 and 18.100.090. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. G. Fire Protection: The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire fighting capabilities. H. Reciprocal Easements: Where a common drive is to be provided to serve more than one lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. I. Accessway: Any accessway shall comply with the standards set forth in Chapter 18.108, Access, Egress, and Circulation. J. Where landfill and /or development is allowed within or adjacent to the one - hundred -year floodplain, the City shall require the dedication of sufficient open land area for greenway adjoining and within the floodplain. This area shall include portions at a suitable elevation for the construction of a pedestrian /bicycle pathway with the floodplain in accordance with the adopted pedestrian /bicycle pathway plan. Criteria A and B are satisfied as there are no minimum lot size or width requirements in the CBD zone. The proposed lot frontages are approximately 80 and 240 feet respectively, thereby exceeding the minimum 15 foot frontage requirement of Criteria C. There are no setback requirements applicable to these parcels under the CBD zone. However, an existing Tigard Feed and Seed store presently occupies the site. As indicated on the site plan, the store will be on both of the proposed parcels. The existing building on the site is to be remodeled and /or moved to conform to the new lot lines. Findings: 1. Streets: The site is located at the northwesterly side of SW Main Street, a Major Collector street as shown on the City Comprehensive Plan, at the intersection of SW Tigard Street, a Minor Collector street. Access to the site will be provided by a joint use driveway onto SW Tigard Street, that will inter - connect on -site and serve the parking lots for the two parcels which will coincide with modifications to the existing building. The applicant should provide a joint use and maintenance agreement for the proposed common use of this driveway. The right -of -way for both streets in insufficient with regards to the City standards for collector streets. The applicant should dedicate additional right -of -way for SW Main Street to establish a width of 40 feet as measured from centerline. For SW Tigard Street, the right -of -way dedication should match the existing half- street improvements on the opposite side of the street and provide for a parallel width of 47 feet, as measured from the curb line, to allow the construction of a 40 foot roadway and future 6 foot wide sidewalk. The requirement for street improvements will be a condition of approval for any future on -site development permit. 2. Sanitary Sewer: Sanitary sewer service is available from the 6" public sanitary sewer main in SW Main Street for proposed Parcel 1. In the future, any development proposed for Parcel 2, other than a parking lot, will require the extension of the public sewer main in SW Tigard Street from SW Main Street westerly to proposed Parcel 2. 3.
