MLP1995-00008 111 EXIIJr Y A NOTICE OF DECISION MINOR LAND PARTITION MLP 95 -0008 SENSITIVE LANDS REVIEW SLR 95 -0009 CHORUBY /BLACKSTONE - OWNER /APPLICANT APPLICATION: The applicant requests approval to partition a parcel of .57 acres into two parcels of approximately 11,821 and 13,077 and a separate Tract A of 7,892 square feet is to be created as a buffer area to an adjoining wetlands area. ZONE: R -4.5 (Low Density Residential) LOCATION: 13705 SW Hall Boulevard. (WCTM 2S1 02DD, tax lot 1000). APPLICABLE LAW: Community Development Code Chapters 18.50, 18.88, 18.92, 18.100 18.102, 18.108, 18.162, and 18.164. DECISION: Notice is hereby given that the Planning Director's designee for the City of Tigard has recommended APPROVAL of Minor Land Partition 95 -0008 and Sensitive Lands Review 95 -0009 SUBJECT TO CERTAIN CONDITIONS as listed below. SECTION I - CONDITIONS OF APPROVAL: THE FOLLOWING CONDITIONS SHALL BE SATISFIED OR FINANCIALLY ASSURED PRIOR TO RECORDING THE FINAL PLAT WITH WASHINGTON COUNTY. UNLESS OTHERWISE NOTED, THE STAFF CONTACT FOR ALL CONDITIONS SHALL BE MICHAEL ANDERSON, ENGINEERING DIVISION: Recommendations: ALL CONDITIONS SHALL BE SATISFIED OR FINANCIALLY ASSURED PRIOR TO RECORDING THE FINAL PLAT WITH WASHINGTON COUNTY. 1. Three mylar copies of the partition plat prepared by a land surveyor licensed to practice in Oregon, and necessary data or narrative. B. The partition plat and data or narrative shall be drawn to the minimum standards set forth by the Oregon Revised Statutes (ORS 92.05), Washington County, and by the City of Tigard. C. NOTICE OF DECISION - MLP 95- 0008 /SLR 95- 0009- BLACRSTONE - PAGE 2 • SECTION II - FINDINGS OF FACT: 1. Vicinity Information The new development site to be created is to the west of the existing home located at 13705 SW Hall Boulevard. Abutting properties in the area are also zoned for R -4.5 residential use and are largely developed with single - family residences. 2. Site Information and Proposal Description The applicant is requesting approval to divide a parcel which currently has an existing home that takes direct access from SW Hall Boulevard into two parcels, with an area of approximately 11,821 and 13,077 and a separate Tract A of 7,892 square feet is to be created as a buffer area to an adjoining wetlands area. 3. Agency Comments The Oregon Department of Transportation has reviewed and had the following comments concerning this proposal: 1. ODOT does not oppose this minor partition, but the existing access will be the only allowed access to tax lot 1000 from SW Hall Boulevard. The Building Department reviewed this request and had the following comments concerning this proposal: 1. The concentrated storm water to be directed to Tract A outfall to be protected to the satisfaction of the Building Division. GTE reviewed this request and had the following comments concerning this proposal: 1. The developer shall place conduit and provide trenches to GTE specifications. The Tualatin Valley Fire District reviewed this request and provided the following comments concerning this proposal: 1. This is not an approval but the Fire District has no problem with the request(s) made on this planning application. Prior to construction, however, the applicant must submit plans to this office showing the design of the emergency access roadway for review and approval. The access roadway shall comply with the Uniform Fire Code requirements. If there are questions concerning NOTICE OF DECISION - MLP 95- 0008 /SLR 95- 0009 - BLACKSTONE - PAGE 3 • 110 these requirements, please feel free to call the fire district at 526 -2469. The Engineering Department reviewed this request and provided the following findings concerning this proposal. Findings: 1. Streets: The site is located on the westerly side of SW Hall Boulevard mid -block between SW O'Mara Street and SW McDonald Street. SW Hall Boulevard is a State Highway and is shown as an arterial on the City Comprehensive Plan. Pursuant to Community Development Code Section 18.108.060(B), direct access to arterials and collectors from single family residences should be discouraged or combined to minimize driveways onto any arterial street. The site plan shows an easement access to SW Hall Boulevard which should be a joint access for the two parcels. The existing right -of -way for SW Hall Boulevard is 20 feet from centerline which is not consistent with City Standards. The applicant should dedicate additional right -of -way to establish a 45 foot width as measured from the centerline. As noted, the parcel is located midway between two existing streets connecting to SW Hall Boulevard and it is recommended that a future street be established along the northerly boundary of this parcel. The application has shown a reservation or setback of 24 feet, the typical half - street for a local street. The applicant should be required to dedicate this 24 foot strip and reserve it for future construction that would occur with the development of adjacent properties, extending the street over to SW Edgewood Street. Due to the limited site constraints of the properties to the north the applicant may reserve a street less than 24 feet in width but not less than 15 feet in width. The street dedication should include a corner dedication with a radius of 17 feet connecting to SW Hall Boulevard. In the interim, the applicant would construct a temporary 10 foot wide easement road along the 24 foot strip to provide access to the rear parcel until the development of the future street. The final design of the vertical and horizontal alignment of the driveway shall include provisions for the future road construction and be approved by the Engineering Department prior to construction. Also, the applicant should establish a NOTICE OF DECISION - MLP 95- 0008 /SLR 95- 0009 - BLACKSTONE - PAGE 4 joint use and maintenance agreement for the proposed joint use driveway. SW Hall Boulevard is not improved to City standards and the applicant should be required to sign an agreement to waive the right to oppose or remonstrate against the formation of a future Local Improvement District (LID) to improve SW Hall Boulevard. In addition, the applicant should provide a similar agreement for any future LID that would be formed to improve the future east /west street along the northerly property line. 2. Sanitary Sewer: Sanitary sewer service will be available with the construction of a new eight inch public sewer main in an existing easement crossing this property. The new sewer is scheduled for construction for this summer with a contract to be administered by the Unified Sewerage Agency. Upon completion, the sewer main will have sufficient capacity to serve the site. 3. Storm Sewer: A minor creek tributary to Fanno Creek crosses the existing property that flows in a southeasterly direction to an existing culvert in SW Hall Boulevard. The applicant has requested approval of a Sensitive Lands Review to allow the construction of the proposed driveway and future street that will cross over the creek and the narrow wetland adjacent to the creek. The driveway construction will require the installation of a culvert for the creek flow. The applicant shall provide a hydrology and hydraulic study to verify the size and slope of the culvert, in accordance with City standards, and be approved by the Engineering Department. The roof and site drainage for the new building construction should be directed to a public facility, or an on -site system designed to prevent runoff onto the adjacent property. The Police Department, the Maintenance Services Division, the Water Department, the Unified Sewerage Agency and Portland General Electric have reviewed this application and had no concerns or comments. SECTION III - ANALYSIS AND CONCLUSIONS: Section 18.84.040(D) states that the Director shall approve or approve with conditions an application request for sensitive lands NOTICE OF DECISION - MLP 95- 0008 /SLR 95- 0009 - BLACKSTONE - PAGE 5 • I permit within wetlands based upon findings that all of the following criteria have been satisfied: 1. The proposed landform alteration or development is neither on wetland in an area designated as significant wetland on the Comprehensive Plan Floodplain and Wetland Map nor is within 25 feet of such a wetland. A portion of the site is within a wetland area but it is not designated as significant wetland on the Comprehensive Plan Floodplain and Wetland Map. The applicant is required to obtain all necessary erosion control permits from the Unified Sewerage Agency. 2. The extent and nature of the proposed landform alteration or development will not create site disturbances to an extent greater than the minimum required for the use. Because the applicant has proposed to develop the narrowest street widths permissible. For this reason the landform alteration is the minimum necessary to accommodate development of this lot. The applicant has proposed to dedicate a 24 feet for future street right - of -way along the northern portion of the property. To serve both lots the applicant is required to develop a minimum of a 10 foot wide joint access driveway to SW Hall Boulevard. 3. Any encroachment or change in on -site or off -site drainage which would adversely impact wetland characteristics have been mitigated. Prior to construction of any street or utility over the wetlands. The applicant is required to obtain all necessary erosion control permits from the Unified Sewerage Agency. 4. Where natural vegetation has been removed due to landform alteration or development, erosion control provisions of the Surface Water Management program of Washington County must be met and areas not covered by structures or impervious surfaces will be replanted in like or similar species in accordance with Chapter 18.100, Landscaping and Screening. Due to existing development constraints some of the vegetation will need to be removed and cleared during construction to accommodate the driveway and future street. All required erosion control measures will be implemented during construction. 5. All other sensitive lands requirements of this chapter have been met. The applicable sensitive lands requirements have been met as addressed elsewhere within this report. 6. The provisions of Chapter 18.150, Tree Removal, shall be met. A tree removal will be required prior to the NOTICE OF DECISION - MLP 95- 0008 /SLR 95- 0009 - BLACKSTONE - PAGE 6 removal trees larger than six is in diameter. 7. Physical Limitations and Natural Hazards, Floodplains and Wetlands, Natural Areas, and Parks, Recreation and Open Space policies of the Comprehensive Plan have been satisfied. Development of the street will not impact the ' wetlands area because the applicant is required to provide approved erosion control measures to minimize erosion impacts of construction on wetlands areas. The applicant is also required to obtain any necessary permits from the Division of State Lands related to performing any landform alteration modifications to the wetlands. The applicant has not indicated a need to do any such modifications. This wetlands does not include any 100 -year floodplain areas. The wetlands is not designated as a significant wetlands as reviewed within the Natural Features and Open Space Report within the Comprehensive Plan. Comprehensive Plan Policy 3.5 states that small open space areas such as this should be preserved for their open space and aesthetic values. The applicant has proposed to establish an open space tract to buffer the wetlands area. Due to existing development constraints the applicant will need to encroach into the buffer to construct utilities, the driveway and future street improvements within the street reservation. This encroachment would be to the least extent possible in order to construct the required improvements. These improvements may in the future serve the larger area as planned through the development of the local street network. This encroachment within the buffer area is permissible where appropriate erosion control measures are followed. Section 18.162.040 contains the following general approval criteria for a Minor Land Partition: 1. The proposal conforms with the city's comprehensive plan; 2. The proposed partition complies with all statutory and ordinance requirements and regulations; 3. Adequate public facilities are available to serve the proposal; 4. All proposed lots conform to the size and dimensional requirements of this title; and 5. All proposed improvements meet city and applicable agency standards (Ord. 89 -06; Ord. 83 -52). NOTICE OF DECISION - MLP 95- 0008 /SLR 95- 0009 - BLACKSTONE - PAGE 7 410 The proposed parcels of approximately 11,821 and 13,070 square feet fall within the density range of the comprehensive plan. A separate undevelopable Tract A is proposed of 7,892 square feet. Each proposed lot also complies with the 7,500 square foot lot minimum in accordance with Criteria #1 and Chapter 18.92. Upon completion of the review period the applicants request will have complied with the statutory requirements of the City of Tigard for review of this application as required by Criteria #2. Adequate public facilities are available or have been required to be provided to serve this site as set forth in Sections 18.164.030 (Streets), 18.164.090 (Sanitary Sewer), and 18.164.100 (Storm Drain) as required by Criteria #3. The applicant has been required to sign a waiver non - remonstrance for the formation of a future Local Improvement District from the properties SW Hall Boulevard frontage. Sanitary sewer service will be available to serve this property upon extension of a sewer trunk in this area under a proposed Capital Improvement project being administered by the Unified Sewerage Agency. It is recommended that the plat not be recorded until the sewer extension project has been completed. Through the Building Permit review the roof and site drainage for the new home to be built on the site will be required to be directed to a public facility or through the use of an approved on -site system. Prior to development of the future driveway and utilities a hydrology and hydraulics analysis will be required to correctly size the facility. The new parcels do not exceed a two and one half to one length to depth ratio and each newly created parcel exceeds 50 feet in average width. The parcel configurations conform with size and dimensional requirements of the zone as required by Criteria #4. All proposed improvements will comply with City and applicable agency standards in satisfaction with Criteria #5 as reviewed through the building permit plan check review process. The newly created parcels comply with the basic solar access requirement which is that 800 of all newly created lots shall have a minimum north -south dimension of 90 feet. Both proposed parcels meet the Basic Solar access standard by providing a north -south lot dimension in excess of 90 feet within 20 degrees of true north. Review of the future structure on the new lot through the Building Permit process to address off -site shade impacts. Section 18.162.050 contains the following provisions for lots NOTICE OF DECISION - MLP 95- 0008 /SLR 95- 0009 - BLACKSTONE - PAGE 8 411 411 created through the partition process: A. Lot Width: The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district. B. Lot Area: The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the accessway may not be included in the lot area calculation. C. Lot Frontage: Each lot created through the partition process shall front a public right -of -way by at least 15 feet or have a legally recorded minimum 15 foot wide access easement. D. Setbacks: Setbacks shall be as required by the applicable zoning district. E. Front Yard Determination for Flag Lot: When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. F. Screening on Flag Lots: A screen shall be provided along the property line of a lot of record where the paved drive in an accessway is located within ten feet of an abutting lot in accordance with Sections 18.100.080 and 18.100.090. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. G. Fire Protection: The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire fighting capabilities. H. Reciprocal Easements: Where a common drive is to be provided to serve more than one lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. I. Accessway: Any accessway shall comply with the standards set forth in Chapter 18.108, Access, Egress, and Circulation. J. Where landfill and /or development is allowed within or adjacent to the one - hundred -year floodplain, the City shall require the dedication of sufficient open land area for greenway adjoining and within the floodplain. This NOTICE OF DECISION - MLP 95- 0008 /SLR 95- 0009- BLACRSTONE - PAGE 9 411 410 area shall include portions at a suitable elevation for the construction of a pedestrian /bicycle pathway with the floodplain in accordance with the adopted pedestrian /bicycle pathway plan. Criteria A, B, C, and D are satisfied. The proposed parcels will both exceed the average lot width of 50 feet and area requirement of 7,500 square feet set forth within the R -4.5 zoning district and the density computation standards set forth in Section 18.92. Each newly created parcel would have in excess of 15 feet of direct frontage on a dedicated street in satisfaction of the lot frontage requirement in Criteria C. Sections 18.50, 18.100 and 18.102 set forth standards for setbacks, clear vision and landscape buffering which will be reviewed through the building permit plan check review in satisfaction of Criteria D. Criteria E is not applicable because the new lot which would be created is not a flag lot in terms of access frontage to a publicly dedicated street. Criteria F is not applicable because the new lot which would be created is not a flag lot. Therefore privacy screening along an access drive is not required. Fire hydrants shall be consistent with Uniform Fire Code standards thereby satisfying Criteria G. Criteria H which requires reciprocal access maintenance agreement to maintain a joint access easement is not required because a flag lot parcel configuration has not been proposed. Criteria I is satisfied through the requirement for construction of a 10 foot minimum driveway width driveway with the 24 foot street reservation. Criteria J has been met because the parcel is not located within the 100 year flood plain or in areas with slopes exceeding 25 percent. The existing home has frontage which abuts the SW Hall Boulevard. This portion of SW Hall Boulevard does not abut an existing bike and /or pedestrian path. One of the required conditions of approval requires that applicant agree to sign a waiver of remonstrance against the formation of a future Local Improvement District at such time as bike and /or pedestrian path improvements are constructed. SECTION IV - DECISION: The Planning Division hereby recommends APPROVAL of Minor Land Partition 95 -0008 and Sensitive Lands Review 95 -0009 subject to the conditions listed in Section I at the beginning of this decision. CLEAR VISION AREA The City requires that clear vision areas be maintained between three and eight feet in height at roadldriveway, roadlrailroad, and roadlroad intersections. The size of the required clear vision area depends upon the abutting street's functional classification. (Refer to Code Section 18.102) BUFFERING AND SCREENING In order to increase privacy and to either reduce or eliminate adverse noise or visual impacts between adjacent developments, especially between different land uses, the City requires landscaped buffer areas along certain site perimeters. Required buffer areas are described by the Code in terms of width. Buffer areas must be occupied by a mixture of deciduous and evergreen trees and shrubs and must also achieve a balance between vertical and horizontal plantings. Site obscuring screens or fences may also be required; these are often advisable even if not required by the Code. Street trees should be spaced 20 to 40 feet apart depending on the branching width of the proposed tree species at maturity. Further information on regulations affecting street trees may be obtained from the Planning Division. A minimum of one tree for every seven parking spaces must be planted in and around all parking areas in order to provide a vegetative canopy effect. Landscaped parking areas shall include special design features which effectively screen the parking lot areas from view. I would have responded sooner but was out of the office last week. • We understand the concern for added traffic and the changes associated with it. The street reservation which accompanies the Blackstone partition provides for an opportunity for connection to Edgewood. As I am sure you are already aware, it does not guarantee the connection. The actual location of any street will depend on the plans and timing of the area property owners. The potential for extension from Hall Boulevard to Edgewood Street may also provide access to sewer service for the Edgewood Street area for new development or failing septic tanks. The City prefers through - street connectivity wherever possible to disperse current and future traffic impacts. Much of the City's traffic problems are the result of the lack of connectivity due to numerous dead -ends and cul-de -sacs which do not provide traffic options. The proposed street you have shown in you letter is also a viable option for at least part of the land adjacent to Edgewood Street. It will, of course, take agreements from the property owners relative to cost sharing and dedication. The Blackstone partition is compatible with your proposal. Specifically, we write with regard to the possibility of a road through the lot west of tax lot 1000 to connect Edgewood Street with Hall Boulevard (page 4, Findings, Streets, paragraph 3). We, the undersigned, are opposed to that suggestion. However, we do appreciate the need for access for future lot subdivision along Edgewood and Hall. This letter is written in a spirit of seeking to maintain what so many people have sought and found along Edgewood St., while at the same time seeking to offer solutions needed for future access. One of the very attractive aspects of living along Edgewood St. is that the traffic volume is relatively low. The street forms a loop connected to O'Mara St. at both ends, so is not attractive as a route for through traffic. If the suggested street is completed from Edgewood to Hall, traffic volume would increase markedly. Edgewood St. would immediately become an attractive option for through traffic with all the associated decline in living environment associated with that change. For example, hazards for small children due to traffic would increase, and street noise would increase. Due to the increased volume, Edgewood could have to be widened and resurfaced to handle the traffic. The street surface is currently oiled gravel that was put in by the local residents prior to being annexed by the City of Tigard. The cost of street improvement to home owners and tax payers is not necessary if traffic volume remains low. As part of the project, several trees would have to be removed, some being quite large. As time passes, the lots along Edgewood and Hall will probably be further developed if possible. How, then, can access be obtained without damaging the environment of Edgewood St.? We suggest that a street accessing Hall as proposed but running along the east edge of the Edgewood properties (a 12' easement) and along the west edge of the Hall properties (a 12' easement) would have the lowest impact on any given property owner (see attached map). This street would dead -end at the south end of the properties located on O'Mara to form a cul -de -sac. Access would be provided for property development, but Edgewood St. would maintain its relatively quiet environment. , 410 410 While others may find fault with our suggestion, we are willing to work with the City of Tigard to find a reasonable solution to the problem of access to support development, but we are opposed to a street running straight through from Edgewood to Hall as suggested in MLP 95 -0008. The existing house on the site will remain. Findings: 1. Streets: The site is located on the westerly side of SW Hall Boulevard mid - block between SW O'Mara Street and SW McDonald Street. SW Hall Boulevard is a State Highway and is shown as an arterial on the City Comprehensive Plan. Pursuant to CDC Section 18.108.060B, direct access to arterials and collectors from single family residences should be discouraged or combined to minimize driveways onto any arterial street. The site plan shows an easement access to SW Hall Boulevard which should be a joint access for the to parcels. The existing right -of -way for SW Hall Boulevard is 20 feet from centerline which is not consistent with City Standards. The applicant should dedicate additional right -of -way to establish a 45 foot width as measured from the centerline. As noted, the parcel is located midway between two existing streets connecting to SW Hall Boulevard and it is recommended that a future street be established along the northerly boundary of this parcel. The application has shown a reservation or setback of 24 feet, the typical half- street for a local street. The applicant should be required to dedicate this 24 foot strip and reserve it for future construction that would occur with the development of adjacent properties, extending the street over to SE Edgewood Street. The street dedication should include a corner dedication with a radius of 17 feet connecting to SW Hall Boulevard. In the interim, the applicant would construct a temporary 10 foot wide easement road along the 24 foot strip to provide access to the rear parcel until the development of the future street. The final design of the vertical and horizontal alignment of the driveway shall include provisions for the future road construction and be approved by the Engineering Department prior to construction. Also, the applicant should establish a joint use and maintenance agreement for the proposed joint use driveway. ENGINEERING COMMENTS MLP 95 -08 BLACKSTONE PARTITION PAGE 1 • • SW Hall Boulevard is not improved to City standards and the applicant should be required to sign an agreement to waive the right to oppose or remonstrate against the formation of a future Local Improvement District (LID) to improve SW Hall Boulevard. In addition, the applicant should provide a similar agreement for any future LID that would be formed to improve the future east /west street along the northerly property line. 2. Sanitary Sewer: Sanitary sewer service will be available with the construction of a new 8" public sewer main in an existing easement crossing this property. The new sewer is scheduled for construction for this summer with a contract to be administered by the Unified Sewerage Agency. Upon completion, the sewer main will have sufficient capacity to serve the site. 3. Storm Sewer: A minor creek tributary to Fanno Creek crosses the existing property that flows in a southeasterly direction to an existing culvert in SW Hall Boulevard. The applicant has requested approval of a Sensitive Lands Review to allow the construction of the proposed driveway and future street that will cross over the creek and the narrow wetland adjacent to the creek.
