• • ° Exhibit A° NOTICE OF DECISION MINOR LAND PARTITION MLP 95 -0002 G OTTTE R APPLICATION: A request for a Minor Land Partition approval to divide one parcel of approximately 51,494 square feet into two parcels of approximately 14,071 and 37,423 square feet. ZONE: R -7 (Residential, 7 units per acre). LOCATION: 15900 SW 76th Avenue (WCTM 2S1 12CD, tax lot 500). APPLICABLE LAW: Community Development Code Chapters 18.52, 18.88, 18.162.040, 18.162.050, 18.164.030, 18.164.090, 18.164.100. DECISION: Notice is hereby given that the Planning Director's designee for the City of Tigard has APPROVED Minor Land Partition MLP 95 -0002 SUBJECT TO CERTAIN CONDITIONS as listed below. SECTION I - CONDITIONS OF APPROVAL: THE FOLLOWING CONDITIONS SHALL BE SATISFIED OR FINANCIALLY SECURED PRIOR TO RECORDING THE FINAL PLAT. UNLESS OTHERWISE NOTED, THE STAFF CONTACT FOR ALL CONDITIONS SHALL BE MICHAEL ANDERSON, ENGINEERING DIVISION: 1. A joint use and maintenance agreement shall be executed and recorded on City standard forms for all common driveways. The agreement shall be referenced on and become part of all applicable parcel Deeds. The agreement shall be approved by the Engineering Department prior to recording. The applicant shall obtain a Street Opening Permit for the construction of the storm drain connections to the existing 24" storm drain pipe. Three copies of the partition plat prepared by a land surveyor licensed to practice in Oregon, and necessary data or narrative. B. The partition plat and data or narrative shall be drawn to the minimum standards set forth by the Oregon Revised Statutes (ORS 92.05), Washington County, and by the City of Tigard. • • • C. The applicant shall indicate on the partition plat that the Tots share a common driveway, and shall reference the recording data relating to the joint use and maintenance agreement on the partition plat. STAFF CONTACT: John Hadley, Engineering Department (639- 4171). 4. Plan which shows screening along the flage pole driveway in accordance with section 18.100.080 and 18.100.090. PRIOR TO THE ISSUANCE OF A BUILDING PERMIT THE FOLLOWING CONDITIONS SHALL BE SATISFIED OR FINANCIALLY ASSURED: 5. Provide the Engineering Department with a recorded mylar copy of the partition plat; or if not recorded with Washington County but has been approved by the City of Tigard the applicant shall have 30 days after recording with Washington County to submit the copy. 6. The applicant shall provide for roof and pavement rain drainage to the public stormwater drainage system or by an on -site system designed to prevent runoff onto the adjacent property. STAFF CONTACT: David Scott, Building Division (639- 4171). SECTION II - FINDINGS OF FACT: 1. Vicinity Information The subject site is located north of SW Durham Road, east of the intersection of SW Bond Street and SW 76th Avenue. Adjacent properties to the north and south are zoned R -7 (Residential, 7 units per acre). Properties to the east are zoned I -P (Industrial Park). Properties to the west are zoned R -12 (Residential, 12 units per acre) and R-4.5 (Residential, 4.5 units per acre). 2. Site Information and Proposal Description This site is approximately 51,494 square feet in size and was created with a Minor Land Partition approval MLP 94 -0015. An existing single family house presently occupies the site with access onto SW 76th Avenue. The applicant requests a Minor Land Partition approval to divide one parcel of approximately 51,494 square feet into two parcels of approximately 14,071 and 37,423 square feet. 3. Agency Comments The City of Tigard Building Division has reviewed this proposal and has offered the following comments: It appears that the storm goes directly into a public storm swale. Does this swale lie in a public easement? NOTICE OF DECISION MLP 95 -0002 GOTTER Page 2 • • • General Telephone and Electronics has reviewed this proposal and has offered the following comments: The developer to provide trench / conduit to GTE's specifications. The City of Tigard Public Works, City of Tigard Water District, Unified Sewerage Agency, Tualatin Valley Fire District, and Portland General Electric have reviewed this proposal and have no objection to it. No other comments have been received. SECTION III - FINDINGS AND CONCLUSIONS - Minor Land Partition Section 18.162.040 contains the following general approval criteria for a Minor Land Partition: 1. The proposal conforms with the City's Comprehensive Plan; 2. The proposed partition complies with all statutory and ordinance requirements and regulations; 3. Adequate public facilities are available to serve the proposal; 4. All proposed lots conform to the size and dimensional requirements of this title; and 5. All proposed improvements meet City and applicable agency standards (Ord. 89 -06; Ord. 83 -52). The proposal conforms with the City's Comprehensive Plan in that the newly created lot will allow for residential development. This proposal therefore is not in conflict with the Medium Density Comprehensive Plan designation. This proposed partition complies with all statutory and ordinance requirements and regulations as demonstrated both by the analysis presented within this administrative decision and by this application and review process. Adequate public facilities are available to serve the proposal. Section 18.162.050 contains the following special provisions for lots created through the partition process: A. Lot Width: The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district. B. Lot Area: The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the accessway may not be included in the lot area calculation. Lot Frontage: Each lot created through the partition process shall front a public right -of -way by at least 15 feet or have a legally recorded minimum 15 foot wide access easement. D. Setbacks: Setbacks shall be as required by the applicable zoning district. E. Front Yard Determination for Flag Lot: When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. F. Screening on Flag Lots: A screen shall be provided along the property line of a lot of record where the paved drive in an accessway is located within ten feet of an abutting lot in accordance with Sections 18.100.080 and 18.100.090. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. G. Fire Protection: The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire fighting capabilities. H. Reciprocal Easements: Where a common drive is to be provided to serve more than one lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. I. Accessway: Any accessway shall comply with the standards set forth in Chapter 18.108, Access, Egress, and Circulation. J. Where landfill and /or development is allowed within or adjacent to the one - hundred -year floodplain, the City shall require the dedication of sufficient open land area for greenway adjoining and within the floodplain. This area shall include portions at a suitable elevation for the construction of a pedestrian /bicycle pathway with the floodplain in accordance with the adopted pedestrian /bicycle pathway plan. Criteria A is satisfied as the proposed lot widths are 70 and 140 feet respectively, thereby exceeding the minimum 50 foot lot width requirement in the R -7 zone. Criteria B is satisfied as this partition would create lots of approximately 14,071 and 37,423 square feet, exceeding the 5,000 square foot minimum lot size requirement. Criteria C is satisfied as each lot shall have a 15 foot access easement to SW 76th Avenue. NOTICE OF DECISION MLP 95 -0002 GOTTER Page 4 • • The required setbacks in the R -7 zone are as follows: front yard - 15 feet; side yard - 5 feet; rear yard - 15 feet; garage - 20 feet; flag lot side yard - 10 feet. As indicated on the site plan, the existing single family home on parcel 2 complies with the setbacks, satisfying Criteria D. Setbacks on parcel 1 will be reviewed when it is built upon. Criteria E is satisfied on parcel 2 and shall be determined on parcel 1 when it is built upon. Criteria F shall be satisfied as screening shall be provided along the flag pole driveway, along the frontage of parcel 1. Fire hydrants shall be consistent with Uniform Fire Code standards thereby satisfying Criteria G. Criteria H shall be satisfied as a shared access and joint use and maintenance agreement shall be provided. Criteria I is satisfied as the site plan shows the provision of a 10 foot paved driveway, with an existing turnaround. Individual driveway provision for parcel 1 will be reviewed when it is built upon. Criteria J requires the dedication of land within the floodplain for greenway and public pathway purposes. Section 18.26 defines development in part as dividing land into two or more parcels, therefore Criteria J would require the dedication of land within the 100 -year floodplain. The partition would create two lots approximately 150 feet from the flooplain boundary. Given the recent Dolan Supreme Court Decision, a condition can be imposed based upon a "rough proportionality" between the impact of the development and the condition imposed. Given the limited nature of the partition and the distance from the floodplain, dedication of land for greenway and pathway purposes is not justified. Therefore, Criteria J is not applicable to this application. The City would encourage the applicant to provide for either dedication or an easement for public greenway and pedestrian pathway for the portion of the property within the 100 -year floodplain. Section 18.88.010 (Solar Access) states that all newly created lots within the City of Tigard shall promote the use of renewable energy sources by providing for improved access to sunlight for residential dwellings. A lot meets the basic requirement if it has a north -south dimension of 90 feet or more and has a front lot line that is oriented within 30 degrees of a true east -west axis. As indicated on the site plan, each lot complies with the basic requirement. Sections 18.164.030 (Streets), 18.164.090 (Sanitary Sewer), and 18.164.100 (Storm Drains) have been addressed and are satisfied as specified below: 1. Streets: Access to the site is provided by a 15 foot wide easement connecting to SW 76th Avenue, a local street. The 25 foot half street right -of -way width for SW 76th Avenue, adjacent to the property, was dedicated on the previous partition plat, as conditioned NOTICE OF DECISION MLP 95 -0002 GOTTER Page 5 • • by MLP 94 -0015, and no additional street dedication is necessary. The applicant should provide a joint use and maintenance agreement for the 15 foot wide easement proposed for the new lots. The applicant previously provided an agreement not to remonstrate the formation of a future LID for the improvement of SW 76th Avenue which is applicable to the new lots. 2. Sanitary Sewer: Sanitary sewer service is provided by the existing 8" sewer located in an easement contiguous to the northerly boundary line of the site. The sewer has sufficient capacity for the proposed development. 3. Storm Sewer: The property slopes in a northerly direction toward the existing swale at the rear of the property that drains to Fanno Creek, contiguous to the easterly property line. The new roof and pavement drainage from the proposed development of the new parcels should connect to the 24" diameter public stormwater system located within the adjacent swale. SECTION IV - DECISION The Planning Division hereby APPROVES Minor Land Partition MLP 95 -0002 subject to the conditions listed in Section I at the beginning of this decision. THIS APPROVAL IS VALID IF EXERCISED WITHIN EIGHTEEN MONTHS OF THE EFFECTIVE DATE OF THIS DECISION. 1. Performance Options - There are two performance options which may be utilized as follows: a. The house to be oriented within 30 degrees of an east -west axis and have at least 80% of the ground floor's south wall protected from shade. b. At least 32% of the glass and 500 square feet of the roof area face south and be protected from shade. PARKING AND ACCESS All parking areas and driveways must be paved. • Single family: Requires 2 off-street parking spaces per dwelling unit. • Multiple family: Requires 1.5 parking spaces per unit for 1 bedroom. Requires 2 parking spaces per unit for 1+ bedrooms. Multi-family dwelling units with more than 10 required spaces shall provide parking for the use of guests and shall consist of 15% of the total required parking. CLEAR VISION AREA The City requires that clear vision areas be maintained between three and eight feet in height at road/driveway, roadlrailroad, and roadlroad intersections. The size of the required clear vision area depends upon the abutting street's functional classification. (Refer to Code Section 18.102) BUFFERING AND SCREENING In order to increase privacy and • either reduce or eliminate adverse noise or visual impacts between adjacent developments, especially between different land use the City requires landscaped buffer areas along certain site perimeters. Required buffer areas are described by the Code in terms of 'dth. Buffer areas must be occupied by a mixture of deciduous and evergreen trees and shrubs and must also achieve a balance be een vertical and horizontal plantings. Site obscuring screens or fences may also be required; these are often advisable even if not r•; ired by the Code. The required buffer areas may only be occupied by vegetation, fences, utilities, and walkways. Street trees should be spaced 20 to 40 feet apart depending on the branching width of the proposed tree species at maturity. A minimum of one tree for every seven parking spaces must be planted in and around all parking areas in order to provide a vegetative canopy effect. PLEASE NOTE: Applications submitted by mail or dropped off at the counter without Planning Division acceptance may be returned. Applications submitted after 4:30 P.M. on Thursday will be batched for processing with the following week's applications. Applications will RIOT be accepted after 3:00 P.M. on Fridays or 4:30 on other days. Maps submitted with an application shall be folded IN ADVANCE to 8.5 by 11 inches. The Traffic Impact Fee program collects fees from new development based on the development's projected impact upon the City's transportation system. The applicant shall be required to pay a fee based upon the number of trips which are projected to result from the proposed development. Buffer areas must be occupied by a mixture of deciduous and evergreen trees and shrubs and must also achieve a balance between vertical and horizontal plantings. Site obscuring screens or fences may also be required; these are often advisable even if not required by the Code. CO. � V-• Applicant is requesting approval to divide Lot 3 of the minor lot partition of Tax Lot 2S1 12CD 500, a 51,494 sft parcel located at 15900 SW 76th Avenue, into two parcels with areas of approximately 14,071 sft, and 37,423 sft respectively. The larger parcel would retain the existing house that occupies the rear portion if the site. Findings: 1. Streets: Access to the site is provided by a 15 foot wide easement connecting to SW 76th Avenue, a local street. The 25 foot half street right - of -way width for SW 76th Avenue, adjacent to the property, was dedicated on the previous partition plat, as conditioned by MLP 94- 0015, and no additional street dedication is necessary. The applicant should provide a joint use and maintenance agreement for the 15 foot wide easement proposed for the new lots. The applicant previously provided an agreement not to remonstrate the formation of a future LID for the improvement of SW 76th Avenue which is applicable to the new lots. 2. Sanitary Sewer: Sanitary sewer service is provided by the existing 8" sewer located in an easement contiguous to the northerly boundary line of the site. The sewer has sufficient capacity for the proposed development. 3. Storm Sewer: The property slopes in a northerly direction toward the existing swale at the rear of the property that drains to Fanno Creek, contiguous to the easterly property line. The new roof and pavement drainage from the proposed development of the new parcels should connect to the 24" diameter public stormwater system located within the adjacent swale. Recommendations: ALL CONDITIONS SHALL BE SATISFIED OR FINANCIALLY ASSURED PRIOR TO RECORDING THE FINAL PLAT WITH WASHINGTON COUNTY. 1. A joint use and maintenance agreement shall be executed and recorded on City standard forms for all common driveways.
