DIR1999-00001 DATE: 2/23/1999 CODE SECTIONS: 18.130 I /167 / 18.520 I TOPIC: Use Classification: Floral Business in the CBD Zone INTERPRETATION: RE: FLORAL BUSINESS AT 8770 SW BURNHAM STREET (DBA: FLOWERS BY DANA KIM) Thank you for your letter dated February 19, 1999 in which you describe the nature of the flower business you propose to locate at the above address. As we previously discussed, the property in question is currently used for Light Manufacturing. A change of use of all or part of the building area would require a Site Development Review (Tigard Municipal Code (TMC) Chapter 18.360). The City's concern was to determine whether your proposed floral business would constitute a change of use. Your letter clearly describes a use that meets the definition of Light Manufacturing, rather than retail or wholesale. "Light Manufacturing" is defined as... "production, processing, assembling, packaging or treatment of finished products from previously prepared materials or components...examples include...art work...." (TMC 18.130.020.D.2.a). Your letter states that there will be no "walk -in" customers and you are not receiving and /or distributing a finished product to other retail locations. Therefore, this letter is formal notification that the use described in your letter may be operated from the Burnham Street location without need for further Land Use review. A sign on your door would be classified as a "wall sign" and may be permissible, however, you will need a sign permit. Wall signs in the CBD zone are limited to 15% coverage of the total wall area. The area restriction includes any signs associated with the primary use of the building. Sign permits can be obtained from Development Services at City Hall.
