INTERPRETATION: HAWK'S BEARD TOWNHOMES
I am writing in response to your request for an interpretation of Tigard Development Code
(TDC) Section 18.720.030(A) which prescribes design standards for multi - family or
attached single - family developments when they are adjacent to properties zoned for
detached single - family developments.
Specifically, you have requested an interpretation to address the height requirements that
you expect will be imposed on Hawk's Beard Townhomes (PDR2002- 00002/SUB2002-
00005). The section states that "building height shall not exceed two stories or 25 feet
within 30 feet of the property line or three stories or 35 feet within 50 feet of the property
line." Density transitions are used to mitigate impacts that may be incurred by a
development that is characterized by single - family developments from multi - family or
attached single - family developments.
Density is the key word in this interpretation. The property you are seeking to develop is
zoned R -25. The properties around you are also zoned R -25 with the exception of the
property east of you which is zoned R -7 and separated by SW 130th Avenue. Properties
that are zoned R -25 are designated Medium -High Density in the comprehensive plan map,
and are designed to accommodate higher densities. Under that premise, there is not a
need for density transition and, therefore, your development would not be required to meet
the specific design standards in Section 18.720.030(A). In fact, properties that are zoned
for single - family residence densities are typically R -1 through R -7. The remainder is zoned
for higher density housing types but allow
single - family developments to occur.
