CONDITIONS OF APPROVAL
°PRIOR TO ISSUANCE OF BUILDING PERMITS, THE FOLLOWING
CONDITIONS SHALL BE SATISFIED: (Unless otherwise noted the staff contact
shall be Mark Roberts in the Planning Oivision!,M, 41.71):
1. The existing storage shed shall be reconstructed as necessary so that the face
of the shed's wall is no closer than 12 feet to the rear yard property line.
2. The applicant shall provide a plan for screening and buffering. The applicant shall
also construct or plant the required screening and buffering materials. At 'a
minimum, the plan shall provide the following elements; one (1) row of trees and
one (1) row of shrubs. The applicant shall also provide one (1) of the following: a
five (5)-foot-tall fence, a hedge that will form a four (4)-foot continuous barrier
within two (2) years, or a six (6)-foot tall landscape berm. Alternatively, the plan .
may provide another combination of screening and buffering elements that provide
the same screening and buffering.
SECTION 111: BACKGROUND INFORMATION
Site History:
The subject property is developed with a detached single-family residence that was
developed as a part of the Hillshire Woods Subdivision. The site is Lot 54 of the
Hillshire Woods Subdivision. The property owner has applied for the necessary permits
for 'the addition to the existing attached storage shed that was constructed without
Building Permits.
Proposal Description.
The property owner has proposed a flexible setback variance to encroach into the rear
yard setback for three (3) feet of the 15-foot rear yard setback minimum requirement.
This flexible setback variance permits an encroachment of up to 20% of the minimum
setback requirement.
SECTION IV: APPLICABLE REVIEW CRITERIA AND FINDINGS
COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS:
Section 18.146.050 allows the Director to approve, or approve with conditions, a request
for a Flexible Setback Variance in order to reduce required setbacks by up to 20% within
the front yard, sideyard, corner sideyard and rear yard based on the following findings:

1. The reduction of the setback area established by the applicable zoning
district shall be necessary to allow for the enlargement or remodeling of an
existing building. The proposed variance will allow an enlargement of the existing
residence.
2. The garage setback to the front property line satisfies the requirements of the
applicable zoning district. The variance involves the rear yard setback, therefore,
this. standard is not modified by this request.
3. The standards of Chapter 18.102, Visual Clearance, shall be satisfied. The
variance does not involve portions of the property that are either within, or adjoining,
a Visual Clearance area as defined by the Community Development Code.
4. The resulting lot coverage shall not exceed the maximum lot coverage of the
base zone. The R-7 Zoning District restricts lot coverage to a maximum of 85% of
the total lot area. Based on the site plan that was provided, the total hard surfaces
on the property including the footprint of the home, the driveway, deck areas, and
the proposed building addition, do not exceed the maximum allowable lot
coverage.
5. The proposed building or addition shall not encroach upon any existing
easements. The statutory warranty deed states that an eight (8)-foot public utility
easement exists along the lots' frontage on SW Windsong Court and SW Walnut
Lane. The proposed building addition does not encroach into this recorded public
utility easement.
6. When the proposed building or addition is within the rear yard, the setback
adjacent to the rear property line shall be landscaped with sight obscuring
plantings in accordance with the standards set forth in Section 18.100.080,
Landscaping and Screening. The area where the addition was constructed does
not presently include the screening and buffering measures required by Section
18.100.080. Prior to issuance of Building Permits, the applicant shall provide a
plan for screening and buffering. The applicant shall also construct or plant the
required screening and buffering materials. At a minimum, the plan shall provide
the following elements: one (1) row of trees and one (1) row of shrubs. The
applicant shall also provide one (1) of the following: a five (5)-foot fence, a hedge
that will form a four (4)-foot continuous barrier within two (2) years, or a six (6)-foot
landscape berm. Alternatively, the plan may provide another combination of
screening'and buffering elements that provide the same screening and buffering.
7. Setback, buffering and screening requirements that apply when commercial
and industrial zones abut a residential zone shall be satisfied. The applicant
states that the building addition was actually constructed at a distance of 11 feet to
the rear yard property line. Prior to the issuance of Building Permits, the structure
shall be rebuilt to comply with the twelve (12)-foot setback standard. The
commercial and industrial screening and buffering standards require a minimum
of one (1) row of trees, one (1) row shrubs, and a fence hedge or wall be provided.
Alternatively, an equivalent level of screening and buffering can be, provided
through the use of another combination of elements.

SECTION V: OTHER STAFF COMMENTS
The Engineering Department and Building Division have both reviewed the
proposal and have offered no comments or objections.
SECTION VI: AGENCY COMMENTS
Utility providers are provided with a copy of this notice of decision. These
agencies will be able to request that the decision be amended, or set aside if the
requested setback variance would conflict with the provision of necessary
services or with existing utilities.
