The purpose of the R-12 zoning district is to provide for single-family attached and multiple-family residential units for medium density residential developments. SECTION III: BACKGROUND INFORMATION Site History: The sit was developed as a part of the Waverly Estates Subdivision that was developed with 46 detached single-family residences. The property is presently developed with a detached single-family residence. Vicinity Information: To the north are athletic fields that are part of the Tigard High School property. To the east, south, and southwest are existing homes within the Waverly Estates Subdivision. To the west is SW 92nd Avenue. Proposal Description: The applicant proposes to construct a six (6)-foot tall fence along a portion of the applicant's street frontage on SW Waverly Drive and SW 92nd Avenue. Because of the property's triangular shape, the Community Development Code states that the entire street frontage adjoining SW Waverly Drive is a front yard setback area. SECTION IV: APPLICABLE REVIEW CRITERIA AND FINDINGS COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: Section 18.134.050 allows the Director to approve, or approve with conditions, a request for a variance based on the following findings: The proposed variance will not be materially detrimental to the purposes of this title, be in conflict with the policies of the Comprehensive Plan, to any other applicable policies and standards, and to any other properties in the same zoning district or vicinity. The proposed variance will allow a limited increase to the height of a fence within an area that is defined as a front yard setback because of the triangular shape of the property. The Development Code defines the front yard on a triangular lot in the R-12 zoning district as the 15-foot setback dimension area along the street frontages. There are special circumstances that exist which are peculiar to the lot size, shape, topography or other circumstances over which the applicant has no control, and which are not applicable to other properties in the same zoning district; The property is of a triangular shape with the properties longest dimension along the street frontage. The applicant has proposed to construct a fence within an area that functions as a part of the property's side yard area because of the design of the home on the.lot. NOTICE OF DECISION VAR 97-0007 - REED FENCE HEIGHT VARIANCE PAGE 2 OF 4 The use proposed will be the same as permitted under this title and City standards will be maintained to the greatest extent that is reasonably possible while permitting some economic use of the land. A variance to the setback requirements would provide the applicant with limited relief from the City's development code standard for front yard fence height. The variance will allow the applicant to create more privacy within this area for private enjoyment of more of the property. Due to the property dimensions, there is currently a limited rear yard area. The fence height variance does not create a conflict with the Clear Vision requirements on either side of the applicant's driveway or at the intersection of SW 92nd Avenue and SW Waverly Drive. Also, due to existing development constraints of the adjoining properties, it is not readily feasible for the property owner to acquire additional property to expand private rear yard areas on this parcel. Existing physical and natural systems, such as but not limited to traffic, drainage, dramatic land forms or parks will not be adversely affected any more than would occur if the development were located as specified by this title. Due to the limited nature of the request, the variance does not affect the above mentioned, larger area natural and physical systems. The hardship is not self imposed and the variance requested is the minimum variance which would alleviate the hardship. The hardship was due to the configuration of the property which was dictated by the topography and shape of the underlying parcel on which Waverly Estates was developed. Because the variance allows a limited fence height encroachment into a portion of the properties front yard setback, the variance is the minimum required to allow private enjoyment of an extended front yard area given the applicants triangular shaped parcel. The additional privacy which would be provided through this variance would be similar to that enjoyed by other property owners of regularly shaped parcels located throughout the Waverly Estates Subdivision. SECTION V: OTHER STAFF COMMENTS The Engineering Department and Building Division have both had the opportunity to review this proposal and have offered no comments or objections. SECTION VI: AGENCY COMMENTS Affected Utility Agencies have been provided with a copy of.this notice of decision. These agencies will be able to request that the decision be amended, or set aside if the requested setback variance would conflict with the provision of necessary services or existing utilities.
