PERMANENT TRAFFIC SIGNAL EASEMENT
KNOWN ALL MEN BY THESE PRESENT THAT Byte Investments hereafter
called the Grantors, in consideration for the traffic signal at Bonita
) Road and 72nd Avenue from the City of Tigard, hereinafter called Grantee;
v grant and convey unto the City of Tigard a perpetual easement for the
construction, maintenance, and free access to, the traffic signal
apparatus on the following described parcel of land, situated in the City
of Tigard, Washington County, State of Oregon:
See attached Exhibit "A"
IT IS EXPRESSLY UNDERSTOOD that this easement does not convey any
right, title or interest except those expressly stated in this easement,
nor otherwise prevent Grantors from the full use and dominion thereover;
provided, however, that such use shall not be permitted to damage or
destroy the traffic signal apparatus or otherwise interfere with
construction, maintenance, and access to, such traffic signal apparatus,
and it is FURTHER UNDERSTOOD AND AGREED that the City of Tigard shall
never be required to be subject to any damages to the Grantors, their
heirs, successors, and assigns by reasons of change of access or grade
at the street abutting said property. All costs of installation,
maintenance, and power for the traffic signal apparatus shall be paid by
the City unless otherwise stated above.
IN CONSIDERATION of the premises, Grantee agrees that if Sid
Grantee, its successors or assigns should cause said easement to be
vacated, the right of the Grantee in the above-described easement will
be forfeited and shall immediately revert to the Grantors, their
successors, and assigns in the case of such event.
TO HAVE AND TO HOLD the above-described and granted premises unto
said Grantee, its successors, and assigns forever.
The Grantors does hereby covenant to and with the City of Tigard,
that it is the owner in fee simple of said premises; that the above
described property is free from all encumbrances, and that it will
warrant and defend the same from all lawful claims whatsoever.
IT IS WITNESS WHEREOF, the undersigned has caused this easement to
be executed.

TRAFFIC SIGNAL EASEMENT
A parcel of land situated in the Northeast quarter of Section 12,
Township 1 South, Range 1 West, Willamette Meridian, Washington
County, Oregon. Said parcel of land being more particularly
described as follows:
Beginning at the centerline intersection of S.W. Bonita Road (CR
736) and (CR 636) Engineering Station 7+82.40 and S.W.72nd Avenue
(CR 126) Engineering Station 67+25.88 as illustrated and recorded
.on Sheet 4 of 5 of CS 20,596, being a Record of Survey for the City
of Tigard, Washington County, Oregon. Thence Northerly along the
centerline of S.W. 72nd Avenue NO° 16'56"W a distance 69.04 feet to
Engineering Station 67+94.92, being 30 feet at right angle from the
point of curvature on the westerly right-of-way line merging left
into the northerly right-of-way line of S.W.Bonita Road; thence
turning 90 degrees to the left a distance of 30 feet to the west
right-of-way line; thence southwesterly along said right-of-way by
way of a curve an arc distance of 23.35 feet with radius of 40.00
feet, included angle of 33°27"05" (chord distance and bearing of
23.02 feet S16°26'36"W) to the True Point of Beginning. Thence by
way of the same curve a distance of 15.57 feet with radius of 40.00
feet, included angle of 22°18'02" (chord distance and bearing of

a distance of 4.00 feet to a point of curvature; thence by a curve
4.00 feet parallel and inward to the right-of-way an arc distance
