WHEREAS, the City of Tigard is authorized by ORS 222.120(4)(B) and 222.170 to iivtiate mi annexation
upon receiving consent in ~Nqiting from a majority of the electors registered in the territory proposed to he
annexed and written co.nsent from owners of more than hal:f the land in the territory proposed to be
annexed;and Wl:dFREAS, the City of 7igard is aulhorized by O.RS 222.120(5) and 222.520 to withdraw properties
which currently lie with.in the botuidary of the Tigard Water District, the Washington County Enhanced
Sheriffs Patrol District, Washington County Urban Roads Maintenance District, Waslvngton County Street
i,ighting District #1, Clean Watcr Services, aild the Washington County Vector Control Districl upon
completion of the aruiexation; and WHEREAS, the Tigard City Council held a puhlic hearing on January 22, 2002 to consider the annexation
of a parcel of land calsisting of 8.6 acres and withdrawal of said property from the Tigard Water District,
the Washington County Enhanced Sheriffs Patrol District, Washington County Urban Roads Maintenance
llistrict, Washington County Street Lighting Districl #1, Clean Water Services, and the Waslungton County .
Vector Control District; and
W14F.REAS, pursuant to ORS 222.520(2) the City is liable to the Water District for certain debt
obligarions, however, i.n this instaiice die tiVater District has no debt for the City to assume, therefore, np
option regarding the assumption of debt needs to bc madc; aiad
WIIEREAS, pursuacrt to Metro 3.09, ORS 222.120 and 222.524, notice was given and die City held a
public hearing on the issue of the annexation into the City and withdrawal of the annexed property from the
Tigard Water District, the Wash»igton County Er►hanced Sherif..Fs Patrol District, Washuigton County
Urbai1 Roads Maintenance District, Washington County Street Lighting District #l, Cleaii Water Services,
and the Washington Cuunty Vectcr Contral Distric: en Jar.uary 22, 2002; and
WHEREAS, pursuant to ORS 222.524, the City must declare the withdrawal of azinexed properties from
the Tigard Water District, the Washington County Enhanced Sheriffs Patro{ District, Washington County
Urban Roads Maintenance District, Washington County Street Lighring District #1, Clean Water Services,
and the Washington County Vector Control llistrict by Ordinance; and
WHEREAS, the Tigard Development Code states that upon annexation, the zone is automatically changed
to the City 2oning most closely confoiming to the County zoning; and
WI-IEREAS, the curreiit and proposed coning district is R-7, thercfore, no zorie change is necessary; and
VVHE.REAS, the annexation has been processed in accordance witli the requirements ofMetro 3.09 and has
been reviewed for compliance with the Tigard Community Developmcnt Code and the Comprehensive
Plan and the amiexation substantially addresses the standards in Metro 3.09 regulating annexations; and

WHEREAS, the City Council has carefully considered the testimony at the public hearing and deternuned
thal withdrawal of the aiuicxed properties froni the applicablc scrvicc districts is in the bc;st interest of the
City of Tigard.
~ NOW, THEREFORE, THE C1TY OF'TTGARD ORDAINS AS FOLLOWS:
SECTIQN 1: The Tigard City Council hereby annexes the parcels desciibed in the attached Exhibit "A"
and shown in Exhibit "B" and withdraws said parcels frbm the Tigard Water District, the
Washinston Couiity Enhwiced Shcriffs Patrol Distc-ict, Washington County Urban Roads
Maintenance District, Washington County Street Lightuig District #1, Clean Water
Services, and tlie Wasltington County Vectoc Control District.
SECTION 2: This ordinmace shall be effective 30 days after its passage by the Council, sionature by the
Mayor and posting by the City Recorder.
SECTION 3: The City Recorder is hereby directed to file certified copies of the Ordinance with Metro for
administrative processing.
SECTION 4: Pursuant to ORS 222.120(5), the effective date of the withdra'%val of the property from the
Washington County Enhanced Sheriff's Patrol llistrict, Waslvngton County Urban Roads
Maintenance District, Washington County Street Lighting District #1, Clcan Water '
Services, and the Washington County Vector Control District shall be the effective date of
this annexation.
SECTION 5: Pursuant to ORS 222.465, tlhe effectivc datc of tlie withdrawal of tlus property from the
Tigard Water District shall be July 1, 2002.
SECTXON fi: In accordance ~N7th ORS 222.180, the annexation shall be effective upon filing with the
Secretary of State.

(ZCA) 2001-00003 THORNWOOD ANNEXATION
REQUEST: The applicant is requesting to annex two (2) parcels of 8.6 acres into the
City of Tigard. This request follows the approval of the Thornwood Subdivision (Case
File No. SUB2000-00006), and is a requirement of that approval. LOCATION:
Washington County Tax Assessor's Map Number 2S110BC, Tax Lots 1100 and
1200. ZONE: R-7: Medium-Density Residential District. The R-7 zoning district is

designed to accommodate attached single-family homes, detached single-family homes
with or without accessory residential units, at a minimum lot size of 5,000 square
feet, and duplexes, at a minimum lot size of 10,000 square feet. Mobile home parks
and subdivisions are also permitted outright. Some civic and institutional uses are also
permitted conditionally. APPLICABLE REVIEW CRITERIA: The approval standards
for annexations are set out in Community Development Code Chapters 18.320.020
and 18.390, Comprehensive Plan Policies 2 and 10; ORS Chapter 222; and Metro
Code Chapter 3.09.

c. Staff Report: Community Development Director Hendryx summarized the staff
report, which is on file in the City Recorder's office. It was noted in the staff
report that TCI was referenced as the cable provider; however, cable services
are now offered by another provider and should be referenced correctly.
d. Public Testimony
Mayor Griffith read the following statement:
- For all those wishing to testify, please be aware that failure to raise an
issue accompanied by statemenu or evldence sufflclent to afford the
Council and parties an opportunity to respond to the issue will preclude
an appeal to the Land llse Board of Appeals on this issue. Testimony

and the Washington County Vector Control llistrict by Ordinance; and
WHEREAS, the Tigard Development Code states that upon annexation, the zone is automatically changed
to the City zoning most closely confoiming to the Coimty zoning; and
WHEREAS, the cutTent and proposed zoning district is R-7, thcc-efore, no zone change is necessLuy; aix1

been reviewed for compliance with the Tigard Community Developmcnt Code and the Comprehensive

administrative processing.
SECTION 4: Pwsuant to ORS 222.120(5), the effective date of the withdrawal of the property from the

Maintenance District, Washington County Street Lighting District #1, Clean Water Services, and the Washington County Vector Control District shall be the effective date of

SHERIFF'S PATROL DISTRICT, WASHINGTON COUNTY URBAN ROA.DS MAINTENANCE
DISTRICT, WASHINGTON COUNTY STREET LIGHTING DISTWCT #1, CLEAN WATER
SERVICES, AND THE WASHINGTON COUNTY VECTOR CONTROL DISTRICT.
WHEREAS, the City of Tigard is authorized by ORS 222.120(4)(B) and 222.170 to initiate an annexation
upon receiving consent in writing from a majority of the electors registered in the territory proposed to be
annexed and written consent from owners of more than half the Iand in the territory proposed to be
annexed;and .
WHEREAS, the City of Tigard is authorized by ORS 222.120(5) and 222.520 to withdraw properties
which currently iie within the boundary of the Tigard Water District, the Washington County Enhanced
Sheriffs Patrol District, Washington County Urban Roads Maintenance District, Washington County Street
Lighting District #1, Clean Water Services, and the Washington County Vector Control District upon
complction of thc anncxAtion; nnd
WHEREAS, the Tigard City Council held a public hearing on January 22, 2002 to consider the annexation
of a parcel of land consisUng of 8.6 acres wid withdrawal of said propcrty from the Tigard Water District,
the Washington County Enhanced Sheriffs Patrol District, Washington County Urban Roads Maintenance
District, Washington County Street Lighting District #1, Clean Water Services, and the Washington County
Vector Control District; and
WHEREAS, pursuant to ORS 222.520(2) the City is liable to the Water District for certain debt
obligations, however, in this instance the Wafer District has no debt for the City to assume, therefore, no
option regarding the assumption of debt needs to be made; and
WHEREAS, pursuant to Metro 3.09, ORS 222.120 and 222.524, notice was given and the City held a
public hearing on the issue of the annexation into the City and withdrawal of the annexed property from the
Tigard Water District, the Washington County Enhanced Sheriff's Patrol District, Washington COUnty
Urban Roads Maintenance District, Washington County Street Lighting Disri-ict #l, Clean Water Services,
and the Washington County Vector Control District o.7 January 22, 2002; and
WHEREAS, pursuant to ORS 222.524, the City must declare the withdrawal of annexed properties from

PROPERTY FROM TEIE TIGARD WATER DISTRICT, WASH[NGTON COUNTY EIYHANCED
SHERIFF'S PATROL DISTRICT, WASHINGTOIY COUNTY URBAN ROADS MAINTENANCE
DISTRICT, WASHILYGTON COUIYTY STREET LIGHTING DISTRICT #1, CLEAN WATER
SERVICES, AND THE WASIiIIYGTON COUNTY VECTOR CONTROL DISTRICT.
WHEREAS, the City of Tigard is authorized by ORS 222.120(4)(B) and 222.170 to initiate an annexation
upon receiving consent in writing &om a majority of the electors registered in the territory proposed to be
annexed and written consent from owners of more than half the land in the territory proposed to be
^ annexed; and • f-
WI-IEREAS, the City of Tigard is authorized by ORS 222.120(5) and 222.520 to withdraw properties
which currently lie within the boundary of the Tigard Water District,.the Washington County Enhanced
Sherifrs Patrol District, Washington County Urban Roads Maintenance District, Washington County Street
Lighting District #1, Clean Water Services, and the Washington County Vector Control District upon
completion of the annexation; and
WIiEREAS, the Tigard City Council held a public hearing on January 22, 2002 to consider the annexation
of a parcel of land consisting of 8.6 acres and withdrawal of said property &om the Tigard Water District,
the Washington County Enhanced Sheriffs Patrol District, Washington County i7rban Roads Maintenance
District, Washington County Street Lighting District #1, Clean Water Services, and the Washington County
. Vector Control District; and . WHEREAS, pursuant to ORS 222.520(2) the City is liable to the Water District for certain debt
obligations, however, in this instance the Water District has no debt for the City to assume, therefore, no
option regarding the assumption of debt needs to be made; and
WHEREAS, pursuant to Metro 3.09, ORS 222.120 and 222.524, notice was given and the City held a
public hearing on the issue of the annexation into the City and withdrawal of the annexed property from the
Tigard Water District, the Washington County Enhanced Sheriff's Patrol District, Washington County
Urban Roads Maintenance District, Washington.County Street Lighting District #l, Ctean Water Services,
and the Washington County Vector Control District on January 22, 2002; and
WHEREAS, pursuant to ORS 222.524, the City must declare the withdrawal of annexed properties from
the Tigard Water District, the Washington County Enhanced Sheriffs Patrol District, Washington County
Urban Roads Maintenance District, Washington County Street Lighting District #l, Clean Water Services,
and the Washington County Vector Control District by Ordinance; and
WHEREAS, the Tigard Development Code states that upon annexation, the zone is automatically changed
to the City zoning most closely conforming to the County zoning; and
WHEREAS, the current and proposed zoning district is R-7, therefore, no zone change is necessary; and
WHEREAS, the annexation has been processed in accordance with the requirements ofMetro 3.09 and has
been reviewed for compliance with the Tigard Community Development Code and the Comprehensive
Plan and the annexation substantially addresses the standards in Metro 3.09 regulating annexations; and

WHEREAS, the City Council has cazefully considered the testimony at the public hearing and determined
that withdrawal of the annexed properties from the applicable service districts is in the best interest of the
City of Tigard.
NOW, THEREFORE, THE CITY OF TIGARD ORDAIIYS AS FOLLOWS:
SECTIOIY 1: The Tigard City Council hereby annexes the parcels described in the attached Exhibit "A" and shown in Exhibit "B" and withdraws said parcels from the Tigard Water District, the
Washington County Enhanced Sheriffs Patrol District, Washington County Urban Roads
Maintenance District, Washington County Street Lighting District 91, Clean Water
Services, and the Washington County Vector Control District. .
SECTION 2: This ordinance shall be effective 30 days after its passage by the Council, signature by the
Mayor and posting by the City Recorder.
SECTION 3: The City Recorder is hereby directed to file certified copies of the Ordinance with Metro for
administrative processing.
SECTION 4: Pursuant to ORS 222.120(5), the effective date of the withdra.wal of the property &om the .
Washington County Enhanced Sheriffs Patrol District, Washington County Urban Roads
Maintenance District, Washington County Street Lighting District #l, Clean Water
Services, and the Washington County Vector Control District shall be the effective date of
this annexation.
SECTION 5: Pursuant to ORS 222.465, the effective date of the withdrawal of this property from the
Tigard Water District shall be July 1, 2002.
SECTION 6: In accordance with ORS 222.180, the annexation shal( be effective upon filing with the
Secretary of State.

Adopt the attached Ordinance annexing the property.
INFORMATION SUMMARY The proposed annexation consists of territory comprised of two (2) taac lots of 8.6 acres which is contiguous to the
City of Tigard. The annexation request is to fulfill conditions of approval for subdivision (SUB2000-00006). The
existing policy is to require annexation of parcels adjacent to the City limits as part of development approvals.
The property is currently developed with a single-family residence. Staff asked adjacent property owners if they
wished to annex because it would have resulted in a more uniform boundary, however, none responded to staff's
request. The proposed annexation will not create any temtorial islands.
Staff has notified affected agencies of the proposed annexation and did not receive any comments in opposition to
the proposal. Staff has reviewed the proposal for compliance with Metro 3.09, the Comprehensive Plan Policies
and the Development Code and, as indicated in the attached staff report, found the proposed annexation meets the
applicable standards.
OTHER ALTERNATIVES CONSIDERED
Deny the request.
VISION TASK FORCE GOAL AND ACTION COMMITTEE STRATEGY
This request is consistent with Growth & Management "Goal 2" - Urban services are provided to all citizens within
Tigard's urban growth boundary and recipients of services pay their share.

AN ORDINANCE ADOPTING FINDINGS AND CONCLUSIONS TO APPROVE AN
ANNEXATION (ZCA) 2001-00003/THORNWOOD ANNEXATION AND WITHDRAWING
PROPERTY FROM THE TIGARD WATER DISTRICT, WASHINGTON COUNTY ENHANCED
SHERIFF'S PATROL DISTRICT, WASHINGTON COUNTY URBAN ROADS MAINTENANCE
DISTRICT, WASHINGTON COUNTY STREET LIGHTING DISTRICT #1, CLEAN WATER
SERVICES, AND THE WASHINGTON COUNTY VECTOR CONTROL DISTRICT.
WHEREAS, the City of Tigard is authorized by ORS 222.120(4)(B) and 222.170 to initiate an annexation
upon receiving consent in writing from a majority of the electors registered in the temtory proposed to be
annexed and written consent from owners of more than half the land in the territory proposed to be
annexed; and WHEREAS, the City of Tigard is authorized by ORS 222.120(5) and 222.520 to withdraw properties
which currently lie within the boundary of the Tigard Water District, the Washington County Enhanced
Sheriffs Patrol District, Washington County Urban Roads Maintenance District, Washington County Street
Lighting District #1, Clean Water Services, and the Washington County Vector Control District upon
completion of the annexation; and
WHEREAS, the Tigard City Council held a public hearing on January 22, 2002 to consider the annexation
of a parcel of land consisting of 8.6 acres and withdrawal of said property from the Tigard Water District,
the Washington County Enhanced Sheriffs Patrol District, Washington County Urban Roads Maintenance
District, Washington County Street Lighting District #1, CleanWater Services, and the Washington County
Vector Control District; and
WHEREAS, pursuant to ORS 222.520(2) the City is liable to the Water District for certain debt
obligations, however, in this instance the Water District has no debt for the City to assume, therefore, no
option regarding the assumption of debt needs to be made; and
WHEREAS, pursuant to Metro 3.09, ORS 222.120 and 222.524, notice was given and the City held a
public hearing on the issue of the annexation into the City and withdrawal of the annexed property from the
Tigard Water District, the Washington County Enhanced Sheriffs Patrol District, Washington County
Urban Roads Maintenance District, Washington County Street Lighting District #1, Clean Water Services,
and the Washington County Vector Control District on January 22, 2002; and
WHEREAS, pursuant to ORS 222.524, the City must declare the withdrawal of annexed properties from
the Tigard Water District, the Washington County Enhanced Sheriffs Patrol District, Washington County
Urban Roads Maintenance District, Washington County Street Lighting District #1, Clean Water Services,
and the Washington County Vector Control District by Ordinance; and
WHEREAS, the Tigard Development Code states that upon annexation, the zone is automatically changed
to the City zoning most closely conforming to the County zoning; and
WHEREAS, the current and proposed zoning district is R-7, therefore, no zone change is necessary; and
WHEREAS, the annexation has been processed in accordance with the requirements of Metro 3.09 and has
been reviewed for compliance with the Tigard Community Development Code and the Comprehensive
Plan and the annexation substantially addresses the standards in Metro 3.09 regulating annexations; and

WHEREAS, the City Council has carefully considered the testimony at the public hearing and determined
that withdrawal of the annexed properties from the applicable service districts is in the best interest of the
City of Tigard.
NOW, THEREFORE, THE CITY OF TIGARD ORDAINS AS FOLLOWS:
SECTION 1: The Tigard City Council hereby annexes the parcels described in the attached Exhibit "A"
and shown in Exhibit "B" and withdraws said parcels from the Tigard Water District, the
Washington County Enhanced Sheriff s Patrol District, Washington County Urban Roads
Maintenance District, Washington County Street Lighting District #l, Clean Water
Services, and the Washington County Vector Control District.
SECTION 2: This ordinance shall be effective 30 days after its passage by the Council, signature by the
Mayor and posting by the City Recorder.
SECTION 3: The City Recorder is hereby directed to file certified copies of the Ordinance with Metro for
administrative processing.
SECTION 4: Pursuant to ORS 222.120(5), the effective date of the withdrawal of the property from the
Washington County Enhanced Sheriff s Patrol District, Washington County Urban Roads
Maintenance District, Washington County Street Lighting District #1, Clean Water
Services, and the Washington County Vector Control District shall be the effective date of
this annexation.
SECTION 5: Pursuant to ORS 222.465, the effective date of the withdrawal of this property from the
Tigard Water District shall be July 1, 2002.
SECTION 6: In accordance with ORS 222.180, the annexation shall be effective upon filing with the
Secretary of State.

Staff recommends that the Council-:fintl :that fhe: proposed annexation will not adversely

SECTION III. BACKGROUND INFORMATION
Site information and proposal description: One of the two subject parcels is currently developed with a single-family residence. The
other parcel has no dwellings. The applicant initiated the annexation in order to satisfy a
condition of a previous subdivision approval, case file number SUB 2000-00006. The
proposal is to annex approximately 8.6 acres of land into the City of Tigard with a combined
assessed value of $1,386,990.
Vicinity Information:
The area to be annexed consists of 8.6 acres. The existing city boundary runs along a
portion of north and west property lines. The subject properties and the properties to the
east, west and south are outside the Tigard city limits.
SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS
The relevant criteria in this case are Tigard Comprehensive Plan Policies 2.1.1, 10.1.1,
10.1.2, and; Tigard Community Development Code Chapter 18.320.
Staff has determined that the proposal is consistent with the relevant policies of the
Comprehensive Plan based on the following findings:
Policy 2.1.1:
This Policy requires an ongoing citizen involvement program and is satisfied because the
West CIT and surrounding property owners have been notified of the public hearing and
notice of the hearing has been published in a newspaper of general circulation. Policy 10.1.1:
This Policy requires that adequate service (water, sewer, drainage, streets, police, and fire
protection) capacity is available to serve the annexed parcels. The City of Tigard Police,
Engineering and Water Departments, Clean Water Services (CWS), and Tualatin Valley Fire
and Rescue have all reviewed the annexation request and have offered no objections. In
addition, Portland General Electric, Metro Area Communications, NW Natural Gas, TCI
Cable, General Telephone, US West Communications have also reviewed the proposed
annexation and offered no objections. Additionally, the adequacy and availability of services
was reviewed as part of the subdivision approval. Therefore, this policy is satisfied.
Policy 10.1.2:
This Policy pertains to boundary criteria for annexations. If the annexation is not eliminating
a pocket or island, then the annexation must:
a) not create an irregular boundary for the efficient provision of emergency services
b) have received comments from the Tigard Police Department

c) be located within the Tigard Urban Planning Area and contiguous to the city limits, and
d) services as required by Policy 10.1.1, above are available.
This annexation request extends, in a uniform manner, the contiguous city boundary and is
located within the Urban Services Area. The Tigard Police Department has commented as
noted previously. Lastly, no concerns or objections were raised by the service providers,
thereby indicating that services can be provided to the site. This policy is satisfied.
Staff has determined that the proposal is consistent with the relevant portions of the
Community Development Code based on the following findings:
Section 18.320.020: This Section addresses approval standards for annexation
proposals and is satisfied because:
The applicable Comprehensive Plan Policies and Community Development Code provisions
have been reviewed and satisfied as previously indicated in this report.
The property is currently zoned R-7. Because this property is in the Urban Services Area,
the equivalent zoning has already been applied to the property; therefore, the property does
not need to be rezoned upon annexation.
Metro 3.09 requires the additional standards to be addressed in annexation decisions,
in addition to the local and state review standards. These are addressed and satisfied
as discussed below:
Consistency with the directly applicable provisions in an urban service provider
agreement or annexation plan adopted pursuant to ORS 195.065;
The processing has been done consistent with applicable Urban Service Provider
agreements.
Consistency with directly applicable provisions of urban planning or other agreement,
other than agreements adopted pursuant to ORS 195.065, between the affected entity
and a necessary party;
The process required by the Development Code and Comprehensive Plan is consistent with ,
the Urban Planning Agreement for annexations. .
Consistency with specific directly applicable standards or criteria for boundary
changes contained in comprehensive land use plans and public facility plans;
This has been discussed previously in this report and, as discussed, this criterion is satisfied.
Consistency with specific directly applicable standards or criteria for boundary
changes contained in the Regional Framework Plan or any functional plans;
Because the Development Code has been amended to comply with applicable Metro
functional plan requirements, by complying with the Development Code and Comprehensive
Plan, the annexation is consistent with the applicable functional plan and the Regional
Framework plan.

Whether the proposed changes will promote or not interFere with the timely, orderly
and economic provisions of public facilities and services;
The proposed annexation will not interfere with the provisions of public facilities or services
because it is adjacent to existing City limits and services have already been extended to the
property by the property owner.
If the proposed boundary change is for annexation of territory to Metro, a
determination by Metro Council that the territory should be included in the Urban
Growth Boundary shall be the primary.criterion for approval;
The subject property is already within the Metro boundaries.
Consistency with other applicable criteria for the boundary change in question under
state and local law.
Consistency with other applicable criteria has been discussed previously in this report.
SECTION V. OTHER STAFF COMMENTS
The City of Tigard Engineering, Police Department, Public Works, and Water Department
have all reviewed this proposal and have offered no comments or objections.
SECTION VI. AGENCY COMMENTS
The Metro Area Boundary Commission, Unified Sewerage Agency, Metro Area
Communications, TCI, PGE, NW Natural Gas, US West Communications, GTE, and
Washington County have had the opportunity to review the proposal and have offered no
objections.

SERVICES, AIVD THE WASH[IYGTON COUNTY VECTOR CONTROL DISTRICT.
WHEREAS, the City of Tigard is authorized by ORS 222.120(4)(B) and 222.170 to initiate an annexation
upon receiving consent in writing from a majority of the electors registered in the territory proposed to be
annexed and written consent &om owners of more than half the land in the terntory proposed to be
annexed; and .
WHEREAS, the City of Tigard is authorized by ORS 222.120(5) and 222.520 to withdraw properties
which currently lie within the boundary of the Tigard Water District, the Washington County Enhanceci
Sheriffs Patrol District, Washington County Urban Roads Maintenance District, Washington County Street
Lighting District #1, Clean Water Services, and the Washington County Vector Control District upon
completion of the annexation; and
WHEREAS, the Tigard City Council held a public hearing on January 22, 2002 to consider the annexation
of a parcel of land consisting of 8.6 acres and withdrawal of said property Crom the Tigard Water Districl,
the Washington. County Enhanced Sheri fFs Patrol District, Washington County LJrban Roads Maintenance
District, Washington County Street Lighting District #1, Clean Water Services, and the Washington County
Vector Control District; and
WHEREAS, pursuant to ORS 222.520(2) the City is liable to the Water District for certain debt
obligations, however, in this instance the Water District has no debt for the City to assume, therefore, no
option regarding the assumption of debt needs to be made; and WHEREAS, pursuant to Metro 3.09, ORS 222.120 and 222.524, notice was given and the City held a
public hearing on the issue of the annexation into the City and withdrawal of the annexed property fi-om the
Tigard Water District, the Washington County Enhanced Sheriffs Patrol District, Washington County
Urban Roads Maintenance District, Washington County Street Lighting District #l, Clean Water Services,
and the Washington County Vector Control District on January 22, 2002; and
WHEREAS, pursuant to ORS 222.524, the City must declare the wilhdrawal of annexed properties from
the Tigard Water District, the Washington County Enhanced Sheriffs Patrol District, Washington County
Urban Roads Maintenance District, Washington County Street Lighting District #1, Clean Water Services,
and the Washington County Vector Control District by Ordinance; and
WHEREAS, the Tigard Development Code states that upon annexation, the zone is automatically changed
to the City zoning most closely conforming to the County zoning; and
WIiEREAS, the current and proposed zoning district is R77, therefore, no zone change is necessary; and
WHEREAS, the annexation has been processed in accordance with the requirements ofMetro 3.09 and has
been reviewed for compliance with the Tigard Community Development Code and the Comprehensive
Plan and the annexation substantially addresses the standards in Melro 3.09 regulating annexalions; and

WHEREAS, the City Council has cazefully considered the testimony at the public hearing and determined
that withdrawal of the annexed properties from the applicable service districts is in the best interest of the
City of Tigard.
IYOW, TIiERECORE, THE CITY OF TIGARD ORDAINS AS FOLLOWS:
SECTIOIY 1: The Tigard City Council hereby annexes the parcels described in the attached Exhibit "A"
and shown in Exhibit "B" and withdraws said parcels &om the Tigard Water District, the
Washington County Enhanced Sheriffs Patrol District, Washington County Urban Roads
Maintenance District, Washington County Street Lighting District #l, Clean Water
Services, and the Washington County Vector Control District. .
SECTION 2: This ordinance shall be effective 30 days after its passage by the Council, signature by the
Mayor and posting by the City Recorder.
SECTION 3: The City Recorder is hereby directed.to file certified copies of the Ordinance with Metro for
administrative processing. SECTION 4: Pursuant to ORS 222.120(5), the effective date of the withdrawal of the property from the .
Washington County Enhanced Sheriffs Patrol Dishict, Washington County Urban Roads
Maintenance District, Washington County Street Lighting District #l, Clean Water
Services, and the Washington County Vector Control District shall be the effective date cif
this annexation.
SECTION 5: Pursuant to ORS 222.465, the effective date of the withdrawal of this property from the
Tigard Water District shall be July t, 2002.
SECTION 6: In accordance with ORS 222.180, the annezation shall be effective upon filing with the
Secretary of State.

30. The applicant shall either place the existing overhead utility lines along SW Bull Mountain Road
underground as a part of this project, or they shall pay the fee in-lieu of undergrounding. The fee shall be
calculated by the frontage of the site that is parallel to the utility lines and will be $27.50 per lineal foot. If the
fee option is chosen, the amount will be $13,860.00 and it shall be paid prior to approval of the final plat.
31.00 STATE PLANE COORDINATES N BR
31. The applicant's final plat shall contain State Plane Coordinates on two monuments with a tie to the City's
global positioning system (GPS) geodetic control network. These monuments shall be on the same line and
shall be of the same precision as required for the subdivision plat boundary. Along with the coordinates, the
plat shall contain the scale factor to converT ground measurements to grid measurements and the angle from
north to grid north. These coordinates can be established by: 1) GPS tie networked to the City's GPS survey
and 2) by random traverse using conventional surveying methods.
32.00 FINAL PLAT APPL. SUB. REQMNT. N BR
32. Final Plat Application Submission Requirements: A. Submit for City review four (4) paper copies of the
final plat prepared by a land surveyor licensed to practice in Oregon, and necessary data or narrative; B. The
final plat and data or nanative shall be drawn to the minimum standards set forth by the Oregori Revised
Statutes (ORS 92.05), Washington County, and by the City of Tigard; C. The right-of-way dedication for SW
Bull Mountain Road shall be made on the final plat; D. NOTE: Washington County will not begin their
review of the final plat until they receive a letter from the City Engineering Department indicating: 1) that the
City has reviewed the final plat and submitted comments to the applicant's surveyor, and 2) that the applicant
has either completed any public improvements associated with the project or has at least obtained the necessary
public improvement pernut from the City to complete the work and E. Once the City and County have
reviewed the final plat, submit two mylar copies of the final plat for City Engineer's signature.
33.00 ANNEX PORTION OF DEV. SITE N KY
33. Prior to final plat approval, the applicant shall apply to annex the portion of the development site that is
within the urban services area into the City of Tigard.
34.00 SURFACE WATER DRAINAGE EASEMNT N KY
34. To ensure that an adequate vegetated buffer exists in the vicinity of the wetland, the applicant shall
establish surface water drainage easements on Tracts B,C,D and E, as shown on the preliminary utility plan.
35.00 BOND FOR TREE PLANTING N KY
35. The applicant shall provide a bond to provide for the planting of 592 caliper inches of trees. Based on an
approximate figure of $150 per 2-inch caliper tree, this would amount to a$44,400 bond. The applicant shall
specify how they propose to mitigate for the 592 caliper inches required to be mitigated. All mitigation trees
shall be a minimum of 2-inch caliper size. If the applicant intends to mitigate on-site by planting trees, a
revised landscaping plan shall be required that indicates which trees are to be counted towards the mitigation
total. Street trees and trees required to meet the buffer and parking lot tree requirements shall not be counted
toward the mitigation trees. Preserved trees shall be protected with a conservation easement or other recorded
instrument, a copy of which must be reviewed and approved by the City prior to final plat approval.
36.00 PUBLIC EASEMENT N KY
36. T'he applicant shall provide a public easement along the alignment of the proposed pedestrian path to allow
the general public necessary access.
37.00 DEMOLITION PERMITS N KY
37. The applicant will apply for demolition permits for the existing dwellings and associated structures on the
development site. The homes must be removed from the development site prior to final plat approval.
38.00 MYLAR COPY FINAL PLAT N BR
38. Prior to issuance of building permits, the applicant shall provide the Engineering Department witli a mylar
copy of the recorded final plat.
39.00 CONSTRUCTION ACCESS/PARKING PLAN N BR
39. The City Engineer may deternune the necessity for, and require submittal and approval of, a construction
access and parking plan for the home building phase. If the City Engineer deems such a plan necessary, the
applicant shall provide the plan prior to issuance of building permits.

City of Tigard, for the developm nt of the future subdivision named THORNWOOD. DISCUSSION:
The Thornwood Type [I subdivi ion application was reviewed by the City of Tigard and Final
conditions of approval issued on May 18, 2001, City of Tigard Casefile 42000-00006.
The subdivision is comprised of 3 legat parcels, tax lots 1000, 1100, and 1200. Tax lot 1000
(Stevens Parcel) is already anne ed into the City.
SECTiON 18.320.020 APPRO AL PROCESS AND STANDARDS
A. Approval Process: Annexa ions shall be processed by means of a Type 1V procedure, as
govern by Chapter 18.390 using standards contained in subsection
