ZONE: MUE-1: Mixed Use Employment District. The MUE-1 zoning district is designed
to apply to areas where employment uses such as office, research and development
and light manufacturing are concentrated. Commercial and retail support uses are
allowed but are limited, and residential uses are permitted which are compatible
with employment character of the area. Lincoln Center is an example of an area
designated MUE-1, the high density mixed use employment district.

SECTION I. DECISION
Notice is hereby given that the City of Tigard Community Development Director's designee has
APPROVED the above request. The findings and conclusions on which the decision is based are noted in
Section V.

SECTION II. &KGROUND INFORMATION •
Site Information and History:
The 0.32-acre site is the location of the approved Freeman Office Building (SDR2003-00010). Prior to
this decision, the subject site was the location of a veterinary clinic. In 1988, the City granted approval to
demolish a single-family dwelling and construct a veterinary clinic on the site (SDR88-11). At that time,
the property was zoned C-P (Professional Commercial). It is now zoned MUI~-1 (ML\ed-Use
Employment - High Density).
Vicinity Information:
The site is located on SW Locust Street, east of SW Greenburg Road, in the Washington Square Regional
Center near unincorporated Metzger. The site is surrounded b commercial uses and homes, with
Metzger Elementary School nearby.
Proposal Description:
The applicant is requesting an adjustment to the access spacing standard (18.705.030.H.3) for a driveway
on Locust Street because it does not meet the spacing standard for driveways on a collector. The subject
driveway is closer than 200 feet to other driveways on SW Locust Street. This adjustment is required by a
condition of approval for SDR2003-00010.
SECTION III. APPLICATION SUMMARY
The applicant is requesting a variance to the following standard:
Section 18.705.030.H.3: The minimum spacing of driveways and streets along a collector shall be
200 feet.
SW Locust Street is identified as a collector in Tigard's Transportation System Plan. There are a total five
driveways within 200 feet of the proposed driveway (3 across the street and 2 on the same side of the street).
Measuring centerline to centerline, the subject driveway is 127.3 feet from the driveway to the west and,
from an aerial photo, appears roughly 120 feet from the driveway to the east on the same side of the street.
The driveways across the street (centerline to centerline) are about 165 feet and 10 feet and to the cast and
140.6 feet to the west. The proposed variance would allow the site to have access.
SECTION IV. COMMENTS FROM PROPERTY OWNERS WITHIN 500 FEET
No comments were received from property owners within 500 feet.
SECTION V. APPLICABLE REVIEW CRITERIA AND FINDINGS
ADJUSTMENT TO ACCESS AND EGRESS STANDARDS:
Section 18.370.020.C.5.a provides that in all zoning districts where access and egress drives cannot
be readily designed to conform to Code standards within a particular parcel, access with an
adjoining property shall be considered. If access in conjunction with another parcel cannot
reasonably be achieved, the Director may grant an adjustment to the access requirements of
Chapter 18.705 through a Type II procedure, as governed in Section 18.390.030, using approval
criteria contained in Subsection 5.b below.
The Director may approve, approve with condition, or deny a request for an adjustment from the
access requirement contained in Chapter 18.705, based on the following criteria:
(1) It is not possible to share access.
The proposed access is already a shared access with the adjacent office building to the west. It would not
be appropriate to share access with the single-family home to the east. Therefore, it is not possible or
logical to share access with another property, other than the property to the west.

(2) There are no qW alternative access points on the •et in question or from another
street.
There are no other alternative access points on the site because of the building's location and the site
does not have access to streets other than SW Locust Street. Therefore, the only access is the existing
driveway, which the neighboring office to the west continues to use.
(3) The access separation requirements cannot be met.
The access requirements cannot be met for the existing driveway because of its close proximity to other
driveways on SW Locust Street.
(4) The request is the minimum adjustment required to provide adequate access.
The applicant does not propose to create a new driveway, but is requesting approval to use the existing
driveway, which currently serves the adjacent property. Therefore, the request is the minimum
adjustment required to provide adequate access.
(5) The approved access or access approved with conditions will result in a safe access; and
The proposed driveway is on a straight flat street, meets the visual clearance requirement and is not
within the influence area of a collector or arterial intersection. In addition, the applicant has submitted a
preliminary sight distance certification, certifying that the proposed access exceeds the rerired 250 feet
of sight distance (358 feet to the east and 521 feet to the west). Therefore, the approved driveway will
result in a safe access because it will meet the visual clearance requirement, will not be in an influence
area, will not be subject to topographical constraints and will have adequate site distance.
(6) The visual clearance requirement of Chapter 18.795 will be met.
Section 18.795.040.B states (concerning non-arterial streets 24 feet or more in width): At all intersections
of...a non-arterial street and a driveway... where one of the streets or driveway is 24 feet or more in width, a
visual clearance shall be a triangle formed by the right-of-way property lines along such lots and a straight
line joining the right-of-way or property line at points which are 30 feet distance from the intersection of the
right-of-way line measured along such lines. The decision approving the Freeman Office Building
(SDR2003-00010) finds that the visual clearance triangle is correctly shown on the site plan. Therefore, this
criterion has been met.
FINDING: Based on the analysis above, Staff finds that the special adjustment criteria are satisfied.
SECTION VI. OTHER STAFF COMMENTS
The City of Tigard Building Division reviewed the proposal and has no objections.
SECTION VII. AGENCY COMMENTS
Tualatin Valley Fire and Rescue was notified of the adjustment request and did not comment.

SW Hall Boulevard, Tigard, OR 97223.
Unless the applicant is the appellant, the hearing on an appeal from the Director's Decision shall be confined

PROPOSAL: The applicant is requesting an adjustment to the access spacing standard (18.705.030.H.3)
for a driveway on Locust Street because it does not meet the spacing standard for
driveways on a collector. The subject driveway is closer than 200 feet to other driveways
on SW Locust Street. This adjustment is required by a condition of approval for the

18.390.040.G.1. may appeal this decision in accordance with Section 18.390.040.6.2. of the Tiggard Community
Development Code which provides that a written appeal together with the required fee shall be filed with the
Director within ten (10) business days of the date the Notice of Decision was mailed. The appeal fee schedule and
forms are available from the Planning Division of Tigard City Hall, 13125 SW Hall Boulevard, Tigard, Oregon

Unless the applicant is the appellant, the hearing on an appeal from the Director's Decision shall be confined to the

The access for this proposal is located 6 feet west of the site's west property line, onto Locust
Street. The speed limit along Locust Street is 25 M.P.H., based upon the posted speed,
requiring 250 feet of sight distance in both directions.
As required, sight distance from the access to Locust was measured to be 358 feet to the east
of the access in one direction and 521 feet to the west of the access in the other direction. These
Code Sections respectively require that measurements be based on an eye height of 3.5 feet and
an object of 4.25 feet above the road; and be assumed to be 15 feet from the near edge of pavement
to the front of a stopped vehicle. This may require removal of the 2 trees in the right of way. If 15 feet
from the edge of traveled way is used; the stopping site distance becomes greater in both directions.
In conclusion, I hereby certify that the intersection sight distance at the access to S.W. Locust
conforms to the requirements for sight distance as required by the City of Tigard.

I hope everything's going well. I am writing to follow up on the preliminary sight distance certification for
the Freeman Office Building Access Spacing Adjustment (VAR2006-00082). Would you happen to know
when it will be submitted?
I understand Engineering has said a final sight distance certification is not necessary for the PFI permit,
but a preliminary one is (this is a one-page statement written by your engineer). Also, without the
preliminary sight distance certification, I can't issue a decision for the adjustment. As we get closer to the
120-day deadline, I would have no choice but to deny the adjustment application, which will hold up if not
prevent building permits.
There are a couple of options you have: 1) Submit the sight distance certification as soon as possible or
no later than Dec. 29, 2006; or if it will be longer than that 2) Request an extension of the 120-day period
for the adjustment for 6 weeks after the submittal of the preliminary sight distance certification. The six
weeks will allow for an appeal process, if an appeal is made. I would need the request for an extension in
writing.
Please let me know what you plan to do about the adjustment. If you have any questions, feel free to
call.

Narrative for Access to the Access spacing Standards for TDC 18.705.030.H.3 and HA Using
Criteria Found in 18.370.C.5
Dear Emily,
The Freeman Office Building Was approved as SDR2003-00010 on 9/09/04. As part of the conditions of
approval it was necessary as part of Planning Division Condition 3 to apply for an adjustment to the
access spacing standards.
We understand that Under Chapter 18.705 ACCESS, EGRESS, AND CIRCULATION, one of the
general provisions it that driveways along a collector should be 200 feet minimum spacing, but existing
driveways are closer than 200 feet between them. Specifically the accesses on the same side of Locust
exist 154.1 feet to the west and 114.8 feet to the east. On the opposite side of the street accesses exist 13.1
feet to the west, 141.1 feet to the west and 168.2 feet to the east. These driveways are a result of an
existing street changing designation during the rezoning and reclassification of Locust from a local to a
collector street many years ago.
We therefore cannot meet the access management standards that would result in the proper standards. The
property already minimizes it driveway location impact by sharing access with the existing office building
to the west.
This letter requests consideration of obtaining an adjustment under Chapter 18.370 Variances and
Adjustments. More specifically under adjustments Section 18.370.020.C.5.b. 1 -5.
b. The Director may approve, approve with conditions, or deny a request for an adjustment from the
access requirements contained in Chapter 18.705, based on the following criteria:
(1) It is not possible to share access;

Response:
The proposed access already shares its access with the adjacent property.
(2) There are no other alternative access points on the street in question or from another street;
Response:
The proposed access has only one place of access, which already shares an access with the
adjacent property. Any other location would add another access and would not create a better
situation than already exists.
(3) The access separation requirements cannot be met;
Response:
Any other access point along the site frontage cannot meet the access spacing based on existing
accesses that are existing. Sharing the existing access with the property to the west already
maximizes the number and spacing of accesses possible.
(4) The request is the minimum adjustment required to provide adequate access:
Response:
The request is the minimum adjustment required to provide adequate access by sharing the
access with the adjacent property and thus not adding an additional separate access.
(5) The approved access or access approved with conditions will result in a safe access; and
Response:
The extent of trips from each drive is small due to the size of the existing individual lots and the
limited present and future full development trips from each driveway. The site plan provides
one access for the development and the lot to the west. This minimizes safety problems by
minimizing number of accesses on Locust and provides the best level of service possible along
Locust by minimizing driveway turning conflicts along Locust.
(6) The visual clearance requirements of Chapter 18.795 will be met.
Response:
A 30 foot visual clearance triangle at the center of the driveway as shown on the site plan
demonstrates that no obstructions over 36 inches high above the curb exists in the triangle.
Based on the above adjustment justification we respectfully request that the adjustment be granted.
