The MUE zoning district is designed to apply to a majority of the land within the Tigard Triangle, a regional mixed-use employment district bounded by Pacific Highway (Hwy. 99), Highway 217 and I-5. This zoning district permits a wide range of uses including major retail goods and services, business/professional offices, civic uses and housing; the latter includes multi- family housing at a maximum density of 25 units/acre, equivalent to the R-25 zoning district. A wide range of uses, including but not lurnlted to community recreation facilities, religious institutions, medical centers, schools, utilities and transit-related park-and-ride lots, are permitted conditionally. Although it is recognized that the automobile will accommodate the vast ma ority of trips to and within the Triangle, it is still important to 1) support alternative modes of transportation to the greatest extent possible; and 2) encourage a mix of uses to facilitate intra-distract pedestrian and transit trips even for those who drive. The zone maybe applied elsewhere in the City through the legislative process. APPLICABLE REVIEW CRITERIA: Community Development Code Chapters 18.370,18.390 and 18.795. SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request, contingent upon satisfaction of the condition of approval below. The findings and conclusions on which the decision is based are noted in Section VI. A sign permit for the illuminated cabinet is required. The applicant shall apply for a sign permit prior to erecting the sign. The sign shall be as described in this approval an d not exceed 2 feet tall (in addition to the monument structure). BACKGROUND INFORMATION Site Histo eTh 0.39-acre site is the location of the approved Newham Office Building (SDR1999-00008). The current tenant is Jim Shook, CPA. Vicini Information: The site is located on the south side of SW Beveland Road, west of SW 72"d Avenue, in a mainly commercial area. Properties to the immediate north and east are zoned MUE; properties to the immediate south and west are zoned GG (General Commercial). Proposal Description: The applicant is requesting a variance to the visual clearance standards to allow the placement of a freestanding sign within the visual clearance area because the existing monument sign is not visible from the road. SECTION IV. APPLICATION SUMMARY The applicant is requesting a variance to the visual clearance standards to allow the placement of a freestanding sign within the visual clearance area. Blocked by landscaping, trees and parked cars, the existing monument sign is not visible from the road. While the code limits the monument structure to being 3 feet tall, a variance would allow the applicant to install a 2-foot illuminated sign cabinet on top of the existing monument structure. SECTION V. COMMENTS FROM PROPERTY OWNERS WITHIN 500 FEET No comments were received from property owners within 500 feet. SECTION VI. APPLICABLE REVIEW CRITERIA AND FINDINGS VARIANCES AND ADJUSTMENTS: Section 18.370.010 states that the Director shall appprove, approve with conditions, or deny an application for a variance based on finding that the toIlowing criteria are satisfied: a. The proposed variance will not be materially detrimental to the purposes of this title, to any other applicable policies and standards, and to other properties in the same zoning district or vicinity, Under normal circumstances, a variance to the vision clearance standards would be materially detrimental to ty~u%o ses of th is title, etc... However, the driveway access adjacent to the sign is marked as an entrance the driveway design makes it almost impossible for a vehicle to turn around and exit from the entrance. Because drivers will not be exiting from this driveway access, the sign will not impact their ability to safely exit. Therefore, this criterion is met. There are special Oumstances that exist which are par to the lot size or shape, topograpphy or other circumstances over which the ap hcant has no control, and which are not app cable to other properties in the same zoning district; The monument sin is blocked by street trees, parked cars on the street and shrubbery which is required to screen the parking lot. The poor placement of the sign-maybe a result of existing concitions at the time the site was developed, along wih certain requirements. Normally, a sign would not be simultaneously blocked by landscaping, trees an parked cars. Therefore, special circumstances exist which are peculiar to the site. c. The use proposed will be the same as permitted under this title and City standards will be maintained to the greatest extent that is reasonably possible while permitting reasonable economic use of the land; The site is used for office purposes, which is permitted under the code. The appplicant does not propose any changes to the site other than the addition of a 2-foot illuminated sign cabinet. Landsca in g, street trees and the availability of off-site parking will continue to meet City standards. Therefore, CTaty standards will be maintained to the greatest extent that is reasonably possible while allowing reasonable economic use of the land. d. Existing physical and natural systems, such as but not limited to traffic, drainage, dramatic land forms or parks will not be adversely affected any more than would occur if the development were developed as specified in the title; and The variance would not cause any adverse changes to the above systems. e. The hardship is not self-imposed and the variance requested is the minimum variance which would alleviate the hardship. The hardship is not self-imposed, but more a result of circumstances unique to the site. In addition, the applicant purchased the property after it had been developed and the monument structure had been built. The applicant does not propose changes to landscaping, street trees or street parking. Because it is not visible, the monument sign serves no purpose as it is now. Addin~~gg a two-foot illuminated sign cabinet will make the sign visible and, because it is adjacent to the entrance, willnot make the exit unsafe. Therefore, the variance requested is the minimum variance that would alleviate the hardship. FINDING: Based on the analysis above, the Variance criteria have been met. SECTION VII. OTHER STAFF COMMENTS The City of Tigard Police Department has reviewed the proposal and has no objections to it. SECTION VIII. AGENCY COMMENTS Tualatin Valley Fire and Rescue was notified of the variance request and did not comment. SECTION IX. Dear Cheryl, We are requesting that a variance to the Visual Clearance Area standard (Code Chapter 18.795) be granted to Triangle Properties of Tigard, the property owner at 7410 SW Beveland Road, Tigard, Oregon to accommodate the addition of an illuminated sign cabinet to the existing sign structure which will allow the sign to be visible by motorists on the street. The current brick monument sign structure is 36" tall and meets the requirements stated in Section 18.795.030B "Obstructions prohibited. A clear vision area shall contain no vehicle, hedge, planting, fence, wall structure or temporary or permanent obstruction (except for an occasional pole or tree), exceeding three feet in height, measured from the top of the curb, or where no curb exists, from the street center line grade, except that trees exceeding this height may be located in this area, provided all branches below eight feet are removed. " The problem arises from the relative position of the landscaping, trees, and cars parked in front of the property and the existing sign structure. The monument sign face is not visible from the roadway and serves no useful purpose. Please see Figures 1, 2, and 3. The existing monument structure is located on the NW end of the property, just to the east of the west driveway. As you can see from the attached photos the brick structure is completely obscured by the landscaping between the parking lot and the sidewalk. Additionally the parked cars along the curb also block the visibility of the current sign from numerous positions along the street. To make this sign visible would require that parking be prohibited in front of the property between the two driveways and that the landscaping be removed. Elimination of the parking, though minimal, would cause some impact to other business in the area and require the city to paint the curb yellow along this section of the street. Elimination of the shrubbery would impact the aesthetics of the property and the surrounding area and would likely violate code section 18.745 LANDSCAPING AND SCREENING. At all intersections of two non- arterial streets, a non-arterial street and a driveway, a non-arterial street or driveway and railroad where at least one of the streets or driveways is 24 feet or more in width, a visual clearance area shall be a triangle formed by the right-of-way or property lines along such lots and a straight line joining the right-of-way or property line at points which are 30 feet distance from the intersection of the right-of- way line and measuring along such lines. See Figure 18.795.1 " Using this methodology the north end (street end) of the existing monument structure falls within the visual clearance triangle (see figure 4). (See Attachment A: Site Plan) The driveway adjacent to the sign is clearly marked as an entrance only and the driveway to the east is clearly marked as an exit. Large white directional arrows are painted on the pavement at each driveway and an additional arrow is painted on the pavement midway in the parking lot. Additionally, the parking spaces are stripped in a diagonal manner such that it would be very difficult and very un-natural to turn a vehicle around and exit out of the lot via the "Entrance Driveway". In fact, the major obstructions impacting the visual clearance are the cars parked along the curb. From figure 7, it is evident that even in the rare occurrence of a vehicle exiting via the "Entrance Drive", there would not be a significant safety concern for passing motorists or pedestrians. As a confirmation of our statement that this would not be a safety concern, we have checked several other metro area city code sections to compare the 30 foot standard used in Tigard for consistency. Though there we did not find specific provisions for one-way drive ways we did note that the Tigard City code is much more restrictive than the surrounding cities. In the neighboring community of Tualatin, the vision clearance triangle is defined by a line drawn to a point 10 feet from the intersection versus the 30 foot requirement specified in Tigard code. In both Canby and Portland the requirement is 15 feet. We have included the city code references below from both Tualatin and Portland since they are the neighboring communities to Tigard. They will not be allowed to have even a minimal sign that is visible from the street in front of their property. Without adequate signage their business will be negatively impacted and motorist may be confused trying to locate the business. B. Applicability of Provisions. 1. The variance standards are intended to apply to individual platted and recorded lots only. Response: This criteria is met. C. Approval process and Standards: 1. Variances shall be processed by means of a Type II procedure, as governed by Section 18.390.040, using standards of approval contained in Subsection 2 below. 2. The director shall approve, approve with conditions, or deny an application for a variance based on finding the following criteria are satisfied: a. The purposed variance will not be materially detrimental to the purposes of this title, to any other applicable policies and standards, and to other properties in the same zoning district or vicinity; Response: As shown in the narrative above, granting this variance will in no way be materially detrimental to the purposes set forth in any section of the Tigard City Code or Ordinances, nor will it be materially detrimental to any other property in the area or similar zones. b. There are special circumstances that exist which are peculiar to the lot size or shape, topography or other circumstances over which the applicant has no control, and which are not applicable to other properties in the same zoning district; Response: Special circumstances exist on this lot which are peculiar to it. These circumstances include: 1) the existence of an existing sign structure already placed within an island which includes electrical wiring and landscaping. Unfortunately this sign structure is not visible from the roadway with the existing landscaping and street parking. It would be cost prohibitive to move the existing structure or to remove it and build a new one at a location which fell outside the Visual Clearance standard. Movement of the sign would also result in some confusion over which driveway is to be used as an entrance. 2) The driveway in with which the conflict occurs is used only to enter the parking lot and not as an exit. Therefore the visual clearance standard should not apply since. c. The use propose will be the same as permitted under this title and City standards will be maintained to the greatest extent that is reasonably possible while permitting economic use of the land; d. Existing physical and natural systems, such as but not limited to traffic, drainage, dramatic land forms or parks will not be adversely affected any more than would occur if the development were developed as specified in the title; and Response: There will be no impact or adverse effects to any systems including traffic if this variance is granted. e. The hardship is not self-imposed and the variance request is the minimum variance which would alleviate the hardship. Response: This hardship is not self imposed since the structure was already in existence prior to the purchase of the property by the current owner. This request is the absolute minimum that can alleviate the hardship. Conclusion We feel that it is appropriate to grant this waiver to the Tigard City Code Section 18.795 which requires a 30 foot triangle for the vision clearance area. We base our conclusion on the following findings: 1. The driveway in question is clearly marked as a one way "ENTRANCE" with directional arrows clearly painted on the pavement, thus eliminating any safety concerns which the visual clearance code language is addressing. 2. It is virtually impossible to turn a vehicle around to exit from via the "ENTRANCE" driveway. 3. Recognizing that each city sets their own standards, we would suggest that the standards of both Tualatin and Portland have been reviewed by many staff people over the years and are felt to maintain the safety of both motorists and pedestrians and therefore, they provide some validation that granting this variance will not impact the safety or welfare of either motorists or pedestrians in Tigard. If there are no sensitive areas, CWS must still issue a letter stating a CWS Service Provider Letter is not required. ❑ SIGNS [Refer to Code Chapter 18.7801 SIGN PERMITS MUST BE OBTAINED PRIOR TO INSTALLATION OF ANY SIGN in the City of Tigard. A "Guidelines for Sign Permits" handout is available upon request. Additional sign area or height beyond Code standards may be permitted if the sign proposal is reviewed as part of a development review application. Alternatively, a Sign Code Exception application may be filed for Director's review. ❑ THEE REMOVAL PLAN REQUIREMENTS [Refer to Code Section 18.790.030.CJ A TREE PLAN FOR THE PLANTING, REMOVAL AND PROTECTION OF TREES prepared by a certified arborist shall be provided for any lot, parcel or combination of lots or parcels for which a development application for a subdivision, partition, site development review, planned development, or conditional use is filed. Protection is preferred over removal where possible. THE TREE PLAN SHALL INCLUDE the following: ➢ Identification of the location, size and species of all existing trees including trees designated as significant by the City; ➢ Identification of a program to save existing trees or mitigate tree removal over 12 inches in caliper. Mitigation must follow the replacement guidelines of S6ction 18.790.060.D according to the following standards and shall be exclusive of trees required by other development code provisions for landscaping, streets and parking lots: 0 Retainage of less than 25% of existing trees over 12 inches in caliper requires a mitigation program according to Section 18.150.070.D. of no net loss of trees; 0 Retainage of from 25 to 50% of existing trees over 12 inches in caliper requires that two- thirds of the trees to be removed be mitigated according to Section 18.790. 60.D.; 0 Retainage of from 50 to 75% of existing trees over 12 inches in caliper requires that 50% of the trees to be removed be mitigated according to Section 18.790.060.D.; 0 Retainage of 75% or greater of existing trees over 12 inches in caliper requires no mitigation; ➢ Identification of all trees which are proposed to be removed; and ➢ A protection program defining standards and methods that will be used by the applicant to protect trees during and after construction. TREES REMOVED WITHIN THE PERIOD OF ONE (1) YEAR PRIOR TO A DEVELOPMENT APPLICATION LISTED ABOVE will be inventoried as part of the tree plan above and will be replaced according to Section 18.790.060.D. ❑ MITIGATION (Refer to Code Section 18.790.060.E.) REPLACEMENT OF A TREE shall take place according to the following guidelines: ➢ A replacement tree shall be a substantially similar species considering site characteristics. ➢ If a replacement tree of the species of the tree removed or damaged is not reasonably available, the Director may allow replacement with a different species of equivalent natural resource value. If this number of trees cannot be viably located on the subject property, the Director may require one (1) or more replacement trees to be planted on other property within the city, either public property or, with the consent of the owner, private property. ➢ The planting of a replacement tree shall take place in a manner reasonably calculated to allow growth to maturity. IN-LIEU OF TREE REPLACEMENT under Subsection D of this section, a party may, with the consent of the Director, elect to compensate the City for its costs in performing such tree replacement. CLEAR VISION AREA (Refer to Code Chapter 18.7951 The Cit requires that CLEAR VISION AREAS BE MAINTAINED BETWEEN THREE (3) AND EIGHT (8) FEET IN HEIGHT at road/driveway, road/railroad, and road/road intersections. The size of the required clear vision area depends upon the abutting street's functional classification and any existing obstructions within the clear vision area. ❑ ADDITIONAL LOT DIMENSIONAL REQUIREMENTS [Refer to Code Section 18.810.0601 MINIMUM LOT FRONTAGE: 25 feet unless lot is created through the minor land partition process. Lots created as part of a partition must have a minimum of 15 feet of frontage or have a minimum 15-foot-wide access easement. Applications involving difficult or protracted issues or requiring review by other jurisdictions may take additional time to review. Written recommendations from the Planning staff are issued seven (7) days prior to the public hearing A 10-day public appeal period follows all I nd use decisions. An appeal on this matter would be heard by the Tigard ~.r i o g ' S c e-r . A basic flowchart which illustrates the review process' rocess is available from the Planning Division upon request. Land use applications requiring a public hearing must have notice posted on-site by the applicant no less than 10 days prior to the public hearing. This PRE-APPLICATION CONFERENCE AND THE NOTES OF THE CONFERENCE ARE INTENDED TO INFORM the prospective applicant of the primary Community Development Code requirements applicable to the potential development of a particular site and to allow the City staff and prospective applicant to discuss the opportunities and constraints affecting development of the site. BUILDING PERMITS PLANS FOR BUILDING AND OTHER RELATED PERMITS WILL NOT BE ACCEPTED FOR REVIEW UNTIL A LAND USE APPROVAL HAS BEEN ISSUED. On behalf of my client, James L. Shook, CPA, P.C., I am requesting that a variance be granted to allow the placement of an illuminated sign cabinet on top of an existing brick monument wall structure at his new office building. This variance would allow the height of the new sign to encroach into the vision clearance area for this location. The current wall structure is within the 30' vision clearance triangle at the intersection of the driveway and the street, but the current wall height is less than 36". In its original design, the wall was planned to have signage placed on the wall in a recessed area. This is however a poor placement option due to existing landscaping and parking both on the street and in the parking lot. This section of the wall is so low, that it is almost impossible to see a sign position in that location. The placement of a sign on top of the wall provides significantly better visibility, but does violate the vision clearance height restriction of 36". The new cabinet on top of the wall would make the sign approximately 60" (5 feet) tall. Under normal circumstances, we would not request a variance due to the potential safety issues that this might present. However, at this particular site, there is not a safety concern. The parking lot for this building has two driveways and is clearly labeled as one way. The sign is located at the intersection of the driveway entrance to the parking lot. All of the vehicles using this driveway will be entering the lot, not exiting the lot and therefore the sign does not create any obstruction or visibility issue. The parking lot is clearly marked with traffic flow arrows and entrance and exit only signs which identify the driveways as one way only. As you will find in a site visit, granting this variance does not compromise public safety in any way, does not create a sign that is out of character nor is ascetically un-appealing, but it will facilitate motorist being able to more easily find their destination when going to this building.
