SECTION III. BACKGROUND INFORMATION
Site Information and Proposal Description:
The subject property is located at 10750 SW North Dakota Street. The lot is 16,396 square feet. A single-
family dwelling exists on the property, along with a shop. Currently, the dwelling is in the process of remodel
and will be 31794 square feet. The applicant proposes to reduce the dimensional standard for the front yard
setback of his property by 25 percent to allow for the relocation of the gara e for safer street access. The
applicant desires to reduce the front setback (on the north side of the lot) from 20 feet to 15 feet. The
garage face is oriented toward the west side of the property.
SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS
COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS:
Tigard Development Code Section 18.370 allows the following development Adjustments by
means of a Type I procedure:
Front yard setbacks. Up to a 25% reduction of the dimensional standards for the front yard
setback required in the base zone. Setback of garages may not be reduced by this provision.
Interior setbacks. Up to a 20% reduction of the dimensional standards for the side and rear yard
setbacks required in the base zone.
Lot coverage. Up to 5% increase of the maximum lot coverage required in the base zone.
The applicant requests a reduction of the dimensional standard for the front yard setback by 25 percent,
from 20 feet to 15 feet, which is the maximum allowed under the code.
A development Adjustment shall be granted if there is a demonstration of compliance with all of
the applicable standards:
A demonstration that the Adjustment requested is the least required to achieve the desired effect;
The aglicant requests a reduction of dimensional standard for the front yard setback by 25 percent to
allow or the relocation of the garage. The applicant desires safer street access. A reduction o the front
setback by 5 feet is the least required to achieve the desired effect.
The Adjustment will result in the preservation of trees, if trees are present in the development
area;
No trees will be affected by this adjustment.
The Adjustment will not impede adequate emergency access to the site;
The adjustment will improve emergency access.
There is not a reasonable alternative to the Adjustment which achieves the desired effect.

SECTION V. PROCEDURE AND APPEAL INFORMATION
Final Decision:
A setback Adjustment is a Type I procedure. As such, the Director's decision is final on the date it is
mailed or otherwise provided to the applicant, whichever occurs fast. The Director's decision may not be
appealed locally and is the final decision of the Qty.

3. The Director shall approve, approve with modifications, or deny an application for a subdivision
variance subject to the criteria set forth in Section 18.370.010.C.
18.370.020 Adjustments
A. Purpose. The purpose of this section is to establish two classes of special variances:
1. "Development adjustments" which allow modest variation from requited development standards
within proscribed limits. Because such adjustments are granted using "clear and objective
standards," these can be granted by means of a Type I procedure, as opposed to the more
stringent standards of approval and procedure for variances.
2. "Special adjustments" which are variances from development standards which have their own
approval criteria as opposed to the standard approval criteria for variances contained in Section
18.370.020.C.
B. Development adiustments.
1. The following development adjustments will be granted by means of a Type I procedure, as
governed by Section 18.390.030, using approval criteria contained in Subsection B2 below:
a. Front yard setbacks. Up to a 25% reduction of the dimensional standards for the front yard
setback required in the base zone. Setback of garages may not be reduced by this provision.
b. Interior setbacks. Up to a 20% reduction of the dimensional standards for the side and rear
yard setbacks required in the base zone.
c. Lot coverage. Up to 5% increase of the maximum lot coverage required in the base zone.
Approval criteria. A development adjustment shall be granted if there is a demonstration of
L compliance with all of the applicable standards:
a. A demonstration that the adjustment requested is the least required to achieve the desired '
effect;
b. The adjustment will result in the preservation of trees, if trees are present in the development
area;
c. The adjustment will not impede adequate emergency access to the site;"

.Variances and Adjustments 18.370-2 SE/Code Update: 04102
We would like to relocate the existing garage on our house to be at 90 degrees to the
front. In doing so we need to decrease the set back on the north side of the garage to be
(20' less 25%) 15' on the.set back. The north side will be parallel to SW North Dakota
St. as per plans.
The actual living space will be 48' from the property line. The garage is not being
enlarged in this process. The reason for this is to be able to have adequate garage space
without having to back onto SW North Dakota St. which is a fairly busy street with heavy
traffic at times.
#2 We feel that this plan has the least impact to the set backs.
A) Because the way the house is located on the lot it was designed to be as tight as
possible.
B) There are no trees affected by construction. We are actually having less paving &
concrete and more landscaping.
Q Emergency access will be greatly increased with these adjustments.
D) The design incorporated set back requirements along with safety and livability
and decided that this request would be the best option to achieve all areas of
concern.
