PROPOSAL: The applicant is requesting a variance to the driveway and street spacing standard
for a collector (18.705.030.H3) to allow easement right holders continued use of an
existing private driveway approach onto SW Bull Mountain Road. The subject
variance is required by a condition of approval for the decision approving the
Alpine View subdivision (SUB2004-00024).

LOCATION: The subject site is located north of SW Bull Mountain Road, west of the
intersection with SW 133'd Avenue; WCIM 2S109AB, Tax Lots 700, 800, 900 and
1000.
ZONE: R-7: Medium Density Residential District. The R-7 zoning district is designed to
accommodate attached single-family homes, detached single-family homes with or
without accessory residential units, at a minimum lot size of 5,000 square feet, and
duplexes, at a minimum lot size of 10,000 square feet. Mobile home parks and
subdivisions are also permitted outright. Some civic and institutional uses are also
permitted conditionally.

findings and conclusions on which the decision is based are noted in Section VI.

THE FOLLOWING CONDITION SHALL BE SATISFIED PRIOR TO THE APPROVAL OF
THE FINAL PLAT:
The applicant shall address the reqqueste materials to the CURRENT PLANNING DI O,
ATTN: EMILY ENG, Tigard City-Hall, 13125 SW Hall Blvd, Tigard, OR 97223, (503) 718-2712.
1. The applicant shall submit a cover letter along with a site plan and any other supporting
documents showing that the subject driveway will be in compliance with the 30-foot visual
clearance standard described in Section 18.795.040.B: The coverletter shall clearly identify where
in the submittal the required information is found.
SECTION III. BACKGROUND INFORMATION
Site ~I-Esto .
eTh 8.69-acre site is the location of the approved Alpine View subdivision (SUB2004-00024). The site
was annexed to the Ci of Tigard and zoned R 7 recently before the application process. Originally
consisting of four legalty lots, the site has been divided into 46 lots, 45 ofpwhich will be developed for
single-family detached dwellings.
Vicini Information:
The site is located north of Bull Mountain Road, west of SW 133`d Terrace and east of SW 133`d Avenue.
On the northern boundary, the site is abutted by two lots in unincorporated Washington County. Three
Mountain Estates subdivision abuts the site on the western boundary. Foran and Raven Ridge
subdivisions abut the site's eastern boundary. The four tax lots abutting the site on the south end are in
unincorporated Washington County. All surrounding properties within the City of Tigard's jurisdiction
are zoned R-7.
Site Information and Pro osal Descrition:

Currently the site can be accessed from SW 33' Terrace, which is the subject private driveway
contained in an access easement that extends from SW Bull Mountain Road to the Alpine View site and
properties abutting Alpine View. A variance is required because residents on the abuttirig properties
retain easement rights to use the existing driveway and the existing driveway does not meet the 200-foot
spacing standard for driveways on a collector street. While residents of the new subdivision will use
alternative accesses, a variance would preserve the easement rights of existing residents of the abutting
properties.
SECTION IV. APPLICATION SUMMARY
The applicant has requested a variance to 18.705.030.FL• Access Management. Section 18.705.030.H3 states
that the minimum spacing of driveway and streets along a collector shall be 200 feet. SW Bull Mountain
Road is identified as a collector in Tigard's Transportation System Plan. The subject driveway is 165 feet
from SW 133d Avenue. In addition the subject driveway is 134 feet and 176 feet, respectively, from two
driveways. to the east. The~~pproposeJ variance would allow existing residents of abutting properties to have
continued access to SW BullMountain Road by using the private driveway.
SECTION V. COMMENTS FROM PROPERTY OWNERS WITHIN 500 FEET
No comments were received from property owners within 500 feet.
SECTION VI. APPLICABLE REVIEW CRITERIA AND FINDINGS
VARIANCES AND ADJUSTMENTS:
Section 18.370.010 states that the Director shall a pprove, approve with conditions, or deny an
application for a variance based on finding that the foIlowing criteria are satisfied:

a. The proposed variance will not be materially detrimental to the purposes of this title, to any
other applicable policies and standards, and to other properties in the same zoning district
or vicinity;
The variance is proposed to_ preserve ex sting easement rights to the existing driveway. Residents of the
Alpine View subdivision will not be using this access and no new access which is in violation of the
standards will be developed. Therefore, the proposed variance is not materially detrimental to the p oses
of this title, any other applicable policies and standards and to other properties in the same zoning district
and vicinity.
b. There are special circumstances that exist which are peculiar to the lot size or shape,
topograpphy or other circumstances over which the applicant has no control, and which are
not app&cable to other properties in the same zoning district;
The applicant has no control over the permanent easement rights to the existing driveway. Therefore, a
special circumstance exists which is not applicable to other properties in the same zoning district.
C. The use proposed will be the same as permitted under this title and City standards will be
maintained to the greatest extent that is reasonably possible while permitting reasonable
economic use of the land;
The requested variance will not result in a change of use that is not permitted within an R-7 zone. In
addition, the use of the existing driveway access will not add an additional access to Bull Mountain Road in
violation of the driveway spacing standard. Therefore, this criterion has been satisfied.
d. Existing physical and natural systems, such as but not limited to traffic, drainage, dramatic
land forams or parks will not be adversely affected an more than would occur if the
development were developed as specified in the title; any
This criterion does not. apply because the existing driveway is not a result of new development. In addition,
the existing driveway is not a detriment to the above anymore than it would be if in compliance with the
current standard.
e. The hardship is not self-imposed and the variance requested is the minimum variance
which wouldalleviate the hardship.
The hardship is not self-imposed because the applicant has no control over the desire of easement right
holders to continue using the existing driveway. Therefore, the variance is the minimum variance that would
alleviate the hardship.
FINDING: Based on the analysis above, the Variance criteria have been met.
ADJUSTMENT TO ACCESS AND EGRESS STANDARDS:
Section 18.370.020.C.5.a provides that in all zonin districts where access and egress drives cannot
be readily designed to conform to Code stanfards within a particular parcel, access with an
adjoinin property_ shall be considered. If access in conjunction with another parcel cannot
reasonably be achieved, the Director may grant an adjustment to the access requirements of
Chapter 18.705 through a Type II procedure, as governed in Section 18.390.030, using approval
criteria contained in Subsection 5.b below.
The Director may approve, approve with condition, or deny a request for an adjustment from the
access requirement contained in Chapter 18.705, based on the following criteria:
(1) It is not possible to share access.
No new residents will use the existing driveway access. Only those who hold easement rights to the
driveway will be using it. The six easement right holders have indicated they will not use an alternative
access. Although shared access may be possible, it's not guaranteed because the easement rights allow
certain residents to continue using the existing private driveway. Therefore, it's not possible to share
access.

(2) There are no otl6alternative access points on the A in question or from another
street.
Alternative access points are available, but easement right holders may choose not to use them.
Therefore, there are no other alternative access points on the street in question or from another street.
(3) The access separation requirements cannot be met.
The access requirements cannot be met for the existing driveway because of its close roximity to SW
133` and other existing driveways. In addition, it's not possible to move the dpveway because
surrounding properties are privately owned.
(4) The request is the minimum adjustment required to provide adequate access.
Given the permanence of the easement rights, the request is the minimum adjustment required to
provide adequate access to those residents w1io hold easement rights.
(5) The approved access or access approved with conditions will result in a safe access; and
Although it does not meet driveway spacing standards, the existing access will be a safe access if it is in
compliance with the current visual clearance requirement.
(6) The visual clearance requirement of Chapter 18.795 will be met.
Section 18.795.040.B states (concerning non-arterial streets 24 feet or more in width): At all intersections
of... a non-arterial street and a driveway... where one of the streets or driveway is 24 feet or more in width, a
visual clearance shall be a triangle formed by the right-of-way pro erty lines along such lots and a straight
line joining the right-of-way or property line at ppo_ints which are 30 eet distance from the intersection of the
right-of-way.lirne,measured along such lines. 'The applicant has shown on the submitted plan that, with
vegetation trimming within the existing SW Bull Mountain Road right-of-way, the sight distance to the east
and west of the driveway will exceed 350 feet. However, the submitted plan does not show that the required
30-foot visual clearance areas will be maintained at the intersection of the existing driveway and SW Bull
Mountain Road.
FINDING: Based on the analysis above, Staff finds that all but # 6 of the special adjustment criteria
are satisfied.
SECTION VII. OTHER STAFF COMMENTS
No other staff comments were received.
SECTION VIII. AGENCY COMMENTS
Tri-Met Transit Development was notified of the variance request and did not comment.
Tualatin Valley Fire and Rescue was notified of the variance request and did not comment.

REQUEST: The applicant is requesting approval for a Variance to the driveway spacing standard
(18.750.030.H.3) to allow continued use of an existing private driveway approach onto SW Bull
Mountain Road. The subject variance is required by a condition of approval for the decision
approving the Alpine View Subdivision (SUB2004-00024).
LOCATION: North of SW Bull Mountain Road west of the intersection with SW 133 Avenue; WCTM 2S109AB,
Tax Lots 700, 800, 900 and 1000.
ZONE: R-7: Medium-Density Residential District. The R-7 zoning district is designed to accommodate
attached single-family homes, detached single-family homes with or without accessory residential
units, at a minimum lot size of 5,000 square feet, and duplexes, at a minimum lot size of 10,000
square feet. Mobile home parks and subdivisions are also permitted outright. Some civic and
institutional uses are also permitted conditionally.

The Alpine View site was annexed into the City of Tigard and was given a City of Tigard zoning
designation of R-7: Medium-Density Residential District. The site consists of four parcels that
will be combined to form a single subdivision that is 8.69 acres in size. The northern boundary of
the Alpine View site abuts two parcels that are in unincorporated Washington County. The
western boundary abuts the Three Mountain Estates subdivision. The eastern boundary abuts the
Foran and Raven Ridge subdivisions. The southern boundary abuts four parcels that are in
unincorporated Washington County.

The City of Tigard Planning Department approved the Alpine View Preliminary Plat Application
last summer. The staff approval was appealed to the City's Hearing Officer last fall; the hearings
officer subsequently upheld the staff approval.
Condition number 46 in the Alpine View Notice of Decision dated 9/20/2005, states:
"prior to construction, the applicant shall apply for an adjustment to the street spacing standard
for the existing driveway on Bull Mountain Road
This application narrative is a response to the applicable City of Tigard Community
Development Code Criteria for the adjustment of the street spacing standard for the private
driveway access onto SW Bull Mountain Road.

DECISION-MAKING PROCEDURES
18.390.010 Purpose
A. Purpose. The purpose of this chapter is to establish a series of standard decision-making
procedures that will enable the City, the applicant, and all interested parties to reasonably
review applications and participate in the local decision-making process in a timely and
effective way. Each permit or action set forth in Chapters 18.320 - 18.385 has been assigned
a specific procedure type.
18.390.020 Description of Decision Making Procedures
B. Wipes defined. There are four types of decision-making procedures, as follows:
2. Type II Procedure. Type II procedures apply to quasi-judicial permits and actions that
contain some discretionary criteria. Type II actions are decided by the Director with
public notice and an opportunity for a hearing. If any party with standing appeals a
Director's Type II decision, the appeal of such decision will be heard by the Hearings
Officer.
18 390.030 Type HProcedure
A. Preapplication conference. A preapplication conference is required for Type II actions.
Preapplication conference requirements and procedures are set forth in section
18.390.080C.
B. Application requirements.
1. Application Forms. Type II applications shall be made on forms provided by the Director
as provided by Section 18.390.080 (E-1).
2 Application Requirements. Type II applications shall:
a. Include the information requested on the application form;
b. Address the relevant criteria in sufficient detail for review and action; and
c. Be accompanied by the required fee.
d. Include two sets of pre-stamped and pre-addressed envelopes for all property owners
of record as specified in Section 18.390.0400 The record of the Washington County
Department of Assessment and Taxation are the official records for determeing
ownership. The applicant shall demonstrate that the most current assessment records
have been used to product the notice list;

e. Include an impact study. The impact study shall quantify the effect of the development
on public facilities and services. The study shall address, at a minimum, the
transportation system, including bikeways, the drainage system, the parks system, the
water system, the sewer system, and the noise impacts of the development. Fore each
public facility system and type of impact, the study shall propose improvements
necessary to meet City standards and to minimize the impact of the development on
the public at large, public facilities systems, and affected private property users. In
situations where the Community Development Code requires the dedication of real
property interests, the applicant shall either specifically concur with the dedication
requirements, or provide evidence which supports the conclusion that the real
property dedication requirement is not reoughly proportional to the projected
impacts of the development.
C. Notice of pending Type II Administrative Decision.
1. Prior to making a Type II Administrative Decision, the Director shall provide notice to:
a. All owners of record within 500 feet of the subject site;
b. Any City-recognized neighborhood group whose boundaries include the site;
c. Any governmental agency which is entitled to notice under an inter governmental
agreement entered into with the City which includes provision for such notice or who is
otherwise entitled to such notice.
2. The purpose of such notice is to provide nearby property owners and other interested
parties with an opportunity to submit written comments concerning the application, prior
to issuance of the Type II Administrative Decision. The goal of this notice is to invite
relevant parties of interest to participate early in the decision-making process;
3. Notice of a pending Type II Administrative Decision shall:
a. Provide a 14-day period for the submission of written comments prior to issuance of a
decision on the permit;
b. List by commonly used citation, the approval criteria relevant to the decision;
c. State the place, date and time the comments are due, and the person to whom the
comments should be addressed;
d. Include the name and telephone number of the person who will make the
Administrative Decision;
e. Identify the specific permits or approvals requested;
f. Describe the street address or other easily understandable geographic reference to the
subject site;

g. Indicate that failure of any party to address the relevant approval criteria with
sufficient specificity may preclude subsequent appeals to the Land Use Board of Appeals
or Circuit Court on that issue. Comments directed at the relevant approval criteria are
what constitute relevant evidence;
h. Indicate that all evidence relied upon by the Director to make this decision shall be
contained within the record, and is available for public review. Copies of this evidence
can be obtained at a reasonable cost from the Director;
i. Indicate that after the comment period closes, the Director shall issue a Type II
Administrative Decision. The Director's decision shall be mailed to the applicant and to
owners of record of property located within 500 feet of the subject site, and to anyone
else who submitted written comments or who is otherwise entitled to notice;
j. Contain the following notice: "Notice to mortgagee, lienholder, vendor, or seller: The
Tigard Development Code requires that if you receive this notice it shall be promptly
forwarded to the purchaser. "
D. Administrative decision requirements. The Director's Decision shall address all of the
relevant approval criteria. Based upon the criteria and the facts contained within the record, the
Director shall approve, approve with conditions or deny the requested permit or action.
E. Notice o decision.
1. Within five days after signing the decision, a Notice of Decision shall be sent by mai to:
a. The applicant and all owners or contract purchasers of record of the site which is the
subject of the application;
b. All owners of record of property as shown on the most recent property tax assessment
roll, located within 500 feet of the site;
c. Any City-recognized neighborhood group whose boundaries include the site;
d. Any governmental agency which is entitled to notice under an intergovernmental
agreement entered into with the City which includes provision for such notice or who is
otherwise entitled to such notice.
2. The Director shall cause an affidavit of mailing of such notice to be prepared and make a
part of the file, which indicates the date the notice was mailed and demonstrates that the
required notice was mailed to the necessary parties in a timely manner;
3. The content of the Type II Notice of Decision shall contain:

a. The nature of the application in sufficient detail to apprise persons entitled to notice of
the applicant's proposal and of the decision;
b. The address or other geographic description of the subject property, including a map
of the site in relation to the surrounding area, where applicable;
c. A statement of where the Director's decision can be obtained;
d. The date the Director's decision shall become final, unless appealed;
e. A statement that all persons entitled to notice or who are otherwise adversely affected
or aggrieved by the decision may appeal the decision;
f. A statement briefly explaining how an appeal can be taken, the deadline for filing such
an appeal, and where further information can be obtained concerning the appeal; and
g. A statement that unless the applicant is the appellant, the hearing on an appeal from
the Director's Decision shall be confined to the specific issues identified in the written
comments submitted by the parties during the comment period. Additional evidence
concerning issues properly raised in the Notice of Appeal may be submitted by any party
during the appeal hearing, subject to any additional rules of procedure that may be
adopted from time to time by the appellate body.
F. Final decision and egective date. A Type II Administrative Decision is final for purposes of
appeal when notice of the decision is mailed. A Type II Administrative Decision becomes
effective on the day after the appeal period expires, unless an appeal is filed. If an appeal is
filed and dismissed after the appeal period has expired, the Type II Administrative Decision
becomes effective on dismissal of the appeal.
G. peal. A Type II administrative decision may be appealed as follows:
1. Standing to appeal. The following parties have standing to appeal a Type II Administrative
Decision:
a. The applicant;
b. Any party who was mailed written notice of a pending Type II administrative decision;
c. Any other party, who demonstrates by clear and convincing evidence that they
participated in the proceeding through the submission of written or verbal testimony;

2. Appeal procedure.
a. Notice of appeal. Any party with standing, as provided in Section G1 above, may
appeal a Type II Administrative Decision by filing a Notice of Appeal according to the
following procedures;
(1) Time for filing. A Notice of Appeal shall be filed with the Director within ten business
days of the date the Notice of Decision was mailed;
(2) Content of notice of appeal. The Notice of Appeal shall contain:
(a) An identification of the decision being appealed, including the date of the
decision;
(b) A statement demonstrating the partyfiling the Notice of Appeal has standing
to appeal;
(c) A detailed statement of the specific issues raised on appeal;
(d) A statement demonstrating that the specific issues raised on appeal were
raised during the comment period, except when the appeal is filed by the
applicant;
(e) Filing fee.
(3) All Notices of Appeal for Type II Administrative Appeals shall be filed with the
Director, together with the required filing fee. The amount of the filing fee shall be
established by the Director. The maximum fee for an initial hearing shall be the cost to
the local government for preparing and for conducting the hearing, or the statutory
maximum, whichever is less.
b. Scope of appeal. The appeal of a Type II Administrative Decision by a person with
standing shall be limited to the specific issues raised during the written comment period,
as provided under Section 18.390.040C, unless the Hearings Officer, at his or her
discretion, allows additional evidence or testimony concerning any other relevant issue.
The Hearings Officer may allow such additional evidence if he or she determines that
such evidence is necessary to resolve the case. The intent of this requirement is to limit
the scope of Type H Administrative Appeals by encouraging persons with standing to
submit their specific concerns in writing during the comment period. The written
comments received during the comment period will usually limit the scope of issues on
appeal. Only in extraordinary circumstances should new issues be considered by the
Hearings Officer on appeal of a Type II Administrative Decision;

c. Appeal procedures. Type III notice and hearing procedures shall be used for all Type
II Administrative Appeals, as provided in Sections 18.390.050 C - F;
H. Final decision and effective date. The decision of the Hearings Officer with regard to any
appeal of a Type II Administrative Decision is the final decision of the City. The decision of
the Hearings Officer is final for purposes of appeal on the day the decision is mailed. The
decision is effective on the day after the appeal period expires, unless an appeal is filed. If an
appeal is filed, the decision is effective on the day after the appeal is resolved;
Comment: The proposal is to file the access spacing adjustment application as a Type II
procedure, as allowed by Section 18.370.020C.5a.

VARIANCES AND ADJUSTMENTS

18.370.010 Variances

18.370.020 Adjustments
A. Purpose. The purpose of this section is to establish two classes of special variances:
1. "Development adjustments " which allow modest variation from required development standards
within proscribed limits. Because such adjustments are granted using -clear and objective
standards, " these can be granted by means of a Type I procedure, as opposed to the more
stringent standards of approval and procedure for variances.
2. "Special adjustments " which are variances from development standards which have their own
approval criteria as opposed to the standard approval criteria for variances contained in Section
18.370.020.C.
Comment: The proposed adjustment is allowed as a special adjustment, as discussed below.
C. Special Adjustments.
5. Adjustment to access and egress standards (Chapter 18.705).
a. In all zoning districts where access and egress drives cannot be readily designed to conform to
Code standards within a particular parcel, access with an adjoining property shall be
considered. If access in conjunction with another parcel cannot reasonably be achieved, the
Director may grant an adjustment to the access requirements of Chapter 18.705 through a Type
II procedure, as governed in Section 18.390.030, using approval criteria contained in Subsection
2b below.
Comment: SW Bull Mountain Road is shown as a Collector on the City of Tigard
Transportation System Plan, adopted in February of 2002. Section 18.705.030.H.3, Access
Management, requires a minimum driveway and street spacing of 200 along a collector. The
existing access spacing to the west is 165 feet from the center of the private drive to the center of
SW 133rd Avenue to the west. The existing access spacing to the driveways to the east is 134
feet and 176 feet (refer to sketch). An access modification adjustment is required.
b. The Director may approve, approve with conditions, or deny a request for an adjustment from the
access requirements contained in Chapter 18.705, based on the following criteria:
(1) It is not possible to share access;

Comment: The newly created lots within the Alpine View subdivision will not utilize the
existing private drive onto SW Bull Mountain Road; only the 6 existing easement right owners
will continue to use the gated access. The existing easement right holders have indicated that
they will not use the new local street roadway connections to the east and west of Alpine View.
Shared access is achievable for the 6 existing easement right owners, if they choose to use the
Alpine View local street connections; but can't be guaranteed since they can exercise their
existing easement rights to continue access via the private driveway onto SW Bull Mountain
Road. The existing easement right was not discontinued by the City of Tigard, or Washington
County, during the Land Use Process, onto the SW Bull Mountain Road right-of-way.
(2) There are no other alternative access points on the street in question or from another street;
Comment: Alternate access points are available, but the existing easement right owners may
chose not to use them.
(3) The access separation requirements cannot be met;
Comment: The private driveway location onto SW Bull Mountain Road can not be moved to
the east more than 5 feet from its existing location since Tax lot 1100 to the east of the private
driveway is privately owned.
(4) The request is the minimum adjustment required to provide adequate access;
Comment: The adjustment of 35 feet to the west and 65 feet to the east, to meet the 200 foot
spacing requirement, is the minimum needed to provide adequate access spacing, as defined in
Section 18.705.030.H.3, Access Management, of the City of Tigard Community Development
Code.
(5) The approved access or access approved with conditions will result in a safe access; and
Comment: The existing access location is not being moved. The existing access operates in a
safe manner today.
(6) The visual clearance requirements of Chapter 18.795 will be met.
Comment: With some minor vegetation trimming within the existing SW Bull Mountain Road
Right-of-Way, site distance to the east and west of the of the private drive entrance will be in
excess of 350 feet. Refer to the intersection access spacing sketch for the 350 foot sight lines
from the existing driveway access along SW Bull Mountain Road.
