Mobile home parks and subdivisions are also permitted outright. APPLICABLE Some civic and institutional uses are also permitted conditionally. REVIEW CRITERIA: Community Development Code Chapters, 18.360, 18.370, 18.390, 18.510. SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request subject to certain conditions of approval. The findings and conclusions on which the decision is based are noted in Section IV. NOTICE OF TYPE 11 DECISION VAR2005-00050- GREENBURG OAKS APTS. REHABILITATION PAGE 1 OF 5 CONDITIONS OF APPROVAL The applicant shall prepare a cover letter an submit it, along with any supporting documents and/or plans that address the following requirements to the CURRENT PLANNING DIVISION, ATTN: MATHEW SCHEIDEGGER 503-639-4171, EXT 2437. The cover letter shall clearly identify where in the submittal the required information is found: Show the five foot strip between the proposed basketball court and the southern property line to be planted with vertical shrubbery. THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site History: Greenburg Oaks Apartments, formerly Villa La Paz, is an affordable housing development originally built in 1968. The complex consists of four apartment buildings with a total of 84 units, a community building, an outdoor swimming pool, a playground, and parking. Site Information and Proposal Description: The subject property is approximately 2.9 acres and is located on the west side of SW 91St Avenue, south of SW Greenburg Road. The applicant is proposing a renovation that will include interior upgrades, re-siding and new windows for the building exteriors, and demolition of two existing carports. Additional site improvements will include a basketball court, small building entry plaza, a plaza at the entry to the site, site accessible paths, bicycle parking, new landscaping, and reconfiguration and reduction of the parking. SECTION IV. COMMENTS FROM PROPERTY OWNERS WITHIN 500 FEET One letter was received from a neighbor to the south regarding the noise and litter created by the proposed basketball court. The neighbor would like to see a more secure fence and possible a more visible area for the court. Staff Response: The applicant is providing a 12-foot chain link fence with vinyl slats around the basketball court area, which should provide ample security for flying objects (basketballs). The subject site shows, a five foot area between the proposed court and the southern property line. A condition of approval will require the applicant to plant a form of vertical shrubbery to help block the view and noise from the site. SECTION V. APPLICABLE REVIEW CRITERIA AND FINDINGS Adjustments to parking standards: Reduction from minimum parking requirements. By means of a Type II procedure, as governed by Section 18.330.04 , the Director may authorize up to a 20% NOTICE OF TYPE 11 DECISION VAR2005-00050- GREENBURG OAKS APTS. REHABILITATION PAGE 2 OF 5 reduction in the total minimum vehicle parking spaces required in Section 18.765.070.H when an applicant for a development permit can demonstrate in a parking study prepared by a traffic consultant or in parking data from comparable sites that: (1) Use of transit, demand management programs, and/or special characteristics of the customer, client employee or resident population will reduce expected vehicle use and parking space demand for this development, as compared to standards Institute of Transportation Engineers (ITE) vehicle trip generation rates and minimum city parking requirements, and (2) A reduction in parking will not have an adverse impact on adjacent uses. The applicant has requested to reduce the required parking at the Greenburg Oaks Apartment complex from 126 stall to 106 stalls (20%). To demonstrate that parking space demand for the Greenbur Oaks Apartments will be below the minimum requirements (required parking: 126 spaces), the applicant counted the number of cars on-site on four different occasions. Sunday morning was specifically chosen since parking is most intensely utilized at that time given that there are often visitors spending the night, and most residents are usually home. The number of vehicles counted varied from 30 vehicles on a Tuesday at 8:00am to 76 vehicles on a Sunday morning at 9:00 am. The applicant has included a memo that indicates actual days, times, and vehicle counts. The applicant has also included a memo from the owners of Greenburg Oaks (Community Partners for Affordable Housing (CPAH) that addresses comparable sites under the same ownership. According to the memo, developments managed by CPAH are all affordable housing developments for low income households. Due to the demographics of the residents of projects such as Greenburg Oaks and similar projects, Village at Washington Square, vehicle ownership is low. The mentioned developments are chosen for affordable housing due to their close proximity to public transportation facilities such as Tigard's public transfer station, and bus routes on SW Hall Blvd. The Village at Washington Square was approved with an adjustment to reduce their minimum parking under SDR2000-00021. The applicant has also provided an assessment of the on-site parking by Lancaster Engineering which addresses the Institute of Transportation Engineers vehicle trip generation rates. Based on measurements at 19 sites in suburban areas, it was found that the average weekday peak-period parking demand is 1.20 vehicles per dwelling unit. For 84 apartment units, this would result in an estimated weekday demand of 101 parking spaces. No weekend parking demand data is available for weekends for suburban apartments. For urban apartments, the weekday parking demand is 1.00 vehicles per unit, and for Saturdays 1.02 vehicles per unit. 'If the same ratio of Saturday to weekday parkin demand holds true for suburban apartments, then the peak demand would increase to 100 spaces. Because these apartments are intended for low-income tenants, it would be reasonable to expect that the actual parking demand would be somewhat less than that shown by using the handbook rates. Because parking at the Greenburg Oaks is underutilized, and will continue to be underutilized even at a reduction to 106 spaces, adjacent uses will not be adversely affected. FINDING: Based on the analysis above, the parking adjustment criteria have been met. Minor Modification: The applicant is requesting a minor modification to the Greenburg Oaks complex in order to construct interior upgrades, add new windows, add an additional storage room and re-side the community building. Other improvements include, demolishing two existing carports, adding a basketball court, entry plazas, site accessible paths, bicycle parking, new landscaping, and reconfigure and reduce the existing parking. A search of City records was conducted and no original land-use case was found for the property. The Director shall determine that a major modification(s) will result if one or more of the following changes are proposed. NOTICE OF TYPE 11 DECISION VAR2005-00050- GREENBURG OAKS APTS. REHABILITATION PAGE 3 OF 5 • • There will be: 1. An increase in dwelling unit density, or lot coverage for residential development; No change in residential density is proposed. Therefore, this standard does not apply. 2. A change in the ratio or number of different types of dwelling units; The applicant is not proposing a change in the number of dwelling units. This standard does not apply. 3. A change that requires additional on-site parking in accordance with Chapter 18.765; No change is proposed that requires additional parking. 4. A change in the type of commercial or industrial structures as defined by the Uniform Building Code; No change is proposed for the type of structures on the site. 5. An increase in the height of the building(s) by more than 20%; No increase to building height is proposed. 6. A change in the type and location of accessways and parking areas where off-site traffic would be affected; No change in the accessway is proposed which will affect off-site traffic. 7. An increase in vehicular traffic to and from the site and the increase can be expected to exceed 100 vehicles per day; No change is proposed that will increase traffic to the site. This criterion does not apply. 8. An increase in the floor area proposed for a nonresidential use by more than 10% excluding expansions under 5,000 square feet; The proposed storage extension to the community building is approximately 160 square feet. Therefore, this standard does not apply. 9. A reduction in the area reserved for common open space and/or usable open space which reduces the open space area below the minimum required by this code or reduces the open space area by more than 10%; The applicant is proposing to add common open space by constructing a basketball court on the property. The applicant is also proposing to add to the existing landscaping. However, the applicant has not shown landscaping between the proposed basketball court and the southern property line. Therefore, the applicant is required to show the five foot strip between the proposed basketball court and the southern property line to be planted with vertical shrubbery. 10. A reduction of project amenities below the minimum established by this code or by more than 10% where specified in the site plan: a. Recreational facilities; b. Screening; and/or c. Landscaping provisions. As mentioned above, the applicant is proposing to add a recreational facility and landscaping. Therefore, this standard does not apply. A modification to the conditions imposed at the time of site development review approval which are not the subject of 131 through 10 above of this subsection. A search of City records was conducted, and no original approval could be found. Therefore, this standard does not apply. FINDING: Based on the analysis above, the Minor Modification criteria have not been met. If the applicant complies with the condition below, the standards will be met. CONDITION: Show the five foot strip between the proposed basketball court and the southern property line to be planted with vertical shrubbery. SECTION VI. BACKGROUND INFORMATION Site History: Greenburg Oaks Apartments, formerly Villa La Paz, is an affordable housing development originally built in 1968. The complex consists of four apartment buildings with a total of 84 units, a community building, an outdoor swimming pool, a playground, and parking. Site Information and Proposal Description: The subject property is approximately 2.9 acres and is located on the west side of SW 91St Avenue, south of SW Greenburg Road. The applicant is proposing a renovation that will include interior upgrades, re-siding and new windows for the building exteriors, and demolition of two existing carports. Additional site improvements will include a basketball court, small building entry plaza, a plaza at the entry to the site, site accessible paths, bicycle parking, new landscaping, and reconfiguration and reduction of the parking. SECTION IV. COMMENTS FROM PROPERTY OWNERS WITHIN 500 FEET One letter was received from a neighbor to the south regarding the noise and litter created by the proposed basketball court. The neighbor would like to see a more secure fence and possible a more visible area for the court. Staff Response: The applicant is providing a 12-foot chain link fence with vinyl slats around the basketball court area, which should provide ample security for flying objects (basketballs). The subject site shows, a five foot area between the proposed court and the southern property line. I am excited about the renovation for the tenant's and our city but would like to hear that a more visible area or more secure fence would be provided for the basketball court. The noise issues that a basketball court might bring to neighborhood if the court is to be hidden away at the back of the building where supervision is little. It consists of four apartment buildings with a total of 84 units, a Community Building, an outdoor swimming pool, a playground, and parking. In 1997 Community Partners for Affordable Housing acquired the property and undertook a renovation of the project at that time. Another renovation is currently being proposed for the development. This renovation will include interior upgrades, re-siding and new windows for the building exteriors, a storage room addition to the Community Building, demolition of the two existing carports, and site improvements including a basketball court, small building entry plazas, a plaza at the entry to the site, site accessible paths, bicycle parking, new landscaping, and reconfiguration and reduction of the parking. Page 1 of 4 • • MINOR MODIFICATION AND ADJUSTMENT The Greenburg Oaks Rehabilitation project has been undertaken to provide some needed upgrades to the buildings and to improve the site. By providing areas for residents to hang out, places for kids to play, improvements to pedestrian circulation, and additional landscaping, Greenburg Oaks will become a better place for the residents to live and a welcome improvement to the neighborhood. In order to implement the proposed site improvements, and because the existing parking is underutilized, it is proposed that parking on the site be reduced. Through the application of a Minor Modification and an Adjustment, we hope to reduce the amount of parking on the Greenburg Oaks site from the existing 137 spaces to the proposed amount of 106 spaces. The Minor Modification is being applied for to reduce the parking from the existing 137 spaces to the code minimum of 126. The Adjustment is being applied for to further reduce the parking from the code minimum of 126 to the proposed amount of 106 spaces. This number includes 52 standard spaces, 7 van accessible spaces, and 47 compact spaces. The amount of proposed parking is a reduction of 16% from that required by the Tigard Development Code. Based on Table 18.765.2 of the Code, the minimum required parking spaces for this site is 126 per the following calculation: 12 - 1 bedroom units x 1.25 = 15 60 - 2 bedroom units x 1.5 = 90 12 - 3 bedroom units x 1.75 = 21 Total 126 A Minor Modification is also being applied for in order to construct a 180 square foot addition to the existing Community Building for added maintenance storage. This addition will take the existing building form (which is 20 feet wide) and extend it 9 feet to the west. With respect to the form, the siding, and the building details, this addition will be identical in character to the existing building. Please see the Site Development Plan for the configuration of the Community Building and the new addition, and its location on the property. Minor Modification It is our understanding that in order to reduce the parking from the existing 137 spaces to the required minimum of 126, and to add square footage to the existing Community Building as mentioned above, a Minor Modification must first be applied for. Following is a summary addressing the 11 criteria listed in Section 18.360.050, B of the Tigard Development Code required for a Minor Modification: 1. An increase in dwelling unit density or lot coverage for residential development. No change in dwelling unit density or lot coverage is proposed. 2. A change in the ratio or number of different types of dwelling units. No change in the ratio or number of different types of dwelling units is proposed. 3. A change that requires additional on-site parking in accordance with Chapter 18.765. No change is proposed which requires additional on-site parking. 4. A change in the type of commercial or industrial structures as defined by the Uniform Building Code. No change is proposed for the type of structures on the site. 5. An increase in the height of the buildings by more than 20%. No change in the height of buildings on the site is proposed. 6. A change in the type and location of accessways and parking areas where off-site traffic would be affected. No change in the accessways is proposed which will affect off-site traffic. 7. • An increase in vehicular traffic to and from the site and the increase can be expected to exceed 100 vehicles per day. Vehicular traffic to and from the site will be unchanged by the proposed modification. Page 2 of 4 8. An increase in the floor area proposed for a non-residential use by more than 10% excluding expansions under 5,000 square feet. No floor area expansion for a non-residential use over 5,000 square feet is proposed. 9. A reduction in the area reserved for common open space and/or usable open space that reduces the open space area below the minimum required by this code or reduces the open space area by more than 10%. No change is proposed which will reduce the common or usable open space for this project. Several changes are proposed which will increase the open space including a basketball court, a plaza at the entry to the site, and new landscaping. 10. A reduction of project amenities (recreational facilities, screening, and/or landscaping provisions) below the minimum established by this code or by more than 10% where specified in the site plan. No reduction of project amenities is proposed for this project. Several amenities are being added including a basketball court, building entry plazas, a plaza at the entry to the site, site accessible paths, bicycle parking and new landscaping. 11. A modification to the conditions imposed at the time of Site Development Review approval that are not the subject of Criteria 1 through 10 above. This is to be determined. Adjustment It is our understanding that in order to reduce the parking below the required minimum of 126 spaces indicated in the Tigard Development Code, a Type II Adjustment is required. This Adjustment is being proposed based on Section 18.370.020, C, 7, a, l & 2 of the Tigard Development Code. This section states that a 20% reduction from the minimum parking requirement may be allowed when the applicant can demonstrate through parking data from comparable sites that: 1) special characteristics of the resident population will reduce expected vehicle use and parking space demand for this development as compared to standards Institute of Transportation Engineers (ITE) vehicle trip generation rates and minimum city parking requirements, and, 2) A reduction in parking will not have an adverse impact on adjacent uses. To demonstrate that parking space demand for this development will be below the minimum city parking requirements, vehicles parked on the Greenburg Oaks site were simply counted. This took place on four different days. Sunday morning was specifically chosen since parking is most intensely utilized at that time given that there are often visitors spending the night, and most residents are usually home. The number of vehicles counted varied from a minimum of 30 vehicles on Tuesday at 8:00 am to 76 vehicles on Sunday morning at 9:00 am. Please see the attached memo prepared by Income Property Management that shows the exact days, times, and vehicle counts. Also included with this application is a Memo from Community Partners for Affordable Housing who own not only this development, but other affordable housing developments with similar resident demographics. This Memo demonstrates that the special characteristics of the resident population will reduce expected vehicle use from the minimum city parking requirements, and that this situation is not likely to change in the foreseeable future. An assessment by Lancaster Engineering of the on-site parking which addresses the Institute of Transportation Engineers vehicle trip generation rates is also included with this application. This assessment shows that the parking proposed for this site is more than adequate based on the criteria found in data published by the ITE. Because parking at Greenburg Oaks is so underutilized, and will continue to be underutilized even at a reduction to 106 spaces, adjacent uses will not be adversely affected. With 106 spaces there should be ample parking for all residents and their visitors with plenty of spaces to spare, and residents will not be forced to park anywhere but on the Greenburg Oaks site. Page 3 of 4 In conclusion, we feel that the reduction in parking being requested is warranted based on the underutilization of parking currently on the site. Given current parking usage and demographics of the resident population, the reduction to 106 parking spaces would still leave a comfortable cushion in the parking number, and, therefore, adjacent sites would not be adversely affected. Most importantly, a reduction in parking would make it possible to diminish the current perception that the site is a "sea of pavement", and would greatly improve the site with some valuable amenities. It is my understanding that current code would require 126 spaces, while we currently have about 137 parking spaces at the project. I also understand that the development plan requires that we reduce the total count to 106 spaces. Based on the current and anticipated population of our project, I think that 106 parking spaces is a reasonable number. Current peak utilization at the property is less than 80 spaces. This count was made early on a Sunday moming at a time when 100% of the tenants were likely to be at home. It is likely that a reasonable number of guest cars would have been present as well. This count was made at a time of a 10% vacancy at the property. Adjusting for vacancy, it would be likely that if the project were 100% occupied, maximum demand for parking would be less than 90 spaces. The reason for this low utilization of parking can be attributed to the special characteristics of our resident population. Our residents are mostly very low income households. Many of them are unemployed due to disabilities. Many are employed in low wage service jobs with employers in the Tigard and Washington Square area. One of the benefits offered by Greenburg Oaks is that the proximity of the project to transit routes along Greenburg Road and 99W allows our tenants to avoid the need for car ownership for commuting or access to services and shopping. Attached is a demographics spreadsheet identifying many characteristics of our tenants at Greenburg Oaks. The list is sorted by % of AMI. This is the household income as a percent of the Metropolitan Area Median Income. For 2005, 100% of the Area Median Income is $67,900. Thus a 4 person household earning $34,000 would be at 50% AMI. The average AMI % at Greenburg Oaks is 34.13%, just over $23,000 for a four-person household. This is considered extremely low income. The Employer column reflects the sources of income for each household. You can see how many households are on Social Security and/or TANF (emergency) assistance. Even those folks who are employed, are working in jobs that offer very low wages and benefits. These statistics show why our project is so important to the community (providing safe, decent, affordable housing to families threatened with homelessness), and why we have such a small percentage of car owners among our tenants. While the proposed rehabilitation project will improve the quality of life at the project, it is not our intention to dramatically alter the overall demographic of our population. We have made a 40 year commitment to the state to preserve this project as affordable housing for low income households. As the economy improves, we expect a proportional increase in the incomes of our tenants. We expect that the increased incomes will support a slight increase in car ownership. However, we do not expect this to be as much as 20% over current demand for parking. I understand that the development is an 84-unit apartment complex that will be intended for low-income tenants. To estimate the parking demand for this project, I reviewed the data in PARKING GENERATION, Third Edition, published by the Institute of Transportation Engineers. Although there is not a land-use category in this handbook specifically for low-income housing, ITE land-use 221, Low/Mid-Rise Apartment, appears to be the closest fit. Based on measurements at 19 sites in suburban areas, it was found that the average weekday peak-period parking demand is 1.20 vehicles per dwelling unit. For 84 apartment units, this would result in an estimated weekday demand of 101 parking spaces. No weekend parking demand data is available for weekends for suburban apartments. For urban apartments, the weekday parking demand is 1.00 vehicles per unit, and for Saturdays is. 1. 02 vehicles per unit. If the same ratio of Saturday to weekday parking demand holds true for suburban apartments, then the peak demand would increase to 103 spaces. Because these apartments are intended for low-income tenants, it would be reasonable to expect that the actual parking demand would be somewhat less than that shown by using the handbook rates.
