APPLICATION SUMMARY FILE NAME: DAFFODIL HILL SIDE YARD SETBACK ADJUSTMENT CASE NO.: Adjustment (VAR) VAR2003-00089 PROPOSAL: The applicant has requested a 20% adjustment to the side yard setback to reduce the setback from 5 feet to 4 feet on Lot 1 of Daffodil Hill Subdivision to accommodate construction. ZONING DESIGNATION: The subject property is within the R-7 Medium-Density Residential zoning district. The R-7 zoning district is designed to accommodate attached single-family homes, detached single-family homes with or without accessory residential units, at a minimum lot size of 5,000 square feet, and duplexes, at a minimum lot size of 10,000 square feet. APPLICABLE REVIEW CRITERIA: Community Development Code Chapters 18.370, 18.390 and 18.510. SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request subject to certain conditions of approval. The findings and conclusions on which the decision is based are noted in Section IV. VAR2003-00089 -SETBACK ADJUSTMENT PAGE 1 OF 3 NOTICE OF TYPE I DECISION CONDITION OF APPROVAL 1. All construction must be completed in compliance with the conditions of approval of the Daffodil Hill Subdivision (SUB2001-00004). THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION SECTION III. BACKGROUND INFORMATION Site Information and Proposal Description: The property is bordered on all sides by single-family residences. The proposal is to intrude into the 5-foot side yard setback by 1-foot to accommodate construction of the proposed home. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: Tigard Development Code Section 18.390 allows the following development Adjustments by means of a Type I procedure: Front yard setbacks. Up to a 25% reduction of the dimensional standards for the front yard setback required in the base zone. Setback of garages may not be reduced by this provision. Interior setbacks. Up to a 20% reduction of the dimensional standards for the side and rear yard setbacks required in the base zone. Lot coverage. Up to 5% increase of the maximum lot coverage required in the base zone. The applicant has requested an Adjustment to the side yard setback adjacent to lot #2 of the Daffodil Hill Subdivision to allow the placement of the house. The required side yard setback is 5 feet therefore, a 1-foot reduction of this setback may be allowed provided the following criteria are addressed. A development Adjustment shall be granted if there is a demonstration of compliance with all of the applicable standards: A demonstration that the Adjustment requested is the least required to achieve the desired affect; The adjustment is being requested to allow the structure to protrude into the side yard setback by 1-foot. The lot is encumbered on the opposite side yard by an 8-foot pedestrian access easement. According to the applicant this is the minimum relief needed to allow placement of the home. VAR2003-00089 -SETBACK ADJUSTMENT PAGE 2 OF 3 NOTICE OF TYPE I DECISION The Adjustment will result in the preservation of trees, if trees are present in the development area; All trees on the site were removed during construction of the subdivision. There are no trees to preserve, therefore, this criterion is inapplicable. The Adjustment will not impede adequate emergency access to the site; The Adjustment will not impede emergency access. Emergency service can still access this dwelling and adjacent dwellings. There is not a reasonable alternative to the Adjustment which achieves the desired affect. Because of the size of the home, there are no other reasonable alternatives to the placement or orientation of the home that would achieve the desired affect. FINDING: Based on the analysis above, the adjustment criteria have been satisfied. SECTION V. PROCEDURE AND APPEAL INFORMATION Notice: o1~Ttice was mailed to the applicant and owners. Final Decision: setback Adjustment is a Type I .procedure. As such, the Director's decision is final on the date it is mailed or otherwise provided to the applicant, whichever occurs first. The Director's decision may not be appealed locally and is the final decision of the City. THIS DECISION IS FINAL ON AUGUST 22, 2003 AND BECOMES EFFECTIVE ON AUGUST 23, 2003. Leah Terrace Tigard, Oregon 97224 Summary of Adjustment request(s): 1. This application is for an adjustment to reduce the required eastern side yard setback by 20%. In the proposed plan, we are considering the eastern side yard to be that portion of the site, which abuts lot 2. The current required minimum set back is 5'-0", the 20% reduction would reduce this to 4'-0". Overview of site and existing conditions: • The site is the first lot to the south as you enter into the project on S.W. Leah Terrace. The site is mainly flat other than the southern most portion, which abuts S.W. Bull Mountain Road. There is an 8' wide public pedestrian path easement that runs along the entire western side of the lot. Applicant's Response to Approval Criteria (A through D) of section 18.370.020 (adjustments) item B(2). Section 18.370.020 Adjustments - 2(B) Annroval Criteria. A development adjustment shall be granted if there is a demonstration of compliance with all of the applicable standards: a) A demonstration that the adjustment requested is the least required to achieve the desired effect; b) The adjustment will result in a preservation of trees, if trees are present in the development area; c) The adjustment will not impede adequate emergency access to the site, d) There is not a reasonable alternative to the adjustment, which achieves the desired effect Response to approval criteria A through D a) This proposal meets criteria A because: • A review of the proposed floor plans to determine if the overall width of the home could be reduced to meet the standard showed that a reduction of 1'-0" required would be a detriment to the proposed interior living space of the plan. The plan has already been narrowed from its original layout in order to meet the Lot 11, Daffodil. Hill - Adjus*nt Application • 7/23/2003 Page 2 proposed requirements. Since the site is a corner lot and therefore sits prominently as an entry feature to the project, the owner is working diligently to not only create a functional floor plan but also an exterior which is pleasing and proportional in terms of width to height, window configurations & sizes, columns sizes, roof pitches, eave details, etc. The owner is also trying to maintain some consistency in terms of room sizes with the other existing homes in the project. Reducing the room sizes further, we feel, would have a negative impact in this regard. • In order to try and help minimize the impact of this house to the street scene, we have proposed using a plan with a side-loaded garage rather than front-loaded, thus eliminating the garage door prominence. • The portion of the house, which would encroach into the required 5' setback area, is a small wall section at the rear portion of the house. Thus the impact to both the street scene and adjoining residence is minimal. b) This proposal meets criteria B because: • There are no existing trees on site. c) This proposal meets criteria C because: • There are no foreseen impediments to emergency access to the site as a result of this adjustment. d) This proposal meets criteria D because: • To the best of the applicant's knowledge there are no alternatives to the proposed adjusted setback that would better suit the intended purpose.
