CONDITION OF APPROVAL
THE FOLLOWING CONDITIONS SHALL BE SATISFIED
PRIOR TO THE ISSUANCE OF SITE/BUILDING PERMITS:
SUBMIT TO THE PLANNING DIVISION (MORGAN TRACY, 503-639-4171, EXT. 407)
FOR REVIEW AND APPROVAL:
1. Provide certification that the two banner wall signs. on the eastern warehouse
building have been removed prior to installation of the new freestanding sign.
SECTION III. BACKGROUND INFORMATION
Site History:
Staff has conducted a search of computer records and found a Zone Change approval
(ZON90-0001 1)'to rezone the property from I-P, Industrial Park, to its current I-L zoning
classification. In 1996, a Conditional Use Approval (CUP96-00001) was granted to allow a
Wireless Communications tower to be erected on a portion of the site. A sign code
exception (SCE91-00003/VAR9.1-00011) was approved in 1991 to allow sign to be placed
within the right of way on 72nd Avenue. Several other sign permits have also been issued
for the property (SGN 91-00027, 00084, 00085, 00090, SGN 92-00180, SGN 93-00183,
and SGN 1999-00054). No other land-use records could be found.
Vicinity Information:
The site is located on the east side of SW 72"d Avenue and backs up to Highway 217, at
the interchange with 1-5. To the north and south, properties are developed with Light
Industrial uses.
Site Information and Proposal Description:
The subject site is zoned Light Industrial (17L) and is developed with a warehouse storage
and office building with a large area for equipment vehicle storage. The applicant is
requesting a variance to allow a freeway-oriented sign which was removed during the
.construction of the 1-5/217 interchange to be replaced at an increased height. The
proposed 43 foot height exceeds the maximum 35 feet allowed for freeway oriented signs
by 8 feet (a 22.9% increase). The reconstructed freeway on-ramp was increased in height
and thus prevents a sign meeting the 35-foot height limit to be visible from the freeway.
SECTION IV. PUBLIC COMMENTS
No public comments were received. One agency comment was received from ODOT, as
described later in this report.
SECTION V. APPLICABLE REVIEW CRITERIA AND FINDINGS
VARIANCES AND ADJUSTMENTS:
Section 18.370.020.C.6.a states that an application for a sign adjustment must meet
one of five of the listed criteria.
(1) The proposed adjustment to the height limits in the sign code is necessary to
make the sign visible from the street because of the topography of the site,
and/or a conforming building or sign on an adjacent property would limit the
view of a sign erected on the site in conformance with Chapter 18.780, Signs;

The proposed 8-foot adjustment is the minimum necessary to elevate the sign above the
adjacent on-ramp retaining wall and allow it to be visible to passing vehicles. While the
topography of the site remains unchanged, the newly constructed on-ramp was built to a
higher profile than the preceding on-ramp, and thus limits the view of a sign conforming to
the 35-foot height limit.
(2) A second freestanding sign is necessary to adequately identify a second
entrance to a business or premises that is oriented towards a different street
frontage;
This criteria is not applicable as the only entrance to the site is from SW 72"d
(3) Up to an additional 25% of sign area or height may be permitted when it is
determined that the increase will not deter from the purpose of Chapter
18.780, Signs. This increase should be judged according to specific needs
and circumstances which necessitate additional area to make the sign
sufficiently legible. The increase(s) shall not conflict with any other non-
dimensional standards or restrictions of this chapter;
As described under the first criteria, the legibility of the sign is impacted by the presence of
the freeway on-ramp which sits higher than the previous sign. The proposed increase in
height represents a 22.9% increase, below the 25% threshold.
(4) The proposed sign is consistent with the criteria set forth in Subsection
18.780.130 G;
The criteria in this subsection reserve area around the sign for landscaping. If landscaping
is not feasible, then a 14-foot vertical clearance must be maintained between the ground
and the bottom of the sign. The applicant's sign will be protected at its base with curbing,
however, the nature and placement of the sign in the rear of the property is such that its
base will not be readily visible and not likely maintained. Therefore landscaping is not
seen as a practical or effective requirement. Minimum vertical clearances will be satisfied.
(5) The proposed exception for a second freestanding sign on an interior lot
which is zoned commercial or industrial is appropriate because all of the
following apply:
This criterion is not applicable as the proposed exception is not to allow. a second
freestanding sign. Freeway-oriented signs are allowed in addition to a primary
freestanding sign, per Section 18.780.090.
In addition to the criteria above, the Director shall review all of the existing or
proposed signage for the development and its relationship to the intent and purpose
of Chapter 18.780, Signs. As a condition of approval of the adjustment, the Director
may require:
(1) Removal or alteration of nonconforming signs to achieve compliance with the
standards contained in Chapter 18.780, Signs;

(2) Removal or alteration of conforming signs to establish a consistent sign
design throughout the development; and
(3) Application for sign permits for signs erected without permits or removal of
such illegal signs.
A field visit confirmed the following signs already present on site:
1. A monument sign at the intersection of SW 72nd and the driveway.
2. A freestanding sign on posts at the gated entrance to the property.
3. A wall sign located on the south face of the office building.
4. A banner sign on the north face of the warehouse building
5. A banner sign on the east face of the same warehouse building.
6. A freeway billboard sign.
Sign permits were found for signs #1, 2, 3, and 6. The banner signs on the warehouse
building do not appear to be legally installed. These signs shall be removed as a condition
of approval for this application.
FINDING: Based on the analysis above, staff finds that the variance criteria are
satisfied. The banner wall signs on the warehouse building are not legally
non conforming signs.
CONDITION:The two banner wall signs on the eastern warehouse building shall be
removed prior to installation of the new freestanding sign.
INDUSTRIAL ZONE STANDARDS:
Chapter 18.530 specifies the base zone requirements for the I-L Zone. The existing use,
vehicle and equipment rentals, is a permitted use in the I-L zone, per Section 18.530.030.
Table 18.530.2 sets forth the development standards for uses in the I-L Zone as
follows:

[1] No setback shall be required except 50 feet shall be required where the zone abuts a residential zoning district.
The proposed sign is located in the rear of the property, surrounded by either industrial or
commercially zoned parcels. Therefore,. no setbacks are applicable. The sign, while not
specifically'subject to the building height limitations in the zone, will nevertheless be 2 feet
shorter than the maximum height allowed for buildings in this zone. No other aspects of
the site will be affected by the proposal.
SIGNS:
Chapter 18.780 specifies the t pes of signs and the restrictions for their placement
and design. Section 18.780.05 defines a freeway oriented sign as "a. sign primarily

designed to be read by a motorist traveling on a highway designated by the Oregon
State Highway Department as a freeway or expressway; specifically, these shalt be
Interstate 5 and Oregon State Highway #217, and shall not include Highway 99W."
Section 18.780.090 provides additional standards for "Special Condition Signs,"
including the following criteria for freeway oriented signs:
1. Anyone who qualifies for a permit from the State of Oregon under the
provisions of the Oregon Motorist Information Act need not seek separate
approval from the City of Tigard;
2. Freeway-oriented signs shall be permitted only in the C-G, I-P, I-L and I-H
zoning districts;
3. Freeway-oriented signs shall be permitted to be located within 200 feet of
Highway 217.and/or Interstate Freeway No. 5 rights-of-way as shown in the
Freeway-Oriented Sign (FOS) overlay zone. maps in Figure 1; (Figure 1 is on
file in the City Recorder's office.)
4. One freestanding freeway-oriented sign shall be allowed per premises;
5. The maximum height of a freeway-oriented sign shall not exceed 35 feet from
the ground level at its base;
6. For freestanding signs a total maximum sign area of 160 square feet per face
,(320 square feet total) shall be allowed. If the sign is a billboard, then the
provisions of Subsection 18.780.090 shall apply; NOTE Billboards are
prohibited by 18.780.070.
7. Freeway-oriented signs shall be oriented to be viewed from the freeway;
8. In addition to a freeway-oriented sign, each parcel, development complex or
premises shall be allowed one freestanding sign provided all other provisions
of this chapter can be met and both signs are located on separate frontages
with different orientations;
9. Freeway-oriented signs are not permitted as roof, tenant, temporary, balloon,
wall and awning signs;
10. Freeway-oriented signs shall be allowed onl by administrative approval of a
sign permit application or by approval of~a sign code exception by the
Commission.
The proposed sign does not require a permit from the State of Oregon under the
provisions of the Oregon Motorist Information Act and is located within the I-L zoning
district and within 200 feet of the Highway 217 right of way. The proposed sign is the sole
freeway oriented sign on site, with the exception of a non-conforming billboard sign on the
southeastern corner of the site. The maximum height of 35 feet is proposed to be
exceeded by eight feet as addressed in this adjustment' request. The proposed sign
measures 8' high by 16' wide for a total of 128 square feet per side. The sign will be
oriented towards Highway 217. A separate freestanding sign is located near the property
frontage along 72" Avenue. The proposed sign will not be a roof, tenant, temporary,
balloon, wall or awning sign. The freeway-oriented sign is undergoing a sign permit
application subject to approval of the height adjustment, an administrative process as
required by Chapter 18.370 and described in 18.390.
SECTION VI. OTHER STAFF COMMENTS
No comments were received.
SECTION VII. AGENCY COMMENTS
The Oregon Department of Transportation (ODOT) reviewed the proposal and commented
that if the sign qualified as an "on-premise sign" and complies with ORS 377.720 then
ODOT had no objections.

The sign will advertise the business located on the premises and is, therefore, an on
premise sign per the definitions of ORS 377.710 and OAR 734-059-0005. Additionally the
sign, as proposed, does not qualify as a prohibited sign per ORS 377.720.

PROPOSAL: The applicant requests approval for an Adjustment to the sign standards to allow a
freeway oriented sign to be increased from 35 feet to 43 feet in height. This request is
due to the revised height of the 1-5/217 on ramp that is adjacent to the property.
ZONE: I-L: Light Industrial District. The I-L zoning district provides appropriate,
locations for general industrial uses including industrial service, manufacturing and

The following will be considered by the Tigard City Council on Tuesday May 28, 2002 at 7:30 PM at the
Tigard Civic Center - Town Hall Room, 13125 SW Hall Boulevard, Tigard, Oregon. Both public oral and
written testimony is invited.

68 PARKWAY @ ATLANTA STREET PUBLIC RIGHT-OF-WAY VACATION
The public hearing on this matter is to consider the proposed vacation involving a portion of public
right-of-way on the corner of SW 68th Parkway at SW Atlanta Street and consolidate into tax lot
1 S136DD, 00900. The purpose of the request is to allow the adjoining property to the west to develop
according to the Tigard Triangle development standards. According to the development standards of
the Tigard Triangle, a building must be located within 10 feet of a public right-of-way. The configuration
of the existing right-of-way creates a buffer between the property and SW 68th Parkway, which would not
allow the adjoining property to meet the setback criteria without a variance. A public storm line lies
within the northeast corner of the public right-of-way to be vacated. A public storm water easement will
be granted to the City of Tigard concurrently with the right-of-way vacation, that will encompass
approximately 7.5 feet on each side of the existing stormpipe. The location of the portion of the vacation
request is the section of SW 68th Parkway public right-of-way which lies southeast of SW Atlanta Street.
The request was filed with the City on February 15, 2002 and initiated by the City Council at the request of
the applicant on March 26, 2002. Any interested person may appear and be heard for or against the
proposed vacation of said 68th Parkway @ Atlanta Street Public Right-of-Way Vacation. Any written
objections or remonstrance's shall be filed with the City Recorder by 7:30 PM on May 28. 2002.

377.710. Definitions--As used in ORS 377.700 to 377.840 unless the
context otherwise requires:
(22) "On-premises sign" means a sign designed, intended or used to
advertise, inform or attract the attention of the public as to:
(a) ' Activities conducted on the premises on which the sign is located;
or
(b) The sale or lease of the premises on which the sign is located.
(23) "Outdoor advertising sign" means a sign designed, intended or
used to advertise, inform or attract the attention of the public as to:
(a) Goods, products or services which are not.sold, manufactured or
distributed on or from the premises on which the sign is located;
(b) Facilities not located on the premises on which the sign is located;
or
(c) Activities not conducted on the premises on which the sign is
located.

Premises
For the purpose of establishing whether a sign, visible from a State Highway and
regulated under ORS Chapter 377, is not an on-premise sign, the following
definition shall be used:
(1) The premises on which any activity is conducted Is determined by the physical
facts rather than property lines. It is the land occupied by the buildings or other
physical uses that are necessary or customarily incident to the activity, including
such open spaces as are arranged and designed to be used in connection with
such buildings or uses.
(2) Except for farms and ranches, the following will not be considered to be a part
of the premises on which the activity is conducted and any signs located on such
land will be considered outdoor advertising signs;
(a) Any land which is not used as an integral part of the principal activity. This
would include, but is not limited to:
(A) Land which is separated from the the activity by a public road;
(B) Land which is separated by, an obstruction and is not used by the activity; and
(C) Land that is undeveloped highway frontage adjacent to the land actually used
by the advertised activity; even though it might be under the same ownership.
(b) Any land which is used for, or devoted to, a separate purpose unrelated to the
.advertised activity would not be part of the premises on which the activity is
conducted even though under the same ownership;
(c) Any land which is separated from the principle activity, and is developed or
used only at the sign site by structures or uses which are only incidental to the
principle activity, and which serves no reasonable or integrated purpose related
to the activity other than to attempt to qualify the land for signing purposes;
(d) Where the sign site is located at or near the end of a narrow strip contiguous
to the 'advertised activity, the sign site shall not be considered part of the
premises on which the activity being advertised is conducted. A narrow strip shall
include any configuration of land which is such that it cannot be put to any
reasonable use related to the activity other than for signing purposes except the
major entrance or exit roadway to or from the premises which serves only the
advertised activity.

377.720. Prohibited signs; exceptions. A sign may not be erected or
maintained if it:
(1) Interferes with, imitates or resembles any official traffic control sign,
signal or device, or attempts or appears to attempt to direct the movement of
traffic.
(2) Prevents the driver of a motor vehicle from having a. clear and
unobstructed view of official traffic control signs and approaching or merging
traffic.
(3) Contains, includes or is illuminated by any flashing, intermittent,
revolving, rotating or moving light or moves or has any animated or moving parts.
This subsection does not apply to:
(a) A traffic control sign.
(b) Signs, displays, devices or portions thereof with lights that may be
changed at intermittent intervals by electronic process or remote control
providing only public service information such as time, date, temperature,
weather or similar information.
(c) Signs, displays, devices or portions thereof with lights that may be
changed at intermittent intervals by electronic process or remote control and that
advertise activities conducted on the premises where the sign, display or device
is located.
(d) ' A tri-vision sign, if allowed specifically for Oregon, in writing, by the
United States Department of Transportation,
(4) Has any lighting, unless such lighting is so effectively shielded as to
prevent beams or rays of light from being directed at any portion of the main
traveled way of a state highway, or is of such low brilliance as not to cause glare
or to impair the vision of the driver of a motor vehicle or otherwise to interfere
with the operation thereof.
(5) Is located upon a tree, or painted or drawn upon a rock or other
natural feature.
(6) Advertises or calls attention to a business or other activity or a
profession, commodity, product, service or entertainment no longer carried on,
produced, sold or offered.
(7) Advertises activities that are illegal under any state or federal law
applicable at the location of the sign or of the activities.
(8) Is not maintained in a neat, clean and attractive condition and in
good repair. ,
(9) Is not able to withstand a wind pressure of 20 pounds per square
foot of exposed surface.
(10) Is on a vehicle or trailer that is located on public or private property.
This subsection does not apply to a vehicle or trailer used for
transportation by the owner or person in control of the property.

January 17th letter. The City has now received the information necessary to begin the
review of your sign variance application.' Staff has, therefore, deemed your application
submittal as complete. We will send notices to neighboring property owners within 500'
for comments. Following the comment period, staff will review the proposal and make a
decision. Notices of that decision will be sent to you and the same neighboring
properties. Our target date for this review to be complete March 12th, but may be sooner
based on current workloads. Please note that the process may take as long as 120
days should any appeals be filed.

Dear Mr. Brady:
The City has not received the information necessary to begin the review of your setback
variance application. Staff has, therefore, deemed your application submittal as
incomplete. In order for staff to proceed,. the following materials will need to be
submitted:
• 2 sets of Pre-Addressed/Pre-Stamped legal size envelopes for all property owners of
record within 500 feet of proposed property. The labels for this'mailing may be
obtained from the Development Service Technicians at the front counter of City Hall.
It would also be helpful to include some photographic evidence for the land use record
that shows why the sign would not be visible from the freeway. I am not advocating
going out to the center of the freeway to take pictures, but rather, perhaps a picture from
the site that shows the on ramp and provides a scalable reference in the picture so as to
gauge the height of the ramp and the proposed sign.
Once the required information has been submitted, staff will deem the application
complete and begin the review process. An application is reviewed for compliance with
all standards in effect at the time the application is deemed complete.

Reason for Adjustment Request:
As a result of the I-5 and Hwy 217 interchange project (completed in July 2001), our
sign adjacent to the southbound onramp from Hwy 217 to I-5 was removed during
the early part of the construction phase.
This sign, measuring 8' high by 16' wide, originally stood at a height of 35' (to the
top of the sign). Due to the revised height of the new onramp, if the sign is to be
reinstalled to its original height, it would no longer be visible. We are requesting
that this sign be raised to a height of 43' (to the top of the sign) in order to correct
the visibility issue.
