APPLICATION SUMMARY FILE NAME: QUAIL HOLLOW WEST (LOT 10) REAR YARD SETBACK ADJUSTMENT CASE NO: Setback Adjustment (VAR) VAR2001-00005 PROPOSAL: The applicant has requested approval for a Development Adjustment to reduce the minimum rear yard setback from 15 feet to 12.2 feet. The adjustment is the only way the applicant can position the home on the lot. APPLICANT: Chateau Development, Inc. OWNER: Quail Hollow-Tigard LLC PO Box 1406 5335 SW Meadows Road Sherwood, OR 97140 Lake Oswego, OR 97035 COMPREHENSIVE PLAN DESIGNATION: Low-Density Residential. ZONING DESIGNATION: R-4.5; The R-4.5 zoning district is designed to accommodate detached single-family homes with or without accessory residential units at a minimum lot size of 7,500 square feet. Duplexes and attached single-family units are permitted conditionally. Some civic and institutional uses are also permitted conditionally. LOCATION: 13469 SW 128th Place; WCTM 2S104DA, Tax Lot 02400. APPLICABLE REVIEW CRITERIA: Community Development Code Chapters 18.370, 18.390 and 18.510. SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request. The findings and conclusions on which the decision is based are noted in Section IV of this decision. NOTICE OF TYPE I DECISION VAR2001-00005/QUAIL HOLLOW REAR YARD SETBACK ADJUSTMENT PAGE 1 OF 3 SECTION III. BACKGROUND INFORMATION Site History: A search of City records shows Quail Hollow West to be approved 'under Washington County jurisdiction. The property is designated R-4.5 but has been allowed to use R-7 setbacks which are consistent with the Washington County approval. Four (4) Temporary Use permits have been issued for model homes. No other land-use records were found. Vicinity Information: The property is located on SW 128th Place, which is west of SW Gaarde Street and east of SW 129th Avenue. Site Information and Proposal Description:. The subject property has frontage on SW 128th Place. The applicant has requested approval for a Development Adjustment to reduce the minimum rear yard setback. The adjustment is the only way the applicant can position the home on the lot. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS DEVELOPMENT ADJUSTMENT - APPROVAL STANDARDS: Section 18.370.020.13.1.1b provides that up to a 20% reduction of the dimensional standards for the rear yard setbacks required in the base zone may be approved as a Type I Development Adjustment. Section 18.370.020.B.2, Approval Criteria, provides that a development adjustment shall be granted if there is a demonstration of compliance with all of the applicable standards: A demonstration that the adjustment requested is the least required to achieve the desired effect; The applicant has requested an 18.8% reduction. This would reduce the rear yard setback from 15 feet to 12.2 feet: The "desired effect" is to allow the proposed floor plan on this particular lot. In order to accomplish the desired effect, the rear corner of the house will need to extend 2.8 feet into the rear yard setback. The adjustment would cause the least impact. The adjustment will result in the preservation of trees, if trees are present in the development area; No trees are impacted by the proposal. Therefore, this standard does not apply. The adjustment will not impede adequate emergency access to the site; and The adjustment will affect the rear yard setback only. Emergency access from,the street fronting the property will not be affected. Therefore, this criterion is satisfied. There is not a reasonable alternative to the adjustment, which achieves the desired effect. NOTICE OF TYPE I DECISION VAR2001-00005/QUAIL HOLLOW REAR YARD SETBACK ADJUSTMENT PAGE 2 OF 3 The adjustment will have no impact on the applicant's property except by reducing the rear yard by 2.8 feet. Therefore, staff finds the adjustment to be the most reasonable alternative. SECTION V. PROCEDURE AND APPEAL INFORMATION A rear yard setback adjustment is a Type I procedure. As such; the Director's decision is final on the date it is mailed or otherwise provided to the applicant, whichever occurs first. The Director's decision may not be appealed locally and is the final decision of the City. THIS DECISION IS FINAL; S OF MAY'9, 2001. THE EFFECTIVE DATE OF THIS DECISION SHALL BE MAY 10, 2001. The house cannot be re-positioned on the lot as to not encroach on this setback. There are no trees present on this lot, therefore, no trees are affected by this adjustment.
