DESIGNATION: R-25; The R-25 zoning district is designed to accommodate existing
housing of all types and new attached single-family and multi-family
housing units at a minimum lot size of 1,480 square feet. A limited
amount of neighborhood commercial uses is permitted outright and a
wide range of civic and institutional uses are permitted conditionally.
LOCATION: 12103 SW 135th Avenue; WCTM 2S10413A, Tax Lot 00200.

CRITERIA: Community Development Code Chapters 18.360, 18.370, 18.390 and
18.510.
SECTION II. DECISION
Notice is hereby given that the City of Tigard Community Development Director's
designee has APPROVED the above request. The findings and conclusions on
which the decision is based are noted in Section V of this decision.

SECTION 111. BACKGROUND INFORMATION
Site History:
Staff has conducted a search of computer records and found a Home Occupation Permit
was issued in 1995 for a CPA/Accounting business to be run from the home. An
adjustment was also done to reduce the minimum rear yard setback. The adjustment was
requested to allow a garage within the required rear yard setback. No other land-use
records could be found..
Vicinity Information:
The site is located on the west side of SW 135~h Avenue. To the north and south,
properties are developed with multi-family residential units.
Site Information and Proposal Description:
The subject site is zoned Medium Density Residential (R-25) and developed with a single-
family residence. The applicant is requesting a variance to the side yard setback from 5
feet to 2 feet for a staircase that has already been built. The staircase placement was
overlooked by the City's building department during plans review of the new garage with
recreation room on top.
SECTION IV. PUBLIC COMMENTS
No comments were received.
SECTION V. APPLICABLE REVIEW CRITERIA AND FINDINGS
VARIANCES AND ADJUSTMENTS:
Section 18.370.010.C.2.a states that the proposed variance will not be materially
detrimental to the purposes of this title, to any other applicable policies and
standards, and to other properties in the same zoning district or vicinity.
The applicant has requested a setback variance only. No other applicable policies or
standards will' be affected. Because of the layout of the new accessory structure and
neighboring apartment complex, the location of the stairway will not be opposite living
quarters of the apartments thus not affecting existing buffers intended to provide distance
between uses.
There are special circumstances that exist which are peculiar to the lot size or
shape, topography or other circumstances over which the applicant has no control,
and which are not applicable to other properties in the same zoning district;
The applicant, built the accessory structure. per approved plans. However, the plans did
not comply with current setbacks, thus triggering a violation of setbacks pursuant the
Tigard Development Code. If the applicant was made aware that the stairway location was
within.a mandatory setback prior to construction, the applicant could have adjusted the
placement of the structure to accommodate for setbacks.
The use proposed will be the same as permitted under this title and City standards
will be maintained to the greatest extent that is reasonably possible while permitting
reasonable economic use of the land;
The proposed use (accessorystructure) is allowed in, the zone. The structure, as
evidenced within this decision, will otherwise, fully comply with the development code
standards.

Existing physical and natural systems, such as but not limited to traffic, drainage,
dramatic land forms or parks will not be adversely affected anymore than would
occur if the development were developed as specified in the title; and
The existing physical and natural systems will remain unchanged. No additional
landscaping, drainage or land formation was conditioned with the approval of the structure.
Therefore, this standard does not apply.
The hardship is not self-imposed. and the variance requested is the minimum
variance, which would alleviate the hardship.
There are no other locations that the stairway could be located without completely
reconfiguring the already completed structure.
FINDING: Based on the analysis above, staff finds that the variance criteria are
satisfied.
SECTION V11. OTHER STAFF COMMENTS
City of Tigard Engineering Department and the City of Tigard Operations
Department have reviewed the proposal and have offered no comments or objections.
City of Tigard Operations Department has reviewed the proposal and has no objections
to it.
The City of Tigard Police Department has reviewed the proposal and has no objections
to it.

Appeal:
The Director's Decision is final on the date that it is mailed. All persons entitled to notice or
who are otherwise adversely affected or aggrieved by the decision as provided in Section
18.390.040.G.1. may, appeal this decision in accordance with Section' 18.390.040.G.2. of
the Tigard Community Development Code which provides that a written appeal together
with the required fee shall be filed with the Director within ten (10) business days of the
date the Notice of Decision was mailed. The appeal fee schedule and forms are available
from the Planning Division of Tigard City Hall, 13125 SW Hall Boulevard, Tigard, Oregon
97223.

Unless the applicant is the appellant, the hearing on an appeal from the Director's Decision
shall be confined to the specific issues identified in the written comments submitted by the

to any additional rules of procedure that may be adopted from time to time by the appellate
body.

Enclosed please find the Variance Type II Application, which your office
forwarded to me. I have filled out the requisite information, stated the reason for the variance
request, and signed it.
Pursuant to my prior email with Jim Hendryx, I understand that the City of Tigard
will be waiving the $545.00 administrative filing fee. In addition, you already have on file
evidence of title, the site plot plan, as well as the building plans for your ability to review this
application.
I was uncertain about the two sets of pre-addressed; pre-stamped #10 envelopes
and that process. In providing me the form for the Variance Type II Application, and in your
emails, there was no mention of this requirement. if you are anticipating that we are responsible
for doing some sort of a mailing to our neighboring property owners, I would very much
appreciate you giving me some greater detail as to the nature of this process.
