detached single-family homes with or without accessory residential,
units at a minimum lot size of 7,500 square feet. Duplexes and
attached single-family units are permitted conditionally. Some civic
and institutional uses are also permitted conditionally.

SECTION III. BACKGROUND INFORMATION
Site History:
A search of City records shows (SUB) 98-00001 Walnut Glen Subdivision. to be associated
with this project. The Walnut Glen Subdivision is a 22-lot subdivision. No other land-use
cases were found.
Vicinity Information:
The property is located on 'SW Sweeney Place, which is north of SW 114th Terrace
between SW 112th and SW 116th Avenue.
Site Information and Proposal Description:
The subject property has frontage on SW ,Sweeney Place. The applicant is requesting
approval to adjust the required 20-foot front yard setback. The purpose of the adjustment
is to have enough room to build a new home.
SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS
DEVELOPMENT ADJUSTMENT - APPROVAL STANDARDS:
Section 18.370.020.B.1.a provides that up to a 25% reduction of the dimensional
standards for the front yard setbacks required in the base zone may be approved'as a
Type I Development Adjustment. Section 18.370.020.13.2, Approval Criteria, provides
that a development adjustment shall be granted if there is a demonstration of
compliance with all of the applicable standards:
A demonstration that the adjustment requested is the least required to achieve the
desired effect;
The applicant has requested the full 25% reduction. This would reduce the front yard
setback from 20 feet to 15 feet. The "desired effect" is to allow the placement of a new
home. The adjustment would cause the least impact.
The adjustment will result in the preservation of trees, if trees are present in the
development area;
No trees are impacted by the proposal. Therefore, this standard does not apply.
The adjustment will not impede adequate emergency access to the site; and
The adjustment will affect the front yard setback only. Emergency access from the private
street fronting the property will not be affected. Therefore, this criterion is satisfied.
There is not a reasonable alternative to the adjustment, which achieves the desired
effect.
The adjustment will have no impact on the applicant's property or the neighboring property.
Therefore, staff finds the adjustment to be the most reasonable alternative.

SECTION V. PROCEDURE AND APPEAL INFORMATION
A front yard setback adjustment is a Type I procedure. As such, the Director's decision is
final on the date it is mailed or otherwise provided to the applicant, whichever occurs first.
The Director's decision may not be appealed locally and is the final decision of the City.
THIS DECISION IS FINAL AS OF JUNE 7, 2000.
THE EFFECTIVE DATE OF THIS DECISION SHALL BE JUNE 8, 2000.

Adjustment Narrative
Riverside Homes, Inc., applicant, requests an adjustment for the front setback of Lot 12 in the Walnut
Glen Subdivision, case number,# SUBDIVISION (SUB) 98-0001. The front yard setback is to be reduced
from 20 feet to 15 feet (25% reduction).
Development Adjustment Criteria
a. A demonstartation.that the adjustment requested is the least required to achieve the desired affect.
As demonstrated on the attached plot plan. The requested adjustment for front setback is needed to fit the
house on the lot. This specific home is the only one in our inventory that can be placed upon the lot due to
its odd shape and access.
b. The adjustment will result in the preservation of tress, if trees are present in the development area.
Per approval of the Walnut Glen subdivision (SUBDIVISION (SUB) 98-0001), tree removal was
approved. The requested adjustment does not have a direct impact on the removal of trees on the site.
c. The adjustment will not impede adequate emergency access to the site.
Emergency access is provided by a 25' wide private drive described as Tract B on the recorded plat of
Walnut Glen. The requested adjustment does not impact this access way.
d. There is not a reasonable alternative to the adjustment which achieves the desired affect.
Requesting the adjustment for reduction of the front setback is the only way to accommodate a house on
the lot because of the odd shape and limited access onto the private tract. If the home is "flipped", it would
take access onto the driveway/maintenance easement of Lot 13 which is not allowed. The way the home is
situated on the attached site plan is the only way it can be constructed.
