Dear Stephen:
I am enclosing:
1. Warranty Deed from my client to Tigard conveying
the right of way;
2. Executed permission for right of entry; and
3. Executed street dedication.
These documents are being tendered to you as part of the
agreement that my client has with the City of Tigard.
I would appreciate your sending me a letter for my files
which states that the conveyance by Warranty Deed is only
for the 10 foot strip along the east border of my client's
property. The description on the Warranty Deed is not
clear, though I am sure a surveyor would be able to understand
it. But the language is such that I will have to rely upon
your representations.
I am obtaining a partial release of mortgage from the First
Interstate Bank of Oregon. Dan Felton, assistant manager,
has supplied me with a form of the partial release which I
have approved. I am sending him the legal description which
appears on the Warranty Deed. As soon as that document is
executed, I will forward it on to you.
