ROGERS MACHINERY COMPANY, INC., an Oregon corporation
9 ("Grantor"), releases and quitclaims to the city of Tigard,
a municipal corporation organized and existing under the laws
of the state of Oregon ("Grantee")
3 (1) Permanent and temporary rights-of-way and easements
over, across and under the real property described in
Exhibits A, B and C hereto for the purpose of laying,
constructing, replacing and maintaining underground storm
drainage lines (Exhibits A and B) and underground utilities
lines (Exhibit C) and
(2) Perpetual right-of-way for street, road and
utility purposes on, over, across, under and within the
real property described in Exhibit D.
The true consideration for this conveyance is none.
This instrument does not guarantee that any particular use
may be made of the real property described in Exhibits A,
B•, C and D, which are attached hereto and by this reference
incorporated herein. Grantee should check with the appropriate
city or county planning department to verify approved uses.

This temporary easement is solely for the purpose
of construction of the lines within the above-described permanent
easement and shall cease to exist 30 days following certification
of completion of the installation of those lines by the Tigard
City Engineer. Both the permanent and temporary easements
are granted with the understanding that the premises will
be returned following the work to a condition as close as
practicable to its previous state.
