INFORMATION SUMMARY When Merestone Subdivision was platted, an open space parcel (Tract "A" ) was to be dedicated which corresponded approximately with the 100 year flood plain boundary of Summer Creek. This tract also includes a 10 foot wide access strip between Lots 9 and 10 of the subdivision (see attached map) . The owner of Lots 9 and 10 has requested that the intervening 10 foot access strip be combined with Lot 10. The staff recommends approval of this transfer because the Park Board has recommended favorably, the path to be built along Summer Creek will be on the south side of the Creek, and the 10 foot strip has not been improved. It is recommended that the existing utility easement which applies to all of Tract "A" be retained. ALTERNATIVES CONSIDERED • 1. Approve the attached resolution approving the transfer of the 10 foot access strip to Lot 10 of Merestone Subdivision 2. Modify and approve the attached resolution 3 . Deny the request and direct staff to prepare a corresponding resolution FISCAL IMPACT The applicant has submitted a $300 fee for processing this request. INFORMATION SUMMARY When Merestone Subdivision was platted, an open space parcel (Tract "A" ) was to be dedicated which corresponded approximately with the 100 year flood plain boundary of Summer Creek. This tract also includes a 10 foot wide access strip between Lots 9 and 10 of the subdivision (see attached map) . For reasons unknown to the staff, the dedication did not occur and the tract remained under the ownership of the developer, J. Allen Paterson. Mr. Paterson recently signed a bargain and sale deed transferring the property to the City. He also signed a letter acknowledging that the City may dispose of any surplus portions of Tract "A" . Copies of the deed and acknowledgement letter are attached. The owner of Lots 9 and 10 has requested that the intervening 10 foot access strip be combined with Lot 10 . The staff recommends approval of this transfer because the Park Board has recommended favorably, the path to be built along Summer Creek will be on the south side of the Creek, and the 10 foot strip has not been improved. It is recommended that the existing utility easement which applies to all of Tract "A" be retained. ALTERNATIVES CONSIDERED 1. Approve the attached resolution approving the transfer of the 10 foot access strip to Lot 10 of Merestone Subdivision 2 . Modify and approve the attached resolution 3. Deny the request and direct staff to prepare a corresponding resolution FISCAL IMPACT The applicant has submitted a $300 fee for processing this request. I have asked the Planning Division to advise me on the need for this ten foot access to the public greenway along summer creek. They have recently informed me that this access is not necessary and that sufficient access exist on SW 121st Avenue and off SW Summercrest Drive. Therefore, I will recommend that we vacate this ten foot access strip. The vacation process typically takes 60 to 90 days before the vacated lands return to private ownership. In this particular case the ten foot strip will split between the owners of Lots 9 and 10. In order for one owner to receive the whole ten feet, the other benefiting owner must quit-claim their interest in the ten feet. There are two methods by which we can vacate this property through the public vacation process. One would be to request the City Council to initiate the process by resolution or have you initiate the process by circulating a petition. Beyond this point both processes are pretty much the same. There is no set fee for vacating lands within the City; however, we do require that the requesting party or parties absorb the City's cost in completing the process. This typically runs 1300 to 1500.
