PERMANENT PUBLIC UTILITY EASEMENT
KNOW ALL MEN BY THESE PRESENTS THAT B & F Purchaser's Inc . , an
Oregon Corporation
hereinafter c holed the Grantors, in consideration.for the sum of
dollars 3 n'a ) from the City of
Tigard, hereinafter called Grantee, grant and convey unto the City of Tigard 'a
perpetual easement for constructing, reconstructing, operating, maintaining,.
inspecting and repairing of public utlities and appurtenances, together with
.the right to remove, as necessary, vegetation, foliage, trees and other
obstructions on the following described parcel of land, situated in the City
of Tigard, Washington County, State of Oregon:
see attached exhibit and its condition
IT IS EXPRESSLY UNDERSTOOD that this easement does not convey any right,
title or interest except those expressly stated' in this easement, nor
otherrise prevent Grantors from the full use and dominion thereover; provided.,
however, that such use shall not interfere with ; the uses and, purposes of the
intent of the easement.
IN CONSIDERATION of the premises, Grantee agrees that if said Grantee, its
successors or assigns should cause said easement to be vacated, the rights of
the Grantee in the above-described easement will be forfeited and shall
immediately revert to the Grantors, their successors and assigns in the case
of such event.
TO HAVE AND TO HOLD the above-described and granted premises unto said
Grantee, its successors and assigns forever.

Utility Basement
A parcel of land 5.00 feet wide for utility purposes located in the
Southwesterly one-half of Lot 12, and all of Lots 13 and 14, Block 2,
"Kingston" subdivision, a subdivision of record in the City of Tigard in
the George Richardson D.L.C. No. 38 in the Northeast one-quarter (1/4) of
Section 2, Township 2 South, Range 1 West, and in the Southeast
one-quarter (1/4) of Section 35, Township 1 South, Range 1 West,
Willamette Meridian, Washington County, Oregon, the centerline of which
is described as follows:
Beginning at a point on the Southwesterly property line of said Lot 14
which point being North 46005100" West 2.61 feet from the Southerly
corner of Parcel "8" as surveyed by Curtis J. Liesenfelt LS 2213,
Deoember.16, 1988 said corner being marked with a typical monument
(5/8"x30" rebar with a yellow plastic cap stamped "Devco Eng_ LS 2213");
thence North 60039'38" West 114.82 feet along a line 2.50 feet northerly
of when measured at right angles to and parallel to the Southerly
property line of Parcels "A" and "B" as.surveyed by Curtis J. Liesenfelt
LS 2213, December 16, 1988; thence North 47024'03" East 15.10. feet along
a line 2.50 feet Northwesterly of when measured at right angles to and
parallel to the Southeasterly property line of said Lot 12 to a point on
the Northeasterly property line of said Parcel "A", which point being
North 46 05100" West 2.50 feet from the Easterly corner of said Parcel
"A", said corner being marked with said typical monument.
Containing 649.5 square feet of land, more or less. The basis of
bearings of the,above described parcel. -is the plat of said "Kingston"
subdivision. This description is based on a survey done by Curtis J.
Liesenfelt LS 2213, dated December 16, 1988 to be filed in Washington
County, Oregon.
That portion of the easement which is currently occupied by
existing structures can not be used by any public utility or
government agency until such times that the buildings are
removed.
