2308 2308 E A S E M E N T KNOW ALL MEN BY THESE PRESENTS that WILLIAM J. BONNEY and PATRICIA BONNEY, husband and wife, and J. 0. JOHNSON and LAURA C. JOHNSON, husband and wife, in consideration of One and no/100 Dollars and other valuable consideration to each of them paid by the-Tigard Water District, a municipal corporation, and the South Tigard Sanitary District, a municipal corporation, hereby grant, sell and convey to said municipal corporations or their successor corporations an easement and right to lay, construct, and perpetually maintain a water main and a sewer line through, under and along the following described property, to-wit: In Sectians 1 & 2, T 2 S, R 1 W, W.M. The southerly 15.0 feet of a strip of land 15.5 feet in width, when measured at right angles to the northerly line of that tract of land conveyed to William J. Bonney by deed recorded in Book 426, Page 27, Washington County, Oregon, Deed Records, the boundary of which 15.5 foot strip is described as follows: Beginning at the intersection of the northerly line of said Bonney tract with the east line of State Highway No. 217, and running thence, S 64° 50' E along said northerly line, 348.14 feet to an angle point on the southwesterly line of the Oregon Electric Railway right-of-way; thence, S 68° 26' 36" W 21.29, feet; thence, N 64° 50' W, parallel with the northerly line of said Bonney tract,.326.41 feet to the east line of said high- way; thence, N 000 26' E, along said highway line, 17.07 feet to the point of beginning. Also, a strip of land 20.0 feet.in width, when measured at right angles to the southwesterly line of said railway right- of-way, extending S 416 35' E, along said right-of-way line from the easterly end of theeabove described 15.5 foot strip to the offset in said right-of-way line which bears S 480 25' W for a distance of 25.0 feet. and a temporary right of use during the construction of said water main and sewer line over and along the adjoining property of said easement, not to exceed 10 feet on each side of said described easement, which temporary right shall cease when the construction is completed. It is understood and agreed that no building shall be erected upon said easement premises without the written consent of the Tigard Water District and the South Tigard Sanitary District, and that said municipal corporations shall replace as near as practical the surface of said easement premises after construction and maintainance work on said water main and sewer line is completed. This instrument does not grant or convey unto the Tigard Water District or the South Tigard Sanitary District any right or title to the surface of the soil along the route of said sewer or water line except for the purpose of;laying down, inspecting, maintaining and replacing the same.
