E A S E M E N T
KNOW ALL MEN BY THESE PRESENTS that the ;Western Foundry Co., an Oregon
Corporation, E. C. Hunziker.and Betty Hunziker, husband and wife, J. A. Wiley
and Dorothy Wiley, husband and wife, and George E. Lockman, in consideration of
One and no/100 Dollars and other valuable consideration to each of them paid by
the Tigard Water District, a municipat corporation, and the South Tigard Sanitary
District, a municipal corporation; hereby grant, sell and convey to said municipal
corporations or their successor corporations an easement and right to lay, con-
struct and perpetually maintain a water main and a sewer line through, under and
along the following described property, to-wit:.
A strip of land 20.0 feet in width in Section 1 T 2 S, R 1 W
W.M., Washington County, Oregon, extending southwesterly from
Hunziker Road to the southwesterly line of the Oregon Electric
Railway right-of-way, being 10.0 feet on each.side of the
center line, which is described as follows:
.Beginning at the intersection of the southerly line of said
Hunziker Road with the westerly line of the George E. Lockman
.property, as described in Book 417, Page 406, Washington County,
Oregon, Deed Records, and running thence, on the line between
said Lockman property and the property of.Western Foundry Co.,
as described in took 404, Page 23, and Book 407, Page 86, said
deed records, S 29° 01' W 313.2 feet and S 46° 50' W 720.46
feet to the most westerly corner of said Lockman property;
thence, S 440 12' 05" W 217.66 feet; thence, S. 46° 50' W
parallel with and 10.0 feet from, the westerly line of.the
J. A. Wiley property, as described in Book 417, Page 410,
said deed records, 191.10 feet to the northeasterly line of
the Southern Pacific company right-of-way; thence, continuing
S 46° 50' W 200.47 feet to a point in the Oregon Electric
Railway right-of-way which bears S 46° 50' W 55.02 feet from
the center line of said right-of-way
and a temporary right*of use during the construction of said water main and sewer
line over and along the adjoining property of said easement, not to exceed 10
feet on each side of said described easement, which temporary right shall cease
when the construction is completed.
It is understood and agreed that no building shall be erected upon said
easement premises without the written consent of the Tigard Water District and
the South Tigard Sanitary District, and that said municipal corporations shall
replace as near as practical the surface of said easement premises after con-
struction and maintainance work on said water main and sewer line is completed.
This instrument does not grant or convey unto the Tigard Water District
or the South Tigard Sanitary District any right or title to the surface of the
soil along the route of said sewer or waterline except for the purpose of laying.
down, inspecting, maintaining and replacing the same.
IN WITNESS WHEREOF, the Western Foundry Co.., an Oregon Corporation, by
Edward G. Huffschmidt, its secretary, pursuant to a resolution of its Board of
Directors, has signed this easement and affixed the seal of the Corporation, and
E. C. Hunziker and Betty Hunziker, husband and wife, have affixed their signatures
and their seals this day of August, 1960, and J. A. Wiley d Dorothy
Wiley, husband and wife, have affixed their signatures this '70 day of
August, 1960, and George E. Lockman has affixed his signature and seal this
day of , 1960.

skid Edward G. Huffschmidt is the Secretary of Western Foundry Co. the within
named Corporation, and that the seal affixed to said instrument is the corporate
peal of said Corporation, and that the said instrument was signed and sealed
in.'behalf of said Corporation by authority of its Board of Directors, and Edward
G. Huffschmidt acknowledged said instrument to be the free act and deed of said
Corporation.
