EASEMENT.
We, L. R. BROWN and MLRY BROWN.. husband and wife, sole owners
of the property hereinafter described, in consideration of ten dollars
paid to them upon execution hereof, hereby grant and convey to the
TIGARD STATER DISTRICT, a municipal corporation, of the County of Wash-
ington, State of Oregon, the right to construct, operate and maintain
a water main:-on a strip.of.land six feet in width, across Lot Six (6),
Greenburg Heights, Washington County, Oregon, the centerline of which
strip is described as follows:
" Beginning at a point on the northeasterly side of the Oregon
Electric Co's right-of-way, which point is 53.6 feet north-
westerly from the intersection of said right-of=way line and
the north line of Katherine Avenue extended easterly; thence,
northeasterly in.a straight line 116 feet to a point on the
southwesterly side of the Southern Pacific Railroad Co's
rightrof-way, which point is 100.7 feet northwesterly from
the intersectic% of said right-of-way line and Latherine
Avenue extended easterly.." All being on Lot Six, Greenb~u.rg
Heights, Washingftn County, Oregon.
TIGARD ViATER DISTRICT agrees that said line shall be laid with
not less than a twenty-four-inch cover; that the top soil shall be
replaced on top of the ditch; that the surface of the ditch shall at
all times be kept approximately level without the surrounding terrain;
that said work shall be so conducted as to cause the least possible
inconvenience to tenants of said property; and that the District will
promptly repair or pay for any damage caused by said work.
GRANTORS and their successors in interest shall enjoy full sur-
fgce rights for,all purposes which will not seriously impede or
interfere with the rights herein granted..
