PERMANENT PUBLIC UTILITY EASEMENT
KNOW ALL MEN BY THESE PRESENTS THAT Malcolm L. Ash and Jolynne A. Ash,
husband and wife
hereinafter called the Grantors, in consideration other good and valuable
consideration 3 -0- from the City of
Tigard, hereinafter called Grantee, grant and convey unto the City of Tigard a
perpetual easement for constructing, reconstructing, operating, maintaining,
inspecting and repairing of public utlities and appurtenances, together with
the.:!right to remove, as necessary, vegetation, foliage, trees and other
obstructions on the following described parcel of land, situated in the City
of Tigard,,Washington County, State of Oregon:

IT'-IS EXPRESSLY UNDERSTOOD that this easement does not convey any right,
title or interest except those expressly stated in this easement, nor
otherwise prevent Grantors from the full use and dominion thereover; provided,
however, that such use shall not interfere with the uses and purposes of the
intent of the easement.
IN CONSIDERATION of the premises, Grantee agrees that if said Grantee, its
successors or assigns should cause said easement to be vacated, the rights of
the Grantee in the above-described easement will be forfeited and shall
immediately revert to the Grantors, their successors and assigns in the case
of such event.
TO HAVE AND TO HOLD the above-described and granted premises unto said
Grantee, its successors and assigns forever.

That portion of land located in the southeast quarter of Section 3,
Township 2 South, Range 1 West, Willamette Meridian, in the City of Tigard,
Washington County, Oregon, and described as follows:
Beginning at the northwest corner of Lot 48, Genesis No. 2, a recorded
plat, Washington County Plat Records; thence North 880 32' 20" East, on the
north line of said Lot 48, 5.55 feet; thence southerly, on a 180 foot radius
curve concave to the west (the long chord bears South 120 15' 47" East, 90.53
feet), 91.51 feet to the south line of said Lot 48; thence North 890 31' 09"
West, on. said south line, 5.00 feet to the east right=-of--way line of S.W.
Novare Place; thence northerly, on said right-of--way line, on a 175 foot
radius curve concave to the west (the long chord bears North 120 37' 34" West,
90.47 feet) 91.51 feet to the point of beginning, containing 458 square feet.
