-E- 4" D o hereinafter called the "Grantors",
grant, convey, and transfer unto the City of Tigard, a municipal corporation. of Washington
County, Oregon hereinafter referred to as "Grantee", its successor and assigns forever, a
permanent easement over and upon the following described real property, to wit:
This easement shall be for the construction, maintenance, and repair of an underground pipeline
and/or mains for the purpose of conveying water over, across, through, and under the hereinabove
described real property and shall: include the perpetual right to enter upon said real property at
reasonable times, together with the right to excavate and refill ditches for the location of said
pipelines and/or mains, and the further right to remove all obstructions interfering with the
location, construction, and maintenance of said pipeline and/or mains.
The true consideration for this conveyance is $ 0.00 . However, the actual consideration consists
of or includes other property or value given or promised which is the whole consideration.
It is expressly understood that this easement does not convey any right,. title, or interest except
those expressly stated in this easement; nor otherwise prevent Grantors from the-full. use and
dominion thereover; provided, however, that such use shall not interfere with the uses and
purposes of the intent of the easement.
In consideration of the premises, Grantee agrees that if said Grantee, its successors or assigns
should cause said easement to be vacated, the rights of the Grantee in the above-described
easement will be forfeited and shall immediately revert to the Grantors, their successors and.
assigns in the case of such event.
To have and to hold the above-described and granted premises unto said Grantee, its successors,
and assigns forever.

Section 2 a distance of 92.06 feet to a point on the Southerly right of way line of SW
Park Street; thence North 99° 09' 37" Ract along said Southerly right of way line a
distance of 157.56 feet to the true point of beginning of the parcel of land herein
described;
thence continuing North 89" 09' 37" East along said Southerly, right of way line a distance
of 329.58 feet to the Northwest corner of that parcel of land described in Deed to TBLD
Corp., a California corporation, recorded August 18. 1993, Fee No. 93067756,
Washington County Deed Records; thence South 28141' 36" West along the Westerly
boundary line of said Fee No. 93067756 a distance of 105.80 feet to a point that is 92.05
feet Southerly of when measured at right angles to the Southerly right of way line of said
SW Park Street; thence South 89° 09' 37" West, parallel with said Southerly right of way
line a distance of 277.41 feet; thence North 001 50' 23" West a distance of 92.05 feet to
