KNOW ALL MEN BY. THESE,PRESENTS, that LUCILLE
FOSKETT, hereinafter referred to as "Grantor" for and
in consideration of the sum of One Dollar ($1.00), the
receipt of which is hereby acknowledged, to us paid.by
TIGARD WATER DISTRICT, a municipal corporation of Wash-
ington County, Oregon, hereinafter referred to as
"Grantee", does hereby grant, bargain, sell, convey and
transfer unto Grantee., its successors and assigns for-
ever, a permanent easement over and upon the following
described real property, to.wit:
All that portion of each of the
following described tracts lying south of
a line drawn parallel to and 10 feet north
of the southerly boundary of each of said,
tracts:
Parcel I: That certain portion of Lot 14,
Woodside #2, a subdivision in Section 9,
T2S, R1W, W. M., Washington County, Oregon,
described as follows:
Beginning at a point on the East line.
of Lot 14, which is 344.50' from She NE
corner of Lot 14, thence South 60 West
187.5' more or less to the East line of
S. W. 133rd Avenue;. thence. Northwesterly
along the East line of S. W-. 133rd Avenue
to a point on a line, that is 50' (as
measured perpendicular.to.) and is parallel
to the first described course; thence
North 60° East in a straight line to a
point at the intersection of said straight
line and the East line of. Lot 14, running
parallel to the first described course;
thence South down the East line of Lot 14
to the point of beginning.
Parcel II: South 172' as measured parallel
to the South boundary of the following
described portion of land situated in the
SE 4 of Section 9, T2S, R1W, W. M., Wash-
ington County, Oregon:
Beginning at a point located as follows:
from a one inch iron pipe marking the NW
corner of the SE, h of the. SE 34- of Section 9;
thence along the West line of She SE k of
the SE 34- of Section 9 South 00 21' 40" West
253..81' to the SW corner as described in Deed
Book 425-, Page 584; thence along,the monu-
mented southerly line of that certain described
tract in.Deed-Book 425, Page 584, North 67°
33' 48" East 127.96 feet; thence South 00°
21' 40" West parallel with the West line of

thence North 89° 38' 20" West 117.96
feet to the West line of the SE 4 of
the SE 4;. thence along last said West
line North 00 21' 40" East 344.50 feet
to the point of beginning.
This easement shall be for the construction,
maintenance and repair of an underground pipeline and/or
mains for the purpose of conveying water over, across,
through and under the hereinabove described real property
and shall include the perpetual right to enter upon said
real property at reasonable times, together with the right
to excavate and refill ditches for the location of said
pipelines and/or mains and the further right to remove all
obstructions interferring with the location, construction
and maintenance of said pipelines and/or mains.
Grantee, its successors and assigns, does
hereby covenant that it shall restore said property to
its original condition as nearly as is practicable upon
the completion of construction and upon completion of any
subsequent maintenance and repair work, including but not
limited to existing utilities, drain lines, and driveway.
TO HAVE AND TO HOLD said easement and right-of-
way unto Grantee and unto its successors and assigns for-
ever. This easement is a covenant running with the land.
