EASEMENT
KNOW ALL MEN BE THESE PRESENTS, that LANE WILTON and
HARRIET WILTON, husband and wife, hereinafter referred to as
'Grantors,' for and in consideration of the sum of One Dollar
($1.00), the receipt of. which is hereby acknowledged, to us
paid by TIGARD WATER DISTRICT, a municipal corporation of
Washington County, Oregon, hereinafter.referred to as "Grantee,"
do hereby grant, bargain, sell, convey and transfer unto Grantee,
its successors and assigns forever, a permanent easement over
and upon the following described real property, to wit:
This 10-foot wide water easement is
immediately east of, and adjacent to, a
15-foot wide sanitary sewer easement granted
to Unified Sewerage Agency as recorded in.
document #85047170, Washington County, Oregon,
more particularly described as follows:
A parcel of land in the southeast quarter
of Section 8, T2S, R1W, W. M., Washington
County, Oregon, said parcel.being a portion
of that tract described in deed to Derryck H.
and Ann Marie Dittman in Book 923, Page 960,
Deed Records of said County, said parcel
being 10.00 feet in width, 5.0 feet on each
side of the following described center line:

is Grayhawk Subdivision).
Beginning at a point on the south line of
said Dittman tract N 890 44' 50" W 204.12
feet from the southeast corner of said Dittman
tract; thence N 140 54' 10" W 5.66 feet to
a point; thence N 30 10' 10" W 324.39 feet
to a point on north line of said Dittman tract,
N 890 44' 50" W 223.18 feet from the northeast.
corner of said Dittman tract. The side lines
to be extended or shortened to meet at the
property lines.
This easement shall be for the construction, mainten-
ance and repair of an underground pipeline and/or mains for the
purpose of conveying water over, across, through and under the
hereinabove described real property and shall include the per-
petual right to enter upon said real property at reasonable
times, together with the right to excavate and refill ditches
for the location of said pipelines and/or mains, and the fur-
they right to remove all obstructions interferring with the
location, construction and maintenance of said pipelines and/or
mains.
Grantors, their heirs, executors, administrators and
assigns, do hereby covenant with Grantee that they are lawfully
seized and possessed of the hereinabove described real property,
and that they have a lawful right to convey same, and that they
will warrant and forever defend the title thereto against-the
lawful claims of all persons whomsoever.

Grantee, its successors and assigns, does hereby
covenant that it shall restore said property to its original
condition as nearly,as is practicable upon the completion of
construction and upon completion of any subsequent maintenance
and repair work.
As additional consideration for granting this easement,
Grantor shall not incur any liability for the cost of the water
main extension and Grantee waives the provisions of ORS 264.320
pertaining to refund of cost of water main extension. Grantor
may make connection to the water main extension without charge,
except for the expense of meter installation(s) as defined in
the Rules and Regulations of the district.
TO HAVE AND TO HOLD said easement and right-of-way
unto Grantee and unto its successors and assigns forever.
This easement is a covenant running with the land.
