KNOW ALL MEN BY THESE PRESENTS, That LESTER E. TAYLOR and LOISS M.
TAYLCR, husband and wife, hereinafter referred to as "Grantors", in
consideration-of the sum of One Dollar, the receipt of which is acknow-
ledged, paid by TIGARD WA`1'FR DISTRICT, a municipal corporation of Wash-
ington County, Oregon, "Grantee," do hereby grant, bargain, sell, convey
and transfer unto Grantee, its successors and.assigns forever, an easement
over and upon the following described real property:
An easement 10 feet in width running north and south
along the east portion of the following described
property:
The westerly 25 feet of the East one-half of a tract
of land in Section 4, Township 2 South, Range 1 West
of the Willamette Meridian, in the County of-Washington,
State of Oregon, described as-follows:
Beginning at the Northwest corner of the North half of
the Southeast quarter of the Northeast quarter of said
Section and running thence South along the legal sub-
division line to a point on the North line of County
Road No..934; thence easterly along the North line of
said County Road to the Southwest corner of that certain
tract conveyed to Erwin T. Wills by deed recorded February
61 1947, in Book 270, page 535; thence North along the'
West line of said Wills tract to a point on the North line
of the North half of the Southeast quarter of the Northeast
quarter of said Section 4; thence West along the legal
subdivision line to the place of beginning.
SUBJECT TO easements of record or presently existing against
said 25 foot strip in favor of landowners adjacent thereto
or having access easements rights therein.
This Easement shall be for the construction, maintenance and repair
of an underground pipeline and/or mains for the purpose of conveying
water over, across, through and under the hereinabove-described real
property and shall include the perpetual right to enter upon said real
property at reasonable times, together with the.right to excavate and
refill ditches for the location of said pipeline and/or.mains and fur-
ther right to remove all obstructions interferring with the location,
construction and maintenance of said pipeline and/or mains.
Grantor, its successors and assigns, does covenant with Grantee
that it is lawfully seized of the hereinabove-described real property
and that it has the lawful right to convey same, and that it will warrant
and defend the title thereto against the lawful claims of all persons.
To have and to hold said easement and right of way unto Grantee, its
successors and assigns forever.
This easement is a covenant running with.the land.
