hereinafter referred to as "Grantors, " for and in consideration of the
sum of One Dollars, the receipt of which is hereby acknowledged, to us
paid'by TIGARD WATER DISTRICT, a municipal corporation of Wash-
ington County, Oregon, hereinafter referred to as "Grantee, " do here-
by grant, bargain, sell, convey and transfer unto Grantee, its succes-
sors and assigns forever, a permanent easement over and upon the
following described real property, to-wit:
PARCEL I:
The east 25 feet of the south 125 feet of the following des-
cribed real property, to-wit:
Beginning at the northeast corner of Section 9. Township
2 South, Range 1 West of the* Willamette Meridian.. Wash-
ington County, Oregon; running thence west along the north
line of said section 660 feet; thence south 610.95 feet;
thence east 660 feet to the east line of said section; thence
north along said section line 610.95 feet to the place of be-
ginning, excepting therefrom a triangular parcel in the
northeast corner of said Section conveyed to Jacob Strom
by deed recorded in Book 71, page 51, Washington County,
Oregon Deed Records.
- PARCEL II:
Beginning at the center of the county road (also commonly
described as Bull Mountain Road) where it crosses the east
' line of Section 9, Township 2 South, Range 1 West of the
W. M.. Washington County. Oregon; running thence north

along the east line of said section 1244.75 feet to the
southeast corner of Parcel I described hereinabove;
thence west 20 feet; thence south 1244.75 feet, more
or less. to the center of said County Road; thence
east along the center of said County Road 20 feet to
the place of beginning.
This easement shall be for the construction, maintenance
and repair of an underground pipeline and/or mains for the purpose of
conveying water over, across, through and under the hereinabove des-
cribed real property and shall in--lude the perpetual right to enter upon
said real property at reasonable times, together with the right to exca-
vate and refill ditches for the location of said pipeline and/or mains
and the further right to remove all obstruction interferring with the lo-
cation. construction and maintenance of said pipeline and/or mains.
Grantors, their heirs, executors, administrators and
assigns, do hereby covenant with Grantee that they are lawfully seized
and possessed of the portion of the hereinabove described real property
described in the document recorded in the Washington County Deed Rec-
ords in the Book and upon the page set opposite their names, and that
they have a lawful right to convey same. and that they will warrant and
forever defend the title thereto against the claims of all persons whom-
soever.
Grantors. their heirs, executors, administrators and as-
signs, do further covenant that in the event they are responsible for
destruction of said water line or interruption to the water service, they
hereby agree to pay the reasonable cost of repairing same.
Grantee, its successors and assigns, does hereby cove-
rant that it shall restore said real property to its original condition as
nearly as is practical upon the completion of construction and upon com-
pletion of any subsequent maintenance and repair work.
TO HAVE AND TO HOLD said easement and right of way
unto Grantee and unto its successors and assigns forever. This ease-
ment is .a covenant running with the land.
