sideration of the an of One Dollar $1.00), the receipt of which is here-
by aelmewledged,.to us paid by TIGM WATER DISTRICT, a ®nicipal corpora-
tion of Washington County, Oregon, hereinafter referred to as "Grantee",
do hereby grant, bargain, sell, convey and transfer unto Grantee, its
successors and assigns forever, a permanent easement ever and upon the
following described real property, to wits
The most westerly 2$ feet of the following described
property; more particularly described-as the southerly
extension of the easterly half. of S. W. 108th Avenue
which is a 50-foot public right-of-way, a distance of
90 feet, more or less, to the Southwest corner of the
following described propertyt
Lot 99, ALDM88B Fes, Washington County, Oregon;
excepting therefrom the North 208.65 feet of the Bast
146.85 feet thereof.
This easement shall be for the construction, maintenance and
repair of an underground pipeline and/or mains for the purpose of con-
veying water over, acress, through and under the hereinabove described
..real property and shall include the perpetual rightte enter upon said
real property at reasonable tiros, together with the right to excavate
and 'refill ditches for the location of said pipelines and/er mans and
t#e further right to remove all obstructions interferring with the-loca-
tion,, construction and maintenance of said pipelines and/or mains.
Grantors, their heirs, executors, administrators and assigns,
de hereby covenant with Grantee that they are lawfully seised and pos
sensed of the hereinabove described real property, and that they have a
lawful right to convey same, and that they will warrant and forever de-
fend the title thereto against the lawful .claims of all persons whomso-
ever.
Grantee, its saceessers and assigns, doeshhereby covenant that
it shall restore said property to its original condition as nearly as
is practicable upon the cnffipletion of construction and upon completion
of any subsequent maintenance and repair work.
Granters, their heirs, executors, administrators and assigns,
do farthedt..eovenant that.in the event they are responsible for des-
traction-of said water.j ine or interruption to the water service, they
hereby agree to pay the reasonable cost of -repairing same.
