CONSENT TO PERMANENT PUBLIC UTILITY EASEMENT - THE UNDERSIGNED is the beneficiary under a Trust Deeds dated January 11, 1990, recorded January 18, 1990, as Recorder's Fee No. 90-02846, in Washington County, Oregon. WAVERLY CONSTRUCTION COMPANY, the grantor under the Trust Deed, is to convey a Permanent Public Utility Easement to the City of Tigard, an Oregon municipal corporation, its successors and.assigns, over that portion of the real property described on Exhibit "A," attached hereto and incorporated herein by this reference, as lies within the real property owned by Waverly Construction Company. Such easement will be dedicated on the plat of Woodford Estates Subdivision. NOW, THEREFORE, for good and valuable consideration, the sufficiency of which is hereby acknowledged, the undersigned does hereby consent to and subordinate its beneficial interest under the Trust Deed to such easement.
