V.= 89-16299 Washington county Co/ EASEMENT KNOW ALL MEN BY THESE PRESENT, that OREGON STATE EMPLOYEES. TRUST hereinafter referred to as "Grantor", for and in consideration of the sum of One Dollar ($1.00), the receipt of which is hereby acknowledged, to me paid by TIGARD WATER DIS- TRICT, a municipal corporation of Washington County, Oregon, hereinafter referred to as "Grantee",. does hereby grant, bargain, sell, convey and transfer unto Grantee, its successors and as- signs forever, a permanent easement over and upon the following described real property, to wit: An easement for water line purposes, 30.00 feet in width being 15.00 feet on each side of the following described centerline: Situate in the southwest one-quarter of Section 5, Township 2 South, Range 1 West, of the Willamette Meridian, Washington County, Oregon and being a portion of that parcel of land described in book 1205, page 508, deed records of Washington County with bearings based on the east line of said southeast one-quarter being S 0 52' 51" W, and more particularly described as follows: Beginning at a point on the south right-of-way line of S.W. Scholls Ferry Road, said point bears N 83 35' 04" W, on said south right-of-way line, a distance of 15.07 .feet from the northeast corner of said parcel thence S 0 52' 51" W, 15.00 feet from and parallel with the east line of said parcel, a distance of 1030.00 feet to the terminus of this easement. This easement shall be for the construction, main- tenance and repair of an underground pipeline and/or mains for the purpose of conveying water over, across, through and under the hereinabove described real property and shall include the, perpetual right to enter upon said real property at reasonable times, together with the right to excavate and refill ditches for the.location of said pipelines and/or mains, and the further right to remove all obstructions interferring with the location, .construction and maintenance of said pipelines and/or mains. Grantor, its heirs, executors, administrators and as- signs, do hereby conversant with Grantee that they are lawfully seized and possessed of the hereinabove described real property, -and: that they have a lawful right to convey same, and that, they will warrant and forever defend the title thereto againt the lawful claims of all persons whomsoever. PAGE I- EASEMENT EASEMENT (Continued) Grantee, its successors and assigns, does hereby covenant that it shall restore said property to its original con- dition as nearly as is practicable upon the completion of con- struction and upon completion of any subsequent maintenance and repair work. TO HAVE AND TO HOLD said easement and right-of-way unto Grantee and unto its successors and assigns forever. This easement is a covenant running with the land.
