2551 2551 E A S E M E N T Richard W. Dyke and Zeruiah Dyke, husband and wife, herein- after referred to as "Grantors," for and in consideration of the sum of One Dollar ($1.00), receipt of which is acknowledged, to us paid by Tigard Water District, a municipal corporation of Washington County, Oregon, hereinafter referred to as "Grantee," do hereby grant, bargain, sell, convey, and transfer to Grantee and its successors and assigns forever a permanent easement over and upon the following described real property: The southeasterly 5 feet of the following described property: A portion of Lots 37 and 38, North Tigardville Addi- tion, Section 2, Township 2 South, Range 1 West, Willamette Meridian, Washington County, Oregon, more particularly described as follows: Beginning at the northeast corner of said Lot 38, North Tigardville Addition; running thence northwesterly 108.84 feet, more or less, along the northeasterly line of Lot 38 to a point which is the most easterly corner of a tract of land conveyed to Ray E. and Meta H. Christenson by Roger L. Hawley and Dorothy Hawley by deed in Volume 273, page 439, Washington County Deed Records; thence southwesterly on Christenson's south- westerly line 156.5 feet, more or less, to a point 16 1/2 feet, more or less, beyond the north line of Lot 37; thence running southeasterly parallel with the south line of Lot 38, 125 feet to the east line of Lot 37; thence northeasterly along the southeasterly line of said Lots 37 and 38, 180 feet, more or less, to the point of beginning. Excepting therefrom the rights of the public in road- way along the southeasterly and northeasterly line of Lots 37 and 38; and excepting that portion conveyed to the State of Oregon by Deed. Records in Volume 184, page 337, and Volume 333, page 35. This easement shall be for the construction, maintenance, and repair of. an underground pipeline and/or mains for the pur- pose of conveying water over, across, through, and under the hereinabove described real property and shall include the per- petual right to enter upon said real property at reasonable times, together with the right to excavate and refill ditches for the location of said pipelines and/or mains and the further right to remove all obstructions interferring with the location, construction, and maintenance of said pipelines and/or mains. Grantee agrees that the ID sign and shrub planters need not be removed. Grantors and their heirs, personal representatives, and assigns covenant with Grantee that they are lawfully seized and possessed of the hereinabove described real property, that they have a lawful right to convey same, and that they will warrant and forever defend the title thereto against the lawful claims of all persons whomsoever. Page 1 EASEMENT HAW PaLFS(16 - Grantee and its successors and assigns covenant that they shall restore said property-to its original condition as nearly as practicable upon the completion of construction and upon com- pletion of any subsequent maintenance and repair work.
