6495 6495 EASEMENT. KNOW ALL MEN Br THESE PRESENTS, That GEORGE L. PENROSE and ELINORE S. PENROSE, husband and wife, hereinafter referred to as "Grantors," for and in consideration of the sum of One Dollar, the receipt of which is hereby acknowledged, to us paid by TIGARD WATER DISTRICT, a municipal cor- poration of Washington County, Oregon, hereinafter referred toas "Grantee," do hereby grant, convey and transfer unto the Grantee, its successors and assigns temporarily, an easement over and upon an 8-foot wide strip of land beginning at the Northeasterly corner, thence southerly along the Easterly boundary line a distance of 322 feet of the following described real property, to wit: Beginning at the Northeast corner of Section 11, Township 2 South, Range 1 West of W.M., Washington County, gregon; thence South 21.35 chains; thence North 89 58' West 29.03 chains; thence North 89 40' West 9.13 chains; thence South 89 40' East 377.14 feet to the true place of beginning; thence North 0° 22' East 693 feet to an iron stake; thence South 890 40' East 251.43 feet to the, westerly boundary line of that certain tract of land conveyed by deed recorded July 26, 1926, in Book 133 Page 345, Deed Records; thence South along said boundary line 693 feet; thence North 89 40' Vest 251.43 feet to the place of beginning, reserving, however, a right of way over and across the North 20 feet of the above-described tract of land. This easement shall be for the construction, maintenance and repair of an underground pipe line and/or mains for the purpose of conveying water over, across, through and under the hereinabove-described real property and shall include the right to enter upon said real property at reasonable times, together with the right to excavate and refill ditches for the location of said pipelines and/or mains and the further right to remove all obstructions interferring with the location, construction and maintenance of said pipe line and/or mains. Grantors, their heirs, executors, administrators and assigns, do hereby covenant with Grantee that they are lawfully seized and possessed of the hereinabove described real property and, that they have a lawful right to convey same, and that they will warrant and forever defend the title thereto against the lawful claims of all persons whomsoever. Grantee, its successors and assigns, does hereby covenant that it shall restore said real property to its original condition as nearly as is practical upon the completion of construction and upon completion any sub- sequent maintenance and repair work, and-that it shall spread sawdust over a strip 4 -feet wide and 6 inches deep, thus covering the area disturbed. BOOK 711 PAGE►3 - - 649 5 EAST (Continued) TO HAVE AND TO HOLD the said easement and right of way unto Grantee and unto its successors until such time as a permanent water pipe line and/or mains are installed along.other proposed dedicated streets or roads, i.e., the extension of S.W. 93rd Avenue and Inez Street, to re-con- stitute a water circulation loop, but in no case shall this easement extend beyond January 1, 19750 Grantors do hereby reserve the right to demand removal of pipeline within ninety (90) days after installation of an alternate circulation loop, or January 1, 1975, whichever occurs first, and at which time this easement will be null and void.
