1703 1703 EASEMENT KNOW ALL MEN BY THESE PRESENTS, That BEATRICE ZEDNICK, a single woman, hereinafter referred. to as "Grantor", for and in consideration of the earn of. Ten Dollars, and other good and valuable consideration, the receipt of which is hereby acknowledged, to me paid by TIGARD WATER DISTRICT, a municipal corporation of Washington County, Oregon, hereinafter referred to as "Grantee", do hereby grant, bargain, sell, convey and transfer unto Grantee, its successors and assigns forever, a permanent easement over and upon the North /3° feet of the following. described real property, to«•wit; The following described real property situated in the County'of Washington and State of Oregon, bound and described as follows, to.-wit: Commencing at the Northeast corner of the Northeast quart.. er of the Northwest quarter of Section 9, Township 2 South, Range 1 West, W. M.; thence West 80 rods; thence South 68 1320 rods; thence East along the center of z otz County Road to the Ea st line of the z- Northwest quarter of said Section 9; thence North to the place of beginning 73 rods; except the East 10 acres thereof heretofore sold on contract to James Arthur Menzies and Florence Gould Menzies. This easement shall be for the construction, maintenance and repair of an underground pipeline and/or mains for the purpose of conveying water over, across, through and under the hereinabove described real prop. erty. It shall include the perpetual right to enter upon said real property at reasonable times, together with the right to excavate and refill ditches for the location of said pipelines and/or mains, and the further right to remove all obstructions interferring with the location, construction and maintenance of said pipeline and/or mains. Grantor, her heirs, executors, administrators and assigns, does hereby covenant with Grantee that she is lawfully seized and possessed of the hereinabove described real property, and that she has a lawful right to convey the same, and that she will warrant and forever defend the title thereto against the lawful claims of all persons whomsoever. Grantor, her heirs, executors, administrators and assigns, does further covenant that in the event she is responsible for the destruc. tion of said water line or interruption to the water service, she hereby agrees to pay the reasonable sum of repairing same.
